A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST.
LUCIE COUNTY, FLORIDA, CLOSING, VACATING AND ABANDONING AN
INGRESS/EGRESS RIGHTS-OF-WAY IN ST. LUCIE GARDENS, PLAT BOOK
1, PAGES 35-36 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made
the following determinations:
1. That Sections 177.101, 336.09 and 336.10, Florida Statutes, as amended, and
Section 11.10.01 et. seq. of the St. Lucie County Land Development Code, provide that the
County may adopt resolutions vacating plats in whole or in part, which are under the
jurisdiction of the Board of County Commissioners of St. Lucie County, Florida.
2. Pursuant to Plat Book 1, Pages 35-36, known as St. Lucie Gardens, St. Lucie
County and the general public have a dedicated interest in the following described land:
A portion of land lying North of the South line of Section 7, Township 37 South, Range
41 East and portion of Lot 16, Block 4, Section 12, Township 37 South, Range 40 East St.
Lucie Gardens, as recorded in Plat Book 1, pages 35 and 36 of the Public Records of St.
Lucie County, Florida. Lying West of U.S. 41, and being more particularly described as
follows:
Commence at the Southeast corner of Section 12, Township 37 South, Range 40 East;
then run South 89°27'05" East, a distance 144.08 feet, along the south line of Section 7,
to the intersection of said line and Southwesterly right-of-way line of State Highway U.S.
No. 1 said right-of-way being 200 feet wide, said point being the Point and Place of
Beginning; thence run North 2730'47" West, a distance of 17.01 feet along the

Southwesterly right-of-way line of State Highway U.S. No. 1 to a point; thence run north
89'27'05" West, a distance of 121.14 feet, along a line parallel to the South line of
Section 7, to the intersection of said line and the East line of a 30 foot right-of-way, as
shown on the Plat of St. Lucie Gardens; thence run North 00°20'01" East, a distance of
228.85 feet, along said East line of 30 foot right of of -way, to the intersection of said line
and the Southwesterly right-of-way of State Highway U.S. No. 1; Thence run North
27'30'47" West, a distance of 64.23 feet, to the intersection of the Southwesterly right-
of-way line of State Highway U.S. No. 1 and the West line of 30 foot right-of-way, as
shown on the Plat of St. Lucie Gardens; thence run South 00'20'01" West, a distance of
285.54 feet, to a point; thence run North 89°27.05" West, a distance of 246.83, to a
point; thence run South 12°03'08" East, a distance of 15.37, to the intersection with the
South line of Section 12; thence run South 89°27'05" East, a distance of 402.62 feet, to
the intersection of the South line of Section 12 and the Southwesterly right-of-way line
of State Highway U.S. No. 1, said point being the Point and Place of Beginning.
Containing an area of 13,721 square feet, 0.31 acres.
3. A Notice of Intent to Abandon was advertised on November 21, 2016 and
November 28, 2016 in the St. Lucie News Tribune and no objections were filed.
4. On December 20, 2016, the Board of County Commissioners approved
Permission to Advertise for a Public Hearing on January 10, 2017.
5. On December 21, 2016, letters were mailed to all property owners lying within
300 feet of the proposed abandonment and we received no responses.
6. On December 21, 2016, a Notice of Public Hearing was advertised in the St. Lucie
News Tribune.
7. All relevant public utilities have been notified. The County has not received a
form from AT&T but in an email, their representative said that if the location was acceptable to
the surveyor, it was acceptable to AT&T as well. Buildings have already been built on the
property and there are no issues.

8. County staff has reviewed the petition and have no objections to the proposed
abandonment.
It is in the best interest of the public to vacate and abandon the ingress/egress rights-of-
way in St. Lucie Gardens Plat Book 1, Pages 35-36 more particularly described as follows:
A portion of land lying North of the South line of Section 7, Township 37 South, Range
41 East and portion of Lot 16, Block 4, Section 12, Township 37 South, Range 40 East St.
Lucie Gardens, as recorded in Plat Book 1, pages 35 and 36 of the Public Records of St.,
Lucie County, Florida. Lying West of U.S. #1, and being more particularly described as
follows:
