HomeMy WebLinkAbout17-109RESOLUTION NO. 17-109 A RESOLUTION INCREASING THE FEES FOR PROCESSING AND DISPOSING OF YARD WASTE AT THE ST. LUCIE COUNTY GLADES ROAD LANDFILL AND ASSOCIATED FACILITIES; AMENDING RESOLUTION NO. 16-035; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Board of County Commissioners of St. Lucie County, Florida (the "Board"), finds: 1. The County owns and operates a solid waste management facility ("Facility") located at 6120 Glades Cut -Off Road in the City of Fort Pierce, Florida. The County's Facility includes a Class I landfill, a disposal area for construction and demolition debris, a recycling center, and related facilities that are used for processing, recycling, and disposing of various types of solid waste, including yard waste. 2. On March 1, 2016, the Board adopted Resolution No. 16-035, which established certain "tipping fees" (i.e., disposal fees) and charges that the County will bill and collect for processing, disposing of, or otherwise managing solid waste and recyclable materials at the County's Facility. The Board now wishes to amend Resolution No. 16-035 to increase the tipping fees for yard waste, effective October 1, 2017. The current tipping fee for yard waste has not been increased for approximately eight years and it is no longer sufficient to cover the costs that the County incurs when the County receives, processes, and manages yard waste at the Facility. Accordingly, this resolution authorizes new tipping fees for yard waste. The new rates are highlighted with underlining; the current rates are shown as stricken ( en). All of the other rates and provisions in Resolution No. 16-035 will remain in effect and will be unchanged. 3. The new fees for yard waste are reasonable and appropriate — i.e., the rates fairly compensate the County for the services it provides when processing, disposing of, or otherwise managing yard waste at the County's Facility. The new fees are necessary for the County to protect the public health, safety, and welfare, and thus the fees are in the public interest. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida, that the following fees and charges concerning the use of the County's Facility are hereby approved and adopted: SECTION A: Section A.2.c of Resolution No. 16-035 is hereby amended to read as follows: Yard Waste - vegetative matter resulting from landscaping, yard maintenance, and land clearing activities: 1 Regular fee $35.00 26.09 per ton Uncovered fee/Unsecured $70.00 52 AA per ton SECTION B. Municipalities and approved operators shall pay the fees specified in Section A of this Resolution on a monthly basis, following their receipt of the County's bill for the use of the County's solid waste management facility. SECTION C. All other users of the County's solid waste management facilities shall pay the fees specified in Section A of this Resolution when they deliver their solid waste or recyclable materials to the St. Lucie County Landfill, unless the user has entered into a Landfill Use Agreement with the County and posted the required security. SECTION D. Effective October 1, 2017, this Resolution shall amend Section A.2.c of Resolution No. 16- 103.7 SECTION E. The rates authorized in this Resolution shall take effect on October 1, 2017.
