A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST.
LUCIE COUNTY, FLORIDA, DISSOLVING THE SOUTH HUTCHINSON
ISLAND MUNICIPAL SERVICES BENEFIT UNIT; TRANSFERRING THE
SOUTH HUTCHINSON ISLAND WASTEWATER SYSTEM ASSETS AND
FUNDS TO THE ST. LUCIE COUNTY WATER AND SEWER DISTRICT;
AUTHORIZING AND DIRECTING COUNTY STAFF AND OFFICIALS TO
TAKE ACTION IN CONNECTION THEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY, FLORIDA:
Section 1. Authority for this Resolution. This Resolution is adopted pursuant to Section
40-107 and Section 40-102 of the St. Lucie County Code.
Section 2. Findings. It is hereby found, declared, and determined as follows:
(A) The County created the South Hutchinson Island Regional Wastewater System
Municipal Services Benefit Unit/North District (the "SHI MSBU") pursuant to Resolution No. 95-
165 adopted on August 3, 1995 (the 'Resolution"). The SHI MSBU funded certain wastewater
system assets and holds certain funds and reserves ("SHI MSBU Assets") to provide for
wastewater and reclaimed water service to customers within the boundaries of the SHI MSBU
("SHI MSBU Customers").
(B) The County issued its $14,920,000 St. Lucie County, Florida Special Assessment
Refunding Bonds, Series 1998 (South Hutchinson Island Wastewater System) on July 16, 1998
(the "1998 Bonds") to refund bonds used to fund construction of the wastewater facilities for the
SHI MSBU, which 1998 Bonds were the only SHI MSBU bonds or other financing issued by the
County or any entity controlled by the County relating to the SHI MSBU.
(C) The County has redeemed the Series 1998 Bonds, and desires to dissolve the SHI
MSBU and consolidate the SHI MSBU Assets, including all funds and reserves, and SHI MSBU
customers into the St. Lucie County Water and Sewer District (the "District").
(D) The County adopted Ordinance No. 04-023 on June 15, 2004, creating the District,
including the District Charter attached as Exhibit "A" to the Ordinance. Pursuant to such
Ordinance, the Board may modify, expand and supplement the District facilities from time to
time.
Section 3. Dissolution of SHI MSBU. The SHI MSBU is dissolved pursuant to Section 40-
107 of the St. Lucie County Code.

Section 4. Transfer to District. Pursuant to Section 40-102 of the St. Lucie County Code,
and the District Charter, the SHI MSBU Assets, including all SHI MSBU funds and reserves, and
SHI MSBU customers are transferred to the District and incorporated into the District Facilities, as
defined in the District Charter. The District shall assume all existing duties and obligations of the
dissolved SHI MSBU.
Section 5. Rates and Policies. Until revised by the District, the SHI MSBU wastewater and
reclaimed water utility rates, fees and chargees adopted by the Board in Resolution No. 15-087 on
May 19, 2015, shall be applicable to the existing SHI System customers transferred to the District.
New customers within the former SHI System boundaries shall be subject to the District's existing
wastewater and reclaimed water utility rates, fees and charges, as revised from time to time by the
District. Current and new customers within the former SHI System boundaries shall be subject to
the District's existing Uniform Service Policy and Uniform Extension Policy, as revised from the
time by the District.
Section 6. Effective Date. This Resolution shall take effect immediately upon its adoption.
County and District staff and officials are authorized and directed to take all actions necessary or
proper to execute the provisions of this Resolution.
