WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Lot Split submitted by Robert and Lori Kennedy together with their neighbor Enrique Muniz and made the following findings: The Lot Split application has been approved for property consisting of 35,075 square feet and zoned RS -3 (3 du/1 ac) and located approximately and legally described as follows: SEE ATTACHMENT "A" 2. The division of the subject property creates two lots depicted on the revised Boundary Survey(s) created by Michael T. Owen, PSM, dated 312412017. Parcel "A" is owned by Kennedy, consists of 35,075 square feet m.o.l., and has an address of 1322 White Oak Lane. Parcel "B" is owned by Muniz, consists of 21,789 square feet m.o.l., and has an address of 1319 Parkland Avenue, 3. Muniz is purchasing 3,555 square feet of the Kennedy property that abuts his parcel to the northwest. As a result, the Kennedy Parcel A will decrease in size from 35,075 square feet to 31,529 square feet m.o.l. The Muniz Parcel B will increase in size from 21,789 square feet m.o.l. to 25,344 square feet as provided on the boundary survey referenced above. 4. The Development Review Committee has reviewed the lot split on the subject property and found it to meet technical requirements of the Code and the standards of review in Section 11.03.04.D of the St. Lucie County Land Development Code and to be consistent with the St. Lucie County Comprehensive Pan. S. Staff has provided an analysis of the parcel's eligibility for a one-time split pursuant to Section 11.03.04 of the St. Lucie County Land Development Code. That analysis is found in a project summary and memorandum dated April 18, 2017 entitled Kennedy/Muniz Lot Split, File No. LS 320175113, NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the Lot Split as described hereinabove is approved as shown on the boundary survey prepared by Michael T. Owen PSM, dated March 24, 2017 by the Planning and Development Services Director, subject to the following conditions: 1. Co -applicant, Enrique Muniz shall file a unit of title with the Property Appraiser's office combining the 3,555 square feet with his parcel 3409-703-0129-00012. 2. No further division of parcel 3409-432-0007-00040 is permitted unless a final record plat is submitted in accordance with the Code. One parcel would consist of 31,526 feet and the other parcel would consist of approximately 3,555 square feet. The later parcel will be unified with the Muniz parcel which abuts the Kennedy parcel to the south and southeast. Kennedy/Muniz Lot Split File No.: LS 320175113 Page 2 Additionally, the proposed lot split complies with the standards of review as set forth in Section 11.03.04 of the LDC as follows: 1. Each lot conforms with the requirements of this Code as conditioned: One parcel consisting of 3,555 m.o.l. will be combined with the "Muniz" parcel 3409-703- 0129-000-2. Both the Muniz and the Kennedy parcels will conform to the requirements of this code upon the unification as stated. 2. Each lot shall abut a public or private street (except as hereinafter provided) for the required minimum road frontage for the Zoning District where the lots are located. See response to number 1. 3. If any lot abuts a street right-of-way that does not conform to the design specifications provided in this Code, the owner shall be required to dedicate ane -half of the right-of-way width necessary to meet the minimum design requirements. NIA Recommendation: Approval of PDS Order No. 17-017 with Conditions Staff has reviewed all comments on file, and has determined that the subject parcel can be divided as shown on the attached revised survey by Michael T. Owen, PSM, dated 3/24/2017 as it meets all applicable provisions of the code subject to the conditions of approval below. 1. The land that is being split from parcel 3409-432-0007-000-0 (Parcel A) shall be combined with parcel 3409-703-0129-000-2 (Parcel B). This will be accomplished by the filing of a combination of parcels with the Property Appraisers office by the owner of Parcel "B" Enrique Muniz. See also, Owen Survey dated 312412017. 2. 3. No further division of the property is permitted unless a final record plat is submitted in accordance with the Code.
