HomeMy WebLinkAboutPDS-17-020 - Orange Ave Baptist Church Adj.to Minor Site PlanPDS NO. 17-020 File No. SPMN 120175103 AN ORDER GRANTING A MINOR ADJUSTMENT TO THE MINOR SITE PLAN FOR ORANGE AVENUE BAPTIST CHURCH WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Adjustment to the Minor Site. Plan known as Orange Avenue Baptist Church and reviewed the comments of the Development Review Committee and has made the following determinations: 1. Orange Avenue Baptist Church requested a Minor Adjustment to the Minor Site Plan for Orange Avenue Baptist Church Site Plan to construct a 10,000 s.f. covered playground on an approximately 4.54 acre property located at 100 Cyclone Drive in the I (Institutional) zoning district, more particularly described in Part B below. 2. On June 14, 1988, the St. Lucie County Planning and Development Services Director, through staff delegation, approved a Major Adjustment to the Orange Avenue Baptist Church Site Plan for the purpose to construct a 3,840 s.f. addition to the fellowship hall. 3. On June 9, 1989, the St. Lucie Planning and Development Services Director, through staff delegation, approved a Minor Adjustment to the Orange Avenue Baptist Site Plan for the purpose to re -locate a pre -constructed temporary classroom located north of the fellowship hall. 4. St. Lucie County Planning Staff has performed a detailed analysis of the proposed Minor Adjustment and determined it to be consistent with the St. Lucie County Land Development Code, Comprehensive Plan and with the intent of the previously approved Site Plan for Orange Avenue Baptist Church. The analysis is found in the Planning and Development Services memorandum titled Orange Avenue Baptist Church — Minor Adjustment to Minor Site Plan, dated May 1, 2017. 5. The project will not have an undue adverse impact on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate surroundings through building design, site design, landscaping and screening. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 11.02.04(C) of the St. Lucie County Land Development Code, the Minor Adjustment is hereby approved as shown on the drawing prepared by David Norris Engineering, dated April 25, 2017, and date stamped by the Planning and Development Services Department on May 1, 2017 subject to the following condition(s): Planning and Development Services — Planning Division 1. The property owner shall comply at all times with the St. Lucie County Code of Ordinances, Section 28-107 through 28-112, as amended regulating noise. 2. Any exterior lighting that is provided for the covered playground area shall be shielded with zero (0) footcandle readings at adjacent property lines. 3. The covered playground area shall remain unenclosed with no walls. If it is the desire of the property owner to enclose the structure, site plan adjustment approval shall be obtained prior to any construction to evaluate the use of the proposed enclosed structure, the need for additional on-site parking, and compliance with community architectural standards. Environmental Resources Department 4. Prior to issuance of a Certificate of Occupancy, the applicant shall replace all removed or damaged landscape material per the approved landscape plan. 5. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 6. All other applicable state or federal permits must be obtained before commencement of the development. Prior to the issuance of a building permit for the 10,000 s.f. covered playground structure, a sketch and description shall prepared by a surveyor licensed in the State of Florida for the 30' right of way dedication fronting Orange Avenue as required per the Right of Way Protection Plan. Said dedication shall be reviewed and approved by the St. Lucie County Attorney's Office and the Board of County Commissioners. 8. Prior to the issuance of a building permit for the 10,000 s.f. covered playground structure, a License Agreement will need to be entered into between Orange Avenue Baptist Church and St. Lucie County and approved by the Board of County Commissioners for the existing monument sign and parking stall located along the frontage of Orange Avenue. Please contact the Legal Department, Property Acquisitions Division for further information. B. Legal Description: The property affected by this Minor Adjustment is described as follows: The South % of the East % of the West % of the Southwest % of the Northeast 1/4 , Section 8, Township 35 South, Range 39 East; excepting all rights-of-way for drainage canals and public roads (4.54 acres). Address Location: 100 Cyclone Drive C. The applicant, property owner, their successors and assigns, are advised that as part of the approval of this Minor Adjustment to the Orange Avenue Baptist Church Minor Site Plan, the applicant, property owner, their successors and assigns, shall obtain all applicable development permits and construction authorizations from the appropriate State, Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, South Florida Water Management District, and St. Lucie County, prior to the commencement of any development activities on the property described in Part B applicable to the proposed activity for which site construction or development authorization is sought. Issuance of this Minor Adjustment approval by St. Lucie County does not in any way create any rights on the part of the applicant, property owner, their successors and assigns to obtain a permit from a state or federal agency and does not create any liability on the part of the County through issuance of this Minor Adjustment approval to obtain local development permit(s) if the applicant, property owner, their File No. SPMN 120175103 PDS 17-020 May 3, 2017 Page 3 of 4 successors and assigns, fail to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. This Order shall become effective upon the date of approval indicated below and shall expire on May 3, 2018, unless a building permit is issued or an extension is granted in accordance with the provisions of Land Development Code, Section 11.02.06. E. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.05(D), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of any action or activity authorized through this Minor Adjustment until the appeal is resolved. F. A copy of this Order, or printed reference to it, shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie Planning and Development Services Director a copy of which shall be provided to the developer and agent of record as identified on the Minor Adjustment application. G. This order shall be recorded in the Public Records of St. Lucie County. ORDER effective the 3rd day of May, 2017. PLANNING & DEVELOPMENT SERVICES ST.
