AN ORDER APPROVING AN LOT SPLIT FOR PROPERTY CONSISTING
OF 9.62 ACRES LOCATED AT 5053 EMERSON AVENUE
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
application for a Lot Split submitted by Dwight and Margaret Goodner and made the following
findings:
1. The Lot Split application has been approved for property consisting of 9.62 acres of
property zoned AG -1 (Agricultural - 1 du/ac) and located approximately and legally
described as follows:

2. The division of the subject property creates two lots depicted on the revised Boundary
Survey(s) created by Richard A. Mixon, PSM, dated 12118116. The two lots are further
described on the boundary survey as proposed parcel "A", and proposed parcel "B". Lot
"B" has a property address of 6053 Emerson Avenue. Lot A has a pole barn.
3. The Development Review Committee has reviewed the lot split on the subject property
and found it to meet technical requirements of the Code and the standards of review in
Section 11.03.04.D of the St. Lucie County Land Development Code and to be consistent
with the St. Lucie County Comprehensive Pan.
4. Staff has provided an analysis of the parcel's eligibility for a one-time split pursuant to
Section 11.03.04 of the St. Lucie County Land Development Code. That analysis is found
in a project summary and memorandum dated May 3, 2017 entitled Goodner Lot Split,
File No. LS 320175113.
NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the
Goodner Lot Split is hereby approved as shown on the revised boundary survey prepared
by Richard A. Mixon, PSM dated 12/18/16 by the Planning and Development Services
Director, subject to the following conditions:
No further division of the property is permitted Unless a final record plat is submitted in
accordance with the Code.
B. St. Lucie County is not responsible for the maintenance, upkeep or improvement of any
private drives, roads, streets, easements, or rights-of-way providing ingress and egress or
drainage service to the subject property herein.
C. A copy of this Order shall be attached to the boundary survey described in hereinabove,
and shall be placed on file in the Planning and Development Services Department.

On March 9, 2016, Dwight and Margaret Goodner submitted a Lot Split application for parcel
1315-113-0001-000-4. The applicants propose to subdivide approximately 9.62 acres into two
parcels. Parcel A will consist of 4.18 acres and Parcel B will consist of 5.42 acres.

Pursuant to the St. Lucie County Land Development Code (LDC) adopted on January 1, 1990, a
property owner of a meets and bounds tract of land may apply for a one time lot split free from
any previous division of land. Following staff's review of the deeds for the subject property and
adjacent properties, it is determined that no previous split has occurred since the adoption of the
1990 LDC.

Additionally, the proposed lot split complies with the standards of review as set forth in Section
11.03.04 of the LDC as follows:
1. Each lot conforms with the requirements of this Code.
Both parcels when split will conform to the AG -1 zoning district lot size and dimensional
requirements.
2. Each lot shall abut a public or private street (except as hereinafter provided) for the
required minimum road frontage for the Zoning District where the lots are located.
Both lots as proposed meet the minimum requirements for road frontage for the AG -1
Zoning District.
3. If any lot abuts a street right-of-way that does not conform to the design specifications
provided in this Code, the owner shall be required to dedicate one-half of the right-of-way
width necessary to meet the minimum design requirements.

Recommendation. Approval of PDS Order No. 17-016 with Conditions
Staff has reviewed all comments on file, and has determined that the subject parcel can be divided
as shown on the attached revised survey by Richard A. Mixon, PSM, dated 12/18116 as it meets
all applicable provisions of the code subject to the conditions of approval below.
1. No further division of the property is permitted unless a final record plat is submitted in
accordance with the Code. (Section 11.03.04, LDC)
