SMITH, CLERK OF THE CIRCUIT COURT SAINT LUCIE COUNTY FILE # 4324835 06/29/2017 08:42:33 AM OR BOOK 4013 PAGE 2616 - 2621 Doc Type: ORD • RECORDING: $52.50 PDS NO. 17-026 File No. SPMN 1220165102 AN ORDER GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO THE SPANISH LAKES FAIRWAYS FINAL PLANNED UNIT DEVELOPMENT SITE PLAN WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Adjustment to the Final Planned Unit Development Site Plan known as Spanish Lakes Fairways PUD and reviewed the comments of the Development Review Committee and has made the following determinations: 1. Wynne Building Corporation requested a Minor Adjustment to the previously approved Spanish Lakes Fairways Final PUD (Planned Unit Development) Site Plan to install a new monument ground sign (6' x 20') to be located in the Spanish Lakes Boulevard median on the north side of Indrio Road and a new directional sign (5'8" x 4') to be located on the east side of Spanish Lakes Boulevard, approximately 1,100 feet north of Indrio Road as depicted in Exhibit A. 2. On December 18, 1986, the St. Lucie County Board of County Commissioners through Resolution 86-300 granted Development Order approval to the Development of Regional Impact known as Spanish Lakes Fairways. 3. On December 18, 1986, the St. Lucie County Board of County Commissioners through Resolution 86-301 granted preliminary development approval for Spanish Lakes Fairways PUD consisting of 1,598 manufactured home dwelling units. 4. On May 26,' 1987, the St. Lucie County Board of County Commissioners through Resolution 87-57 amended certain conditions contained in Resolution 86-300 which granted Development Order approval to the Development of Regional Impact. 5. On May 26, 1987, the St. Lucie County Board of County Commissioners through Resolution 87-98 granted final development approval for Spanish Lakes Fairways PUD consisting of 1,598 manufactured home dwelling units. On June 14, 1989, the 'St. Lucie County Board of County Commissioners through Resolution 89-156 modified certain conditions of approval. 7. On January 16, 1996, the St. Lucie County Board of County Commissioners through Resolution 96-008 authorized the permitting and construction of conventionally built homes and extended the building out date of the project to December 17, 1996. 8. On January 16, 1996 the St. Lucie County Board of County Commissioners approved the Spanish Lakes Fairways PUD Northeast Plat consisting of 413 fee simple, single family residential lots. 9. On November 9, 2004, the St. Lucie County Board of County Commissioners approved up to two hundred (200) total building permit applications to be processed that would result in the construction of conventionally constructed homes in the following Spanish. Lakes Communities: Spanish Lakes I, Spanish Lakes Riverfront PUD, Spanish Lakes Fairways PUD and Spanish Lakes Country Club Village PUD. 10. On November 15, 2005, the St. Lucie County Board of County Commissioners approved an additional three hundred (300), for a total of five hundred (500) building permit applications, to be processed that would result in the construction of conventionally constructed homes in the following Spanish Lakes Communities: Spanish Lakes I, Spanish Lakes Riverfront PUD, Spanish Lakes Fairways PUD and Spanish Lakes Country Club Village PUD. 11. On February 2, 2012, the Planning and Development Services Director through PDS Order 12-016 granted a Minor Adjustment to the Final PUD Site Plan to modify building setbacks/sepa rations. 12. On June 6, 2017, the Board of County Commissioners approved a Revocable License Agreement for the monument ground sign (6' x 20') to be located in the Spanish Lakes Boulevard median on the north side of Indrio Road and the directional sign (5'8" x 4') to be located on the east side of Spanish Lakes Boulevard, approximately 1,100 feet north of Indrio Road 13. St. Lucie County Planning Staff has performed a detailed analysis of the proposed Minor Adjustment to the Final PUD Site Plan and determined it to be consistent with the St. Lucie County Land Development Code, Comprehensive Plan and with the intent of the previously approved Final PUD Site Plan for Spanish Lakes Fairways. PUD. The analysis File No. SPMN 1220165102 PDS 17-026 June 15, 2017 Page 2 of 6 is found in the Planning and Development Services memorandum titled Spanish Lakes Fairways PUD — Minor Adjustment to Final PUD Site Plan, dated June 9, 2017. 14. The improvements will not have an undue adverse impact on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 15. All reasonable steps have been taken to minimize any adverse impact the improvements may have on the immediate surroundings through building design, site design, -landscaping and screening. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the proposed Minor Adjustment to the Final PUD Site Plan for the Spanish Lakes Fairways PUD, is hereby approved as shown on the site plan drawing prepared by MAI Design Build dated March 30, 2017, and date stamped by the Planning and Development Services Department on June 9, 2017 subject to the following condition(s): 1. At such time power and/or irrigation become available within the proposed signage locations, native vegetation and irrigation shall be installed three (3) feet in all directions of each sign. Landscaping materials shall be reviewed and approved by the Environmental Resources Department. 2. The issuance of County development permit does not in anyway create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 3. All other applicable state or federal permits must be obtained before commencement of the development. B. The applicant, property owner, their successors and assigns, are advised that as part of the approval of this Minor Adjustment to the existing approved Final PUD Site Plan for the Spanish Lakes Fairways PUD, the applicant, property owner, their successors and assigns, shall obtain all applicable development permits and construction authorizations from the appropriate State, Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, ' the Florida Department of File No. SPMN 1220165102 PDS 17-026 June 15, 2017 Page 3 of 6 Environmental Protection,- and South Florida Water Management District, and St. Lucie County, prior to the commencement of any development activities. Issuance of this Minor Adjustment to Final PUD Site Plan approval by St. Lucie County does not in any way create any rights on the part of the applicant, property owner, their successors and assigns to obtain a permit from a state or federal agency and does not create any liability on the part of the County through issuance of this Minor Adjustment to Final PUD Site Plan approval to obtain local development permit(s) if the applicant, property owner, their successors and assigns, fail to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may "result in a violation of state or federal law. C. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.05(D), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of any action or activity authorized through this Minor Adjustment until the appeal is resolved. D. A copy of this Order, or printed reference to it, shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie Planning and Development Services Director a copy of which shall be provided to the developer and agent of record as identified on the Minor Adjustment application. E. The conditions set forth in Part A are an integral non -severable part of the Minor Adjustment approval to the existing PUD Site Plan for the Spanish Lakes Fairways PUD granted by this Order. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, unless otherwise amended in accord with the provision of the St. Lucie County Land Development Code, the Minor Adjustment approvals authorized through this Order, to the existing, approved PUD Site Plan for the Spanish Lakes Fairways PUD shall become null and void, and any construction or development activity completed pursuant to this parcel shall be required to revert to the previously approved condition. F. This order shall be become effective upon the date of approval indicated below and recorded in the Public Records of St. Lucie County.
