LUCIE COUNTY GRANTING MAJOR SITE PLAN APPROVAL FOR A RECREATIONAL VEHICLE PARK TO BE KNOWN AS MISSIONARY FLIGHTS INTERNATIONAL RECREATIONAL VEHICLE PARK ON APPROXIMATELY 5.20 ACRES OF PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Missionary Flights International, Inc. presented a petition for a Major Site Plan to be known as Missionary Flights International Recreational Vehicle Park consisting of 12 recreational vehicle sites and 6 residences or cottages in the RVP (Recreational Vehicle Park) zoning district on approximately 5.20 acres of land as described in Part A. 2. On August 15, 2017, this Board held a public meeting on the petition. 3. The St. Lucie County Development Review Committee has reviewed the Major Site Plan for the project and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part B of this Resolution. 4. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. 5. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and general welfare. 6. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 7. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the 22 Major Site Plan for the project known as Missionary Flights Internationa 23 Recreational Vehicle Park is hereby approved as shown on the site plan drawings foi 24 the project prepared by Engineering Design and Construction, Inc. dated August 16. 25 2017 and date stamped received by the St. Lucie County Planning & Developmenl 26 Services Department on August 28, 2017, subject to the following conditions: 27 28 Environmental Resources Department 29 30 1. Prior to the issuance a Vegetation Removal Permit or Exemption, a gopher 31 tortoise survey per Florida Fish and Wildlife Conservation Commission 32 protocol shall be provided to the Environmental Resources Department. 33 Should the survey show impacts to gopher tortoises, a Florida Fish and 34 Wildlife Conservation Commission permit shall be required. 35 36 2. Prior to issuance of a Certificate of Occupancy all Category I listed invasive 37 species shall be eradicated from the site. 38 39 3. The landscaping within the ten (10) foot wide landscape buffer along the 40 north property line shall be installed in accordance with the ERD approved 41 landscape plan when the parcel to the north of the canal is developed. 42 43 4. The issuance of County development permit does not in any way creatE 44 any rights on the part of the applicant to obtain a permit from a state o 45 federal agency and does not create any liability on the part of the County i August 15, 2017 Resolution No. 2017-162 Page 2 File No.: MJSP 420175121 1 the applicant fails to obtain requisite approvals or fulfill the obligations 2 imposed by a state or federal agency or undertakes actions that result in a 3 violation of state or federal law. 4 5 5. All other applicable state or federal permits must be obtained before 6 commencement of the development. 7 8 Planning and Development Services Department — Planning Division 9 10 6. The recreational vehicle sites and residences or cottages shall only be 11 occupied only by Missionary Flights and Services, Inc. employees or 12 volunteers. These facilities shall be limited to temporary, short term 13 occupancies by individuals or families for no more than sixty (60) 14 consecutive days. 15 16 7. The applicant shall place a note on the Major Site Plan document that the 17 property owner acknowledges that the subject property is near or in close 18 proximity to the closed Hammond Road landfill, previously owned and 19 operated by the City of Fort Pierce. 20 21 8. Any change in use to permanent housing or change in ownership of 22 property shall void the Major Site Plan. 23 24 Public Works Department — Engineering Division 25 26 9. Prior to the issuance of any building permits, the applicant shall provide 27 engineering plans for review and approval by the Engineering Division. 28 29 10. Prior to the issuance of a building permit, the applicant shall provide a 30 recorded access agreement with the owner of the private driveway 31 adjacent to the south property line. 32 33 C. The approvals and authorizations granted by this Resolution shall expire on August 34 15, 2019 unless a building permit is secured or a site plan extension is granted in 35 accordance with Section 11.02.06(B)(2), St. Lucie County Land Development Code. 36 37 D. The property owner, including any successors in interest, shall obtain all applicable 38 development permits and construction authorizations from the appropriate State and 39 Federal and local regulatory agencies including, but not limited to, the United States 40 Army Corps of Engineers, the Florida Department of Environmental Protection, 41 Florida Department of Transportation, South Florida Water Management District, and 42 the St. Lucie County Environmental Resources and Building Departments prior to the 43 commencement of any development activities on the property described in Part A. 44 Issuance of this permit by the County does not in any way create any rights on the 45 part of the developer to obtain a permit from a state or federal agency and does not August 15, 2017 Resolution No. 2017-162 Page 3 File No.: MJSP 420175121 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part B are an integral non -severable part of the site plan approval granted by this Resolution. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. F. A Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made part hereof the Resolution, was granted by the Planning & Development Servic( Department Director on August 15, 2017. G. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director.
