HomeMy WebLinkAboutPDS-17-031 - Class A Mobile HomePDS ORDER 17-031 FILE NO.: MH 620175158 AN ORDER GRANTING APPROVAL FOR A CLASS A MOBILE HOME AS A SINGLE FAMILY DETACHED DWELLING UNIT IN THE AG -5 (AGRICULTURAL — 1 DWELLING UNIT /5 ACRES) ZONING DISTRICT WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request of Richard Wilder and made the following determinations: Richard Wilder requested a Class A Mobile Home Permit to be defined as a as a detached single family dwelling unit in the AG -5 (Agricultural —1 du/5 acres) Zoning District for the property described below and depicted on Exhibit A. 2. On August 11, 2017 mail notices were sent to all owners of property within 500 feet of the subject property. No written objections for the request were received by the Planning Division within fourteen (14) calendar days of receiving said notice. 3. Staff has performed a detailed analysis of the request and determined it to be consistent with Section 11.05.02. — Class A Mobile Home Permits, of St. Lucie County Land Development Code. The analysis is found in the Planning and Development Services Director Memorandum entitled Richard Wilder — Class A Mobile Home Permit dated September 5, 2017. NOW, THEREFORE, BE IT ORDERED: A. The St. Lucie County Planning and Development Services Director hereby approves the request of Richard Wilder to define a Class A Mobile Home as a detached single family dwelling unit to be located at the following described property and as depicted in Exhibit A. Legal Description: LOT2: THE SOUTH 292.47 FEET OF THE FOLLOWING DESCRIBED PARCEL: COMMENCING AT THE SOUTHWEST CORNER OF SECTION 29, TOWNSHIP 36 SOUTH, RANGE 38 EAST, ST. LUCIE COUNTY, FLORIDA. This approval is subject to the following conditions: 1) The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 2) Prior to issuance of a Certificate of Occupancy, all FLEPPC Category I listed invasive plants, specifically Schinus terebinthifolius (Brazilian pepper), shall be eradicated from the site. 3) All other applicable state or federal permits must be obtained before commencement of the development. C. The developer is advised as part of this minor adjustment approval for Wilder Mobile Home, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate state and federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. A copy of this Order shall be attached to the building permit, which shall be placed on file with the St. Lucie County Planning and Development Services Director.
