AN ORDER GRANTING APPROVAL FOR A WAIVER FROM THE ALL WEATHER
SURFACE PAVING REQUIREMENTS AND AN ALTERNATIVE LANDSCAPE PLAN
FOR PROPERTY LOCATED AT 5280 NORTH US HIGHWAY 1 IN ST. LUCIE
COUNTY, FLORIDA
WHEREAS, the Planning and Development Services Director of St. Lucie County,
Florida, based on the written request and staff report, has made the following
determinations:
Dennis Moore petitioned for Waiver, Deferral and Alternative relief from the
provisions of Section 7.06.02.13.3 to allow for the use of asphalt milling materials
for a proposed on-site parking area and Section 7.09.04 to allow an alternative
landscape plan of the St. Lucie County Land Development Code (LDC). The
subject property is within the CG (Commercial, General) Zoning District consists
of two buildings totaling 4,120 square feet of floor area and depicted on the
attached map as Exhibit "A".
2. The request for administrative relief has met the provisions for relief set forth in
LDC Section 7.06.03.A. The applicant has provided a written request and
analysis that demonstrates the proposed relief is based upon conditions that are
unique and peculiar to the site conditions and will not affect surrounding property
or the safety of the onsite circulation pattern. The County Engineer has reviewed
the request for administrative relief from the all-weather parking surface
requirements and found it to be acceptable.
3. The request for administrative relief has met the provisions for relief set forth in
LDC Section 7.09.04.0. The applicant has provided a written request and
analysis that demonstrates the proposed relief is based upon conditions that are
unique and peculiar to the site conditions and will not affect surrounding property.
The Environmental Regulations Manager has reviewed the request for
administrative relief from the minimum landscaping requirements and found it to
be acceptable.
4. Planning and Development Services Department, Planning Division staff has
performed a detailed analysis of the request and determined it to be consistent
with the St. Lucie County Land Development Code. The analysis is found in the
Planning and Development Services Department Memorandum entitled J. T. Auto
& Custom — 5280 North US Hwy 1, WDA 720175165 dated September 27, 2017.

NOW, THEREFORE, BE IT ORDERED:
A. The petition of Dennis W. Moore for Waiver, Deferral, and Alternative request from
the provisions of Section 7.06.02.B.3 and Section 7.09.04, of the St. Lucie County
Land Development Code is hereby approved as depicted on the WDA Cure Plan
detail sheet prepared by MBV Engineering, Inc. dated September 27, 2017 and date
stamped received by the Planning Division on September 27, 2017. Said approval
will allow the parking area with 8 regular parking spaces to be surfaced with asphalt
millings, and alternative landscape plan, subject to the following conditions of
approval:
1. Within 180 days of Waivers, Deferrals, and Alternatives approval, the applicant
shall install the required landscaping in accordance with the ERD approved
landscape plan.
2. Within 180 days of Waivers, Deferrals, and Alternatives approval, the applicant
shall remove all category I invasive plant species throughout the site, including
but not limited to Brazilian pepper trees.
3. The issuance of County development permit does not in any way create any
rights on the part of the applicant to obtain a permit from a state or federal
agency and does not create any liability on the part of the County if the applicant
fails to obtain requisite approvals or fulfill the obligations imposed by a state or
federal agency or undertakes actions that result in a violation of state or federal
law.
4. All other applicable state or federal permits must be obtained before
commencement of the development.
B. The subject property is described as follows:
The SW 1/4 of the SE 1/4 of the SW 1/4 of Section 8, Township 34 South, Range 40
East, lying East of 200 foot right-of-way of U.S. Highway No. 1, (Florida Highway No 5.)
lying and being in St. Lucie County, Florida.

C. The approvals and authorizations granted by this Order are granted to the applicant
for the purpose of obtaining construction authorizations or Zoning Compliance from
St. Lucie County.
D. An appeal of the Planning and Development Services Director's action may be
processed in accordance with Section 11.11.02 of the St. Lucie County Land
Development Code.
