LUCIE COUNTY, 9 FLORIDA. 10 11 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida,based on 12 the testimonyand evidence, includingbut not limited to the staff report, has made the p , 13 following determinations: 14 15 1. Treasure Coast Land Clearing Inc. and Treasure Coast Tractor ` ' 16 Service, Inc., presented a petition for a Conditional Use Permit to I 17 allow the operation of an air curtain incinerator in the U (Utilities) 18 Zoning District for the property described below. 19 20 2. On May 18, 2000, the St. Lucie County Planning and Zoning 21 Commission held a public hearing on the petition, after publishing 22 notice at least 10 days prior to the hearing and notifying by mail all 23 owners of property within 500 feet of the subject property, and H 24 recommended that the Board of County Commissioners approve the 25 hereinafter described request for a Conditional Use Permit in the U 26 (Utilities) Zoning District for the property described below. 27 HI 28 . 3. On June 6, 2000, this Board held a public hearing on the petition, '1 29 after publishing a notice of such hearing and notifying by mail all 30 owners of property within 500 feet of the subject property. 31 32 4. The proposed Conditional Use is consistent with the goals, objectives, 33 and policies of the St. Lucie County Comprehensive Plan and has 34 satisfied the requirements of Section 11.07.03 of the St. Lucie County 35 Land Development Code. 36 37 5. The proposed project will not have an undue adverse effect on 38 adjacent property, the character of the neighborhood, traffic 39 conditions, parking, utility facilities, or other matters affecting the ' 40 public health, safety and general welfare. A Certificate of Capacity, a copy of which is attached to this 4 resolution, was granted by the Community Development Director on 5 June 6, 2000. 6 7 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. 8 Lucie County, Florida: 9 10 A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development 11 Code, a Conditional Use Permit for Treasure Coast Land Clearing Inc. and 12 Treasure Coast Tractor Service, Inc., to allow the operation of an air curtain 13 incinerator in the U (Utilities) Zoning District, is granted for the property 14 described below, subject to the following conditions: j 15 16 1. The business operation authorized under this conditional use permit Section shall be 17 limited to the short term storage, processing and burning of land clearing debris 18 generated from land clearing operations as defined below: 19 20 a. Land Clearing Debris means uprooted or cleared vegetation resulting from a 21 land clearing operation. 22 • 23 b. Land Clearing Operation means the uprooting or clearing of vegetation in 24 connection with construction for buildings and rights-of-way, residential or 25 industrial development, mineral operations,or the clearing of vegetation to 26 enhance property value and aesthetics. The removal and destruction of 27 shade trees due to storm or insect damage is included as a land clearing 28 operation.29 30 The business operation authorized under this conditional use permit is 31 specifically prohibited from engaging in the business of land clearing and ! 32 yard trash recycling unless and until a new conditional use permit is granted 33 and the site is determined to be in compliance with the provisions of Section 34 7.10.12(C) of the St. Lucie County Land Development Code. 35 36 2. The total site area devoted to the processing, storage and combustion of the 37 collected land clearing debris shall be limited to 10 acres. 38 39 3. The hours of operation will be from 7:00 a.m.to 5:00 p.m., Monday—Friday. The 40 ignition of the combustion fires may not occur before 9:00 a.m. and must be 41 extinguished one hour before sunset 42 43 4. The processing yard, including all product-receiving areas,shall be surrounded bya 44 fence, wall, or opaque vegetative screening eight(8)feet in height. Such fence or t 45 wall shall be of similar composition,construction, and color throughout and shall be 46 constructed without openings except for one entrance and one exit;the entrance and 147 exit shall be equipped with unpierced gates. Such gates shall be closed and 48 securely locked at all times, except during business hours. , File No.:cu00-006 Resolution 00-022 May 30,2000 Page 2 f'. OR BOOK 1308 PAGE 2137 1 2 If vegetative screening is to be substituted for a fence or wall, plans for such 3 vegetative screening shall be submitted with the application for conditional use 4 approval. Such vegetative screening shall consist of a greenbelt strip at least twenty 5 (20)feet in width adjoining all adjacent lot lines,and a greenbelt strip at least fifteen 6 (15) feet in width adjoining any street line. The greenbelt shall be composed of at 7 least one (1) row of deciduous or evergreen trees and one (1) or two (2) rows of 8 shrubs 9 10 In lieu of the vegetative screen of the greenbelt strip, a citrus buffer of two (2) to 11 three (3) rows of citrus trees may be installed. 12 I i' 13 Maintenance of the fence, wall, or opaque vegetative screening shall be the I 14 responsibility of the property owner consistent with the other provisions of the St. 15 Lucie County Land Development Code. 16 f 17 5. All sides of each Individual debris storage (stockpile) areas shall be accessible by 18 means of fire lanes. Fire lanes shall be a minimum of 1 Y2 times the height of the 111 19 pile,but in no case shall the fire lane be less than 20 feet in width. A minimum 100- 20 foot wide clear space shall be provided between every two debris storage piles and 111 21 there shall be a 100-foot wide fire lane at the end of each storage or stockpile, 1 22 regardless of overall length. Figure 7-29 as found in the St. Lucie County Land 23 Development Code. generally depicts the layout of the debris storage stockpile 24 areas. i9 25 ! 26 The maximum length of an individual debris storage stockpile shall not exceed 500 • 27 feet.The maximum width of an individual debris storage stockpile shall not exceed I; 28 100 feet. The maximum height of any one storage pile shall not exceed thirty 30 29 feet. 30 31 6. An area equal to 15% of the total area occupied by the debris storage areas !! 32 (stockpiles) shall be reserved for the emergency relocation of the stored materials 33 should it be necessary for fire fighting purposes. This emergency storage area may jl 34 not include any of the required minimum setbacks or separation corridors for the :1 35 debris storage areas(stockpiles). This emergency storage area shall be adequately 36 served with access to fire suppression resources,consistent with this code. IL. 37 I, 3 8 7. The total site area that may be covered with the debris storage areas(stockpiles), 1! 39 excluding the emergency stockpile area, shall not exceed 60%of the gross area of 40 the project site. 41 [I 42 8. Individual stockpiles shall be located at least one hundred(100)feet from any brush 43 or tree line and shall be no closer than fifty (50) feet to any property line or street !JJ 44 right-of-way line. 11 45 46 9. The petitioner shall, prior to the issuance any final zoning compliance, which is 2 required for this conditional use permit to be fully executed, shall submit a copy of 3 Fire Prevention Plan for the combustion operation that has been approved by the St. 4 Lucie County Fire District, Fire Prevention Bureau. This fire prevention plan shall,at 5 a minimum, address all requirements and recommendations of NFPA 46, 6 Recommended Safe Practice for Storage of Forest Products, 7 8 11. The petitioner, including any assigns, shall submit to an annual fire prevention 9 inspection to be conducted, upon reasonable notice, by the St. Lucie County Fire 10 District, Fire Prevention Bureau. 11 12 12. All stockpiles shall be constructed and located so as to afford the opportunity to 13 measure the internal temperatures of the land clearing materials in the stockpile in 14 order to monitor fire hazard. 15 16 13. All vehicles used on the stockpile shall be of a type that minimizes the compaction of 17 the stockpile. 18 19 14. Prior to the issuance any final zoning compliance, which is required for this ( 20 conditional use permit to be fully executed, the petitioner shall provide St. Lucie 21 County a cash security fund,bond or provide the County with an irrevocable letter of 22 credit based on the schedule below, to secure the cost of removing of all 23 accumulated land clearing and yard trash debris from the site if it has been 24 determined by the County Commission, following a duly noticed public hearing, 25 combustion facility approved under this conditional use permit has been abandoned 26 or combustion operations have ceased for period in excess of six months,or of the 27 Conditional Use Permit is revoked for any reason. 28 Facility Size - Required Security i . 5 to 7.5 acres $50,000 7.5 to 10 acres $ 100,000 29 30 31 15. The Environmental Control Hearing Board shall be the responsible enforcement 32 board assuring compliance with the provisions of this Conditional Use Permit. If the 33 Environmental Control Officer, in consultation with the Community Development 34 Director and the County Health Director,determines that the Environmental Control 35 Hearing Board process would be an inadequate response to a given violation(s),the 36 Environmental Control Officer may institute appropriate proceedings in a court of 37 competent jurisdiction for prosecution of the violation(s) as provided by laws. 38 39 16. Prior to the issuance any final zoning compliance, which is required for this 40 conditional use permit to be fully executed, the petitioner shall provide St. Lucie 41 County copies of all the Florida Department of Environmental Protection permits for 42 the operation of the air curtain on the subject property. 43 44 File No.:cu00-006 Resolution 00-022 May 30,2000 Page 4 • . In the event that St.Lucie County is declared a federal disaster area following or as a 2 result of either hurricane or freeze damage,the County Commission may suspend 3 any or all of the standards above for the duration of the declared emergency in order 4 to facilitate the removal of vegetative debris. 5 6 B. The property on which this Conditional Use Permit is being granted is 7 described as follows: 8 9 The south 936 feet,less the East 100 feet,and less the West 100 feet,of the following 10 described parcel: A parcel of land lying in Section 9,Township 35.South, Range 38 11 East,St. Lucie County,Florida,being more particularly described as follows: The East 12 1/2 of the East'/2 of the Southwest 1/4 of Section 9,less the north 202 feet and the south 13 39 feet for road and canal right-of-way(9.9 acres). 14 15 (Part of Tax ID. No. 2209-311-0001-000/9). 16 17 (Location: South side of Orange Avenue,approximately 1,800 feet west of Sneed 18 Road) 19 20 C. The approvals and authorizations granted by this Resolution for the purpose 21 of obtaining site plan/building permit approvals on this property, shall expire 22 on June 6, 2001, unless the developer has obtained a site plan or building 23 permit approval for the use described in Part A above, or an extension has ' 24 been granted in accordance with Section 11.07.05(F), St. Lucie County Land 25 Development Code. 26 27 D. The Conditional Use Permit approval granted under this Resolution is 28 specifically conditioned to the requirement that the petitioner,Treasure Coast ;. 29 Land Clearing, Inc. and Treasure Coast Tractor Service, Inc., including any 30 successors in interest, shall obtain all necessary development permits and 31 construction authorizations from the appropriate State and Federal regulatory 32 authorities, including but not limited to; the United States Army Corps of 33 Engineers, the Florida Department of Environmental Protection, and the 34 South Florida Water Management District, prior to the issuance of any local 35 building permits of authorizations to commence development activities on the 36 property described in Part B. 37 ! 38 E. The conditions set forth in Part A is an integral nonseverable part of the site 39 plan approval granted by this resolution. If the conditions set forth in Part A 40 is determined to be invalid or unenforceable for any reason and the 41 developer declines to comply voluntarily with that condition, the site plan 42 approval granted by this resolution shall become null and void. r'. 43 44 File No.:cu00-006 Resolution 00-022 May 30,2000 Page 5 • OR BOOK 1308 PAGE 2140 1 F. The Certificate of Capacity, a copy of which is attached to this resolution, !, 2 shall remain valid for the period of Conditional Use approval.
