AN ORDINANCE AMENDING SECTION 1-14.5-24 (PROGRAM COMMITTEE)
OF THE ST. LUCIE COUNTY CODE AND COMPILED LAWS TO DELETE THE
SHERIFF AND THE SUPERVISOR OF ELECTIONS FROM THE PROGRAM
COMMITTEE; PROVIDING FOR SEVERABILITY AND APPLICABILITY;
PROVIDING FOR FILING WITH THE DEPARTMENT OF STATE; PROVIDING
AN EFFECTIVE DATE; PROVIDING FOR ADOPTION; PROVIDING FOR
CODIFICATION
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following
determinations:
1. Section 112.215, Florida Statutes, authorizes counties to enter into deferred compensation
programs for their respective officials and employees.
2. This Board adopted Ordinance No. 83-04 establishing a Deferred Compensation Plan to be
made available to all eligible County employees, elected officials, and independent contractors pursuant
to Section 457 of the Internal Revenue Code.
3. This Board adopted Ordinance No.13-035 which changed the administratorfrom NACO and
PEBSCO to TIAA CREF.
4. The St. Lucie County Sheriff and the St. Lucie County Supervisor of Elections have
determined not to be a part of the deferred compensation program making it necessary to remove them
from the program committee.

NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County,
PART A. AMENDMENT OF SECTION 1-14.5-24 (PROGRAM COMMITTEE)
The Code of Ordinances of St. Lucie County, Florida, is amended by amending Section 1-14.5-24 to
read as follows:
a) The deferred compensation program committee shall be composed of the following
persons or designates of those persons:
(1) County administrator;
(2) County attorney;

{~j~ Clerk of the circuit court.

The county administrator, or designate, shall serve as chairman of the committee.
(b) The committee shall have the power and responsibility for:
(1) Reviewing the performance ofthefdA£~ Deferred Compensation program and the
administrative performance of PfBSC~ the Program Administrator, and making appropriate
recommendations to the board of county commissioners;
(
~f~Making recommendations tothe board of county commissioners on other matters
related to deferred compensation.
(c) The committee shall meet at such time and place as determined by the committee
chairman,
PART B. SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any reason held or declared to be unconstitutional,
inoperative, orvoid, such holding shall not affect the remaining portions ofthis ordinance. If this ordinance
or any provision thereof shall be held to be inapplicable to any person, property, or circumstances, such
holding shall not affect its applicability to any other person, property, or circumstances.
PART C. FILING WITH THE DEPARTMENT OF STATE.
The Clerk is hereby directed forthwith to send a certified copy ofthis ordinance to the Bureau of
Administrative Code and Laws, Department of State, the Capitol, Tallahassee, Florida 32304.
PART D. EFFECTIVE DATE.
This Ordinance shall take effect upon filing with the Department of State.
PART E. ADOPTION.
After motion and second, the vote on this ordinance was as follows:

BART F. CODIFICATION.
Provisions of this ordinance shall be incorporated in the Code of Ordinances of St. Lucie County,
Florida, and the word "ordinance" may be changed to "section," "article," or other appropriate word, and
the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided,
however, that Parts B through F shall not be codified.
