HomeMy WebLinkAbout14-025ORDINANCE NO. 14-025 AN ORDINANCE AMENDING SECTION 22-95, "CREATION OF THE AFFORDABLE HOUSING ADVISORY COMMITTEE", TO CLARIFY THE COMMITTEE'S REPORTING REQUIREMENTS IN ACCORDANCE WITH F.S. SECTION 420.9076; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, on June 15, 1993, the Board of County Commissioners adopted Ordinance No. 93-17 which amended Chapter 1-10.5 ("Housing") of the St. Lucie County Code of Ordinances and Compiled Laws to create Article V ("State Housing Initiatives Partnership Program"); and WHEREAS, Section 1-10.5-42 provided for the creation of an Affordable Housing Advisory Committee (the "Committee") for the purpose of advising the Board of County Commissioners on matters relating to codes and regulations that may preclude affordable housing policies; and WHEREAS, on May 27, 2008, the Board of County Commissioners adopted Ordinance No. 08-23 which amended Section 1-10.5-43 to provide for membership and duties of the Affordable Housing Advisory Committee in accordance with F.S. Section 320.9076, including but not limited to the requirement for the Committee to conduct a review of the County's housing ordinances and policies affecting affordable housing and submit a report to the Board every three year on or before December 15S beginning December 1, 2008; and WHEREAS, Section 420.9076(4) provides that local governments that receive the minimum allocation under the State Historical Initiatives Partnership Program are required to perform the initial review but may elect not to perform the triennial review; and, WHEREAS, on August 12, 2014, the Board of County Commissioners adopted Ordinance No. 14-020 which recodified the St. Lucie County Code of Ordinances and Compiled Laws, including Section 1-10.5-43 which has been renumbered as Section 22-95; and, WHEREAS, the Board has determined that it is appropriate to amend Section 22-95 to provide that following completion of the initial review of the County's ordinances and policies affecting affordable housing the Committee shall only be required to perform the triennial review as directed by the Board. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA: PART A: AMENDMENT OF SUBSECTION 22-95(b) ("CREATION OF THE AFFORDABLE HOUSING ADVISORY COMMITTEE") The Code of Ordinances of St. Lucie County, Florida, is amended by amending Subsection 22-95(b) to read as follows: 1 Underlined passages are added. Section 420.9076. that iReludes The report shall include recommendations on and evaluate the implementation of affordable housing in the following specific areas: (1) The processing of approvals of development orders or permits, as defined in F.S. Section 163.3164(7) and (8), for affordable housing projects is expedited to a greater degree than other projects. (2) The modification of impact fee requirements, including reduction or waiver of fees and alternative methods of fee payment for affordable housing. (3) The allowance of flexibility in densities for affordable housing. (4) The reservation of infrastructure capacity for housing for very -low income persons, low-income persons, and moderate -income persons. (5) The allowance of affordable accessory residential units in residential zoning districts. (6) The reduction of parking and setback requirements for affordable housing. (7) The allowance of flexible lot configurations, including zero -lot -line configurations for affordable housing. (8) The modification of street requirements for affordable housing. (9) The establishment of a process by which the county considers, before adoption, policies, procedures, ordinances, regulations, or plan provisions that increase the cost of housing. (10) The preparation of a printed inventory of locally owned public lands suitable for affordable housing. (11) The support of development near transportation hubs and major employment centers and mixed-use developments. PART B. SEVERABILITY AND APPLICABILITY. It is declared to be the intent of the Board of County Commissioners of St. Lucie County, that if any section, subsection, sentence, clause or provision of this ordinance be held invalid, the remainder of the ordinance shall not be affected. PART C.FILING WITH THE DEPARTMENT OF STATE. The Clerk is hereby directed forthwith to send a certified copy of this ordinance to the Bureau of Administrative Code and Laws, Department of State, The Capitol, Tallahassee, Florida 32304. PART D. EFFECTIVE DATE. Pursuant to F.S. Section 125.66, a certified copy of this Ordinance shall be filed with the Department of State by the Clerk of the Board of County Commissioners within ten (10) days after enactment by the Board of County Commissioners. This Ordinance shall become effective when the acknowledgment is received from the Secretary of State that the Ordinance has been duly filed. -2- Underlined passages are added. ;, passages are deleted. Provisions of this ordinance shall be incorporated in the Code of Ordinances of St. Lucie County, Florida, and the word "ordinance" may be changed to "section," "article," or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, that Parts B through D shall not be codified.
