LUCIE COUNTY, FLORIDA, AMENDING THE TEXT OF THE LAND DEVELOPMENT CODE PERTAINING TO SECTION 4.12.00, JENKINS ROAD AREA PLAN SPECIAL DISTRICT. PROVIDING FOR CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR APPLICABILITY; PROVIDING FOR FILING WITH THE DEPARTMENT OF STATE; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR ADOPTION; AND PROVIDING FOR CODIFICATION. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, desires to encourage economic development through commercial and industrial development with access to the state Strategic Intermodal System; and WHEREAS, the Jenkins Road Area Plan encompasses an 1-95 interchange; and WHEREAS, the Jenkins Road Area Plan contemplates commercial and industrial development primarily within a mixed use, traditional town center concept; and WHEREAS, the St. Lucie County proposes to reinitiate the neighborhood planning process and develop new regulations for this area based on current economic realities and community goals; and WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: This Board is authorized by Section 125.01(1)(h), Florida Statutes to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public; and, 2. This Board is authorized by Section 125.01(1)(t) to adopt ordinances and resolutions necessary for the exercise of its powers and to prescribe fines and penalties for the violations of ordinances in accordance with law. 3. On August 1, 1990 the Board of County Commissioners of St. Lucie County Florida adopted the St. Lucie County Land Development Code. 4. On August 21, 2014, the Planning and Zoning Commission held a public hearing on the proposed ordinance after publishing notice in the St. Lucie News Tribune at least 10 days prior to the hearing and recommended that the proposed ordinance be approved. 6. On December 16, 2014, this Board held its first public hearing on the proposed ordinance, after publishing a notice of such hearing in the St. Lucie News Tribune at least 10 days in advance. 7. On January 6, 2015, this Board held its second public hearing on the proposed ordinance, after publishing a notice of such hearing in the St. Lucie News Tribune at least 10 days in advance. 8. The proposed amendment to the St. Lucie County Land Development Code is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Comprehensive Plan and is in the best interest of the health, safety and public welfare of the citizens of St. Lucie County, Florida. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida: A. The specific amendment to the St. Lucie County Land Development Code to read as follows in strikethrough and underline format: 4.12.01. Purpose a^Grrd intent AThe a urnnAe of thea I The i#ent purpose of these regulations is to create a viable road system and supporting multi- modal facilities, built within the constraints of existing development, with adequate open space and recreational resources, and to protect natural resources. 4.12.02. Area Affected. The regulations adopted herein shall affect all land development in the unincorporated area of St. Lucie County which is proposed in the area lying south and west of Angle Road, North of Orange Avenue, and east of King's Highway, near the western boundary of the City of Ft.
