4 AN ORDINANCE OF THE BOARD OF COUNTY
5 COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA,
6 AMENDING THE JENKINS ROAD AREA PLAN SPECIAL
7 DISTRICT SECTION 4.12.05, PERMITTED ZONING AND
8 REZONING; PROVIDING FOR CONFLICTS; PROVIDING
9 SEVERABILITY; AND ESTABLISHING AN EFFECTIVE
10 DATE.

13 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida,
14 has made the following determinations:
15
16 1. On August 1, 1990, the Board of County Commissioners of St. Lucie
17 County, Florida, adopted the St. Lucie County Land Development
18 Code.
19
20 2. On February 6, 2007, the Board of County Commissioners approved
21 Ordinance No. 07-011 adopting Land Development Code Section
22 4.12.00, Jenkins Road Area Plan Special District regulations to
23 promote innovative urban design and healthy communities consisting
24 of a multimodal transportation system and mixed land uses.

26 3. St. Lucie County has become aware of a need to modify certain
27 provisions in the Jenkins Road Area Plan Special District regulations to
28 expand development options.

30 4. On April 18, 2013, the Local Planning Agency/Planning and Zoning
31 Commission, held a public hearing on the proposed ordinance after
32 publishing notice in the St. Lucie News Tribune at least 10 days prior
33 to the hearing and recommended that the proposed ordinance be
34 approved.

36 5. On May 7, 2013, this Board held its first public hearing on the
37 proposed ordinance, after publishing a notice of such hearing in the St.
38 Lucie News Tribune at least 10 days prior to the hearing.

40 6. On May 21, 2013, this Board held its second public hearing on the
41 proposed ordinance, after publishing a notice of such hearing in the St.
42 Lucie News Tribune at least 10 days prior to the hearing.

44 NOW, THEREFORE, BE IT ORDAINED by the Board of County
45 Commissioners of St. Lucie County, Florida:

PART A. THE SPECIFIC AMENDMENTS TO THE ST. LUCIE COUNTY
LAND DEVELOPMENT CODE TO READ AS FOLLOWS,
INCLUDE:

No changes in Section 4.12.00 through 4.12.04.
4.12.05 PERMITTED ZONING AND REZONING

Road Area Plan Special District shall be by application for approval of a Planned
Development °1" Dl~nnerl ~ ~ni+ ne„o~„nrv,en+ zoning district, unless otherwise
provided for in this section or Section 4.12.00, et. seq., is first amended to permit
other types of zoning changes. All proposed zoning and development is required
to be consistent with the adopted comprehensive plan, and compatible with
surrounding existing and proposed development.

D°ri-c~°cv Rezoning to Planned Mixed Use Development, or any other wed
mixed use planned unit development is permitted in the areas shown around the
perimeter of the planning area along Kings Highway and Orange Avenue on Map
C:

COMMERCIAL ZONING AREAS AND ROAD NETWORK

1 The parcels zoned AG-1 on Map C within the planning area adjacent to the east
2 right-of-way line of Kings Highway may be rezoned Light Industrial, Planned
3 Non-Residential Development or Planned Mixed Use Development,
4 as those zoning districts may be amended from time to time. The parcels zoned
5 AR-1 erg-~-on Map C within the planning area north of Orange Avenue, south
6 of Canal No. 44, and west of Jenkins Road may be rezoned to a Planned Mixed
7 Use district that would allow light industrial in the area south of the east/west line
8 formed by Selena Avenue. The parcels zoned AR-1 or RS-2 on Map C that lie
9 east of I-95, south of Canal No. 44, north of Orange Avenue, and west of the
10 north/south line formed by Canal No. 29 may be rezoned to a planned
11 development zoning district that allows mixed office/commercial land uses and
12 which may include a substantial residential component in the mix of uses,
13 provided appropriate measures are included to provide for compatibility of the
14 proposed mix of uses.

16 The parcels at the southwest and southeast corners of the intersection of Taylor
17 Dairy Road/Jenkins Road and Angle Road may be rezoned as Planned Non_
18 Residential Development or a Planned Mixed Use Development, as those mixed
19 use districts may be amended from time to time_ ;This area may be developed
20 as a ~r +~pes~+~^ ^~ ~~^^c° cf c:'°et°^y ~ Traditional Neighborhood Design
21 mixed use Commercial Village, in accordance with the standards of this Section
22 4.12.00, et. seq., and any other relevant standards of the Land Development

24 corner may also be rezoned to a commercial ~or other non-residential or mixed
25 use zoning district consistent with the comprehensive plan.

27 The remaining area of Map C shall be amended to be predominantly residential
28 development by application for Planned Mixed Use Development, Planned Non-
29 Residential Development, and/or Planned Unit Development, as those zoning
30 districts may be amended from time to time, to permit development in
31 accordance with the standards of this Section 4.12.00, and the standards of the

35 B. JENKINS ROAD PLANNING AREA DEVELOPMENT STANDARDS

44 The Board of County Commissioners may approve a modified road and trail
45 system location or design based upon physical constraints peculiar to the
46 aroaosed improvements location as set forth__ in LDC Section 4.12.03, and a

determination that the intent of the ordinance is being upheld. Said modification
shalt be approved as part of a Resolution granting site plan approval or a
Development Agreement that incorporates a conceptual development plan. Site
and building design in the remaining areas shall be compatible with the
development in the predominantly residential and commercial village areas north
of an east-west line running through North St. Lucie Water Control District
Cscanal C-44.
PART 2. CONFLICTS.
All ordinances, or parts of ordinances, in conflict herewith are invalid to the extent
of such conflicts, and the same are hereby repealed.
PART 3. SEVERABILITY.
If any portion of this ordinance is for any reason held or declared to be
unconstitutional, inoperative or void, such holding shall not affect the remaining
portions of this ordinance. If this ordinance or any provision thereof shall be held
to be inapplicable to any person, property, or circumstance, such holding shall
not affect its applicability to any other person, property, or circumstance.
PART 4. FILING WITH THE DEPARTMENT OF STATE.
The Clerk is hereby directed forthwith to send a certified copy of this ordinance to
the Bureau of Administrative Code and Laws, Department of State, The Capitol,
Tallahassee, Florida 32304.
PART 5. EFFECTIVE DATE.
This ordinance shall take effect upon filing with the Department of State.
PART 6. CODIFICATION.
Provisions of this ordinance shall be incorporated in the Code of Ordinances of
St. Lucie County, Florida, and the sections of this ordinance may be renumbered
or relettered to accomplish such intention; provided, however, that Parts 2
through 4 shall not be codified.
