LUCIE COUNTY, FLORIDA, AMENDING THE TEXT OF THE LAND DEVELOPMENT CODE (SECTION 7.06.00) REMOVING THE EXISTING OFF STREET PARKING REGIUIREMENTS, NUMBER OF SPACES REQUIRED, REPLACING WITH THE INSTITUTE OF TRAFFIC ENGINEERS STANDARDS, BY REFERENCE; ADDING EXCEPTIONS TO ALLOW NONCONFORMING CONDITIONS TO CONTINUE; REMOVING REDUNDANT SECTION 7.06.04, ST. LUCIE COUNTY FIRE CODE STANDARDS; EDITING AND REARRANGING TEXT FOR CLARITY; PROVIDING FOR CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR APPLICABILITY; PROVIDING FOR FILING WITH THE DEPARTMENT OF STATE; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR ADOPTION; AND PROVIDING FOR CODIFICATION. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, desires to reduce unnecessary off-street parking and- thereby decrease heat islands, increase green .space, reduce unnecessary costs of development and allow for development of smaller lots; and WHEREAS, the Institute of Traffic Engineers Parking Generation manual is the industry- standard for research driven parking standards; and WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: This Board is authorized by Section 125.01(1)(h), Florida Statutes to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public; and, 2. This Board is authorized by Section 125.01(1)(t) to adopt ordinances and resolutions necessary for the exercise of its powers and to prescribe fines and penalties for the violations of ordinances in accordance with law. 3. On August 1, 1990 the Board of County Commissioners of St. Lucie County Florida adopted the St. Lucie County Land Development Code. 4. On September 26, 2013, the Planning and Zoning Commission held a public hearing on the proposed ordinance after publishing notice in the St. Lucie News Tribune at least 10 days prior to the hearing and recommended that the proposed ordinance be approved. 5. On December 3, 2013, this Board held its first public hearing on the proposed ordinance, after publishing a notice of such hearing in the St. Lucie News Tribune at least 10 days in advance. JOSEPH E. On December 17, 2013, this Board held its second public hearing on the proposed ordinance, after publishing a notice of such hearing in the St. Lucie News Tribune at least 10 days in advance. 7. The proposed amendment to the St. Lucie County Land Development Code is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Comprehensive Plan and is in the best interest of the health, safety and public welfare of the citizens of St. Lucie County, Florida. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida: A. The specific amendment to the St. Lucie County Land Development Code to read as follows in strikethrough and underline format: 17 7.06.00. Off Street Parking and Loading 18 19 7.06.01. Purpose and Applicability 20 A. Purpose. The requirements of this Section are intended to insure that every 21 buildinq. structure, or use erected or instituted, except for bona-fide agricultural 22 uses and buildings, shall be provided with adequate off-street parking facilities for 23 the use of occupants. employees. visitors, and patrons. and that certain uses be 24 provided with adequate off-street loading facilities. thereby reducing congestion to 25 the public streets and promoting. the safety and welfare of the public. 26 27 B. AQ~licability 28 1. Existino Uses/Changes in Use. Buildings or structures existing as of the 29 effective date of this Code may be modernized. altered. or repaired 30 without providing additional off-street parking or loading facilities. 31 provided there is no change of use. 32 Effective March 1.1999, anv change in use to an existing buildinq or 33 structure, will require that all on-site parking and loading facilities be 34 brought into full compliance with the provisions of this Code, except as 35 otherwise provided here in Section 7.06.00. as it may be amended from 36 time to time. For the purposes of this Section. "change in use" shall 37 mean anv chance in use or activity that requires the issuance of a new 38 certificate of zoning compliance. Parking surface, landscaping, changes 39 in use and zoning compliance are subject to the provisions of this Code 4o as amended by Ordinance No. 12-003. File No.: TLDC - 820134657 Page 3 1 2. Expansion of Structure. Expansion in floor area, volume, capacity, or 2 space occupied of any structure existina on or before Julv 1, 1984, shall 3 require compliance with all off-street parking and loading requirements 4 contained in this Code to be met for both new construction and existina 5 structures, except as otherwise provided below and in Section 7.06.03. 6 a. Exceptions: 7 1. If the applicant can demonstrate to the satisfaction of the 8 Planning and Development Services Director that the site has provided 9 adeauate off street parkins for its use prior to expansion, only the new 1o construction shall be reauired to comply with the reauirements of this 11 Section. 12 ~ 2. New construction not reauired to comply with off street parking 13 reauirements include: Entry areas or vestibules, unoccupied storaae 14 areas provided these do not exceed 25% of the aross floor area, and 15 areas which do not add to the carrVina capacity of a structure. 16 3. Nonconforming Uses. When repairs arid alterations are to be made 17 in a building occupied by a nonconforming use, all off-street parking 18 reauirements contained in this Code shall be met if the cost of repairs and 19 alterations exceed fifty percent (50%1 of the assessed value of the building 20 and structures. 21 a. Exceptions: 22 ~ 1. If the applicant can demonstrate to the satisfaction of the 23 Planning and Development Services Director that the site has provided 24 adeauate off street parking for its use prior to expansion. only the new 25 construction shall be required to comply with the requirements of this 26 Section. 27 2. Number of off street parking and loading spaces reauired 1. Off Street Parkino Qer Use. The most recently published edition of the Institute of Transportation Engineers Parkino Generation is adopted by reference as the use-specific requirements for off- street parking. The most receltly published standards will be available for the public on the County website and at the Planning and Development Services Department. a. For any uses not listed in the latest edition of Parking Generation, the Planning and Development Services Director will make a determination for reauired parking based on the most similar use, professionally recognized standards, a survey of similar counties' regulations, and/or analysis by File No.: TLDC - 820134657 Page 4 1 2 3 4 5 6 7 a traffic enaineer based on use-specific parkina requirements. The determination will be made in writina referencina the standards or analysis used to make the determination. 2. Handicapped Parking. Handicapped parkina shall be provided as required the Standard Buildina Code and F.S. ~& 316.1955 and 316.1956. All off-street parking areas shall be designed so that motor vehicles can exit without backing into a street, except for single-family, two-family and three-family dwellings. 3. Material a. Requirement for all Weather Surface for all Required Off- Street Parking and Vehicular Use Areas. Subject to the Administrative Relief provisions below, all required off-street parking spaces, access aisles, vehicular use and off-street loading areas constructed: expanded or altered after March 1 „ 1999, shall be constructed with an all weather surface meeting the requirements of the St. Lucie County Public Works Department. The permitted impervious surface materials shall be concrete, asphalt, brick pavers, stamped concrete, or gavina block. Pervious gavina svstems and grass gavina svstems shall be permitted when the paving svstems and materials are approved by the County Engineer. Stabilized unpaved parking areas may be permitted at locations outside the urban service area upon approval of the County Engineer, so Iona as parking spaces, accesswavs, and driveways are clearly marked and the vehicular/pedestrian circulation system is safe. No more than ten (10) parking spaces shall be permitted in a continuous row without being interrupted by a minimum landscape area of one hundred eighty (180) sauare feet for single row parking or three hundred sixty (360) sauare feet for double row parking (see Figure 7-23). b. Parking or display of anv motor vehicle. recreational vehicle. boat, trailer or other vehicle in anv required landscape area is prohibited. 6. Wavfindinq a. Location. Loading spaces shall be located on the same lot as 2 the buildina or structure to which they are accessory. No 3 loadina shall be located in a reauired front yard. 4 b. Designation and Use. Each reauired loadina space shall be 5 designated as such and shall be used only for loading 6 purposes. 7 c. Design and Maintenance. 8 1. Off-street loadina spaces shall be an area at grade 9 level at least 12x55 feet Iona with afourteen-foot 1o vertical clearance. 11 2. For buildings less than 14.999 square feet, the 12 reauired delivery space may have a minimum 13 dimension of 12 feet X 30 feet with a fourteen foot 14 vertical clearance. 15 3. Each loadina space shall be accessible from the 16 interior of the buildina it serves without crossing or 17 entering any other reauired off-street loadina space. 18 off-street parking space, or circulation area. Such 19 loading spaces shall be arranged for convenient and 20 safe ingress and egress by motor truck and trailer. 21 4. All loadina spaces shall be paved. 22 23 7.06.03 Relief 24 A. Administrative Relief. The Planning and Development Services Director 25 ~ may grant administrative relief from the parking standards or the reauired 26 amount of all weather surface for off street parkins and vehicle use areas 27 including vehicular use areas (Small Business <6000 square feet) based 28 upon a written request for such administrative relief and an analysis 29 submitted by the applicant. The analysis must demonstrate that the 3o numeric amount of required parking or the required amount of all weather 31 surface for off street parking and vehicle use areas is unnecessary or not 32 practical to construct because of conditions that are unique and peculiar to 33 the site or conditions that would result in unnecessary hardship for the 34 owner, lessee or occupant as opposed to mere inconvenience and that the 35 conditions are created by the regulations of this Code and not by the 36 actions of the property owner or applicant, environmental considerations. 37 such as micrositina for large trees, for mass transit considerations, such as 38 providing transit stops in an area to be served with mass transit services. 39 and superior design considerations determined by exceeding the minimum 40 requirements of the Land Development Code. The County Engineer shall 41 review the request for administrative relief from the all-weather parking File No.: TLDC - 820134657 Page 13 1 surface reauirements and provide the Plannina and Development Services 2 Director with a written recommendation based on the standards set out in 3 this section. The Countv Engineer may reauire the applicant to provide an 4 engineered solution to anv adverse impacts that the request for a waiver 5 may create. If it is determined by the Plannina and Development Services 6 Director that it is not possible to meet the numeric or narking stall width 7 parking requirements of this Code due to the size or configuration of the 8 existing parcel, the Planning and Development Services Director may grant 9 administrative relief, subject to determining consistency with the Standards 10 of Review set out in Section 10.01.02, to the parking stall width or the 11 number of parking spaces to be reauired. Anv such administrative relief 12 shall be specific to the parcel or property in question and shall be the 13 minimum necessary to address the particular problem. Anv such 14 administrative relief shall include specific findings of fact and shall be 15 issued in a manner and form that is acceptable to the County Attorney. Anv 16 determination for relief that is made by the Plannina and Development 17 Services Director shall be recorded in the public records of St. Lucie 18 County. 19 8. Context Sensitive Parkino. Within downtowns and walkable scale 20 communities having mixed uses, on-street parking. and which may also 21 include parking structures or common parking lots. on-site garkina for each 22 building may not be reauired when all of the required garkina for the land 23 use proposed in the building is provided within six hundred (600) feet of the 24 building, and is not dedicated to another land use. except that shared 25 garkina agreements permitted by Section 7.06.02(61(3) shall be allowed. 26 Parking reauirements for mixed use downtown and walkable scale mixed 27 use areas shall be computed for general retail land uses using the 28 shopping center parking standard. All other land uses and retail land uses 29 that have garkina rates that exceed the shopping center rate shall have 3o their parking requirements computed at their parking generation rates and 31 added to the basic retail shopping center requirement. Reductions may be 32 made for land uses that enter into shared parking agreements. The total 33 parking requirement must be met by a combination of on-street garkina. 34 off-site common garkina facilities, shared parking (if used), and on-site 35 parking. All on-street parking proposed within a public right-of-wav shall 36 reauire the issuance of a right-of-wav use permit by the County Engineer 37 prior to anv land clearing or construction of pavement marking, whichever 38 comes first. This section does not authorize on-street garkina on public 39 right-of-wav but only gives credits for the reduction of on-site parking when 4o properly approved on-street garkina is available, as provided herein. The 41 total garkina requirement derived as required herein may be reduced by ug File No.: TLDC - 820134657 Page 14 1 to twenty percent (20%) by the Plannina and Development Services 2 Director for equivalent facilities that provide for transit access and sheltered 3 transit stops. park-and-ride facilities. remote parkins with motorized access 4 between parking and destination, and/or bicycle parkins and movements. 5 or other modes of around transportation not included herein (e.a., golf cart 6 paths). 7 C. Combined Properties Used for Off-Street Parkino. Two (2) or more owners 8 or operators of buildinas, structures, or uses requiring off-street parking 9 facilities may make collective provisions for such facilities. provided that the 10 total of such parkins spaces when combined or used together shall not be 11 less than the sum of the requirements computed separately. and provided 12 further that no off-site parkins space shall be greater than six hundred 13 (600) feet from any building it is designated to serve. 14 D. Shared Off-Street Parkins Areas. Where, in the determination of the 15 Plannina and Development Services Director, the reauired number of 16 spaces is excessive for a specific building or facility reauirina site plan 17 approval, and the owner of the property has submitted to the Plannina and 18 Development Services Director an enforceable restriction of use, the 19 Plannina and Development Services Director may authorize the use of 20 shared parking facilities effectively reducing the number of required parking 21 spaces. In no case however, shall less than seventy-five percent (75%) of 22 the reauired off-street parkins spaces be provided. The purpose of this 23 provision is to allow land uses located within a unified development or on 24 adjacent lots to enter into agreements to use parkins spaces at different 25 times of day which correspond to their different hours of operation. When 26 shared parkins agreements are applied in approving site plans, no land 27 uses can be permitted that exceed the maximum allowable parking 28 demand at the prescribed times of day. even though the initial land uses 29 may eventually be proposed to be changed. Additional parkins may have to 3o be constructed in order to accommodate new land uses proposed to be 31 operating simultaneously during the day or evening. Restrictions on the 32 parkins generation rates and times of use of the affected buildinas shall be 33 required to be recorded in the public records of St. Lucie County, Florida, 34 and may be in the form of restrictions contained with in a development 35 order or development agreement, or in such other form as the Planning 36 and Development Services Director may prescribe with the approval of the 37 County Attorney reauired for all standard and special forms used for this 38 purpose. 39 E. Provision of Reserved Parkino Areas. Where, in the determination of the 40 Plannina and Development Services Director, the required number of File No.: TLDC - 820134657 Page 15 1 required parking and loading spaces is excessive for a specific use. the 2 owner or agent may substitute landscaping in lieu of paving provided said 3 areas are reserved for future parking and loading should the County find 4 those spaces are needed. and further provided: 5 a. The owner of the land upon which such parking is being reserved 6 shall enter into a written agreement with St. Lucie County which 7 shall include a schematic portrayal as to how the reauired parking 8 and loading areas can be provided with the County. to be filed with 9 the Clerk of the Circuit Court, with enforcement running to the 10 County ensuring that the reserved parking and loadinq area shall 11 never be encroached upon. used. sold. leased. or conveyed. for any 12 purpose except in conjunction with the building or use which the 13 reserved parking area serves so Iona as the off-street parking 14 facilities are reauired. 15 b. CONFLICTING PROVISIONS Special acts of the Florida Legislature applicable only to unincorporated areas of St. Lucie County, County Ordinances and County Resolutions, or parts thereof, in conflict with this Ordinance are hereby superseded by this Ordinance to the extent of such conflict. C. SEVERABILITY If any portion of this Ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this Ordinance. If this Ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property or circumstance. D. APPLICABILITY OF ORDINANCE This Ordinance shall be applicable in the unincorporated area of St. Lucie County. E. FILING WITH THE DEPARTMENT OF STATE The Clerk is hereby directed forthwith to send a certified copy of this Ordinance to the Bureau of Laws, Department of State, The Capitol, Tallahassee, Florida, 32304. F. EFFECTIVE DATE This ordinance shall take effect upon filing with the Department of State. G.
