Flood Insurance Rate Map (FIRM): An official map of a community, on which the Federal Emergency Management Agency has delineated both the areas of special flood hazard and the risk premium zones applicable to the community. Flood Insurance Study: The official hydrology and hydraulics report provided by the Federal Emergency Management Agency. The study contains an examination, evaluation, and deter- mination of flood hazards, and, if appropriate, corresponding water surface elevations, or an examination, evaluation, and determination of mudslide (i.e., mudflow) and other flood-related erosion hazards. The study may also contain flood profiles, as well as the Flood Insurance Rate Map, Flood Hazard Boundary Map (where applicable) and other related data and information. Floodproofcng: Any combination of structural and non-structural additions, changes, or adjustments to structures, which reduce or eliminate flood damage to real estate or improved real property, water and sanitary facilities, structures and their contents. Floodway: The channel of a river or other watercourse and the adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than a designated height. Foster Home: A facility licensed by the Florida Department of Health and Rehabilitative Services, whether operated for profit or not, providing housing and collective care and sustenance for no more than three (3) adults or children on a twenty-four (24) hour basis who are unrelated by blood, adoption, or marriage. Frontage: The length of a lot that fronts on a public street or that fronts on a private street having been constructed in conformance with the St. Lucie County Standard Specifications for Public Works Construction. Frontal Dune: Is the first natural or manmade mound or bluff of sand which is located landward of the beach and which haos sufficient vegetation, height, continuity, and configura- tion to offer protective value. Functionally Dependent Facility: A facility which cannot be used for its intended purpose unless it is located or carried out in close proximity to water, such as a docking or port facility necessary for the loading and unloading of cargo or passengers, shipbuilding, ship repair or seafood processing facilities. The terra does not include long-term storage, manufacture, sales or service facilities. Future Well field: Public water supply well(s) that are designated as future wellfields upon the issuance of a South Florida Wate1• Management District Individual Water Use Permit and upon notification to the Department of specific locations. Garage Sale: The offering for sale Hof ten (i0) or more items of used personal property from any residential real property. Governmental Agency: (1) The United States or any department, commission, agency, or other instrumentality thereof; (2) The State of Florida or any department, commission, agency, or instrumentality thereof; (3) Any county or municipality; or (4) Any school board or other special district. Grade, Natural: The elevation of the ground surface, in its natural conditions, prior to any man made alteration resulting in an increase or decrease in elevation relative to Mean Sea Level (MSL). Grade, Finished: The elevation of tlhe finished surface of the ground adjacent to the exterior wall(s) of a building or structure. Ground Cover: Low growing plants planted in such a manner as to form a continuous cover over the ground. Ground-Level Barrier: Any natural or artificial structure rising above the ground which prevents beachfront lighting from shining directly onto the beach-dune system. Ground Sign: Any sign that is permanently affixed to the ground, either flush or on poles, and not attached to an adjoining building. Ground signs include "pole signs," "monument signs," "freestanding signs," and "detached signs." Group Care Home: A facility or dwelling unit licensed by the Florida Department of Children and Families housing persons unrelated by blood, adoption, or marriage, and operating as a single housekeeping unit under a common housekeeping management plan based on an internally structured relationship providing organization. Growth Management Director: The head of the Department of Community Development, who shall be appointed to serve at the pleasure of the County Administrator. Grubbing: The removal of vegetation from land by means of digging, raking, dragging or otherwise disturbing the roots of vegetation and the soil in which such roots are located. Guyed Tower: A telecommunications tower that is supported in whole or in part by guy wires and ground anchors. Height: The vertical distance between the minimum finished grade and the highest finished main roof surface in the case of flat roofs or shed roofs, the deck line of a mansard roof and the average distance between the eaves and the ridge of sloped roof with a pitch greater than a 4:12 ratio. For the purpose of this Code, minimum finished grade shall be that elevation, for both residential and nonresidential uses, required to meet minimum flood protection regula- tions. For the purposes of this Code, roof mounted solar energy panels are exempt from the building height limitations. Home Occupation: A business, profession, occupation, or trade conducted within a residen- tial building for gain or support by a resident of the dwelling that is incidental and secondary to the residential use of the building and does not change the essential residential character of the use. Hospital: Any building housing a medical institution designed, equipped, and staffed to receive two (2) or more persons for diagnosis, treatment, and other health services under the supervision of a medical doctor for periods continuing twenty-four (24) hours of a day. Hotel /Motel: A building in which lodging is provided or offered to the public for compensa- tion, generally with occupancies of less than four (4) weeks. HRS: The Florida Department of Health and Rehabilitative Services. Illuminated Sign: Any sign designed to emit artificial light or designed to reflect light from one (1) or more sources of artificial light. Impermeable Surface: Any material applied to the surface of land that inhibits the natural infiltration or passage of water into the ground. In Kind: The creation or enhancement of a wetland with vegetation and functions as those of an identified wetland. Indian River Lagoon: The estuarine body of water including creeks, embayments, coves and other water designations abutting the western shoreline of Hutchinson Island. Industrial Equipment: Farm tractors, backhoes, bulldozers, draglines, cranes, derricks, heavy earthmoving equipment normally used in farming, excavation and/or heavy construc- tion activities. Industrial Wastewater: Wastewater not otherwise defined as domestic wastewater (F.A.C. Chapter 17-6.030), including the runoff and leachate from areas that receive pollutants associated with industrial or commercial storage, handling, or processing. Inspect or Inspection: Field surveys that are conducted by qualified personnel. Institutional Residential Home: A dwelling unit licensed to serve clients of the Department of Children and Families, which provides a living environment for more than fourteen (14) unrelated residents who operate as the functional equivalent of a family, including such supervision and care by supportive staff as may be necessary to meet the physical, emotional and social needs of the residents. The term "institutional residential home" shall include congregate care facilities, foster homes, group care homes and child care facilities with more than fourteen (14) residents and that otherwise meet the definitional requirements of institutional residential home. St. Lucie County Land Development Code Supp. No. 4 223 Adopted May 19, 2009 2.00.00 ST. LUCIE COUNTY LAND DEVELOPMENT CODE Internally Illuminated Sign: A sign where the source of illumination is located inside the sign face and light emanates throughh the message of the sign. A sign utilizing exposed neon lighting shall be considered an internally illuminated sign. Intertidal Areas: Those areas between mean low water and mean high water. Jurisdictional Wetland: Any wetland within County jurisdiction as set forth in Section 6.02.03(B). Kennel: An establishment for the breeding, boarding, or shelter of dogs and/or cats. Land: The earth, water, and air above or on the surface, including any improvement or structure customarily regarded as land. Land Clearing Debris: Uprooted or cleared vegetation resulting from a land clearing operation. Land Clearing Operation: The uprooting or clearing of vegetation in connection with construction for buildings and rights-of--way, residential or industrial development, mineral operations, or the clearing of vegetation to enhance property value and aesthetics. The removal and destruction of shade trees due too storm or insect damage is included as a land clearing operation. Land Clearing and Yard Trash Recycling Operation: Those businesses that are engaged in the recycling and processing of land clearing and yard trash debris only and as may be authorized as a specific Conditional Use under Section 7.10.12(C) of this Code, Land Clearing and Yard Trash Recycling Operations shall not include, or apply to, the on-site disposal of land clearing and yard trash debris generated from land clearing activities on that property, provided that any such on-site dispo:;al is not in conflict with any applicable federal, state or local regulations. Land Use: The development, aci~ivity, or use that has occurred on the land, or the development that is proposed by a developer on the land. Lateral Limbs or Other Lateral Branches: Limbs or other branches situated on or coming from the side of the main trunk(s) of a tree. Lattice Tower: A communications tower that is constructed to be self-supporting by lattice type supports and without the use of guy wires or other supports. Level of Service: An indicator of the extent or degree of service provided by a public facility and related to the operational characteristics of the public facility. Local Road or Street: A route providing service which is of relatively low average traffic volume, short average trip length or minimal through-traffic involvements and high land access for abutting property. Lot: A parcel of land occupied or intended for occupancy by a use that includes or will include at least one (1) structure together with any accessory structure, yard, open space, buffer area, or parking spaces required by this Code. St. Lucie County Land Development Code 5upp. No. 4 2:24 Adopted May 19, 2009 DEFINITIONS 2.00.00 Lot, Corner: A lot situated at the junction of two (2) or more public rights-of--way. Lot Coverage: The total horizontal ground area of a lot covered by all buildings or structures on the lot not open to the sky. Lot, Depth of.• The average horizontal distance between the front lot line and the rear lot line. Lot Line: The boundary of a lot. Lot of Record: As used in this Code, a lot of record shall mean: (1) Any contiguous quantity of land that is part of an approved subdivision recorded in the Office of the Clerk of the Circuit Court; or (2) Any contiguous quantity of land which is capable of being described with such definitiveness that its location and boundaries are established, and which has been so recorded in the public records in the Office of the Clerk of the Circuit Court prior to January 9, 1990, unless otherwise considered to be a nonconforming lot of record as described in Section 10.00.04 of this Code; or (3) Any contiguous quantity of land which is the subject of an agreement for deed or other instrument of conveyance properly executed prior to January 9, 1990, and which describes the parcel with such definitiveness that its location and boundaries are established and recognized by Florida Law, unless otherwise considered to be a nonconforming lot of record as described in Section 10.00.04 of this Code. Lot Split: The division of land into two (2) contiguous lots or parcels without involving the establishment of a new street. Lot, Platted: A lot platted in accordance with St. Lucie County after the effective date of this Code. Lot, Width of.• The distance between side lot lines. If the side lot lines are parallel, this distance is measured along a perpendicular to the side lot lines. If the side lot lines are not parallel, this distance is measured along a line drawn such that its intersections with the side lot lines form equal angles. Lowest Floor: As used in Section 6.05.00, Flood Damage Prevention, means the lowest floor of the lowest enclosed area (including basement). An unfinished or flood resistant enclosure, used solely for parking of vehicles, building access, or storage, in an area other than a basement, is not considered a building's lowest floor, provided that such enclosure is not built so as to render the structure in violation of applicable nonelevation design standards. Machinery, Heavy: Trucks, mechanical land clearing, earth moving, or earth working equipment with a gross weight in excess of five thousand (5,000) pounds. For the purposes of this Code, all machinery that utilizes steel tracks for traction shall be considered heavy machinery. Maintenance: The action taken to restore or preserve the functional intent of any facility or system; normal custodial work needed to sustain original plans or permits. LUCIE COUNTY LAND DEVELOPMENT CODE Major Arterial Road: A roadway primarily focusing on carrying through traffic. Major arterials provide service that is relatively continuous, high in volume, of long trip length, and high operating speed. Major Collector Street or Road: A roadway emphasizing traffic distribution between arterial roadways and roadways of a lower hierarchy. A major collector provides for services that are moderate in length, volume and speed. Major Structure: As used in Section 13.00.02, Coastal Construction Code, includes, but is not limited to, residential buildin€;s including mobile homes, commercial, institutional, industrial and other construction having the potential for substantial impact on coastal zones. Mangrove: Any specimen of the species Avicennia germinans (black mangrove), Laguncularia racemosa (white mangrove), Rhizophora mangle (red mangrove) and Conocarpus erectus (buttonwood mangrove). Mangrove Alteration: To cut, remove, damage, or destroy by any means. Mangrove Alteration is distinct from the "trimming" or "pruning" of mangroves. Manufactured Building: A structure, building assembly, or system of subassemblies, approved by and bearing the insignia of approval of the Florida Department of Community Affairs, or its successor agency, pursuant to the provisions of F.S. Ch. 553, Part IV. No mobile home, whether complying or not complying with mobile home construction standards promul- gated by the United States Department of Housing and Urban Development or required by the State of Florida shall be considered a manufactured building for the purpose of this Code. Manufactured Home: As used in Section 6.05.00, Flood Damage Prevention, means a building, transportable in one (1) or snore sections, which is built on a permanent chassis and designed to be used with or without <t permanent foundation when connected to the required utilities. The term also includes park trailers, travel trailers and similar transportable structures placed on a site for one hundred eighty (180) consecutive days or longer and intended to be improved property. Manufactured Home Park or Su~hdivision: As used in Section 6.05.00, Flood Damage Prevention, means a parcel (or contiguous parcels) of land divided into two or more manufactured home lots f'or rent or sale. Marquee: A hood, canopy, or awning of permanent construction that projects from the wall face of a building. Marquee Sign: See "Canopy Sign." Marsh and Salt Tolerant Vegetation: Native salt tolerant forties, herbs, grasses, sedges, rushes, and nurse plants (for recruitment) which are listed in Chapters 17-4.02(17) or 17-4.022, Florida Administrative Code, in addition to: Halodule wrightii (cuban shoal grass), Ruppia maritinia, Syringodium filiformis (manatee grass), and Thalassia testudinum (turtle grass). Mean High Water (MHW): The average height of the high tides over anineteen-year period. St. Lucie County Land Development Code Supp. No. 4 2:26 Adopted May 19, 2009 DEFINITIONS 2.00.00 Mean High Water Line (MHWL): The intersection of the plane of mean high water, with the estuarine or beach-dune shoreline areas. Mean Low Water (MLW): The average height of the low tides over anineteen-year period. St. Lucie County Land Development Code Supp. No. 4 2:26.1 Adopted May 19, 2009 DEFINITIONS 2.00.00 the applicant shall provide the County with an opinion of title from an attorney licensed to practice in the State of Florida or a commitment of title insurance demonstrating the person which has a legal or equitable interest in the property subject to the proposed Development Agreement. Real Estate Sign: A temporary sign indicating that the lot on which the sign is located, or any building or structure located thereon, is for sale, rent, or lease. This definition shall not include Rooming House signs. Record Drawings: Amended site plans and/or construction drawings specifying the loca- tions, dimensions, elevations, capacities and capabilities of structures or facilities as they have actually been constructed. Record drawings must be signed, sealed and dated by a registered professional engineer. Recreational Equipment: Means boats, personal watercraft, trailers and items on trailers, utility trailers, recreational vehicles, and similar vehicles or items. Recreational Vehicle: Any vehicle-type unit primarily designed not for use as a permanent dwelling but as temporary living quarters for recreational, camping, travel, or seasonal use and that either has its own mode of power or is mounted on or propelled by another vehicle as defined in F.S. § 320.01. In addition, as used in Section 6.05.00, Flood Damage Prevention, a recreational vehicle is a vehicle that is built on a single chassis; measures four hundred (400) square feet or less when measured at the largest horizontal projection; and is designed to be self-propelled or permanently towable by a light duty truck. Recreational Vehicle Park: A place set aside and offered by a person or public body for either direct or indirect remuneration of the owner, lessor, or operator of such place, for the parking and accommodation of six (6) or more recreational vehicles or tents utilized for sleeping or eating; and the term also includes buildings and sites set aside for group camping and similar recreational facilities. For the purposes of this chapter, the terms "campground," "camping resort " "R.V. resort " "travel resort "and "travel park " or any variations of these terms, shall be considered synonymous with the term "recreational vehicle park." Recruitment: The trapping of tidally supplied mangrove seeds and seedlings and other appropriate wetland species by nurse plants. Regulated Area: That area within the Zone of Protection surrounding each Public Water Supply Well, as defined by the Zone of Protection Maps. Regulated Substances: (1) Substances which are: a. Known to have hazardous and toxic properties including but not limited to those listed by the EPA in part 40 CFR 302; or b. Listed as a priority toxic pollutant by the EPA in part 40 CFR 122.21; or A toxic degradation product, which includes petroleum-based products; or St. Lucie County Land Development Code Supp. No. 4 2:33 Adopted May 19, 2009 2.00.00 ST. LUCIE COUNTY LAND DEVELOPMENT CODE d. On the Restrictive Use :Pesticide List promulgated pursuant to F.S. Ch. 487, set forth in Chapters 5E-2 and 5E-9, Florida Administrative Code. (2) Regulated substances by generic designation shall include, but are not limited to, those set forth in the list entitled "Public Wellfield Protection Generic Substance List," which is maintained by the Wellfield Protection Officer. (3) Regulated Substances do not include those that are used in the quantities exempt as set out in Section 6.03.05. Religious Facility: A building in which persons regularly assemble for religious worship, and that is maintained and controlled by a religious body organized to sustain public worship. Remainder Parcel: That portion of the parent tract remaining in private ownership following eminent domain action. The remainder parcel may be vacant, or improved, just as the parent tract may be vacant or improved. Remove or Removal of Vegetation: (1) The actual removal of vegetation; or (2) Direct or indirect actions resulting in the effect removal of vegetation through damaging or poisoning; or (3) Similar actions directly or indirectly resulting in the death of vegetation. Resident: As used in "family residential home", "community residential home" and "insti- tutional residential home" resident means any of the following: an aged person as defined in F.S. § 400.618(3); a physically disabled or handicapped person as defined in F.S. § 760.225a; a nondangerous mentally ill person as defined in F.S. § 394.455(3); or a child as defined in F.S. §§ 39.01(8) and (10). Residential Activity: As used in Section 6.03.00, Wellfield Protection, means any building or structure or portion thereof that is dlesignated for or used for residential purposes and any activity involving the use or occupancy of a described parcel of land for residential purposes. Residential activity shall not include any activity or business requiring an occupational license or other form of authorization to conduct a business. Restaurant: Any establishment that serves prepared food and beverage for consumption on the premises. Such establishment may include entertainment which is incidental to the food service character of the use. Restoration: See "Shoreline or Beach Restoration". Retail Trade: The sale of consumer goods, commodities, and services to ultimate consumers. Retrofitting: As used in Section 7.07.00, refers to improving the quality of urban stormwater runoff to whatever degree is achievable. The improvement can include the modification of existing, or the addition of new, structures or stormwater management practices, or changes in activities or land uses. St. Lucie County Land Development Code Supp. No. 4 2:34 Adopted May 19, 2009 DEFINITIONS 2.00.00 Rights-of--Way: Land dedicated or deeded to public use or otherwise owned by a public agency on which facilities such as roads, roadways, swales, bikepaths, sidewalks, railroads, canals, utilities and for public street purposes and includes all dedicated rights-of--way for any such facility. Rigid Structure: As used in Section 6.02.01, Coastal Area Protection, means aman-made or man-placed inflexible installation within the Dune Preservation Zone or Indian River Lagoon St. Lucie County Land Development Code Supp. No. 4 2:34.1 Adopted May 19, 2009 DEFINITIONS 2.00.00 utilize photovoltaic solar cells, but can also be combinations of light reflectors, concentrators, and heat exchangers. A solar generation station is also known as a solar plant, solar generation plant, solar farm, solar power plant, or solar thermal power plant. Special Event Sign: A sign that calls attention to a civic event or meeting, or other similar activity of a temporary nature. Special Flood Hazard Area: See Area of Special Flood Hazard. Special Master Proceeding: Means any combination of facilitation sessions, formal or informal hearings, of a public nature authorized under Section 11.14.00 of this Code. Specified Anatomical Areas: Less than opaquely covered: (1) Human genitals; (2) Human pubic region; (3) Human female breasts at or directly below the areola. This prohibition shall include the entire lower portion of the female breast but shall not be interpreted to include any portion of the cleavage of the breast exhibited by a dress, blouse, shirt, leotard, bathing suit, or other wearing apparel, provided the areola is not so exposed; (4) Human male genitals in discernible turgid state, even if completely and opaquely covered; and (5) Human buttocks. Specified Sexual Activities: Human genitals in the state of sexual stimulation or arousal; acts of human adamitism, anilinctus, bestiality, coprophilia, cunnilingus, fellatio, flagellation, frottage, hyphephilia, masochism, masturbation, sadism, sadomasochism, sexual intercourse, sodomy, or urolagnia; and fondling or other erotic touching of human genitals, human pubic region, or female breasts. Specimen Tree: A tree which has been determined by the Board of County Commissioners, following input from the Community Development Department, to be of high value because of its type, size, age, or other relevant criteria, and has been so designated by the Board in the official record books of the county following a public hearing with due notice provided in advance by certified mail to the owner. Sponsoring Agency: As used in the context of "community residential home" sponsoring agency means an agency or unit of government, a profit or nonprofit agency, or any other person or organization which intends to establish or operate a community residential home. St. Lucie County Port and Airport Authority: That authority created under Chapter 88-515, §2, Laws of Florida responsible for the administration of the St. Lucie County International Airport and Port of Fort Pierce. Start of Construction: (For other than new construction or substantial improvements under the Coastal Barrier Resources Act (P. L. 97-348)), As used in Section 6.05.00, Flood Damage St. Lucie County Land Development Code Supp. No. 4 2:39 Adopted May 19, 2009 2.00.00 ST. LUCIE COU]VTY LAND DEVELOPMENT CODE Prevention, includes substantial improvement, and means the date the building permit was issued, provided the actual start of construction, repair, reconstruction or improvement was within one hundred eighty (180) days of the permit date. The actual start means the first placement of permanent construction of a structure (including a manufactured home) on a site, such as the pouring of slabs or footings, installation of piles, construction of columns, or any work beyond the stage of excavation, or the placement of a manufactured home on a foundation. Permanent construction. does not include land preparation, such as clearing, grading and filling; nor does it include the installation of streets and/or walkways; nor does it include excavation for a basement, footings, piers or foundations or the erection of temporary forms; nor does it include the installation on the property of accessory buildings, such as garages or sheds not occupied as dwelling units or not a part of the main structure. For a substantial improvement, the actual. start of construction means the first alteration of any wall, ceiling, floor, or other structural. part of a building, whether or not that alteration affects the external dimension of the building. State: The State of Florida. State Highway System: Consists of: (1) Interstate system; (2) All rural arterial. routes and their extensions into and through urban areas; (3) All urban principal arterial routes; and (4) Certain urban minor arterial routes designated by the Florida Department of Trans- portation. State Jurisdictional Waters: Those waters and wetlands within the State dredge and fill jurisdiction pursuant to Sections 17-4.02(17) and 17-4.022, Florida Administrative Code, and rules on Sovereignty Lands, Chapter 16Q-21, Florida Administrative Code, and Florida Aquatic Preserves, Chapter 16Q-20, :E'lorida Administrative Code. State Minimum Building Code: 7'he building code adopted by a municipality or county pursuant to the requirements of F.S. § 553.73. State Roads: All streets, roads, highways, and other public ways open to travel by the public generally, and dedicated to the public: use according to law or by prescription, and designated by the Florida Department of Transportation as provided by law, as parts of the State Highway System. Stormwater Management Plan: The detailed analysis which describes the proposed stormwater management system for the development. Street: Public or private ways that have been set aside through dedication, deed, or condemnation for public or private use or that have become a public way by prescriptive use, without regard to maintenance responsibility, but not including easements. This definition does not include any private street or way, that is not constructed in conformance with the provisions of Chapter XIII of this Code. St. Lucie County Land Development Code Supp. No. 4 2:40 Adopted May 19, 2009 DEFINITIONS 2.00.00 Structure: Anything constructed or installed, the use of which requires location on a parcel of land. It does not include a movable structure, even when it is located on land that can be used for housing, business, commercial, agricultural, or office purposes. "Structure" also includes fences, billboards, swimming pools, and signs. Structures should meet Standard Building Code requirements and be permanently affixed. Subdivision: The platting of real property into three (3) or more lots, parcels, tracts, tiers, blocks, sites, units, or any other division of land. Subdivision Collector Roads: Routes collecting and distributing traffic between local roads within a subdivision. Substantial Damage: Damage of any origin sustained by a structure whereby the cost of restoring the structure to its before damaged condition would equal or exceed fifty percent (50°l0) of the market value of the structure before the damage occurred. Substantial Improvement: Any combination of repairs, reconstruction, alteration, or im- provements to a building, taking place during the life of a building, in which the cumulative cost equals or exceeds fifty percent (50%) of the market value of the building, The market value of the building should be (1) the appraised value of the building prior to the start of the initial repair or improvement, or (2) in the case of damage, the value of the building prior to the damage occurring. This term includes structures which have incurred substantial damage regardless of the actual repair work performed. For the purposes of this definition, substantial improvement is considered to occur when the first alteration of any wall, ceiling, floor or other structural part of he building commences, whether or not that alteration affects the external dimensions of the building. The term does not, however, include any project for improvement of a building required to comply with existing health, sanitary or safety code specifications which are solely necessary to assure safe living conditions or any alteration of a structure listed on the National Register of Historic Places or the State Inventory of Historic Places. Substantially Improved Existing Manufactured Home Parks or Subdivisions: Where the repair, reconstruction, rehabilitation or improvement of the streets, utilities and pads equals or exceeds fifty percent (50%) of the value of the streets, utilities and pads before the repair, reconstruction or improvement commenced. Telecommunications Facility: A facility that is used to provide one (1) or more telecommu- nications services, including, without limitation, radio transmitting towers, other supporting structures, and associated facilities used to transmit telecommunications signals. An open video system is not a telecommunications facility to the extent that it only provides video services; a cable system is not a telecommunications facility to the extent that it only provides cable service. St. Lucie County Land Development Code Supp. No. 4 2:40.1 Adopted May 19, 2009 DEFINITIONS 2.00.00 Vegetation, Protected: All vegetation other than: (1) Prohibited plant species; or (2) Non-native fruit trees that are cultivated or grown for the specific purpose of producing edible fruit including, but not limited to, mangoes, avocados, or species of citrus; or (3) Trees that are less than five (5) inches in diameter at a point four and one-half (4~/z) feet aboveground or less than fifteen (15) feet in height; (4) Grasses. Vegetation Inventory: A drawing or sketch prepared to scale which provides the approximate location, extent, and common names of the trees or major groups of vegetation on site. The vegetation inventory shall include the proposed locations of buildings, structures, driveways, and other improvements drawn to scale and the individual location of all protected trees of approximately twelve (12) inches DBH or greater within all improvement areas and within ten (10) feet of all improvement areas. Vehicular Sign: A sign affixed to a vehicle or trailer for the purpose of advertising. For the purposes of this Code, this definition shall only be applicable when said vehicle or trailer is temporarily or permanently located on a parcel for the primary purpose of conveying a commercial message. Violation: As used in Section 6.05.00, Flood Damage Prevention, means the failure of a structure or other development to be fully compliant with the requirements of this section. A structure or other development without the elevation certificate, other certifications, or other evidence of compliance required by this section is presumed to be in violation until such time as that documentation is provided. Wall Face: The entire building front including the parapet. Wall Mural: A wall mural shall mean any picture or graphic design painted on or otherwise applied to the exterior of a building or structure or to the surface of window. A wall mural may include advertising or other commercial slogans or statements to the extent that the advertising or commercial slogan does not violate the wall sign requirements of the zoning district in which the mural is located. Wall Sign: A sign erected parallel and attached to the outside wall facade of any building or fence, including flat, painted, individual letter, or cabinet signs. Water Dependent Activity: An activity which can only be conducted on, in, over, or adjacent to water areas because the activity requires direct access to the water body or sovereignty lands for transportation, recreation, energy production or transmission, or source of water, and where the use of the water or sovereignty lands is an integral part of the activity. Water or Sewer Utility: As used by this Code, a water or sewer utility shall mean a water or sewer utility which is providing service to one hundred (100) or more persons for compensa- tion. St. Lucie County Land Development Code Supp. No. 4 2:45 Adopted May 19, 2009 2.00.00 ST. LLJCIE COUPJTY LAND DEVELOPMENT CODE Well: Any excavation that is drilled, cored, bored, washed, driven, dug, jetted, or otherwise constructed when the intended use of such excavation is to conduct groundwater from a source bed to the surface, by pumping or natural flow, when groundwater from such excavation is used or is to be -used for a public wager supply well. Well field Protection Officer: The St. Lucie County Hydrologist or designee. Wetland: An area that is inundated or saturated by surface water or groundwater at a frequency and duration sufficient to support, and that under normal circumstances does support, a prevalence of vegetation typically adapted for life in saturated soil conditions, commonly known as hydrophytic vegetation. Wetland Alteration: Any dredging, filling, cutting, drainage, or flooding of a jurisdictional wetland. Wetland Dredging: Any disruption or displacement of wetland substrate or bottom sedi- ments or contours. It also means the excavation or creation of a water body which is or will be connected to jurisdictional wetlands as defined in Section 6.02.03(B). Wetland Filling: The placement of any material in, on, or over a jurisdictional wetland. Wetland Functions: The roles wetlands serve, including but not limited to flood storage, flood conveyance, ground water recharge and discharge, erosion control, wave attenuation, water quality enhancement and protection. nutrient removal, food chain support, wildlife habitat, breeding and habitat grounds for fishery species, and recreational values. Wetland Mitigation: The compensation for the loss of wetland acreage, value and functions by the creation of new wetlands or the enhancement of existing wetlands. Whip Antenna: A cylindrical antenna that transmits signals in three hundred sixty (360) degrees. Wholesale Trade: The sale of goods for resale by a retail establishment to the ultimate consumer. Yard: An open space at grade between a building and the property lines of the lot on which the building is located, unoccupied and unobstructed from the ground upward, except as otherwise provided herein.. In measuring a yard for the purpose of determining the depth of a side yard, the depth of a front yard., or the depth of a rear yard, the minimum horizontal distance between the lot line and they main building shall be used. Yard, Front: A yard extending across the front of a lot, bounded by the side lot lines, front property line and the front of the main building or any projections thereof. In all cases, the main building and any projections thereof must be behind the line of minimum lot width. Yard, Rear: A yard extending across the rear of a lot between the side lot lines and the rear property line, and being the required minimum horizontal distance between the rear property line and the rear of the main building or any projections thereof. On all lots the rear yard shall be at the opposite end of the lot from the front yard. St. Lucie County Land Development Code Supp. No. 4 2:46 Adopted May 19, 2009 DEFINITIONS 2.00.00 Yard, Side: A yard between the main building and the side line of the lot, extending from the required front yard to the required rear yard, and being the minimum horizontal distance between a side property line and the side of the main building or any projections thereof. Yard Trash: Means vegetative matter resulting from landscaping maintenance and land clearing operations. Zone of Protection: Those areas around public water supply wellfields meeting the criteria in Section 6.03.02. (Ord. No. 10-003, Pt. A, 2-15-2010; Ord. No. 10-034, Pt. A, 11-9-2010; Ord. No. 11-005, Pts. A, B, 2-1-2011; Ord. No. 11-031, Pt. A, 12-20-2011) St. Lucie County Land Development Code Supp. No. 4 2:47 Adopted May 19, 2009 RESOURCE PROTECTION STANDARDS 6.05.01 c. Devices used for removing debris from the beach should be designed and/or operated such that they do not penetrate beach sediments by more than two (2) inches. 4. Sea Turtle Protection Plan (STPP) Exemption: A STPP may not be required for mechanical beach cleaning activities if it is demonstrated to the Growth Management Director that the proposed operation(s) will have no adverse effects on the normal development and viability of eggs and hatchlings in sea turtle nests and habitats, pursuant to the following procedures: a. The Growth Management Director shall be notified in writing by the applicant that the protective/mitigative measures set out in Section 6.04.02(G)(6) shall not be required as part of the State permit. b. The Growth Management Director shall grant an exemption from the STPP upon consultation with the State and receipt of a copy of the State permit prior to commencement of the mechanical beach cleaning activities. 5. Coordination of Beach Cleaning Operations With State-Sanctioned Scientific Studies: All beach cleaning operations shall be coordinated through the State to ensure that these operations do not interfere with state-sanctioned scientific studies of sea turtle nesting activities. 6.04.03. Manatee Protection (Reserved). 6.05.00. FLOOD DAMAGE PREVENTION 6.05.01. General provisions. A. Purpose. It is the purpose of the Section to promote the public health, safety and general welfare and to minimize public and private losses due to flood conditions in specific areas by provisions designed to: 1. Restrict or prohibit uses which are dangerous to health, safety and property due to water or erosion hazards, or which result in damaging increases in erosion or in flood heights or velocities. 2. Require that uses vulnerable to floods, including facilities which serve such uses, be protected against flood damage at the time of initial development. 3. Control the alteration of natural floodplains, stream channels, and natural protective barriers which are involved in the accommodation of floodwaters. 4. Control filing, grading, dredging and other development which may increase erosion or flood damage; and 5. Prevent or regulate the development of flood barriers which will unnaturally divert floodwaters or which may increase flood hazards to other lands. St. Lucie County Land Development Code Supp. No. 4 6:51 Adopted May 19, 2009 6.05.01 ST. LUCIE COUNTY LAND DEVELOPMENT CODE B. Objectives. The objectives of this Section are: 1. To protect human life and health; 2. To minimize expenditure of public money for costly flood projects; 3. To minimize the need for rescue and relief efforts associated with flooding and generally undertaken at the expense of the general public; 4. To minimize prolonged business interruptions; 5. To minimize damage to public facilities and utilities such as water and gas mains, electric, telephone and sewer lines, streets and bridges located in floodplains; 6. To help maintain a stable tax base by providing for the sound use and development of flood-prone areas in such a manner as to minimize flood blight areas; and 7. To ensure that potential home buyers are notified that property is in a flood area. C. Lands to which this Section Applies. This Section shall apply to all areas of special flood hazard within the jurisdiction of St. Lucie County. D. Basis for Establishing the Areas of Special Flood Hazard. The areas of special flood hazard identified by the Federal Emergency Management Agency in its Flood Insurance Study for St. Lucie County, dated February 16, 2012, with accompanying maps and other supporting data, and any revision thereto, are adopted by reference and declared to be a part of this Code. E. Establishment of Development Permit. A development permit shall be required in conformance with the provisions of this Section and Section 6.05.07 prior to the commence- ment of any development activities. F. Compliance. No structure or land shall hereafter be located, extended, converted, or structurally altered without full compliance with the terms of this Section and other applicable regulations. G. Abrogation and Greater Restrictions. This Section is not intended to repeal, abrogate, or impair any existing easements, covenants, or deed restrictions. However, where this Section and another conflict or overlap, whichever imposes more stringent restrictions shall prevail. H. Warning and Disclaimer of Liability. The degree of flood protection required by this Section is considered reasonable for regulatory purposes and is based on scientific and engineering considerations. Larger floods can and will occur on rare occasions. Flood heights may be increased by man-made or natural causes. This chapter does not imply that land outside the areas of special flood hazard or uses permitted within such areas will be free from flooding or flood damages. This chapter shall not create liability on the part of St. Lucie County or by any officer or employee thereof for any flood damages that result from reliance on this chapter or any administrative decision lawfully made thereunder. (Ord. No. 11-031, Pt. B, 12-20-2011) St. Lucie County Land Development Code Supp. No. 4 6:52 Adopted May 19, 2009 RESOURCE PROTECTION STANDARDS 6.05.03 6.05.02. General standards for flood hazard reduction. A. General Standards. In all areas of special flood hazard the following provisions are required: 1. All new construction and substantial improvements shall be anchored to prevent flotation, collapse or lateral movement of the structure. 2. Manufactured homes shall be anchored to prevent flotation, collapse or lateral movement. Methods of anchoring may include, but are not limited to, use of over-the- top or frame ties to ground anchors. This standard shall be in addition to and consistent with applicable state requirements for resisting wind forces. 3. New construction and substantial improvements shall be constructed with materials and utility equipment resistant to flood damage. 4. New construction or substantial improvements shall be constructed by methods and practices that minimize flood damage. 5. Electrical, heating, ventilation, plumbing, air conditioning equipment and other service facilities shall be designed and/or located so as to prevent water from entering or accumulating within the components during conditions of flooding. 6. New and replacement water supply systems shall be designed to minimize or eliminate infiltration of floodwaters into the system. 7. New and replacement sanitary sewage systems shall be designed to minimize or eliminate infiltration of floodwaters into the systems and discharges from the systems into floodwaters. 8. On-site waste disposal systems shall be located and constructed to avoid impairment to them or contamination from them during flooding. 9. Any alteration, repair, reconstruction, or improvements to a building which is in compliance with the provisions of this Section, shall meet the requirements of new construction as contained in this Section. 10. Any alteration, repair, reconstruction, or improvements to a building which is not in compliance with the provisions of this Section, shall be undertaken only if said nonconformity is not furthered, extended, or replaced. (Ord. No. 11-031, Pt. B, 12-20-2011) 6.05.03. Specific standards for flood hazard reduction. In all areas of special flood hazard where base flood elevation data has been provided, as set forth in Section 6.05.01(D) or Section 6.05.07(B)(10), the following provisions are required: A. Residential Construction: New construction or substantial improvement of any resi- dential building shall have the lowest floor, including basement, elevated to or above St. Lucie County Land Development Code Supp. No. 4 6:53 Adopted May 19, 2009 6.05.03 ST. LUCIE COUNTY LAND DEVELOPMENT CODE base flood elevation. Should solid foundation perimeter walls be used to elevate a structure, openings sufficient; to facilitate the unimpeded movements of flood waters shall be provided in accordance with standards of Section 6.05.03(C). B. Nonresidential Construction: New construction or substantial improvement of any commercial, industrial or other nonresidential building (or manufactured home) shall have the lowest floor, including basement, elevated to or above the level of the base flood elevation. Buildings located in all A-Zones may be floodproofed in lieu of being elevated provided that all areas of the building below the required elevation are watertight with walls substantially impermeable to the passage of water and use structural components having the capability of resisting hydrostatic and hydrody- namic loads and the effects of buoyancy. A registered professionaLengineer or architect shall certify that the standards of this subsection are satisfied. Such certification shall be provided to the Growth Management Director as set forth in Section 6.05.07(B)(9). C. Elevated Buildings: New construction or substantial improvements of elevated build- ings that include fully enclosed areas formed by foundation and other exterior walls below the base flood elevation shall be designed to preclude finished living space and designed to allow for the entry and exit of floodwaters to automatically equalize hydrostatic flood forces on exterior walls. 1. Designs for complying with this requirement must either be certified by a professional engineer or architect or meet the following minimum criteria: (a) Provide a minimum of two (2) openings having a total net area of not less than one (1) square inch for every square foot of enclosed area subject to flooding; (b) The bottom of all openings shall be no higher than one (1) foot above grade; and, (c) Openings may be equipped with screens, louvers, valves or other coverings or devices provided they permit the automatic flow of floodwaters in both direction. 2. Access to the enclosed area shall be the minimum necessary to allow for parking of vehicles (garage door) or limited storage of maintenance equipment used in connection with the premises (standard exterior door) or entry to the living area (stairway or elevator); and 3. The interior portion of such enclosed area shall not be partitioned or finished into separate rooms. D. Standards for manufactured homes and recreational vehicles: 1. All manufactured homes placed, or substantially improved, on individually lots or parcels, in expansions to existing manufactured home parks or subdivisions, or in substantially improved manufactured home parks or subdivisions, must meet all the requirements for new construction, including elevation and anchoring. St. Lucie County Land Development Code Supp. No. 4 6:54 Adopted May 19, 2009 RESOURCE PROTECTION STANDARDS 6.05.03 2. All manufactured homes placed or substantially improved in an existing manu- factured home park or division must be elevated so that: (a) The lowest floor of the manufactured home is elevated to or above base flood elevation, or (b) The manufactured home chassis is supported by reinforced piers or other foundation elements of at least an equivalent strength, of no less than thirty-six (36) inches in height above grade. (c) The manufactured home must be securely anchored to the adequately anchored foundation system to resist flotation, collapse and lateral move- ment. (d) In an existing manufactured home park or subdivision on which a manu- factured home has incurred substantial damage as the result of a flood, any manufactured home placed or substantially improved must meet the stan- dards of Sections 6.05.03(D)(2)(a) and (c). 3. All recreational vehicles placed on sites must either: (a) Be fully licensed and ready for highway use; (b) Be on the site for fewer than one hundred eighty (180) consecutive days; or, (c) The recreational vehicle must meet all the requirements for new construc- tion, including anchoring and elevation requirements of Sections 6.05.03(D)(2)(a) through (c). A recreational vehicle is ready for highway use if it is on its wheels or jacking system, is attached to the site only by quick disconnect type utilities and security devices and has no permanently attached structures. E. Floodways: Located within areas of special flood hazard established in Section 6.05.01(D), are areas designated as floodways. Since the floodway is an extremely hazardous area due to the velocity of floodwaters which carry debris, potential projectiles and has erosion potential, the following provisions shall apply: 1. Prohibit encroachments, including fill, new construction, substantial improve- ments and other developments unless certification (with supporting technical data) by a registered professional engineer is provided demonstrating that encroachments shall not result in any increase in flood levels during occurrence of the base flood discharge. 2. If Section 6.05.03(E)(1) is satisfied, all new construction and substantial improve- ments shall comply with all applicable flood hazard reduction provisions of Section 6.05.02 through Section 6.05.06. 3. Prohibit the placement of manufactured homes (mobile homes), except in an existing manufactured homes (mobile homes) park or subdivision. A replacement manufactured home may be placed on a lot in an existing manufactured home St. Lucie County Land Development Code Supp. No. 4 6:55 Adopted May 19, 2009 6.05.03 ST. LUCIE COUNTY LAND DEVELOPMENT CODE park or subdivision provided the anchoring standards of section 6.05.02(A)(2) and the elevation. standards of Section 6.05.03(A) and the encroachment standards of Section 6.05.03(E)(1) are met. F. Coastal High Hazard Areas (V ZONES): Located within the areas of special flood hazard established in Section 6.05.01(D), are areas designated as coastal high hazard areas. These areas have special flood hazards associated with wave wash, therefore, the following provisions shall. apply: 1. All new construction and substantial improvements shall be located landward of the reach of the mean high tide. 2. The bottom of the lowest horizontal structural member of the lowest floor (excluding pilings or a~lumns) is elevated to no lower than the base flood elevation whether or not the structure contains a basement. 3. All buildings or structures shall be securely anchored on pilings or columns. 4. All pile and. column fi~undations and structures attached thereto shall be anchored to resist flotation, collapse, and lateral movement due to the effect of wind and water loads acting simultaneously on all building components. Water loading values shall equal or exceed the base flood. Wind loading values shall be in accordance with the provisions of Section 13.00.00 of this Code. 5. A registered professional engineer or architect shall certify that the design, specifications and plans for construction are in compliance with provisions contained in Sections 6.05.03(F)(2), (3) and (4). 6. The Floodplain Administrator shall obtain and maintain a record of the elevation (in relation to mean sea level) of the bottom of the lowest horizontal structural member of the lowest floor (excluding pilings and columns) of all new and substantially improved structures. 7. Provide that all new construction and substantial improvements have the space below the lowest floor either free of obstruction or constructed with nonsupport- ing breakaway walls, open wood lattice-work, or insect screening intended to collapse under wind and water loads without causing collapse, displacement, or other structural damage to the elevated portion of the building or supporting foundation system. For the purpose of this section, a breakaway wall shall have a design safe loading resistance of not less than ten (10) and no more than twenty (20) pounds per square foot. Use of breakaway walls which exceed a design safe loading resistance of twenty (20) pounds per square foot (either by design or when so required by State oi.' Florida or local codes) may be permitted only if a registered professional engineer or architect certifies that the designs proposed meet the following conditions: (a) Breakaway wall collapse shall result from water load less than that which would occur during the base flood; and St. Lucie County Land Development Code Supp. No. 4 6:56 Adopted May 19, 2009 RESOURCE PROTECTION STANDARDS 6.05.03 (b) The elevated portion of the building and supporting foundation system shall not be subject to collapse, displacement, or other structural damage due to the effects of wind and water loads acting simultaneously on all building components (structural and nonstructural). The water loading shall be those values associated with the base flood. The wind loading values shall be those required by applicable Florida or local, if more stringent than those of the State of Florida, building standards. (c) Such enclosed space shall be useable solely for parking of vehicles, building access, or storage. Such space shall not be finished, partitioned into multiple rooms, or temperature-controlled. 8. There shall be no fill used as structural support. Non-compacted fill may be used around the perimeter of a building for landscaping aesthetic purposes provided the fill will wash out from storm surge, (thereby rendering the building free of obstruction) prior to generating excessive loading forces, ramping effects, or wave deflection. The Floodplain Administrator shall approve design plans for landscaping/ aesthetic fill only after the applicant has provided an analysis by an engineer, architect, and/or soil scientist, which demonstrates that the following factors have been fully considered: (a) Particle composition of fill material does not have a tendency for excessive natural compaction; (b) Volume and distribution of fill will not cause wave deflection to adjacent properties; and (c) Slope of fill will not cause wave runup or ramping. 9. There shall be no alteration of sand dunes or mangrove stands which would increase potential flood damage. 10. Prohibit the placement of manufactured homes (mobile homes) except in an existing manufactured home (mobile homes) park or subdivision. A replacement manufactured home may be placed on a lot in an existing manufactured home park or subdivision provided the standards of Section 6.05.03(F)(1) through (9) are met. 11. Prohibit the placement of recreational vehicles except in an existing recreational vehicle park. A recreational vehicle may be placed in an existing recreational vehicle park provided it is on the site for fewer than one hundred eighty (180) consecutive days; is fully licensed and ready for highway use; or meets the requirements of Section 6.05.03(F)(1) through (9). (Ord. No. 11-031, Pt. B, 12-20-2011) St. Lucie County Land Development Code Supp. No. 4 6:57 Adopted May 19, 2009 6.05.04 ST. LUCIE COUNTY LAND DEVELOPMENT CODE 6.05.04. Standards for streams without established base flood elevations and floodways. Located within the areas of special flood hazard established in Section 6.05.01(D), where small streams exist but where no base flood data has been provided or where no floodways have been provided, the following provisions apply: A. No encroachments, including; fill material or structures shall be located in areas of special flood haz<~rd unless certification by a registered professional engineer is provided demonstrating that the cumulative effect of the proposed development, when combined with all. other existing and anticipated development will not increase the water surface elevation of the base flood more than one (1) foot at any point within the community. The engineering certification should be supported by technical data that conforms to standard hydraulic engineering principles. B. New construction or substantial improvements of buildings shall be elevated or floodproofed to elevations established in accordance with Section 6.05.07(B)(11). (Ord. No. 11-031, Pt. B, 12-20-2011) 6.05.05. Standards for subdivision proposals. A. All subdivision proposals shall be consistent with the need to minimize flood damage B. All subdivision proposals shall have public utilities and facilities such as sewer, gas, electrical and water systems located and constructed to minimize flood damage; C. All subdivision proposals shall have adequate drainage provided to reduce exposure to flood hazards; and D. Base flood elevation data shall be provided for subdivision proposals and other proposed development (including manufactured home parks and subdivisions) which is greater than the lesser of fifty (50) lots or five (5) acres. (Ord. No. 11-031, Pt. B, 1L-20-2011) 6.05.06. Standards for areas of shallow flooding. Located within the areas of special flood hazard established in Section 6.05.01(D), are areas designated as shallow flooding areas. These areas have special flood hazard associated with base flood depths of one (1) to three (3) feet where a clearly defined channel does not exist and where the path of flooding is unpx•edictable and indeterminate; therefore the following provisions apply: A. All new construction and substantial improvements of residential buildings shall have the lowest floor, including basement, elevated to the depth number specified on the Flood Insurance Rate Map, in feet, above the highest adjacent grade. If no depth number is specified, the lowest; floor, including basement, shall be elevated at least two (2) feet above the highest adjacent grade. St. Lucie County Land Development Code Supp. No. 4 6:58 Adopted May 19, 2009 RESOURCE PROTECTION STANDARDS 6.05.07 B. All new construction and substantial improvements of nonresidential structures shall: 1. Have the lowest floor, including basement, elevated to the depth number specified on the Flood Insurance Rate Map, in feet, above the highest adjacent grade. If no depth number is specified, the lowest floor, including basement, shall be elevated at least two (2) feet above the highest adjacent grade, or 2. Together with attendant utility and sanitary facilities be completely floodproofed to or above that level so that any space below that level is watertight with walls substantially impermeable to the passage of water and with structural compo- nents having the capability of resisting hydrostatic and hydrodynamic loads anal effects of buoyancy. C. Adequate drainage paths around structures shall be provided on slopes to guide water away from structures. (Ord. No. 11-031, Pt. B, 12-20-2011) 6.05.07. Administration. In addition to the administrative provisions in Chapter XI of this Code, the following provisions shall apply. A. Permit Procedures. Application for a development permit shall be made to the Floodplain Administrator on forms furnished by him or her prior to any development activities, and may include, but not be limited to, the following plans in duplicate drawn to scale showing the nature, location, dimensions and elevations of the area in question; existing or proposed structures, earthen fill, storage of materials or equip- ment; drainage facilities and the location of the foregoing. Specifically, the following information is required: 1. Application Stage. a. Elevation in relation to mean sea level of the proposed lowest floor (including basement) of all buildings. b. Elevation in relation to mean sea level to which any nonresidential structure will be floodproofed. c. Certificate from a registered professional engineer or architect that the nonresidential floodproofed structure will meet the floodproofing criteria in Section 6.05.03(B) and Section 6.05.07(A)(2). d. Description of the extent to which any watercourse will be altered or relocated as a result of proposed development. e. Elevation in relation to mean sea level of the bottom of the lowest horizontal structural member of the lowest floor and provide a certification from a registered engineer or architect indicating that they have developed and/or reviewed the structural designs, specifications and plans of the construction and certified that they are in accordance with accepted standards of practice in Coastal High Hazard Areas. St. Lucie County Land Development Code Supp. No. 4 6:59 Adopted May 19, 2009 6.05.07 ST. LIJCIE COUNTY LAND DEVELOPMENT CODE 2. Construction Stage. a. A floor elevation or floodproofing certification after the lowest floor is completed, or in instances where the structure is subject to the regulations applicable to Coastal High Hazard areas, after placement of horizontal structural members of the lowest floor. b. No structural construction beyond the foundation shall be authorized until the required flood certification has been submitted to and approved by the Floodplain Administrator in accordance with subsection c. below. c. Within twenty-one (21) calendar days of establishment of the lowest floor elevation, or floodproofing by whatever construction means, or upon place- ment of the horizontal structural members of the lowest floor, whichever is applicable, it shall be the duty of the permit holder to submit to the Floodplain Administrator: (1) A certification. of the elevation of the lowest floor; or, (2) Floodproofed elevation; or, (3) The elevation of the lowest portion of the horizontal structural mem- bers of the lowest floor, whichever is applicable, in relation to mean seal level. d. Said certification shall be prepared by or under the direct supervision of a registered land surveyor or professional engineer and certified by same. When floodproofing is utilized for a particular building, said certification shall be prepared by or under the direct supervision of a professional engineer or architect and certified by same. e. The Floodplain Administrator shall review the floor elevation survey data submitted. Deficiencies detected by such review shall be corrected by the permit holder immediately and prior to further progressive work being permitted to proceed. Failure to submit the survey or failure to make said corrections required hereby, shall be cause to issue a stopwork order for the project. B. Duties and Responsibilities of"the Floodplain Administrator. Duties of the Floodplain Administrator shall include, but not be limited to: 1. Review permits to assure sites are reasonably safe from flooding 2. Review all development permits to assure that the permit requirements of this Section have been satisfied. 3. Advise permittee that additional federal or state permits may be required, and if specific federal or state permit requirements are known, require that copies of such permits be provided and maintained on file with the development permit. 4. Notifying adjacent communities, the Florida Division of Emergency Management State Floodplain Management Office, the South Florida Water Management St. Lucie County Land Development Code Supp. No. 4 6:60 Adopted May 19, 2009 RESOURCE PROTECTION STANDARDS 6.05.07 District, the Federal Emergency Management Agency, and other Federal and/or State of Florida agencies with statutory or regulatory authority prior to any alteration or relocation of a watercourse. 5. Notify the Federal Emergency Management Agency within six months when new technical or scientific data becomes available to the community concerning physical changes affecting flooding conditions so that risk premium rates and floodplain management requirements will be based on current data. 6. Assure that maintenance is provided within the altered or relocated portion of said watercourse so that the flood carrying capacity is not diminished. 7. Verify and record the actual elevation (in relation to mean sea level) of the lowest floor (A-Zones) or bottom of the lowest horizontal structural member of the lowest floor (V-Zones) of all new or substantially improved structures, in accordance with Section 6.05.03(A) and (B) and 6.05.03(F)(2), (3) and (4), respectively. 8. Verify and record the actual elevation (in relation to mean sea level) to which the new or substantially improved structures have been floodproofed, in accordance with Section 6.05.03(B). 9. In Coastal High Hazard areas certification shall be obtained from a registered professional engineer or architect that the structure is designed to be securely anchored to adequately anchored pilings or columns in order to withstand velocity waters and hurricane wave wash. 10. In Coastal High Hazard areas, the Floodplain Administrator shall review plans for the adequacy of breakaway walls in accordance with Section 6.05.03(F)(7). 11. When floodproofing is utilized for a particular structure, the Floodplain Admin- istrator shall obtain certification from a registered professional engineer or architect in accordance with Section 6.05.03 (B). 12. Where interpretation is needed as to the exact location of boundaries of the areas of special flood hazard (for example, where there appears to be a conflict between a mapped boundary and actual field conditions), the Floodplain Administrator shall make the necessary interpretation. The person contesting the location of the boundary shall be given a reasonable opportunity to appeal the interpretation as provided in Section 10.01.25. 13. When base flood elevation data or floodway data have not been provided in accordance with Section 6.05.01(D), then the Floodplain Administrator shall obtain, review and reasonably utilize any base flood elevation and floodway data available from a federal, state or other source, in order to administer the provisions of Sections 6.05.02 through 6.05.06. 14. All records pertaining to the provisions of this chapter shall be maintained in the office of the Floodplain Administrator and shall be open for public inspection. St. Lucie County Land Development Code Supp. No. 4 6:60.1 Adopted May 19, 2009 6.05.07 ST. LUCIE COUNTY LAND DEVELOPMENT CODE C. Penalties. Violations of this section may be enforced by the St. Lucie County Code Enforcement Board. This provision shall not preclude enforcement of this section in the Circuit Court or as otherwise authorized by law. (Ord. No. 11-031, Pt. B, 12-20-2011) 6.06.00. MINING 6.06.01. Restrictions, Regulation~a, and Conditions on Mining Permit. A. It shall be illegal to excavate o~• mine, as defined in Chapter II, any real property in St. Lucie County without first obtaining a mining permit for such activity, except as exempted in Section 11.05.11. St. Lucie County Land Development Code Supp. No. 4 6:60.2 Adopted May 19, 2009 HARDSHIP RELIEF 10.01.21 d. All information and documentation that will justify the variance. 3. Within a reasonable period of time not to exceed thirty (30) calendar days after receipt of an application or receipt of additional information pursuant to this section, the County Engineer shall examine the application or information and notify the applicant of any apparent error or omission, and request such additional information as may be necessary for the processing of the application. 4. Within thirty (30) working days after an application has been determined to be complete, the County Engineer shall either grant the variance or deny the variance, with reasons clearly stated. 5. Any person aggrieved by a decision of the County Engineer may, within thirty (30) calendar days after the rendition of such decision, appeal to the Board of Adjustment pursuant to Section 11.11.00. B. General Standards for Issuance. 1. The variance requested arises from a condition that is unique and peculiar to the land, structures, and buildings involved; that the particular physical surroundings, the shape or topographical condition of the specific property involved, would result in unnecessary hardship for the owner, lessee, or occupant, as distinguished from a mere inconvenience, if the provisions of this Code are literally enforced; and the condition is created by the regulations of this Code, and not by an action or actions of the property owner or the applicant. 2. The granting of the variance will not impair or injure other property or improvement in the neighborhood in which the subject property is located or endangered the public safety. 3. The variance granted is the minimum variance that will make possible the reasonable use of the land, buildings, or structures. 4. The variance desired will not be opposed to the general spirit and intent of this Code or the St. Lucie County Comprehensive Plan. 10.01.18-10.01.20. Reserved. 10.01.21. Administrative Variances from Requirements of Driveway Regulations. A. The County Engineer may approve variances from any dimensional requirement pursuant to Section 7.05.06, Driveways, provided that no variance shall permit a dimension less than eighty percent (80°l0) of that required by Section 7.05.06, except that in the case of a lot of record and upon demonstration that no other road frontage or road access exists, a variance permitting one (1) driveway for such lot may be granted. St. Lucie County Land Development Code Supp. No. 4 10:15 Adopted May 19, 2009 10.01.21 ST. LiJCIE COUNTY LAND DEVELOPMENT CODE B. The County Engineer shall not approve a variance except upon specific written findings of fact based directly upon the particular facts submitted to him showing that: 1. A literal interpretation of the provisions of this article would deprive the applicant of rights commonly enjoyed by similar properties; 2. The granting of the variance will not be detrimental or injurious to surrounding properties, will not substanti<rlly increase traffic congestion and will not endanger the public safety; 3. The variance is the minimum variance that will make possible the reasonable use of the land, building, and structures; and 4. The variance requested arise:; from a condition that is unique and peculiar to the land involved and that is created by this Code and not by the actions of the property owner. C. An appeal may be initiated by any person aggrieved by a decision of the County Engineer. 1. A Notice of Appeal must be ailed with the Board of County Commissioners and the County Engineer within ten (10) days after rendition of such decision. 2. The filing of such notice will require the County Engineer to forward to the Board of County Commissioners any and all records concerning the appeal. 3. The Board of County Commissioners shall consider the appeal at a regularly scheduled meeting within a reasonable time after a notice of appeal is filed. The Board may reverse, affirm or modify the decision subject to the requirements of subsection 2. 10.01.22-10.01.24. Reserved. 10.01.25. Special Provisions Where Variance is Sought to Requirements of Flood Damage Prevention. A. Generally. 1. The Board of Adjustment as established by St. Lucie County shall hear and decide appeals and requests for variiances from the requirements of Section 6.05.00, Flood Damage Prevention. 2. The Board of Adjustment sha]~l hear and decide appeals when it is alleged there is an error in any requirement, decision, or determination made by the Floodplain Admin- istrator in the enforcement or• administration of Section 6.05.00 3. Variances may be issued for the repair or rehabilitation of historic structures upon a determination that the proposed repair or rehabilitation will not preclude the structure's continued designation as a historic structure and the variance is the minimum to preserve the historic character and design of the structure. St. Lucie County Land Development Code Supp. No. 4 10:16 Adopted May 19, 2009 HARDSHIP RELIEF 10.01.25 B. Application Procedures. 1. A person desiring a variance from the requirements of Section 6.05.00, Flood Damage Prevention shall apply for a variance on a form provided by Floodplain Administrator. 2. An application fee as established by resolution of the Board of County Commissioners shall accompany the application. 3. The application shall be in such form and contain such information and documentation as shall be prescribed from time to time by the Floodplain Administrator, but shall contain at least the following: a. Name and address of applicant. b. Legal description of the property which is the subject of the application. c. Size of the subject property. d. The purpose for the requested variance and a statement of the intended development of property if the variance is granted. e. A statement of the hardship imposed on the applicant by this Code and a statement of why the variance will not be materially detrimental or injurious to other property or improvements in the neighborhood in which the subject property is located. 4. Within a reasonable period of time not to exceed thirty (30) days after receipt of an application or receipt of additional information pursuant to this Section, the Flood- plain Administrator shall examine the application or information and notify the applicant of any apparent errors or omissions, and request such additional information as may be necessary for the processing of the application. 5. Within thirty (30) working days after an application has been determined to be complete by the Floodplain Administrator, he shall review the application, make a recommendation, and submit it to the Board of Adjustment. 6. Upon notification that an application for a variance is complete, the Board of Adjustment shall place the application on the agenda of a regularly scheduled meeting for a public hearing in accordance with Section 11.00.03. In reviewing the application for variance approval, the Board of Adjustment shall use the standards in Section 10.01.25(C) below. The Board may require the applicant to meet certain conditions before approval of the variance. 7. Within a reasonable time of the hearing, the Board of Adjustment shall issue its decision approving, approving with conditions, or denying the variance. 8. The decision of the Board of Adjustment shall be mailed to the petitioner and filed with the Office of the Floodplain Administrator in accordance with Section 11.00.04(F). St. Lucie County Land Development Code Supp. No. 4 10:17 Adopted May 19, 2009 10.01.25 ST. LIJCIE COUNTY LAND DEVELOPMENT CODE 9. Any applicant to whom a variance is granted shall be given written notice specifying the difference between the base flood elevation and the elevation to which the structure is to be built and stating that the cost of flood insurance will be commensurate with the increased risk resulting from the reduced lowest floor elevation. 10. Any person aggrieved by the decision of the Board of Adjustment, or any taxpayer may appeal such decision to a court of competent jurisdiction as provided by the Florida Statutes. 11. The Floodplain Administrator shall maintain the records of all appeal actions and report any variances to the Federal Emergency Management Agency upon request. C. General Standards for Issuance. In passing upon such applications, the Board of Adjustment shall consider all technical evaluations, all relevant factors, all standards specified in Section 6.05.00, and: 1. The danger that materials may be swept onto other lands to the injury of others; 2. The danger to life and property due to flooding or erosion damage; 3. The susceptibility of the proposed facility and its contents to flood damage and the effect of such damage on the individual owner; 4. The importance of the services provided by the proposed facility to the community; 5. The necessity to the facility of a waterfront location, in the case of a functionally dependent facility; 6. The availability of alternative locations, not subject to flooding or erosion damage, for the proposed use; 7. The compatibility of the proposed use with existing and anticipated development; 8. The relationship of the proposed use to the Comprehensive Plan and floodplain management program for that area; 9. The safety of access to the property in times of flood for ordinary and emergency vehicles; 10. The expected heights, velocity, duration, rate of rise and sediment transport of the floodwaters and the effects of wave action, if applicable, expected at the site; and, 11. The costs of providing governmental services during and after flood conditions including maintenance and rE:pair of public utilities and facilities such as sewer, gas, electrical, and water systems, and streets and bridges. D. Ability to Impose Special Condi~!ions. Upon consideration of the factors listed above and the purposes of Section 6.05.00, the Board of Adjustment may attach such conditions to the granting of variances as it deems necessary to further the purposes of Section 6.05.00 E. Variances Within Designated 1%loodways. Variances shall not be issued within any designated floodway if any increase in flood levels during the base flood discharge would result. St. Lucie County Land Development Code Supp. No. 4 10:18 Adopted May 19, 2009 HARDSHIP RELIEF 10.01.30 F. Conditions for Variances. 1. Variances shall only be issued upon a determination that the variance is the minimum necessary, considering the flood hazard, to afford relief; and in the instance of a historical building, a determination that the variance is the minimum necessary so as not to destroy the historic character and design of the building. 2. Variances shall only be issued upon: a. A showing of good and sufficient cause; b. A determination that failure to grant the variance would result in exceptional hardship; and, c. A determination that the granting of a variance will not result in increased flood heights, additional threats to public safety, extraordinary public expense, create nuisance, cause fraud on or victimization of the public, or conflict with existing local laws or ordinances. (Ord. No. 11-031, Pt. B, 12-20-2011) 10.01.26-10.01.29. Reserved. 10.01.30. Variances from Riverine Shoreline Protection Regulations. A. Variances Along the Indian River Lagoon System. The Growth Management Director may approve a variance to the minimum fifty (50) foot vegetation buffers required in Section 6.02.02 along the Indian River Lagoon or other river or creek, excluding the St. Lucie River and its tributaries, provided that no such variance shall permit a vegetation buffer of less than forty (40) feet. B. Variances Along the St. Lucie River System. The Growth Management Director may approve a variance of a maximum of ten (10) feet in the boundaries of Zones A and B along the St. Lucie River and its tributaries, as required in Section 6.02.02(B). C. Indian River LagoonlSt. Lucie River System Variance Requests in Excess of Ten (10) Feet. A variance of greater than ten (10) feet as permitted by paragraphs 1 and 2 above may only be granted by the Board of County Commissioners. Such a request for a variance may only be initiated by filing a written request with the County Administrator, or designee. Upon. receipt of the request and within a reasonable period of time, a public hearing shall be scheduled before the Board. The public hearing shall be subject to the formal notice and advertisement requirements set out in Sections 11.00.03 and 11.00.04. The Growth Manage- ment Director shall be required to submit a report to the Board on such a request including a recommendation for or against the requested vegetation buffer, based on applicable zoning or site data, the purposes listed in the introduction of this Section, and any other applicable information. The Board of County Commissioners shall not grant a variance to permit a vegetation bufler of less than forty (40) feet unless it shall, in each case, make specific findings of f<~ct based directly upon the particular evidence presented supporting written conclusions that: 1. The variance requested arises from a condition that the particular physical surround- ings, the shape, or topographical condition of the specific parcel of land involved, would result in unnecessary hardship for the owner or developer, as distinguished from a mere inconvenience, if the provisions of this Section are literally enforced, and the condition is created by the re;;ulations of this Section, and not by an action or actions of the owner, developer or applicant; 2. The granting of the variance will not impair or injure other property or improvements in the neighborhood in which. the subject parcel of land is located; 3. The variance granted is the rriinimum variance that will make possible the reasonable use of the land, building or structures; and 4. The variance desired will not be opposed to the general spirit and intent of this ordinance or the St. Lucie County Comprehensive Plan. E. Additional Standards for St. Lucie River System Variance. In addition to the standards in paragraph 4 above, a variance along the St. Lucie River or its tributaries shall be granted only when existing conditions on or adjacent to the property are such that granting of the variance will prevent erosion and siltation to a greater extent than not granting the variance. F. Limitations on Variances. Variances shall not be granted that would permit any structure within any required yard, unless otherwise approved by the Board of Adjustment pursuant to Section 10.01.00 of this Code. 10.01.31-10.01.34. Reserved. 10.02.00. TRANSFERABLE DEVELOPMENT RIGHTS-(RESERVED) 10.03.00. EMINENT DOMAIN WA][VER An eminent domain waiver is intended to provide property owners a viable and fair alternative to the adverse impact on their property, as a result of an eminent domain action. It allows the continued use of the remainder parcel in a manner similar to its pre-acquisition condition. Waivers provided herein can be obtained for nonconforming lots and structures. Waivers cannot be granted for nonconforming uses. Sections 10.03.00 and 10.03.01 shall be applicable only after the Board of County Commissioners adopts a resolution approving the use of eminent domain waiver for specific public projects. The County will mail notification via certified mail to the property owner and acquiring authority (if the County is not the acquiring authority) at least ten (10) days prior to the meeting date for the resolution 'to be considered by the Board of County Commissioners.
