7.10.09. Marinas.
(Reserved).
7.10.10. Adult Establishments.
In the CG (Commercial General) zoning district, Adult Establishments may be permitted
as a conditional use subject to the criteria set forth in Section 11.07.00 and the following
requirements:
A. An adult establishment shall be at least one thousand (1,000) feet from any other
adult establishment, established religious facility, public or private school, public
playground, public park, or any area in zoning district R/C, AR -1, RE -1, RE -2, RS -2,
RS -3, RS -4, RMH-5, RM -5, RM -7, RM -9, RM -11, RM -15, RVP, PUD, or HIRD.
B. For purposes of the distance limitations set forth in subparagraph (a) above, the
measurement shall be made by extending a straight line from the main entrance of
the building of the adult establishment to:
1. The main entrance of the building occupied by (any other adult establishment
or any established religious facility, or
2. The nearest property line of any school, playground, park, or residential zoning
district.
7.10.11. Distance Requirements for Alcoholic Beverages.
A. Distance Restrictions for Persons Selling or Transferring Alcoholic Beverages. No sales
or transfers of alcoholic beverages for on -premises consumption shall be permitted except as
noted below, within one thousand six hundred (1,600) feet of an existing religious facility,
school, public park, or public playground. This section shall not be applicable to sales or
transfers by any license holder whose use of his premises for such sale existed before the
establishment of the use of the religious facility, school, public park, or public playground, or
when the religious facility is located in a CG (Commercial General) zoning district.
B. Measurement. The manner of measurement of the distance referred to in Section
7.10.11(A) above shall be as follows:
Begin at the main entrance of the church or school building or a public park or
playground, regardless of which zoning they are in, thence run to the centerline of the street
right-of-way in front of such entrance, thence along the centerline of such street right-of-way
to a point immediately opposite the main entrance of the proposed licensed premises, thence
to the center of the main entrance of the building of the proposed licensed premises.
If there is more than one (1) public entrance to an establishment, the main entrance shall
be construed to mean the principal or leading entrance to the premises involved and to which
the traffic route, whether vehicular or pedestrian, of those going to and from said premises
chiefly directs itself.
In addition, the distance between a licensed establishment and a religious facility, school,
public park, or public playground shall not be less than one thousand (1,000) feet measured
is by a straight line between the nearest corners of the establishment and a religious facility

building, or in the case of a school, public park, or public playground, measured by a straight
line between the licensed establishment and the park, playground, school building, or school
playground area.
C. Waiver Provision for Business Selling or Transferring Alcoholic Beverages as an
Accessory to an Eating Place. Any person whose location or place of business does not meet
the distance restrictions in Section 7.10.11(A) and who is proposing to sell or transfer
alcoholic beverages for on -premises consumption as an accessory to an eating place may have
this distance waived in the following manner:
1. A request for waiver may be initiated by filing an application in writing for such
waiver with the Planning and Development Services Director.
2. The Planning and Development Services Director shall schedule a public hearing
before the Board of County Commissioners in accordance with the requirements of
Section 11.00.00 of this Code.
3. An applicant operating a drinking place accessory to an eating place for which such
waiver is sought must:
a. Dispense sales of beer, wine or liquor only to persons patronizing the establish-
ment for the main purpose of ordering and consuming food.
b. Have permanent kitchen facilities located within the premises in which meals
are regularly prepared for service to patrons of the establishment.
4. A waiver of distance requirements under this section shall be granted only in the
event it does not adversely affect community health, safety or general welfare and in
connection therewith there shall be considered the following:
a. The actual location and distance of the proposed establishment with respect to
other places of business licensed to sell intoxicating beverages, whether on or off
the premises, as well as churches, schools, public park or public playground.
b. The type and size of the establishment, including bar floor space and seating
capacity, capable of seating not fewer than thirty-five (35) persons simultane-
ously for the purpose of consuming food, and whether, in view of such type or
size, the proposed establishment is likely to create a public nuisance or traffic
impediment by drawing crowds or persons milling about outside the building.
C. Whether adequate parking and landscaping for the facility is provided so as to
meet the requirements set forth in Sections 7.06.00 and 7.09.00 of this Code.
d. Whether the facility is physically separated or sufficiently well buffered from all
adjacent residentially zoned areas; schools, churches, public parks and public
playgrounds.
e. Whether, if the facility is located with sixteen hundred (1,600) feet of a church,
school, public park or public playground, it will generate traffic which may
adversely affect the safety of persons attending or using such church, school,
public park or public playground.

5. Before any action is taken upon any application as provided in this section, the
applicant shall deposit with the Planning and Development Services Director, the
sum of three hundred dollars ($300.00) to cover the approximate cost of the
procedure and such sum is not refundable in any event.
D. Waiver Provision for Business Selling or Transferring Alcoholic Beverages as an
Accessory to a Principal Use. This waiver provision shall only apply to tasting rooms
associated with a licensed business establishment authorized to operate in a given zoning
district as Manufacturing of beverages (SIC 208), Wholesale trade (SIC 518) or Retail liquor
store (SIC 592) who is proposing to sell or transfer alcoholic beverages for on -premises
consumption as an accessory to the permitted principal use, is not accessory to an eating
establishment, and whose location does not meet the distance restrictions set forth in
Section 7.10.11(A) as measured by Section 7.10.11(B) above. Such business establishment
may apply to have this distance requirement waived in the following manner:
1. A request for waiver may be initiated by filing an application in writing for such
waiver with the Planning and Development Services Director.
2. The waiver process shall follow the Conditional Use process set forth in Section
11.07.01, except that only one public hearing before the Board of County Commis-
sioners shall be required, including all applicable fees determined by the Board of
County Commissioners and published by the Planning and Development Services
Director, and shall be subject to the standards of review as set forth in Section
11.07.03 where additional conditions may be imposed as necessary to effectuate
compatibility with the surrounding neighborhood. Such conditions may include but
are not limited to hours of operation, intensity, design, size, seating capacity,
configuration and public facility impact associated with the tasting room. In addition
to the mail notice requirements set forth in [Section] 11.07.01, mail notices must also
include religious facilities, schools, public parks, or public playgrounds that fall
within the affected measurement of Section 7.10.11(B) above.
E. Exception. Provided, however, the distance restrictions set out in Sections A, B, C and
D shall not apply to licenses when located within a hotel or motel of one hundred (100) rooms
or more with restaurants with a minimum seating capacity of two hundred (200) containing
a minimum of four thousand (4,000) square feet.

7.10.12. Scrap, Waste and Recycling Operations.
A. In the IL (Industrial Light) zoning district, scrap and waste material collection
operations may be permitted as a conditional use subject to the following criteria:
1. The collection operations shall be limited to the acceptance of glass, plastic, paper,
cardboard, metal cans, and non-ferrous metals.
2. The property on which the collection activity is to take place shall be at least
forty-three thousand five hundred sixty (43,560) square feet (1 acre) and no more
than two hundred thousand (200,000) square feet (4.5 acres) in total area.

3. All activities, including storage of the collected materials shall be conducted within
a completely enclosed structure. No outside storage of materials of any kind shall be
permitted.
4. The property on which the collection activity is taking place shall be surrounded by
a fence, wall, or vegetative screening eight (8) feet in height. Such fence or wall shall
be of similar composition, construction, and color throughout and shall be constructed
without openings except for one (1) entrance and one (1) exit; the entrance and exit
shall be equipped with unpierced gates. Such gates shall be closed and securely
locked at all times, except during business hours.
If vegetative screening is to be substituted for a fence or wall, plans for such
vegetative screening shall be submitted with the application for conditional use
approval. Such vegetative screening shall consist of a greenbelt strip at least twenty
(20) feet in width adjoining adjacent lot lines, and a greenbelt strip at least ten (10)
feet in width adjoining street line. The greenbelt shall be composed of at least one (1)
row of deciduous or evergreen trees and one (1) or two (2) rows of shrubs.
Regardless of building size, a complete site plan prepared in accordance with the
provisions of Section 11.02.00 (Major Site Plan) shall be required with the
application for conditional use. The application for conditional use shall not be
considered complete until all minimum site plan criteria have been determined to be
met.
The reprocessing of the collected materials into any other product, by-product or
other use or form is prohibited, unless the reprocessing is allowed in conjunction with
manufacturing of a new product or material as would otherwise be permitted in the
IL (Industrial Light) district.
B. In the IH (Industrial Heavy) zoning district, scrap and waste material operations may
be permitted as a conditional use subject to the following criteria:
The yard shall be at least forty-three thousand five hundred sixty (43,560) square
feet and no more than two hundred thousand (200,000) square feet in area.
2. No junked vehicle, or any other junk or scrap shall be located for storage,
dismantling, or any other purpose within seventy-five (75) feet of any residential
district, within fifty (50) feet of the front street line, within thirty (30) feet of any side
street line, or within thirty (30) feet of any other lot line.
3. The yard shall be surrounded by a fence, wall, or vegetative screening eight (8) feet
in height. Such fence or wall shall be of similar composition, construction, and color
throughout and shall be constructed without openings except for one (1) entrance
and one (1) exit; the entrance and exit shall be equipped with unpierced gates. Such

4. Junked or wrecked vehicles shall be stacked to a height of no more than twenty-four
(24) feet.
5. Regardless of building size, a complete site plan prepared in accordance with the
provisions of Section 11.02.00 (Major Site Plan) shall be required with the
application for conditional use. The application for conditional use shall not be
considered complete until all minimum site plan criteria have been determined to be
met.
C. In the IH (Industrial Heavy) or U (Utility) zoning district, land clearing and yard trash
recycling operations, that are engaged in the recycling and processing of land clearing and
yard trash only, may be permitted as a conditional use subject to the following criteria:
1. Business operations authorized under this Section shall be limited to the recycling,
processing and short term storage of land clearing and yard trash only, and shall not
be permitted to recycle, process or store for any period of time construction or
demolition debris, except for that construction or demolition debris that may
otherwise be defined as land clearing debris or yard trash.
2. The total site area devoted to the recycling, processing and storage of land clearing
and yard trash debris shall be at least five (5) acres, but no more than fifteen (15)
acres.

2. Conditions of Approval for Granting a Variance. When granting a variance request,
the Environmental Resources Director, and the Public Works Director or designees,
may impose conditions, including, but not limited to, limitations on areal extent and
scope of the project, restricted use, planting requirements, conservation of additional
shoreline buffer and erosion control, etc. which meet the intent and purposes of the
Land Development Code and the Goals, Objectives and Policies of the St. Lucie
County Comprehensive Plan.
C. Expiration and Extension.
1. Expiration. Variances shall be valid for one (1) year from date of issuance, unless a
Building Permit is issued.
2. Extension. Applications for a time extension must be made in writing to the
Environmental Resources Director a minimum of thirty (30) calendar days prior to
expiration of the variance. Variances may only be extended one (1) time for a
maximum of twelve (12) months.
D. Amendment. A variance from Riverine Shoreline Protection Regulations may be
amended, extended, or modified only in accordance with the procedures established for its
original approval.
E. Appeal. Any party aggrieved by a decision may appeal such decision to the Board of
Adjustment pursuant to Section 11.11.01 of this Code.

10.02.00. TRANSFERABLE DEVELOPMENT RIGHTS—(RESERVED)
10.03.00. EMINENT DOMAIN WAIVER
An eminent domain waiver is intended to provide property owners a viable and fair
alternative to the adverse impact on their property, as a result of an eminent domain action.
It allows the continued use of the remainder parcel in a manner similar to its pre-acquisition
condition. Waivers provided herein can be obtained for nonconforming lots and structures.
Waivers cannot be granted for nonconforming uses.
Sections 10.03.00 and 10.03.01 shall be applicable only after the Board of County
Commissioners adopts a resolution approving the use of eminent domain waiver for specific
public projects. The County will mail notification to the owners of property located in
unincorporated St. Lucie County and the acquiring authority (if the County is not the
acquiring authority) at least ten (10) days prior to the meeting date for the resolution to be
considered by the Board of County Commissioners.
A. Applicability.
1. Vacant parcels, whether conforming or non -conforming lots, shall be eligible for
an eminent domain waiver from, including, but not limited to, minimum lot size
requirements, pursuant to Section 10.03.00, Land Development Code.

10.03.00 ST. LUCIE COUNTY LAND DEVELOPMENT CODE
2. Developed parcels. Where an eminent domain action reduces the lot size and
creates a nonconforming remainder parcel but does not require the relocation of
site features, said parcel shall be eligible for an eminent domain waiver from
the Land Development Code such as but not limited to, minimum lot size, and
building coverage requirements, pursuant to Section 10.03.00, Land Develop-
ment Code.
3. Developed parcels. Where an eminent domain action requires the relocation of
site features such as but not limited to, buildings, parking spaces, landscaping,
storm water facilities, dumpsters, light poles and signs such a parcel shall be
eligible for an eminent domain waiver, pursuant to Section 10.03.00, St. Lucie
County Land Development Code.
B. The acquiring authority and/or the property owner are each hereby granted the
authority to apply for a waiver from the Land Development Code on a remainder
parcel that has resulted or will result from an eminent domain action. The
application may be made prior to or after the acquiring authority obtaining title to
some part of the parent tract.
C. Procedure to apply for an.eminent domain waiver.
1. Either the acquiring authority or the property owner shall file for an eminent
domain waiver application within six (6) months from the entry of an Order of
Taking with the County Administrator or designee. The applicable fee,
established by resolution, shall be submitted with the application in addition to
the following documents:
a. A boundary survey prepared according to the current standards of Chapter
5J-17, Florida Administrative Code, as may be amended, of the parent
tract and a legal description of the portion to be acquired and the
remainder parcel shall be submitted for those circumstances described in
Section 10.03.00(A) above. The boundary survey shall show the parent
tract and the remainder parcel including, but not limited to, buildings,
parking, landscaping, sprinkler systems, storm water facilities, wells and
septic systems, lighting features, fences, signage, easements of record,
adjacent rights of ways and topographic data.
b. A site plan (a cure plan as defined herein) showing the parent tract and the
remainder parcel with the proposed changes to the site including, but not
limited to, buildings, parking, landscaping, storm water facilities, topographic
data and adjacent right-of-way. A cure plan shall be required only for those
parcels described in Section 10.03.00A3 above.
2. If an application for a waiver is submitted by an acquiring authority, the
property owner shall be mailed notification via certified mail (return receipt
requested) by the County Administrator or designee within ten (10) days of the
application submittal date. Likewise, if the property owner applies for a waiver,

the acquiring authority shall be mailed notification via certified mail (return

shall consider the request for an eminent domain waiver at a public hearing.
The public hearing may be continued by the BOA to a fixed date, time and place.
After the conclusion of the public hearing, the BOA shall approve, approve with
modifications or deny the request for an eminent domain waiver by resolution
which shall constitute the final action of the BOA. The property owner shall not
be required to implement the waiver or cure plan approved by the BOA.
D. Standards of issuance of eminent domain waivers.
1. If an existing lot, parcel or structure becomes nonconforming (or an existing
nonconformity becomes less conforming) as a result of a governmental acquisi-
tion, a waiver may be granted provided a determination is made that:
a. The requested waiver shall not adversely affect safety, aesthetic or
environmental conditions of neighboring properties; and
b. The requested waiver shall not adversely affect the safety of pedestrians or
operations of motor vehicles; and
C. The requested waiver will not encourage or promote the continuation of
existing uses of the property which have been or will be rendered
unfeasible or impractical due to the impacts of the taking and/or construc-
tion of the roadway or other facility including, but not limited to, aesthetic,
noise, dust, vibration, safety, land use compatibility, environmental or
other impacts.
d. The remainder parcel shown on the As -built drawing and the cure plan
shall be the site on which compliance with the Land Development Code
must be shown. All calculations shall be based upon the acreage of the
remainder parcel.
2. Eminent domain waivers are not restricted by the variance limitations in
Section 10.01.03 of the St. Lucie County Land Development Code.

10.03.01. Status of parcels during or after acquisition by eminent domain action.
A. Where a waiver is issued pursuant to Section 10.03.00, Land Development Code, the
waiver shall become effective and the remainder parcel shall be considered compliant to the
degree feasible after an acquiring authority takes interest in or title to real property subject
to an eminent domain action.

B. Where a property owner accepts a waiver on a vacant parcel or where no cure plan was
necessary, the waiver shall remain valid and applicable to the remainder parcel indefinitely.
However, future site plan and building permit approvals shall comply with all provisions in
the Land Development Code except those listed in the waiver. For developed parcels, the
extent to which a remainder parcel has received specific exceptions listed in a waiver, those
exceptions may not be increased or expanded by future development plans, site plans or
building permits.
C. Where a private property owner accepts a waiver based upon a cure plan, the physical
changes to the remainder parcel, specified in the cure plan, shall occur within 365 days from
the later of (1) the date the acquiring authority takes an interest in or title to some part of
the parent tract, or (2) the date project construction is completed by the condemning
authority, or (3) the date that all license or temporary easement interests of the condemning
authority affecting the area(s) to be cured have terminated or expired. Future site plan and
building permit approvals shall comply with all provisions in the Land Development Code
except those listed in the waiver. Within the 365 day time period described above, the
property owner may apply to the County Administrator for a one (1) time extension of up to
365 additional days. Further extensions may be granted by the County Administrator only
in the event that compensation from the condemning authority has not been resolved within
the first two (2) three hundred sixty-five (365) -day periods.
D. The provisions of Section 10.03.00, Land Development Code shall not be interpreted to
allow for the continued existence of building or safety code violations that are determined to is
be a threat to the public health, safety or welfare.
E. The County shall continue to enforce all applicable building and safety codes even
through the subject property is part of a pending governmental acquisition.
