HomeMy WebLinkAbout11-036 1 ORDINANCE NO. 11-036 2 Annual update to the Capital Improvements Element FY2011/12 through FY2015/16 3 4 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE 5 COUNTY, FLORIDA, TO AMEND THE TEXT OF THE COMPREHENSIVE PLAN, IN 6 ACCORDANCE WITH THE ANNUAL UPDATE TO THE CAPITAL IMPROVEMENTS 7 ELEMENT; PROVIDING FINDINGS; PROVIDING FOR CONFLICTING PROVISIONS; 8 PROVIDING FOR SEVERABILITY; PROVIDING FOR APPLICABILITY; PROVIDING 9 FOR FILING WITH THE FLORIDA DEPARTMENT OF STATE; PROVIDING FOR 10 FILING WITH THE FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY; 11 PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR ADOPTION. 12 13 WHEREAS, the Florida Legislature intends that local planning be a continuous and ongoing 14 process; and 15 16 WHEREAS, the Board of County Commissioners has adopted the St. Lucie County 17 Comprehensive Plan, Ordinance No. 90-01 on January 9, 1990; and 18 19 WHEREAS, the Board of County Commissioners has followed the procedures set forth in Section 20 163.3177(3)(b), Florida Statutes, stating that amendments to the Capital Improvements Element 21 shall require only a single public hearing before the governing board which shall be an adoption 22 hearing. Such amendments are not subject to the requirements of Section 163.3184; and 23 24 WHEREAS, on December 20, 2011, the Board held a public hearing with all required public notice 25 for the purposes of hearing and considering the recommendations and comments of the general 26 public prior to final action on the Comprehensive Plan amendments set forth herein; and 27 28 WHEREAS, the Board of County Commissioners has determined that the proposed amendments 29 are consistent with the state, regional and County Comprehensive Plans; and 30 31 WHEREAS, the Capital Improvements Element must identify committed and planned revenues for 32 capital improvements during the fiscal years 2011/12 through 2015/16 that will ensure adequate 33 capacity based upon the demands of future growth; and 34 35 NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie 36 County, Florida: 37 38 A. ADOPTION OF THE AMENDMENTS 39 40 The Board of County Commissioners does hereby adopt the annual amendments to the Capital 41 Improvements Element of the St. Lucie County Comprehensive Plan, attached here as Exhibit A. 42 43 B. CHANGES TO THE COMPREHENSIVE PLAN 44 45 The Board of County Commissioners does hereby state its intention to amend the text of the St. 46 Lucie County Comprehensive Plan in accordance with the annual amendments to the Capital 47 Improvements Element. 48 JOSEPH E. CONFLICTING PROVISIONS 2 3 Special acts of the Florida Legislature applicable only to unincorporated areas of St. Lucie County, 4 County Ordinances and County Resolutions, or parts thereof, in conflict with this Ordinance are 5 hereby superseded by this Ordinance to the extent of such conflict. 6 7 D. SEVERABILITY 8 9 If any portion of this Ordinance is for any reason held or declared to be unconstitutional, 10 inoperative or void, such holding shall not affect the remaining portions of this Ordinance. If this 11 Ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or 12 circumstances, such holding shall not affect its applicability to any other person, property or 13 circumstance. 14 15 E. APPLICABILITY OF ORDINANCE 16 17 This Ordinance shall be applicable as stated in Paragraphs A and B. 18 19 F. FILING WITH THE DEPARTMENT OF STATE 20 21 The Clerk is hereby directed forthwith to send a certified copy of this Ordinance to the Bureau of 22 Laws, Department of State, The Capitol, Tallahassee, Florida, 32304. 23 24 G. FILING WITH THE DEPARTMENT OF ECONOMIC OPPORTUNITY 25 26 The Planning and Development Services Director shall within 10 working days send a certified 27 copy of this Ordinance to the Department of Economic Opportunity, the Treasure Coast Regional 28 Planning Council, and other agencies in accordance with Section 163.3184, Florida Statutes. 29 30 H. EFFECTIVE DATE 31 32 This Ordinance shall take effect upon filing a copy with the Florida Department of State by the 33 Clerk; provided, however that the effective date of the Comprehensive Plan amendments set forth 34 herein shall be thirty-one (31) days after the Florida Land Planning Agency determines the 35 amendment package is complete and no petition is filed by an affected party. If an affective party 36 challenges the amendments, the amendments shall be effective when a final order is issued by 37 the Land Planning Agency or the Administration Commission determining that the amendments 38 are in compliance in accordance with Section 163.3184, Florida Statutes, whichever occurs 39 earlier. No development orders or development permits, if dependent upon the amendment, may 40 be issued or commence before the amendment has become effective. If a final order of 41 noncompliance is issued by the Administration Commission, these amendments may 42 nevertheless be made effective by adoption of a resolution affirming its effective status, a copy of 43 which resolution shall be sent to the Florida Department of Economic Opportunity, Division of 44 Community Planning. If the amendment's effective date is delayed by law the amendment shall be 45 considered part of the adopted plan until it is determined to be not in compliance by final order of 46 the Administration Commission. 47 48 49 50 51 Ordinance No. 11-036 Page 2 1 I.
