LUCIE COUNTY CLARIFYING LANGUAGE REGARDING THE NOTIFICATION OF DISPOSITION TO INTERESTED PARTIES; PROVIDING FOR SEVERABILITY; AND PROVIDING EFFECTIVE DATE. WHEREAS, Section 125.35, Florida Statutes, allows counties to prescribe by ordinance disposition standards and procedures for surplus real property; WHEREAS, the Board adopted such procedures in Ordinance No. 02-18; WHEREAS, the Board wishes to clarify the procedures relating to notification and of disposition to interested parties. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida: PART A. ARTICLE I. "In General," of Chapter 1-16.2, "Disposition of Surplus Real Property," of the Code of Ordinances of St. Lucie County, Florida, is amended as follows: Sec. 1-16.2-6. Notification of disposition to interested parties. The county administrator or designee shall publish a notice in a newspaper of general circulation once at least twenty (20) days prior to the board of county commissioners' hearing in which the real property is to be declared surplus. The notice shall contain a description of the surplus property sought to be disposed of, the name of the county administrator or designee to which objections shall be addressed, and the date of the regular meeting of the board in which proposed final action is to be taken. Objections to the declaration of surplus f~~al-Ckspositiomof surplus property shall be made in writing no later than ten (10) days prior to the hearine in which the real property is to be declared surplus and shall be given to the board prior to making its final decision. PART B. SEVERABILITY. If any word, phrase, clause, section or portion of this ordinance shall be held invalid or unconstitutional by a court of competent jurisdiction, such portion or words shall be deemed a separate and independent provision and such holding shall not affect the validity of the remaining portions thereof. EFFECTIVE DATE. This ordinance shall become effective September 1, 2010. PART D. FILING WITH THE DEPARTMENT OF STATE. The Clerk is hereby directed forthwith to send a certified copy of this ordinance to the Bureau of Administrative Code and Laws, Department of State, The Capitol, Tallahassee, Florida 32304. PART E. ADOPTION. Provisions of this ordinance shall be incorporated into the Code of Ordinances of St. Lucie County, Florida, and the word "ordinance" may be changed to "section", "article", or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, that Parts "B" through "F" shall not be codified.
