This article shall be known as the "St. Lucie County Merchandising of Tobacco Products Ordinance". (Ord. No. 01-09, Pt. A, 6-19-2001) Sec. 1-6-42. Intent. This article is intended to prevent the sale and delivery of tobacco products to persons under the age of eighteen (18) by regulating the commercial marketing and placement of such products but shall not be interpreted or construed to prohibit the sale or delivery of tobacco products which are otherwise lawful or regulated pursuant to Chapter 569, Florida Statutes. (Ord. No. O1-09, Pt. A, 6-19-2001) Sec. 1-6-43. De~nitions. Vendor means any individual, sole proprietorship, joint venture, corporation, partnership, cooperative association, or other legal entity licensed as a dealer in tobacco products pursuant to Chapter 569, Florida Statutes, and any employee or agent of said dealer. Tobacco product means loose tobacco leaves and products made from tobacco leaves, in whole or in part, which can be used for smoking, sniffing or chewing, including but not limited to cigarettes, cigars, pipe tobacco, snuff or smokeless tobacco and chewing tobacco. Tobacco products also include cigarette wrappers. Specialty tobacco store means an establishment primarily in the business of selling cigars and pipe tobacco. Open display unit means a case, rack, shelf, counter, table, desk, kiosk, booth, stand or other surface, which allows direct public access to the product placed therein. Title; authority; purpose. (a) Title. This article shall be known as the "St. Lucie County Price Gouging Ordinance." The provisions of this article shall be applicable in all geographic areas of St. Lucie County. Unless otherwise provided, nothing in this article shall be construed to relieve a person from compliance with applicable county or municipal regulations. (b) Authority. This article is enacted by the authority of Chapters 125, 252, and 501, Florida Statutes. (c) Purpose. The purpose of this article is to set measures in place necessary to the protection of life and property, threatened because of natural, technological, or other disasters and emergencies. This article is not intended to preempt or to restrict the application of other, more restrictive ordinances of St. Lucie County already in effect. Neither is this article intended to preempt or to preclude the application or enforcement of local emergency management measures already in effect, or which will be effective, upon a declaration of emergency. This article is not intended and shall not be construed as imposing price controls upon lawful business activities in St. Lucie County. (Ord. No. 01-21, Pt. A, 10-16-01) Sec. 1-6.3-52. Definitions. Average retail price. The term "average retail price" shall mean the average price at which similar merchandise was being sold during the thirty (30) days immediately preceding the declaration of a local emergency. Commission. The term "commission" shall mean the Board of County Commissioners of St. Lucie County, Florida. Consumer goods. The term "consumer goods" shall mean any article, product, merchandise, or commodity of any kind or class which is customarily produced or distributed for sale at retail Supp. No. 59 269 § 1-6.3-52 ST. LUCIE COUNTY CODE for consumption by individuals or use by individuals, including but not limited to: food, water, ice, clothing, lumber, hardware, chain saws, generators, home improvement materials, and fuel products. Emergency. The term "emergency" shall mean any occurrence, or threat thereof, whether accidental, natural in war or in peace, which results or may result in substantial injury or harm to the population or substantial damage to or loss of property. Enforcement official. The term "enforcement official" shall mean all police or law enforce- ment of~icers, any code compliance official, code inspector, personnel of the emergency management division, and any other appropriate municipal or county official. Fuel product. The term "fuel product" shall mean home-heating oil, kerosene, propane, natural gas, diesel fuel, methanol, and gasoline. Unconscioncable. The term "unconscionable" shall mean and be used in the sense that it is prima facie evidence that a price is unconscionable if (1) The amount charged represents a gross disparity between the price of the commodity or rental or lease of any dwelling unit or self-storage facility that is the subject of the offer or transaction and the average price at which that commodity or dwelling unit or self-storage facility was rented, leased, sold, or offered for rent or sale in the usual course of business during the thirty (30) days immediately prior to a declazation of a state of emergency, and the increase in the amount charged is not attributable to additional costs incurred in connection with the rental or sale of the commodity or rental or lease of any dwelling unit or self-storage facility, or national or international market trends; however, a mere price increase approved or authorized by a govern- ment agency, law, statute, or regulation shall not be deemed unconscionable and shall not be a violation of this article's prohibitions; or (2) The amount charged grossly exceeds the average price at which the same or similar commodity was readily obtainable in the trade area during the thirty (30) days immediately prior to a declaration of a state of emergency, and the increase in the amount charged is not attributable to additional costs incurred in connection with the rental or sale of the commodity or rental or lease of any dwelling unit or self-storage facility, or national or international market trends; however, a mere price increase approved or authorized by a govemment agency, law, statute, or regulation shall not be deemed unconscionable and shall not be a violation of this article's prohibitions. (a) When a disaster or threat of a disaster has placed all or some persons of St. Lucie County in danger of loss of life or property, a state of emergency shall be declared, pursuant to St. Lucie County Resolution Number 00-277, by the county administrator. A state of Supp. No. 59 2'70 CIVIL DEFENSE AND EMERGENCY MANAGEMENT § 1-6.3-54 emergency so declared shall continue for seven (7) days, unless extended as necessary, in seven-day increments. However, if the local emergency involves a threat to private structure or public infrastructure, the local emergency may remain in effect for up to thirty (30) days. (b) A declaration of emergency shall activate the applicable St. Lucie County emergency management plans and shall constitute authority for the following in lieu of the procedures and formalities otherwise required by the county by law pertaining to: (1) Perforxnance of public work, and any other prudent action necessary to enure the health, safety, and welfare of the citizens of St. Lucie County; (2) Entering into contracts; (3) Incurring obligations; (4) Employment of permanent and temporary workers; (5) Utilization of volunteer workers; (6) Rental of equipment; (7) Acquisition and distribution, with or without compensation, of consumer goods, supplies, materials and facilities; and (8) Appropriation and e~enditure of public funds. (c) The county adxninistrator or designee or enforcement officials shall implement the provisions of this article with or without instructions as may be furnished by the board of county commissioners and the county administrator. (d) Nothing in this article shall be construed to li.mit the authority of the board of county commissioners to declare, limit, or terminate a state of emergency, and to take any action authorized by law, when convened in a regular or special meeting. (a) Upon declaration of an emergency pursuant to section 1-6.3-53 of this article, and through the duration of such emergency, it shall be an unlawful method of competition and an unfair and deceptive trade act or practice for a person or his or her agent or employee doing business in St. Lucie County to charge more than the average retail price for any consumer goods. (b) Upon declaration of an emergency pursuant to section 1-6.3-53 of this article, and through the duration of such emergency, it shall be an unlawful method of competition and an unfair and deceptive trade act or practice for a person or his or her agent or employee to impose unconscionable prices for the rental or lease of any dwelling unit or self-storage facility. LUCIE COLJNTY CODE (c) This section does not prevent the seller of consumer goods from charging an amount in egcess of the average retail price, if such higher price is the direct result of, and limited to, any increased cost for the consumer goods from the manufacturer, distributor, or wholesaler to the seller. In such instances, only the actual cost increase per item from the manufacturer, distributor, or wholesaler can be added to the average retail price. (d) This section does not interfere with the authority of government to acquire and to distribute consumer goods, supplies, materials, and facilities, with or without compensation. It shall be the duty of all enforcement officials to assist in the enforcement of this article. Violations of the provisions of this article may be prosecuted in the name of the state in a court having jurisdiction of misdemeanors by the prosecuting attorney thereof and upon conviction shall be punished by a fine not to exceed five hundred dollars ($500.00) or by imprisonment in the county jail not to exceed sixty (60) days or by both such fine and imprisonment, pursuant to section 125.69(1), Florida Statutes. The economic development ad valorem tax egemption is a local option tax incentive for new or expanding business which may be granted or refused at the sole discretion of the board. Zb apply for such an exemption a business locating or egpanding in the incorporated or unincorporated area of St. Lucie County must file an application Form EDAG-l, attached hereto as Amended Attachment 1* with the board. Satisfactory proof that the business meets the criteria for exemption as a new business or expansion of an existing business as defined by this article must accompany the application. The application shall be filed on or before 1 March of the year in which an exemption is requested. Exemption from county tax may only be granted by the board. The exemption granted under this article shall not accrue to improvements to real property made by or for the use of new or expanding businesses when such improvements have been included on the tax rolls prior to the referendum authorizing this article. (a) Before the board acts on an application, it must be submitted to the property appraiser for review. After careful consideration, the property appraiser shall report to the board concerning the fiscal impact of granting exemptions. The property appraiser's report shall include the following: (1) The total revenue available to the county for the current fiscal year from ad valorem tax sources. (2) The amount of revenue foregone by the county for the current fiscal year because of economic development ad valorem tax egemptions previously granted. (3) An estimate of the amount of revenue which would be foregone for the current fiscal year if the exemption is granted to the new or expanding business. (4) A determination that the business meets the definition of a new or expanding business as defined in this article. Upon request, the department will provide the property appraiser such information as it may have available to assist in making this determination. (b) After consideration of the report of the property appraiser, the board may choose to adopt an ordinance granting the tag exemption to a new or expanding business. The ordinance shall be adopted in the same manner as any other ordinance of the county. Fees charged to offset the cost of processing the economic development ad valorem tax exemption application or any exemption ordinance shall be adopted by the board by resolution. (Ord. Any business or industry, as defined in section 1-19.3-55 subsections (3.1) and (3.2), that does not qualify as an ineligible business or industry as defined in section 1-19.3-60. When considering the issue of whether or not a business or industry is an eligible business as defined herein, the board shall consider the anticipated number of employees, average wage, type of industry or business, environmental impacts, volume of business or production or any other information relating to the issue of whether the proposed development in St. Lucie County prior to accepting the economic development ad valorem tax exemption application. The criteria for determining the length of an egemption and the percentage amount of an egemption may be formulated by the board by resolution.
