Reserved. AR,TICLE II. OFFICERS AND EMPLOYEES Sec. 1-2-16. Terminal incentive pay for accumulated and unused sick leave. (a) The term "county employees of St. Lucie County" as used in this section shall include all employees of the following: (1) Board of County Commissioners; (2) St. Lucie County Erosion District; (3) St. Lucie County Mosquito Control District. (b) All county employees of St. Lucie County shall be entitled to terminal incentive pay for accumulated and unused sick leave to each employee upon normal or regular retirement or termination of employment after six (6) years creditable county employment, or for other reasons other than disability, and to his beneficiary if service is terminated by death, after six (6) years of creditable county employment. (c) The employing agency shall maintain accurate and reliable records showing the amount of sick leave which has accumulated and is unused by the employee at the time of his retirement, death or termination. (d) The payment authorized by this section shall be determined by using the rate of pay received by the employee at the time of his retirement, termination or death applied to the sick leave time for which he is qualified to receive terminal "incentive" pay under this section; provided however, terminal pay allowable for unused sick leave shall not exceed a maximum of four hundred eighty (480) hours for employees with ten (10) or more years of creditable county employment and two hundred forty (240) hours for employees with six or more but less than ten (10) years of creditable county employment. (e) The payments made pursuant to this section shall not be considered in any state administered retirement system as salary payments and shall not be used in determining the average final compensation of an employee in any state administered retirement system. (fl Any employee who is found guilty in a court of competent jurisdiction of committing, aiding or abetting any embezzlement or theft from his employer or bribery in connection with employment, committed prior to retirement or creditable termination as provided in subsec- tion 1-2-16(b), whose employment is terminated by reason of his admitted committing, aiding or abetting of an embezzlement or theft from his employer or by reason of bribery for cause, who, prior to creditable termination or retirement termination as provided in subsection 1-2-16(b), is adjudged by a court of competent jurisdiction to have violated any state law against strikes by public employees, or who has been found guilty by a court of competent jurisdiction of violating any state law prohibiting strikes by public employees shall forfeit all Supp. No. 61 57 § 1-2-16 ST. Any employee whose employment terminates as a result of an act committed subject to this section or for cause will not be given credit for unused sick leave accumulated prior to termination should he be reemployed at a later date. Longevity and special recognition awards to county employees. (a) Definition. The term "county employee" as used in this section shall include all employees of the following: (1) Board of County Commissioners. (2) St. Lucie County Mosquito Control District. (3) St. Lucie County Erosion District. (4) Any county constitutional officer who desires to participate in the award program. (b) Expenditures from county funds. The following expenditures are deemed to constitute valid and proper county purposes for which county funds may be used: (1) The purchase and presentation of awards to county employees for longevity of service or outstanding service or achievement in connection with county employment. Such awards may include framed certificates, plaques, pins and other suitable tokens of recognition as determined by the board of county commissioners. (2) Breakfasts, luncheons, or dinners during which such awards shall be presented to the recipient county employees. (3) Breakfasts, luncheons, dinners or special events during which all county employees shall be recognized for their service to the county. (Ord. No. 87-54, Pt. A, 7-28-87; Ord. No. 90-42, Pt. A, 8-21-90; Ord. No. 99-11, Pt. A, 9-7-99) Sec. 1-2-16.2. Food and non-alcoholic beverage expenses. (a) Expenditures from county funds. The following expenditures are deemed to be in the common interest of the people of St. Lucie County, necessary for the economic welfare of St. Lucie County and constitute a valid and proper county purpose for which county funds may be used: (1) Expenditures, including necessary sales tax and tips not to exceed twenty (20) per cent, for meals and non-alcoholic beverages, of persons in the interest of promoting and engendering goodwill, to publicize, advertise, and promote the activities of the county, to make known the advantages, facilities, resources, projects, attractions and at- tributes of the county, to create a favorable climate of opinion concerning the county, and to cooperate with other agencies, public or private. Supp. No. 61 58 ADMINISTRATION § 1-2-17 (b) All requests for food and non-alcoholic beverage expenses pursuant to this section should be approved by the county administrator or designee prior to the expenditure. Under sufficient extenuating circumstances, as determined by the county administrator, the county administrator or designee, at his or her discretion, may approve food and non-alcoholic beverage expenses after the expense has been paid. Chief judge shall mean the chief judge of Florida's Nineteenth Judicial District. Clerk shall mean the clerk of the circuit court and county court of Florida's Nineteenth Judicial District and accountant to the board of county commissioners. County shall mean the incorporated and unincorporated areas of St. Lucie County, Florida. Defendant shall mean a person charged with a criminal action pursuant to Chapter 839, Florida Statutes. (Ord. (a) Pursuant to Section 893.13, Florida Statutes, the court may assess any defendant, on or after February 1, 1989, who is found guilty of, or pleads nolo contendere to, a violation of any provision of Chapter 893, Florida Statutes, or which involves a criminal violation of Section 316.193, Section 856.011, Section 856.015, or Chapter 562, Chapter 567, or Chapter 568, Florida Statutes, in addition to any fine and other penalty imposed by law for any criminal offense under this chapter or for any criminal violation of Section 316.193, Section 856.011, Section 856.015, or Chapter 562, Chapter 567, or Chapter 568, Florida Statutes, an amount up to the amount of the fine authorized for the violation. Such additional assessment shall be used for alcohol and other drug abuse programs as provided by general law and this article. Pursuant to Section 893.13, Florida Statutes, the court is authorized to order a defendant to pay such assessment if it finds that the defendant has the ability to pay the fine and the additional assessment, and the defendant will not be prevented from being rehabilitated or from making restitution. (b) Once assessed, the clerk will keep a record of assessments and those assessments shall be collected by the clerk. The clerk shall forward all monies collected to the board of county commissioners for deposit into a special and separate account titled "alcohol and other drug abuse trust fund." Once each month, the board of county commissioners shall require a full report from the clerk as to the amount of assessments imposed by its courts, the amount of funds collected and deposited into the alcohol and other drug abuse trust fund, and amount of expenditures from the alcohol and other drug abuse trust fund. This article is enacted pursuant to the authority vested in the board of county commission- ers by virtue of Section 98 of Chapter 2002-20, Laws of Florida known as the "Dori Slosberg Driver Education Safety Act". (Ord. No. 02-17, Pt. A, 6-18-02) Sec. 1-7-31. Definitions. For the purpose of this article, the following terms have only those meanings ascribed to them: Board of county commissioners shall mean the board of county commissioners of St. Lucie County, Florida. Clerk shall mean the clerk of the circuit court and county court of St. Lucie County and accountant to the board of county commissioners. County shall mean the incorporated and unincorporated areas of St. Lucie County, Florida. (Ord. No. 02-17, Pt. A, 6-18-02) Sec. 1-7-32. Creation of fund and accounting. Once each quarter, the board of county commissioners shall require a full report from the clerk as to the amount of funds collected and deposited into the Driver Education Safety Trust Fund, and amount of expenditures from the Driver Education Safety ~ust Fund. The members of this historical commission shall receive no compensation, but may be reimbursed for traveling expenses as provided in section 112.061, Florida Statutes. Members of the historical commission shall not receive directly or indirectly any grant funded in whole or part by the board of county commissioners. (Ord. No. 91-10, Pt. A, 6-11-91) Sec. 1-16-44. Meetings; rules. The board of directors of the historical commission shall meet at an appropriate place and shall arrange a time for holding regular meetings and such other meetings as shall be necessary. The board of directors of the historical commission may adopt such by-laws as it deems necessary, subject to the approval of the board of county commissioners, and it may determine the duties of its members and employees. Duties-Collection of data, etc. The historical commission shall encourage the collection, arrangement, recordation, and preservation of historical material and data, including books, pamphlets, maps, charts, manuscripts, family histories, United States Census records, papers, and other objects and material illustrative of and relating to the history of the county and of Florida. The historical commission shall procure and preserve narratives and material of every description relative to the history of St. Lucie County and of Florida for deposit at museums owned and/or operated by St. Lucie County. The historical commission shall obtain the approval of the leisure services administrator or his designee prior to the deposit of any narrative or material at any museum owned and/or operated by the county. The historical commission may, upon its own initiative or upon petition of historical societies, mark by proper monuments, tablets, or markers, the location of forts, Indian mounds, or other places in the county. Before any monument, tablet, or marker shall be placed or erected on county property, the board of county commissioners shall obtain from the historical commission a recommendation concerning design and content. Disposition of Surplus R.eal Property, §§ 1-16.2-1-1-162-6 AR,TICLE I. DISPOSITION OF SUR,PLUS REAL PROPERTY Sec. 1-16.2-1. Purpose. This article is created for the purpose of establishing a method of disposition of surplus County real property in accordance with section 125.35(3), Florida Statutes. (Ord. No. 02-18, Pt. B, 6-18-02) Sec. 1-16.2-2. Declaration of surplus property. (a) When the board of county commissioners finds that any real property owned by the county is unusable or not needed for county purposes, the board may declare the real property to be surplus property. Once the property is declared surplus, the property may be sold, dedicated, donated or otherwise conveyed to interested parties pursuant to the terms of this article. The declaration of surplus property shall be recorded in the minutes of the board. (b) Once the real property is declared surplus by the board of county commissioners, the county administrator or designee shall have the authority to sell the property to the highest and best bidder. A deed transferring the property to the highest and best bidder shall be presented to the chairman of the board of county commissioners for signature without any further approval of the board being required. The county administrator or designee shall have the authority to reject all bids if the bids are determined to be too low or not in the best interest of the county. In the event the county administrator or designee desires to transfer the property to a person other than the highest and best bidder, the matter shall be presented to the board for approval. (Ord. ~~o. 02-18, Pt. B, 6-18-02) Sec. 1-162-3. Process by which interested persons may acquire surplus property. (a) Any person, corporation, governmental body, or other legal entity may request to acquire surplus real property by submitting a letter of interest to the county administrator or designee. The letter shall include the following information: (1) Name of the person or legal entity interested in the property; (2) The reason for acquiring the property, i.e., personal, charitable, governmental, etc.; (3) The proposed purchase price; (4) The legal description, the alternate key number and, if available, the street address of the property; and (5) Any other information the person deems relevant. Supp. No. 61 855 § 1-162-3 ST. LUCIE COUNTY CODE (b) Upon receipt of the letter of interest, the county administrator or designee shall verify whether the property has in fact been declared surplus. If the property has not been declared surplus, the county administrator or designee shall make a determination as to whether the property is needed for county purposes. If the property is no longer needed, then the county administrator or designee shall request the board of county commissioners to declare the property surplus. Once the property is declared surplus, then the county administrator or designee shall seek to dispose of the property in accordance with the standards of competition set forth in this article. (c) The county may, on its own initiative, dispose of surplus property by following the standards of competition. (Ord. No. 02-18, Pt. B, 6-18-02) Sec. 1-162-4. Standards of competition and notice of disposal (a) For real property valued more than $25,000.00, as appraised by the property appraiser's office, the county may sell the property to the highest and best bidder. Notice calling for bids shall be published in a newspaper of general circulation once each week for two (2) consecutive weeks. The county shall have the option to convey the property to the highest bidder or reject all bids. This procedure applies regardless of whether the surplus property is being disposed of on the county's own initiative or upon receiving a letter of interest. (b) For real property valued at $50,000.00 or more, as appraised by the property appraiser, the county shall have the property re-appraised by a fee appraiser designated by a fee appraiser designated by the county. (c) Alternatively, for real property appraised under $25,000.00 by the property appraiser's office, the county may negotiate the private sale of the property to an interested person. The county shall send notice to all adjacent property owners by certified mail indicating the county's desire to dispose of the real property. If, within ten (10) business days after receiving such notice, any adjacent property owners indicate their desire to purchase the property, the county shall accept sealed bids for the property from the interested parties. The county may then convey the property to the highest bidder or reject all bids. This procedure applies regardless of whether the surplus property is being disposed of on the county's own initiative or upon receiving a letter of interest. (d) The county, regardless of the appraised value of the property, may convey such property to another governmental entity or charitable institution at a private sale for such price as the board of county commissioners may fix. The conveyance shall be done in accordance with section 125.38, Florida Statutes. (Ord. No. 02-18, Pt. B, 6-18-02) Sec. 1-16.2-5. Negotiation procedures. (a) In negotiating the terms and conditions of the disposal of surplus property, the county administrator or designee shall take into consideration the following factors: (1) The appraised value of the real property; Supp. No. 61 856 PUBLIC PROPERTY § 1-16.2-6 (2) The condition of the real property, and the e~rtent to which the party seeking to acquire the property will have to expend funds to make the property useable, or, to bring the property into compliance with the St. Lucie County Code of Ordinances; and (3) The proposed use of the party seeking to acquire the property. (b) In no event shall the disposition of surplus property violate the St. Lucie County Comprehensive Plan or the zoning regulations of St. Lucie County, Florida. (Ord. No. 02-18, Pt. The county administrator or designee shall publish a notice in a newspaper of general circulation once at least twenty (20) days prior to the board of county commissioners' hearing in which the real property is to be declared surplus. The notice shall contain a description of the surplus property sought to be disposed of, the name of the county administrator or designee to which objections shall be addressed, and the date of the regular meeting of the board in which proposed final action is to be taken. Objections to the final disposition of surplus property shall be made in writing no later than ten (10) days prior to the final disposition and shall be given to the board prior to making its final decision.
