AR,TICLE I. ART IN PUBLIC PLACES
Sec. 1-4.5-1. Definitions.
For the purpose of this article, the following words or terms are defined as follows:
Artwork means works in a variety of inedia produced by professional visual artists. Works
may be permanent, temporary or functional.
Board means the Board of County Commissioners for St. Lucie County, Florida.
Capital project means any county capital improvement project costing more than fifty
thousand dollars ($50,000.00) and paid for wholly or in part by funds appropriated by St. Lucie
County to construct or renovate any park, above grade utility, and to construct or renovate any
building, except a county detention facility.
County means St. Lucie County, Florida. For the purposes of this article, the St. Lucie
County Erosion District and the St. Lucie County Mosquito Control District are specifically
excluded from the definition of "County".
Council means the St. Lucie Cultural Affairs Council.
Eligible construction costs means the total project appropriation of county funds for an
eligible project, including engineering and design, but not including demolition costs, equip-
ment costs except for the cost of custom designed equipment or equipment that creates a new
use for a building or facility, real property acquisition costs, impact fees, enterprise funds,
funds contributed by the St. Lucie County Erosion District and/or the St. Lucie County
Mosquito Control District, and soil remediation costs.
Equipment costs means, for the purposes of the public art/design and transportation
enhancement project calculation, those costs for the acquisition of inechanical equipment of
standard manufacture.
Master plan means a manual of criteria for the selection of sites and artwork and
transportation enhancement projects for public capital and transportation facilities to be
developed by the council with public input and approved by the board prior to its implemen-
tation. This manual shall also provide for a comprehensive program for art in public places
which shall include the display of loaned art in appropriate public buildings.

§ 1-4.5-1 ST. LUCIE COUNTY CODE
Renouation means a capital project or transportation capital project which is a major
redesign of a facility or system or a portion of a facility or system which is included in the
county's capital program budget and which requires a building permit from the appropriate
governmental jurisdiction. Renovation shall also include a capital project or transportation
capital project which is an expansion or upgrading the capacity of the facility or system,
enlarging the facility, or creating new use for the facility. It shall not include repairs,
maintenance, installation of inechanical equipment, or modifications required solely for ADA
compliance.
Transportation capital project means any county capital transportation improvement
project costing more than fifty thousand dollars ($50,000.00) and paid for wholly or in part by
funds appropriated by St. Lucie County to construct or renovate any highway or arterial,
bridge or causeway, sidewalk, or bikeway, aviation-related, or any road beautification project.
Transportation enhancement project means one (1) or more of the following projects,
prioritized in the following order:
(1) Visual enhancement of facilities for pedestrians and bicycles.
(2) Scenic or historic highway programs, including the provision of tourist and welcome
center facilities.
(3) Landscaping and other scenic beautification projects.
(4) Historic preservation.
(5) Rehabilitation and operation of historic transportation buildings, structures, or
facilities, including historic railroad facilities.
(6) Preservation of abandoned railway corridors, including the conversion and use thereof
for pedestrian or bicycle trails.
Trust fund means the art in public places trust fund created pursuant to this article and
shall include a11 gifts and donations deposited in the trust fund.

Sec. 1-4.5-2. Art in public places program.
(a) Appropriations for county capital projects shall include an amount equal to two (2) per
cent of the total eligible construction costs to be used for artist design services and for the
selection, acquisition and display of artworks for related education programs, for the
maintenance of county artworks, and for the administration of the master plan. Funds
appropriated pursuant to this section shall not exceed one hundred thousand dollars
($100,000.00) per project. Funds appropriated for one (1) capital project, but not deemed
necessary or appropriate by the council in whole or in part for that project, may be expended
on other public art projects approved under the annual master plan, subject to any bond

restrictions and legal or grant restrictions. Bond funds shall be appropriated and accounted for
in the bond capital project accounts. All county agencies may opt to participate in the art in
public places program for any improvement project not otherwise subject to this article.
(b) Appropriations for transportation capital projects shall include an amount equal to one
(1) per cent of the total eligible construction costs to be used for site specific transportation
enhancement projects, including artist design services for such projects, for the maintenance

ARTICLE I. IN GENERAL
Sec. 1-7-1. Additional costs for law enforcement training.
Every court in the county, created by Article V of the State Constitution shall assess two
dollars ($2.00) pursuant to section 938.15, Florida Statutes, in addition to the three dollars
($3.00) assessed by section 938.01(1), Florida Statutes, as a court cost against every person
convicted for violation of a state penal or criminal statute or convicted for violation of a
municipal or county ordinance or non-criminal infraction. However, no such assessment shall
be made against any person convicted for violation of any state statute, municipal ordinance,
or county ordinance relating to the parking of vehicles. All such costs collected by the aforesaid
courts shall be deposited in a special grant fund of the county to be used for law enforcement
training expenditures by said county.

Sec. 1-7-2. Circuit court-Civil division service charges.
The party instituting any civil action, suit or proceeding in the circuit court shall pay to the
clerk of the court service charges as follows:

Sec. 1-7-3. Circuit court-Probate and guardianship division service charges.
The service charges of the clerk of the circuit court for filing probate and guardianship cases
are as follows:
(a) For the opening of any estate of one document or more, including but not limited to
petitions and orders to approve settlement of minor's claims; to open a safe deposit box;
to enter rooms and places; for the determination of heirs if not formal administration
and for a foreign guardian to manage property of a nonresident, but not to include
issuance of letters or order of summary and family administration:

NOISE CONTROL*
Sec. 1-13.&1. Egcessive, unnecessary, etc., noises prohibited; violation generally.
It shall be unlawful for any person to make, continue, or cause to be made or continued any
excessive, unnecessary or unusually loud noise or any noise which either annoys, disturbs,
injures or endangers the comfort, repose, health, peace or safety of others, within the
unincorporated areas of the county. Failure to comply with this chapter shall constitute a
violation of this Code.

Sec. 1-13.8-16. Terminology, standards, and definitions.
(a) All technical acoustical terminology and standards used in this article which are not
defined below shall be read or constructed in conformance with the American National
Standards Institute, Inc., ("ANSI") publication entitled "Acoustical Terminology", designated
as ANSI Sl.1-1960, or its successor publication.
(b) For the purposes of this chapter, the following definitions shall apply:
Ambient noise is the all-encompassing noise associated with a given environment, being
usually a composite of sounds from many sources, near and far, independent of any single,
identifiable noise source.
Bel is a unit of level when the base of logarithm is ten (10). Use of the Bel is restricted to
levels of quantities proportional to power.
Boat is every description of watercraft, barge and airboat used or capable of being used as
a means of transportation on water, mode of habitation or a place of business or professional
or social association on the water of the unincorporated areas of St. Lucie County including,
but not limited to:
(1) Foreign and domestic watercraft engaged in commerce;
(2) Passenger or other cargo-carrying watercraft;
(3) Privately owned recreational watercraft;

(4) Airboats and seaplanes;
(5) Houseboats or other floating homes.
Decibel is a unit for measuring the volume of a sound, equal to twenty (20) times the
logarithm to the base ten (10) of the ratio of the pressure of the sound measured to the
reference pressure, which is twenty (20) micropascals (twenty (20) micronewtons) per square
meter.
Discrete tone is the condition of a noise source in which sharp, piercing or hum-like steady
tones occur in the octave noise spectrum.
Downwind gradient is within plus or minus forty-five (45) degrees of the wind direction
connecting the center of the noise source and the center of the received, with the wind blowing
from source to receiver. The wind speed is given as up to eleven (11) mph (5m/sec).
Emergency work is work made necessary to restore property to a safe condition following a
public calamity or work required to protect persons or property from an imminent exposure to
danger.
Frequency of a function periodic in time is the reciprocal of the primitive period. The unit is
the cycle per unit time and must be specified.
Ldn leuel is the twenty-four (24) Leq level in an environment in which all the ambient sound
and other noises at night (defined as 10:00 p.m. to 7:00 a.m.) are added up as ten (10) dB(A)
above actual noise level.
Leq level is the level of the time-weighted, mean-square, A-weighted sound pressure.
Stationary noise sources are measured, in terms of octave band Leq, for a minimum of ten (10)
minutes of operation. The background sound level measured for a minimum of five (5) minutes
with the source off, must be subtracted from the Leq level in each of the nine (9) octave
frequency bands.
Person is any person, person's firm, association, copartnership, joint venture, corporation or
any entity, public or private in nature.
Sound level meter is an instruxnent including a microphone, an amplifier, an output meter
and frequency weighting networks for the measurement of noise and sound levels in a specified
manner.
Sound pressure level in decibels of sound is twenty (20) times the logarithm to the base ten
(10) of the ratio of the pressure of this sound to the reference pressure, which reference
pressure must be explicitly stated.

Sec. 1-13.8-17. Classification of use districts.
For purposes of defining the "use occupancy," all premises containing habitually occupied
sleeping quarters shall be considered in residential use. All premises containing transient
commercial sleeping quarters shall be considered commercial use. All premises containing

businesses where sales, professional or other commercial use is legally permitted shall be
considered commercial use. All premises where manufacturing is legally permitted shall be
considered industrial use. In cases of multiple use, the more restrictive use category shall
prevail. Hospitals, nursing homes, schools, libraries, churches and all institutional uses shall
be considered residential uses. Any area not otherwise classified shall conform to commercial
standards.

Sec. 1-13.8-18. Maximum permissible sound levels and vibration levels by use dis-
trict.
(1) It shall be unlawful to project a sound or noise from one property into another property
within the boundary of the use district which exceeds either the limiting noise spectra set forth
in Table 1 below or exceeds the ambient noise level by more than three (3) decibels for any
minimum part of a measurement period which measurement period shall not be less than sixty
(60) seconds when measured as specified under the noise enforcement practices as adopted by
the board of county commissioners by resolution.
(2) (a) Sound or noise projecting from one (1) use district into another use district with
a different noise level limit shall not exceed the limits of the district into which
the noise is projected. For the purpose of this section, "day" shall be considered to
be from 7:00 a.m. to 10:00 p.m., and "night" shall be considered to be from 10:01
p.m. to 6:59 p.m.
(b) Unless provided otherwise, such sound that tests in excess of any such sound
affected site specific applicable resultant value, after applying all site-specific
impulse sound and /or pure tone (character of sound) adjustments, shall be a
violation of this article.
(c) Corrections for character of sound:
1. Steady pure tone. For each sound that is a steady pure tone, the applicable
maximum sound level limits set forth in Table 1 shall be reduced by five (5)
decibels at sound-affected sites/units in residential use districts.
2. Non-repetitive impulsive sound. For any non-repetitive impulsive sound (up to
five (5) impulses in an hour), the ma~cimum sound level limits set forth in Table
1 shall be increased by ten (10) decibels from 7:00 a.m. to 10:00 p.m.

(3) It is a violation of this article to operate, permit, of suffer operation or use of any
industrial, manufacturing and/or commercial device, facility, operation, or process that causes
any vibrations which exceed the applicable displacement(s) in inches specified in Tables 2 and
3 below, at the property boundary of, or within, any vibration affected site or unit in a
residential use district. Steady state vibrations are continuous or occur in discrete pulses more
frequently than 100 impulses per minute. Discrete pulses that do not exceed 100 impulses per
minute must not cause displacement in excess of twice the applicable value(s) in Tables 2 or
3. Impact vibrations occur in discrete pulses which are separated by a time interval of at least
one minute and which occur no more than eight times in any 24-hour period. These vibrations
regulations do not apply to activities conducted pursuant to, and to the extent authorized by,
blasting permits issued by the board or any other governmental entity that is authorized to
issue such permits.

(a) The following standards shall be used, as applicable, to measure vibrations: ISO-2631
(Mechanical vibrations and shock B Evaluation of human exposure to whole body
vibration); ANSI 522-1959 (R1990) (Calibration of shock and vibration pickups); ANSI
52.61-1989 (ASA 78) (Mechanical mounting of accelerometers); ANSI 524.21-1957
(R1989) Characteristics of shock and vibration measurements).
(b) A three-component measuring system shall be used to measure vibrations. The testing
system shall measure earth borne vibrations in three directions, each of which occurs
at right angles to the other two (2).

Sec. 1-13.8-19. Exemptions.
(1) The following uses and activities shall be exempt from noise level regulations:
(a) Noises of safety signals, warning devices, and emergency pressure relief valves.
(b) Noises resulting from any authorized emergency vehicle, when responding to an
emergency call or acting in time of emergency.
(c) Noises resulting from emergency work as defined in section 1-13.8-16.

(d) Noise resulting from the operation of any type of aircraft, not including scale model
aircraft.
(e) Noise resulting from the operation of any motor vehicle as specified in Chapter 316 and
Chapter 403, Florida Statutes.
(f) Noise resulting from the operation of the following facilities existing and in operation
on the effective date of this chapter:
1. Electricity regulating substations.
2. Electric generation plants.
3. Other electric utilities.
4. Gas pressure control stations.
5. Gas production plants.
6. Natural or manufactured gas storage and distribution points.
7. Other gas utilities.
8. Pipeline pressure control stations.
9. Railroad, rapid rail transit, and street railway transportation.
10. Industrial wastewater disposal.
11. Sewage disposal.
12. Sewage pressure control stations.
13. Sewage treatment plants.
14. Sewage sludge drying beds.
15. Water utilities and irrigation.
16. Solid waste disposal.
(g) Noise resulting from agricultural activities in districts zoned agricultural (AG) under
section 3.3.117, St. Lucie County Zoning Ordinance, and agricultural, residential-1
(AR-1), under section 3.3.101, St. Lucie County Zoning Ordinance.
(h) Noise resulting from the operation of the engine of any boat on the waters of the
unincorporated areas of the county.
(i) Noises resulting from any authorized law enforcement and firefighting training
activities including, but not limited to, sheriff department shooting range exercises.
(j) Noise resulting from the activities of any permitted use, conditional use or accessory
use permitted in districts zoned industrial, light (IL) under section 3.3.114, St. Lucie
County Zoning Ordinance, industrial, heavy (IH) under section 3.3.115, St. Lucie
County Zoning Ordinance, and industrial, extraction (IX) under section 3.3.116, St.
Lucie County Zoning Ordinance, existing and in operation on the effective date of this
chapter.

(k) Noise resulting from the temporary operation of equipment or activities relating to
normal maintenance of residential or commercial uses, between the hours of 7:00 a.m.
and 10:00 p.m. including, but not limited to, the following activities: lawn mowing,
maintenance of trees, hedges, and gardens; refuse collection; soil cultivation; and
pavement sweeping and cleaning.
(1) Noise resulting from the operation of any mining activities under a permit issued
pursuant to Chapter 1-12.5 of this Code. The hours of operation shall be limited to the
hours set forth in the permit.
(m) Noise resulting from the operation of railways and shipping activities.
(n) Noise resulting from construction activities occurring between 7:00 a.m. and sundown.
The exemption shall be effective upon obtaining a building permit and shall pertain to
any construction activity directly related to the construction authorized under the
permit. A special permit issued pursuant to section 1-13.8-20 shall be required for the
generation of noise resulting from construction activities between sundown and 7:00
a.m. For any violation of the terms of the special permit, the permit holder and the
violator shall be jointly and severally liable.
(o) Any other noise resulting from activities of a temporary duration permitted by law and
for which a license or permit therefor has been granted by the board of county
commissioners in accordance with section 1-13.8-20.
(2) Where an industrial or commercial use is established on property not adjacent to a
residential use district and the adjacent property subsequently becomes residential, the noise
resulting from the operation of the pre-existing industrial or commercial use which is projected
into the residential use district shall be subject to the permissible noise levels for industrial or
commercial use districts, as appropriate.
(3) Where the noise levels for pre-existing use are more restrictive than those for a
subsequent use established adjacent to the pre-existing use, the noise level for the pre-existing
use shall apply.

Sec. 1-13.8-20. Application for special permit.
Application for a permit for relief from the noise level designated in this chapter on the basis
of undue hardship may be made to the board of county commissioners. Any permit granted by
the board hereunder shall contain all conditions upon which the permit has been granted and
shall specify a reasonable time that the permit shall be effective. The board may grant the
relief as applied for if it finds:
(1) That additional time is necessary for the applicant to alter or modify his activity or
operation to comply with this chapter; or
(2) The activity, operation or noise source will be of temporary duration and cannot be
done in a manner that would comply with other sections of this chapter.

(3) That no other reasonable alternative is available to the applicant; and
The board of county commissioners may prescribe any conditions or requirements it deems
necessary to minimize adverse effects upon the community or the surrounding neighborhood.

Sec. 1-13.8-21. Penalties.
Violation of this chapter is a misdemeanor pursuant to Section 125.69, Florida Statutes, and
is punishable under said section by imprisonment for up to sixty (60) days, or a fine of up to
five hundred dollars ($500.00) or both such imprisonment and fine.
