AR,TICLE I. IN GENERAI.
Sec. 1-2-1. Authority to offer rewards for arrest and conviction of persons violating
laws or ordinances.
The board of county commissioners is authorized to offer and pay rewards for the arrest and
conviction of persons violating any state law or county ordinance, or regulation.

Sec. 1-2-2. E911 system; local option fee.
(a) Public purpose. The establishment of an E911 system in St. Lucie County, Florida, is
declared to be a public purpose and for the benefit of the citizens of St. Lucie County, as well
as for visitors to the county.
(b) Local option fee:
(1) There is hereby imposed a local option fee for E911 service and equipment, in the
amount of fifty cents ($0.50) per month per access line, up to a maximum of twenty-five
(25) access lines per account bill rendered to be paid by the local exchange subscribers
in the county beginning on the next billing date of the telephone company following the
effective date of this section.
(2) The county shall report to the state division of communications, current 911 fee on or
before October 30 of each year. Any fee adjustment shall be reported to the state
division of communications.

(c) Separate fund. The budget and management administrator and finance director are
directed to establish a separate fund specifically for the receipt and expenditures fees related
to the E911 system. All fees placed in such fund shall be used only for 911 costs described in
Section 365.171(13)(1)6, Florida Statutes.
(d) 911 budget. The money collected and interest earned in the separate fund shall be
appropriated for 911 purposes by the board of county commissioners and incorporated into the
annual county budget. No more than ten (10) per cent of the 911 fee billed for the prior year
may be carried forward. The amount of moneys carried forward each year may be accumulated
in order to allow for capital improvements. The carryover shall be documented by resolution
of the board expressing the purpose of carryover or by an adopted capital improvement
program identifying projected expansion or replacement expenditures for 911 equipment and
service features, or both. In no event shall the 911 fee carryover surplus moneys be used for
any purpose other than for the E911 equipment service features and installation charges
authorized in Section 365.171 (13)(a)6, Florida Statutes.
(e) Collection of fee, payment of administrative fee for collection. Southern Bell Telephone of
Florida, Inc., (hereinafter called the telephone company), is hereby requested to collect the fee,
as hereinabove set forth, from its subscribers in the county, such telephone company to retain
as an administrative fee an amount equal to one (1) percent of the fees collected by the
telephone company. The administrative fee shall be first deducted by the telephone company
from the fees collected and the remainder of such fees collected shall be remitted to the county
or retained by the telephone company and applied on the cost of the E911 service and
equipment. In either event, the telephone company shall supply monthly to the county a
statement as to fees collected. The telephone company shall provide quarterly to the county a
list of the names, addresses, and telephone numbers of any and all subscribers who have
identified to the telephone company their refusal to pay the 911 fee. The telephone company
shall have no obligation to take legal action to enforce collection of such fee.
(f) Indemni~cation.
(1) St. Lucie County shall indemnify the telephone company against liability in accor-
dance with the telephone company's lawfully filed tariffs unless the telephone
company acted with malicious purpose or in a manner e~ibiting wanton and willful
disregard of human rights, safety, or property in providing service.
(2) The county shall remain liable to the telephone company for any E911 service,
equipment, operation, or maintenance charge owed by the county to the telephone
company.

ADMINISTRATION § 1-2-63
Sec. 1-2-62. De~nitions.
As used in this article, the following words shall have the following meaning:
Board means the board of county commissioners of the county.
Clerk means clerk of the circuit court for the county.
County means St. Lucie County, Florida.
County attorney means the person appointed by the board to serve as its counsel, or the
designee of such person.
Lobbyist means a person who advocates, urges or seeks to encourage the passage, defeat or
modification of any item pending before the board or the hiring/retaining of any consultant for
any paid or promised compensation or valuable consideration either directly or indirectly,
expressly or implied.
Person means an individual, corporation, governmental agency, business trust, estate, trust,
partnership, association, two (2) or more persons having a joint or common interest, or any
other legal entity.
Professional consultant means an independent contractor who provides assistance in
support of county operations in one (1) of the following professional fields:
(1) Medical services. Medicine, psychiatry, dental, hospital, and other health profession-
als.
(2) Legal services. Attorneys and legal professionals.
(3) Financial services. Bond counsel, rating and underwriting, financial advisor, and
investment services.
(4) Architect and engineering seruices. Architect, engineering, landscape architecture, or
land surveying services.
(5) Appraisal services. Real and personal property appraisers.
(6) Audit and accounting seruices. Auditors and accountants.
(7) Consultants. Planning, management, or scientific advisors.

Sec. 1-2-63. Disclosure of lobbyists by professional consultant required.
(a) No professional consultant shall submit any proposal to the board for the performance
- of any services unless full disclosure is made prior to or concurrently with the submission of
the proposal. The disclosure requirements herein shall be continuing, and the consultant shall

have the obligation to amend any disclosure filed or file appropriate disclosures with the clerk
upon utilization of the services of a lobbyist as defined herein whether same occurs before or
after the employment of the consultant. Such disclosure shall include the following:
(1) The name of any lobbyist, employed directly or indirectly by the consultant for the
purpose of influencing or attempting to influence the selection of the professional
consultant by the board.
(2) The name and address of the lobbyist.
(3) The length of such agreement, contract or understanding and the amount of any fee,
gratuity, compensation or consideration paid or promised to be paid to the lobbyist
either before or after hiring whether or not same is set out as compensation for the
lobbying or is for other services.
(b) The disclosure shall be filed with the clerk on forms provided by the county and such
records shall be open to the public.

Sec. 1-2-64. Lobbyist registration and reporting requirements.
(a) A lobbyist who receives compensation directly or indirectly on an item before the board
shall register with the clerk prior to engaging in any lobbying activity within the county or
with any commissioner or county employee unless such representation has been publicly
announced or will be publicly announced prior to commission action. This shall be a continuing
requirement. Every person required to register as a lobbyist shall register on forms provided
by the county and shall state under oath his name, business address, and the name and
business address of each principal represented. A separate registration form shall be required
for each principal represented. All registrations shall be open to the public.
(b) A lobbyist, when in doubt about the applicability and interpretation of this section in a
particular context, shall submit, in writing, the facts for an advisory opinion to the county
attorney. All advisory opinions of the county attorney shall be numbered, dated and furnished
to the board and shall be open to public inspection.
(c) The clerk shall keep all advisory opinions of the county attorney relating to lobbyists and
lobbying activities, as well as a current list of registered lobbyists and their respective reports
required under this section, all of which shall be open for public inspection.

Sec. 1-2-65. Exemptions.
The following persons shall not be required to register as lobbyists:
(1) County employees acting in the scope of their county employxnent;
(2) Law enforcement personnel conducting an investigation; and

(3) Persons who communicate with board members to express support of or opposition to
any item pending before the board in their individual capacity for the purpose of
self-representation, or on behalf of their immediate family, without compensation or
reimbursement.

Sec. 1-2-66. Definitions.
As used in this article, the following terms shall be defined as follows:
Board shall mean the Board of County Commissioners of St. Lucie County, Florida.
County shall mean St. Lucie County, Florida, a political subdivision of the State of Florida.
Facilities shall mean those public facilities or publicly operated facilities determined by the
board to be critical to security or public safety.
FBI shall mean the Federal Bureau of Investigation.
FDLE shall mean the Florida Department of Law Enforcement.
Private contractor shall mean any private contractor, employee of a private contractor,
vendor, repair person, or delivery person.

Sec. 1-2-67. Criminal history record check for certain employees and appointees.
(a) In accordance with Section 125.5801, Florida Statutes, the county shall require
employment screening as provided in this article for any position of county employment or
appointment which the board finds is critical to security or public safety. The board shall adopt
a resolution, which may be amended from time to time, setting forth a list of such positions.
(b) Each person applying for, or continuing employment, in any such position shall be
fingerprinted. The fingerprints shall be submitted to the FDLE for a state criminal history
record check and the to the FBI for a national criminal history record check.
(c) The county shall use the information obtained from the criminal history record checks
conducted pursuant to this article to determine an applicant's eligibility for employment or
appointment and to determine an employee's eligibility for continued employment. Except as
otherwise provided herein, the county administrator, or his designee, shall be responsible for
this determination. The county attorney shall be responsible for a making a recommendation
to the board with regard to criminal history record checks obtained for applicants for the
position of county administrator or an existing county administrator's continued employment.

§ 1-2-68 ST. LUCIE COUNTY CODE
Sec. 1-2-68. Criminal history record check for certain private contractors.
(a) In accordance with Section 125.5801, Florida Statues, the county shall require screen-

harboring or having control or custody of one (1) or more animals including any custodian or
other person in charge of an animal or if the owner is under the age of eighteen (18), that
person's parent or guardian. An animal shall be deemed to be harbored if it is fed or sheltered
for five (5) consecutive days or more.
Public nuisance.
(1) Any animal which:
a. Attacks passersby or passing vehicles without provocation;
b. Attacks any other animal;
c. Is repeatedly at large and not under restraint;
d. Damages private or public property;
e. Repetitively barks, whines, howls, chirps, caws, or whistles for a period of five (5)
minutes or more so as to disturb adjacent residents, except animals located on
property zoned AG-1, AG-2.5, AG-5, PUD where livestock is permitted, or
property on which livestock is permitted as a nonconforming use; or
£ Causes an annoyance in the neighborhood by acts such as overturning garbage
cans, defecating, digging holes on other than its owner's property, or such other
acts as are generally regarded to create an annoyance.
(2) Any activity, such as, but not limited to, the feeding of wild animals or fowl, which:
a. Causes the fouling of the air by odor and thereby creates unreasonable annoyance
or discomfort to those in close proximity to the premises where the animals or
fowl congregate; or
b. Causes a sanitary nuisance as defined in Section 386.01, Florida Statutes.
Secure enclosure. Secure confinement indoors or in a securely enclosed and locked pen or
structure, suitable to prevent the animal from escaping.
Under restraint. Any animal secured by a leash or lead.
Uicious animal. Any fierce or dangerous animal that constitutes a physical threat to human
beings or other animals; or any animal for which the animal control officer has documentation
to establish that the animal has bitten any person or other animal on two (2) separate
occasions without provocation within a period of one (1) year.

Sec. 1-4-17. Public nuisance prohibited.
It shall be unlawful for any owner to permit his or her animal to become a public nuisance
or for any individual to create a public nuisance as defined herein.

Sec. 1-4-18. Animals in estrus.
Any dog or cat in estrus must be humanely confined in a building or secure enclosure in such
a manner that such dog or cat cannot come into contact with another animal except for planned
breeding.

Sec. 1-4-19. Vicious animals.
It shall be unlawful for any owner to keep any vicious animal within the county unless it is
confined within a secure building or secure enclosure or unless it is securely muzzled and
under restraint.

Sec. 1-4-20. Dangerous dogs.
(a) Adoption of Sections 767.10 through 767.14, Florida Statutes, (1993 and 1994). Sections
767.10, Florida Statutes, through and including Section 767.14, Florida Statutes (1993), and
all subsequent amendments regulating dangerous dogs, as defined in Section 767.11(1),
Florida Statutes, are adopted by reference and incorporated herein and shall apply to the
unincorporated areas of the county.
(b) Fee. The annual fee for issuance of dangerous dog certificates of registration shall be
established by resolution of the board of county commissioners.
(c) Classification.
(1) The public safety manager shall investigate reported incidents involving any dog that
may be dangerous, as defined in Section 767.11(1), Florida Statutes, and shall, if
possible, interview the owner and require a sworn affidavit from any person, including
any animal control officer or enforcement officer, desiring to have a dog classified as
dangerous. Any dog that is the subject of a dangerous dog investigation, that is not
impounded by the county, shall be humanely and safely confined by the owner in a
securely fenced or enclosed area pending the outcome of the investigation and
resolution of any hearings related to the dangerous dog classification. The address of
where the animal resides shall be provided to the public safety manager. No dog that
is the subject of a dangerous dog investigation may be relocated or ownership
transferred pending the outcome of an investigation or any hearings related to the
determination of a dangerous dog classification. In the event that a dog is to be
destroyed, the dog shall not be relocated or ownership transferred.
(2) The public safety manager shall classify any dog as a dangerous dog in the event he
determines that the dog:
a. Has aggressively bitten, attacked, or endangered or has inflicted severe injury on
a human being on public or private property;
b. Has more than once severely injured or killed a domestic animal while off the
owner's property;

(a) The following standards shall be used, as applicable, to measure vibrations: ISO-2631
(Mechanical vibrations and shock B Evaluation of human exposure to whole body
vibration); ANSI 522-1959 (R1990) (Calibration of shock and vibration pickups); ANSI
52.61-1989 (ASA 78) (Mechanical mounting of accelerometers); ANSI 52421-1957
(R1989) Characteristics of shock and vibration measurements).
(b) A three-component measuring system shall. be used to measure vibrations. The testing
system shall measure earth borne vibratio:ns in three directions, each of which occurs
at right angles to the other two (2).

Sec. 1-13.8-19. Exemptions.
(1) The following uses and activities shall be exempt from noise and vibration level
regulations:
(a) Noise and vibration of safety signals, warning devices, and emergency pressure relief
valves.
(b) Noise and vibration resulting from any authorized emergency vehicles, when respond-
ing to an emergency call or acting in time of emergency.

(c) Noise and vibration resulting from emergency work as defined in section 1-13.8-16.
(d) Noise and vibration resulting from the operation of any type of aircraft, not including
scale model aircraft.
(e) Noise and vibration resulting from the operation of any motor vehicle as specified in
Chapter 316 and Chapter 403, Florida Statutes.
(f) Noise and vibration resulting from the operation of the following facilities existing and
in operation on the effective date of this chapter:
1. Electricity regulating substations.
2. Electric generation plants.
3. Other electric utilities.
4. Gas pressure control stations.
5. Gas production plants.
6. Natural or manufactured gas storage and distribution points.
7. Other gas utilities.
8. Pipeline pressure control stations.
9. Railroad, rapid rail transit, and street railway transportation.
10. Industrial wastewater disposal.
11. Sewage disposal.
12. Sewage pressure control stations.
13. Sewage treatment plants.
14. Sewage sludge drying beds.
15. Water utilities and irrigation.
16. Solid waste disposal.
(g) Noise and vibration resulting from agricultural activities in districts zoned AG-1
(Agricultural-1), AG-2.5 (Agricultural-2.5), AG-5 (Agricultural-5), and AR,-1 (Agricul-
tural, Residential-1) under Section 3.01.03 of the St. Lucie County Land Development
Code.
(h) Noise and vibration resulting from the operation of the engine of any boat on the
waters of the unincorporated areas of the county.
(i) Noise and vibration resulting from any authorized law enforcement and firefighting
training activities including, but not limited to, sheriff department shooting range
activities.
(j) Noise and vibration resulting from the activities of any permitted use, conditional use
or accessory use perxnitted in districts zoned industrial, light under Section 3.3.114, St.
Lucie County Zoning Ordinance, industrial, heavy (IH) under Section 3.3.115, St.

Lucie County Zoning Ordinance, and industrial, extraction (IX) under Section 3.3.116,
St. Lucie County Zoning Ordinance, existing and in operation on the effective date of
this chapter.
(k) Noise and vibration resulting from the temporary operation of equipment or activities
relating to normal maintenance of residential or commercial uses, between the hours
of 7:00 a.m. and 10:00 p.m. including, but not limited to, the following activities: lawn
mowing, maintenance of trees, hedges, and gardens, refuse collection; soil cultivation;
and pavement sweeping and cleaning.
(1) Noise and vibration resulting from the operation of any mining activities under a
permit issued pursuant to Chapter 1-12.5 of this Code. The hours of operation shall be
limited to the hours set forth in the permit.
(m) Noise and vibration resulting from the operation of railways and shipping activities.
(n) Noise and vibration resulting from construction activities occurring between 7:00 a.m.
and sundown. The exemption shall be effective upon obtaining a building permit and
shall pertain to any construction activity directly related to the construction autho-
rized under the permit. A special permit issued pursuant to section 1-13.8-20 shall be
required for the generation of noise and vibration resulting from construction activities
~ between sundown and 7:00 a.m. For any violation of the terms of the special permit,
the permit holder and the violator shall be jointly and severably liable.
(o) Any other noise and vibration resulting from activities of temporary duration permit-
ted by law and for which a license or permit therefor has been granted by the board of
county commissioners in accordance with section 1-13.8-20.
(p) Any noise and vibration resulting from golf course maintenance activities.
(2) Where an industrial or commercial use is established on property not adjacent to a
residential use district and the adjacent property subsequently becomes residential, the noise
and vibration resulting from the operation of the pre-existing industrial or commercial use
which is projected into the residential use district, shall be subject to the permissible noise and
vibration levels for industrial or commercial use districts, as appropriate.
(3) Where the noise and vibration levels for a pre-e~usting use are more restrictive than
those for a subsequent use established adjacent to the pre-existing use, the noise and vibration
levels for the pre-existing use shall apply.

Sec. 1-13.8-20. Application for special permit.
Application for a permit for relief from the noise and vibration levels designated in this
chapter on the basis of undue hardship may be made to the board of county commissioners.

Any permit granted by the board hereunder shall contain all conditions upon which the permit
has been granted and shall specify a reasonable time that the permit shall be effective. The
board may grant the relief as applied for if it finds:
(1) That additional time is necessary for the applicant to alter or modify his activity or
operation to comply with this chapter; or
(2) The activity, operation, or noise or vibration source will be temporary duration and
cannot be done in a manner that would comply with other sections of this chapter.
(3) That no other reasonable alternative is available to the applicant.
The board of county commissioners may prescribe any conditions or requirements it deems
necessary to minimize adverse effects upon the community or the surrounding neighborhood.

Sec. 1-13.8-21. Penalties.
Violation of this chapter is a misdemeanor pursuant to Section 125.69, Florida Statutes, and
is punishable under said section by imprisonment for up to sixty (60) days, or a fine of up to
five hundred dollars ($500.00) or both such imprisonment and fine.
