This article is adopted pursuant to section 125.01 and section 190.005, Florida Statutes, and
other applicable provisions of law.

Sec. 1-6.5-22. Established; boundaries.
The Pine Valley Community Development District is herewith established within the
following described external boundaries:
(a) Parcel I: Begin at a concrete monument at the northeast corner of Section 22, Township
36 South, Range 39 East, St. Lucie County, Florida; thence run north 89 degrees 45

(4) No publicly owned property that may be located or acquired within the legal
description of this community development district shall be assessed for, or obligated
in any way to pay for the infrastructure constructed, maintained, or operated by the
community development district described in section 1-6.5-151 above.
(5) The district shall take affirmative steps to provide for the full disclosure of information
relating to the public financing and maintenance of improvements to real property
undertaken by the district. Such information shall be made available to all e~sting
residents, and to all prospective residents, of the district. The district shall furnish
each developer of a residential development within the district with sufficient copies of
that information to provide each prospective initial purchaser of property in that
development with a copy, and any developer of a residential development within the
district, when required by law to provide a public offering statement, shall include a
copy of such information relating to the public financing and maintenance of imprave-
ments in the public offering statement.
(6) Following the establishment of the Creekside CDD, as provided for in sections
1-6.5-150 and 1-6.5-151 above, each contract for the initial sale of a parcel of real
property and each contract for the initial sale of a residential unit within the district
shall include, immediately prior to the space reserved in the contract for the signature
of the purchaser, the following disclosure statement in boldfaced and conspicuous tyge
which is larger than the type in the remaining text of the contract: "THE (Name of
District) COMMUNITY DEVELOPMENT DISTRICT MAY IMPOSE AND LEVY
TAXES OR ASSESSMENTS, OR BOTH TAXES AND ASSESSMENTS, ON THIS
PROPERTY, THESE TAXES AND ASSESSMENTS PAY THE CONSTR,UCTION,
OPERATION, AND MAINTENANCE COSTS OF CERTAIN PUBLIC FACILITIES
AND SERVICES OF THE DISTRICT AND AR,E SET ANNUALLY BY THE GOVERN-
ING BOARD OF THE DISTRICT. THESE TAXES AND A,SSESSMENTS ARE IN
ADDITION TO COUNTY AND OTHER LOCAL GOVERNMENTAL TAXES AND
ASSESSMENTS AND ALL OTHER TAXES AND ASSESSMENTS PROVIDED FOR
BY LAW."

Sec. 1-6.5-162. Powers.
The Celebration Pointe Community Development District shall have all those general
powers granted pursuant to F.S. § 190.011, and those special powers granted pursuant to F.S.
§ 190.012 (1) and (3). Consent is hereby given to the district to exercise those powers relating
to recreation and security contained in F.S. § 190.012 (2)(a) and (d), subject to the following
limitations:
(1) The Celebration Pointe Community Development District shall not provide water or
wastewater service to the lands located within or outside the boundaries of the district.
(2) The Celebration Pointe Community Development District shall not be authorized to
construct fire stations or provide for fire trucks or other vehicles and equipment
related thereto.

(a) The Celebration Pointe Community Development District will use its best efforts to
develop in an integrated fashion the traffic circulation, water, and sewer facilities on the
district property as one functional interrelated community.
(b) The Celebration Pointe Community Development District shall take no action which is
inconsistent with the comprehensive plan, ordinances or regulations of St. Lucie County.
(c) No publicly owned property that may be located or acquired within the legal description
of this community development district shall be assessed for, or obligated in any way to pay for
the infrastructure constructed, maintained, or operated by the community development
district described in section 1.6-5.160 above.
(d) The Celebration Pointe Community Development District shall take af~`irmative steps to
provide for the full disclosure of information relating to the public financing and maintenance
of improvements to real property undertaken by the district. Such information shall be made
available to all existing residents, and to all prospective residents, of the district. The district

shall furnish each developer of a residential development within the district with sufficient
copies of that information to provide each prospective initial purchaser of property in that
development with a copy, and any developer of a residential development within the district,

information relating to the public financing and maintenance of improvements in the public
offering statement.
(e) Following the establishment of the Celebration Pointe Community Development Dis-
trict, as provided for in sections 1-6.5-159 and 1-6.5-160 above, each contract for the initial sale
of a parcel of real property and each contract for the initial sale of a residential unit within the
district shall include, immediately prior to the space reserved in the contract for the signature
of the purchaser, the following disclosure statement in boldfaced and conspicuous type which
is larger than the type in the remaining text of the contract: "THE (Name of District)

GARBAGE, TRASH AND REFUSE § 1-9-91
(b) Written contracts for the collection of solid waste from improved property between a
service provider holding an annual permit issued by the county pursuant to Article III of
Chapter 1-9 of the St. Lucie County Code of Ordinances and the owner or occupant of any
improved property which were in effect prior to the adoption of this article may remain in effect
until revocation or the next expiration date of the service provider's annual permit.

Sec. 1-9-74. Collection by regulated contractors.
The service provided by regulated contractors pursuant to the service agreements is deemed
to provide a special benefit to residential property and commercial property. The service
agreements may authorize the accrual of interest on delinquent service fees. To the full extent
permitted by law, the service agreements may authorize regulated contractors to impose a lien
against residential property as to which service fees are delinquent in the amount of such
delinquent service fee, plus interest to the date of payxnent.

Sec. 1-9-75. Removal of debris from public and private rights-of-way during a
declared state of local emergency.
The board is hereby authorized to provide for the removal of debris from public and private
rights-of-way during a declared state of local emergency. During the declared local state of
emergency, the board, its officials, employees, agents, and contractors are authorized to enter
onto public and private rights-of-way for the purposes of such debris removal.

DIVISION 3. SOLID WASTE COLLECTION SERVICE AGREEMENTS
Sec. 1-9-91. General authority.
(a) The board is hereby authorized to enter into service agreements with any qualified
person or entity to provide for the exclusive collection of solid waste (other than sludge
unregulated under the federal Clean Water Act or Clean Air Act, sludge from a waste
treatment works, water supply treatment plant, or air pollution control facility) and recyclable
materials, from residential property within specific service areas.
(b) The board is hereby authorized to enter into service agreements with any qualified
person or entity to provide for nonexclusive collection of solid waste (other than sludge
unregulated under the federal Clean Water Act or Clean Air Act, sludge from a waste
treatment works, water supply treatment plant, or air pollution control facility) and recyclable
materials, from commercial property throughout the unincorporated area of the county and
from residential property located outside of the urban unincorporated area.

§ 1-9-91 ST. LUCIE COUNTY CODE
(c) Service agreements may require payment of a franchise fee as set by the board to
compensate the county for the cost of administration, supervision and inspection rendered for
the effective performance of regulated contractors and shall include such other terms and
provisions as the board may deem necessary or advisable.

Sec. 1-9-92. Designation of egclusive service areas.
Prior to entering into any service agreement providing for exclusive service to residential
property, the board shall adopt a resolution designating one (1) or more service areas in which
such exclusive service shall be provided. Service areas may be expanded or contracted by
resolution of the board to include additional property located in the unincorporated area of the
county or to include property located within any municipality with the consent of the
governing body of such municipality.

Sec. 1-9-93. Indemnification.
The county shall not be liable or responsible for any accident or damage that may occur in
conjunction with the collection of solid waste or recyclable materials by any regulated
contractor, as a condition to the authority to provide collection, shall be deemed to have agreed
to indemnify and hold harmless the county from any and all liability, loss, cost, damage or
expense which may accrue to the county by reason of the neglect, default or misconduct of the
regulated contractor.

Sec. 1-9-94. Revocation of certain permits.
The board shall revoke a permit to operate garbage collection services issued pursuant to
Article III of Chapter 1-9 of the St. Lucie County Code of Ordinances upon violation of the
provisions of this ordinance. The board shall follow the procedures for revocation of the permit
provided in section 1-9-24 of Chapter 1-9 of the St. Lucie Code of Ordinances.

Sec. 1-9-95. Prohibited acts.
No person shall collect solid waste (other than sludge unregulated under the federal Clean

Sec. 1-20-6. ~rning movements.
(a) Vehicle, for the purpose of this section, is defined as set forth in F.S § 316.003(75), as
amended.
(b) The Board of County Commissioners of St. Lucie County, Florida, is authorized to
regulate or prohibit the turning of vehicles or specified types of vehicles at a previously
advertised public hearing by resolution after determining that such regulation is reasonable
and for the benefit of the public health, safety, or general welfare of the citizens of St. Lucie
County.
(c) All previous resolutions regulating vehicle turning movements adopted by the Board of
County Commissioners of St. Lucie County, Florida, are hereby approved and incorporated as
adopted.

ARTICLE II. STOPPING, STANDING AND PAR.KING
DIVISION 1. GENERALLY
Sec. 1-20-16. Parking for longer than twenty-four hours restricted; removal of
vehicles.
(a) No person, as defined in F.S. § 1.01, shall park, leave or place any motor vehicle on the
right-of-way of any public road in the unincorporated areas of the county for a period of more
than twenty-four (24) hours unless:
(1) It is in operating condition;
(2) It bears current license plates; and
(3) It bears a current inspection decal.
(b) Any motor vehicle not meeting the conditions of subparagraphs (a)(1) through (3) of this
section and that is discarded, left or abandoned on any public road right-of-way in the
unincorporated area of the county may be removed or caused to be removed by the sheriffs
department of the county after posting a notice on such vehicle advising that if such vehicle is
not removed by the owner within forty-eight (48) hours, it will be removed or caused to be

removed by the sheriffs department; provided, however, that, this paragraph shall in no way
limit the sheriff or any other law enforcement agency's authority to remove vehicles from the
paved or main traveled part of any highway under the provisions of F.S. § 316.194.
(c) The maximum fee is established which may be charged on the towing of vehicles from
or immobilization of vehicles on private property, removal and storage of wrecked or disabled
vehicles from an accident scene or for the removal and storage of vehicles, in the event the
owner or operator is incapacitated, unavailable, leaves the procurement of wrecker service to
the law enforcement officer at the scene, or otherwise does not consent to the removal of the
vehicle as follows:

(a) The term "parking" as used herein means the standing of a vehicle, whether occupied or

Sec. 1-20-18. Ticketing of illegally parked vehicles; effect of failure to pay ticket or
appear for hearing; evidence of violations.
(a) Whenever any motor vehicle without a driver is found parked, stopped, or standing in
violation of any restrictions imposed under this division, the law enforcement officer finding
such vehicle shall take its license number, and may take any other information displayed on
the vehicle which may identify its user, and shall conspicuously affix to such vehicle a notice
in writing, on a form provided by the clerk of the county court, requiring the driver to pay a
civil penalty of thirty-two dollars ($32.00) to such clerk within ten (10) days or to appear before
a hearing officer at the time, date and location specified on such notice.
(b) If a violator of the restrictions on stopping, standing or parking under this division does
not pay such civil penalty within such ten (10) days or appear before a hearing officer as
provided in such notice, a warrant for his arrest shall be issued.
(c) In any action charging a violation under this division governing the stopping, standing
or parking of a motor vehicle, proof that the particular vehicle described in the complaint was
parked, stopped or standing in violation under this division, together with proof that the
defendant named in the complaint was at the time of such parking, stopping or standing the
registered owner of such vehicle, shall be prima facie evidence that the registered owner of
such vehicle was the person who stopped, stood or parked such vehicle at the point where, and
for the time during which such violation occurred.
