(2) Material information on the application is incorrect.
(3) Any person or entity listed on the application as responsible for the installation,
maintenance and/or monitoring of the alarm system does not possess any required
occupational or regulatory license to conduct such activities unless the person or entity
is the alarm user.
(4) All false alarm dispatch charges for excessive false alarms owed by the alarm user
have not been paid.
(5) The alarm user had an alarm permit for the alarm site suspended or revoked, and the
violation causing the suspension or revocation has not been corrected.

Sec. 1-2.5-12. Excessive false alarm signals-Generally.
(a) No person shall allow, permit, cause or fail to prevent the emission, for any reason, by
any alarm used by him, or any alarm serving a premises or a building occupied and controlled
by such person, of more than three (3) false alarms within any one-year period of time.
(b) The emission of more than three (3) false alarms within any one-year period of time is
excessive and constitutes a serious public nuisance, and is subject to false alarm dispatch
charges set out in section 1-2.5-13.
(c) In the event an alarm system emits five (5) or more false alarms within any one-year
period, law enforcement officers shall only respond to panic and/or hold-up alarms from the
system until all false alarm dispatch charges pursuant to section 1-2.5-13 for the system are
paid or otherwise resolved pursuant to section 1-2.5-13, and until the alarm user provides
written documentation to the sheriff or fire marshal, as appropriate, of inspection, modifica-
tion, or training as set forth in section 1-2.5-7(h) within thirty (30) days of the false alarm
dispatch which necessitated such service.

Sec. 1-2.5-13. Same-False alarm dispatch charge; collection.
(a) For response to excessive false alarms by law enforcement agencies, the alarm user
shall be charged a service fee by the county of fifty-five dollars ($55.00) for the first alarm in
excess of three (3) false alarms in any one-year period, eighty dollars ($80.00) for the second
false alarm in excess of three (3) in any one-year period, and one hundred five dollars ($105.00)
for the third and each successive false alarm in excess of three (3) in any one-year period. For
response to excessive false alarms by the fire department, the alarm user shall be charged a
service fee by the county of one hundred thirty dollars ($130.00) for the first alarm in excess
of three (3) false alarms in any one-year period, one hundred fifty-five dollars ($155.00) for the
second false alarm in excess of three (3) false alarms in any one-year period, and two hundred
five dollars ($205.00) for the third and each successive false alarm in excess of three (3) in any
one-year period. The law enforcement executive or fire marshal shall determine whether a
false alarm has occurred and the frequency of such false alarms, and the tax collector or other

person designated by the board shall invoice alarm users of amounts owed to the county and
shall make demand thereof, pursuant to the provision of this section. Payxnent of such charges
shall be due within ten (10) working days of the date of receipt of the invoice. Payment shall
be by money order, certified check or cash only. In the event an alarm user does not remit
payment of the charge in a timely manner as provided herein, the t~ collector shall notify the
sheriff or the fire marshal, as appropriate, that the charge is past due. The sheriff or the fire
marshal, as appropriate, shall then make an effort to collect said charge. In the event the
sheriff or fire marshal is unable to collect said charge in a timely manner, the sheriff or fire
marshal shall file a complaint with the county code enforcement division regarding the alarm
user's failure to pay the charge in a timely manner. Upon receipt of such complaint, the code
enforcement division shall initiate enforcement proceedings in accordance with Chapter 1-2,
Article II of the St. Lucie County Code of Ordinances and Compiled Laws and such violations
shall be subject to the penadty and enforcement provisions as therein provided in addition to
the charges provided in this section.
(b) All false alarm dispatch charges collected as the result of such enforce~nent shall only be
used to offset the costs incurred in responding to false alarms.

Sec. 1-2.5-i4. Disbursement of servi~e charges.
S~rvice charg+es will be disburs~ tc~ the fins and forfeitu~e accounts of each law enforcement
agency and the general fund of the St. Lucie CountylFort Pierce Fire District which respond+ed
to the false alarm or in a manner as agreed to by all affected agencies. Pursuant to F.S., § 30.51,
all service fees and charges assess~ed for services of the sheriff shall be remitted to the county.

Sec. 1-6.5-83. Special conditions.
The following special conditions shall apply to the creation, operation, and existence of
Tradition Community Development District No. 1:
(1) The powers and responsibilities of the ~Yadition Community Development District No.
1 shall be limited to the following:
To finance, fund, plan, establish, acquire, construct or reconstruct, enlarge or extend,
equip, operate, and maintain systems, facilities, and basic infrastructures for the
following:
a. Water management and control for the lands within the district and to connect
some or any of such facilities with roads and bridges;
b. Water supply, sewer, and wastewater manageiuent, reclarnation, and reuse or
any combination thereof, and to construct and operate connecting intercepting or
outlet sewers and sewer mains and pipes and water mains, condui~s, or pipelines
in, along, and under any street, allsy, highway, or other public place or ways, and
to dispose of any effiuent, residue, or other byproducts of such system or sewer
system;
c. Bridg+es or culverts that may be needed across any drain, ditch, canal, floodway,
holding basin, egcavation, public highway, tra~t, grade, fill, or cut and roadways
over levees and embanl~eats, and to construct any and all of such works and
improvements across, through, or over any public right-of-way, highway, grade,
fi~l, or cut;
d. 1. District roads equal to or exceeding the specifications of the county in whic'h
such district roads are locatsd, and street ~ights;
2. Buses, trolleys, transit shelters, ridesharing facilities and services, parki.ng
improvements, and related signage;
e. Investigation and remediation costs associated with the cleanup of actual or
perceived environmental contaanination within the district under the supervision
or direction of a competent governmental authority unless the covered costs
benefit any person who is a landowner within the district and who caused or
contributed to the contamination;
f. Conservation areas, mitigation areas, and wildlife habitat, including the main-
tenance of any plant or animal species, and any related interest in real or
personal property;
g. Paxks and facilities for indoor and outdoor recreational, cultural and educational
uses;
h. Fire prevention and control, including water mains and plugs, (but excluding fire
stations, fire trucks and other vehicles and equipment);

i. School buildings and related structures, which may be leased, sold or donated to
the school district, for use in the educational system, when authorized by the
district school board; and,
Security, including, but not limited to, guardhouses, fences and gates, electronic
intrusion detection systems, and patrol cars, when authorized by proper govern-
mental agencies; except that the district may not exercise any police power, but
may contract with the appropriate local general purpose government agencies for
an increased level of such services within the district boundaries.
The commission further consents to provide the district of the right and power of
eminent domain, pursuant to Chapter 73, Florida Statutes and Chapter 74, Florida
Statutes, over any property outside the boundaries of the district and within the
unincorporated areas of the county (except municipal, county, state and federal
property) for the uses and purposes of the district relating solely to water, sewer,
district roads, and water management, specifically including, without limitation, the
power of eminent domain for the taking of easements for the drainage of the land of one
person over and through the land of another; provided, however, that the district shall
exercise the eminent domain power only if for uses and purposes contemplated by,
consistent with or in furtherance of the requirements of approved development
permits or development orders relating to the real property within the district.
The foregoing powers shall be in addition, and supplemental, to the powers which the
district is entitled to exercise pursuant to Chapter 190, Florida Statutes.
(2) The district will use its best efforts to develop in an integrated fashion the traffic
circulation, water, and sewer facilities on the district property as one (1) functional
interrelated community.
(3) The district shall take no action which is inconsistent with the comprehensive plan,
ordinances or regulations of St. Lucie County.

Statutes, over any property outside the boundaries of the district and within the

residents, and to all prospective residents, of the district. The district shall furnish
each developer of a residential development within the district with sufficient copies of
that information to provide each prospective initial purchaser of property in that
development with a copy, and any developer of a residential development within the
district, when required by law to provide a public offering statement, shall include a
copy of such information relating to the public financing and maintenance of improve-
ments in the public offering statement.
(6) Following the establishment of the Southern Grove Community Development District
No. 5, as provided for in sections 1-6.5-120 and 1-6.5-121 above, each contract for the
initial sale of a parcel of real property and each contract for the initial sale of a
residential unit within the district shall include, immediately prior to the space
reserved in the contract for the signature of the purchaser, the following disclosure
statement in boldfaced and conspicuous type which is larger than the type in the

undertaken by the district. Such information shall be made available to all existing

that information to provide each prospective initial purchaser of property in that
development with a copy, and any developer of a residential development within the

(b) Written contracts for the collection of solid waste from improved property between a
service provider holding an annual permit issued by the county pursuant to Article III of
Chapter 1-9 of the St. Lucie County Code of Ordinances and the owner or occupant of any
improved property which were in effect prior to the adoption of this article may remain in effect
until revocation or the next expiration date of the service provider's annual permit.

Sec. 1-9-74. Collection by regulated contractors.
The sexvice provided by regulated contractors pursuant to the service agreements is deemed
to provide a special benefit to residential property and commercial property. The service
agreements may authorize the accrual of interest on delinquent service fees. To the full extent
permitted by law, the service agreements may authorize regulated contractors to impose a lien
against residential property as to which sexvice fees are delinquent in the amount of such
delinquent service fee, plus interest to the date of payment.

Sec. 1-9-75. Removal of debris from public and private rights-of-way during a
declared state of local emergency.
(a) Definitions.
Disaster means the actual occurrence or threat of widespread or severe damage, injury or
loss of life or property resulting from a natural or human-made cause including, but not
limited to, fire, flood, hurricane, tornado, snowstorm, ice storm, wind storm, oil spill, water
contamination, utility failure, hazardous peacetime radiological incident, epidemic, air
contamination, blight, drought, infestation, explosion, or hostile military action or paramil-
itary actions, or similar occurrences resulting from terrorist activities, riots or civil
disorders.
Emergency or local emergency means any natural or manxnade event including but not
limited to flood, conflagration, hazardous material dispersal, hurricane, tornado, earth-
quake or explosion within the limits of the county resulting in imminently threatening the
death or injury of persons, or the destruction of property, to such an extent that
extraordinary measures must be taken to protect the public health, safety and welfare.
(b) Declaration of State of Emergency. The county administrator, or his or her designee, is
empowered to declare a local state of emergency, pursuant to St. Lucie County Resolution
Number 00-277, whenever he or she shall determine that a natural or manmade disaster or
emergency has occurred or that the occurrence or threat of one is imminent and requires
immediate and expeditious action.
(c) Declaration ¢nd duration of state of emergency; activ¢tion of disaster plans.
(1) The county administrator, or his or her designee, shall have the authority to declare a
state of local emergency, pursuant to St. Lucie County Resolution Number 00-277.

(2) The declaration of the state of emergency shall activate the disaster emergency plans
applicable to the county and shall be the authority for emergency measures such as
evacuation orders and declaring of certain areas as being off limits, as well as
authorize the use or distribution of any supplies, equipment, materials or facilities
assembled or arranged to be made available to such plans.
(3) A state of local emergency shall continue for seven (7) days, unless extended as
necessary, in seven-day increments. However, if the local emergency involves a threat
to private structure or public infrastructure, the local emergency may remain in effect
for up to thirty (30) days.
(d) Emergency powers.
(1) During the state of emergency, the procedures and formalities otherwise required of
the county by law may be waived by the county administrator and he or she may
authorize actions pertaining to the following as l~e or she deems necessary:
a. Performing Qublic work and taking whatevsr action is necessary to ensure the
heaith, safety, and weifare of the community;
b. Determining a threat to ~ublic health ai-d safety that may result from the
generation of widespread debris throughout the county, that such debris co~sti-
tutes a hazardous environment for all mo~es of movesnent and trarisportation of
the residents as weil as emergency aid and relief services, endangerinent to all
properties in the county, an enviroa~ment conducive to breeding disease and
vermin, and greatly increased risk of fire, and that it is in the public interest to
collect and remove disaster debris from all property whether public lands, public
or private roads, and gated comrnuuities to eliminate an immediate threat to life,
public l~ealth and safety to reduc~e the threat of additional damage to improved
property and xo promote economic recovery of the community at large;
c. Authorize the county or their contracted agent right of access to private roads or
gated commur~ities as needed by emergency vehicles such as, but not limited to,
police, fire, medical care, debris removal, and sanitation to alleviate immediate
threats to public health and safety;
d. Authorize the removal of debris and wreckage resulting from a major disaster
from all property whether public lands, public or private roads, or gated
communities for a safe and sanitary living or functioning condition.
(e) Hold harmless.
(1) This section shall provide to indemnify and hold harmless the United States Govern-
ment, the Federal Emergency Management Agency (FEMA), the State of Florida, the
County of St. Lucie and their agencies, agents, contractors, and subcontractors, for
damages of any type whatsoever, either to property or to persons situated thereon, by
obtaining a right of entry permit and agreement from private and gated communities
prior to removing storm-generated debris from the property;

(2) The county shall obtain and update these agreements annually and have them readily
available for use as needed;
(3) The county is not responsible for any debris that it generated by any contractor. The
contractor who generated this debris is responsible for its removal and disposal.
(f~ Implementation of provisions. The county administrator or his or her designee or
enforcement officials shall implement the provisions of this article with or without instructions
as may be furnished by the board of county commissioners and the county administrator.
(g) Limitation of authority. Nothing in this section shall be construed to limit the authority
of the board of county commissioners to declare, limit, or terminate a state of emergency, and
to take any action authorized by law, when convened in a regular or special meeting.

DIVISION 3. SOLID WASTE COLLECTION SERVICE AGREEMENTS
Sec. 1-9-91. General authority.
(a) The board is hereby authorized to enter into service agreements with any qualified
person or entity to provide for the exclusive collection of solid waste (other than sludge
unregulated under the federal Clean Water Act or Clean Air Act, sludge from a waste
treatment works, water supply treatment plant, or air pollution control facility) and recyclable
materials, from residential property within specific service areas.
(b) The board is hereby authorized to enter into service agreements with any qualified
person or entity to provide for nonexclusive collection of solid waste (other than sludge
unregulated under the federal Clean Water Act or Clean Air Act, sludge from a waste
treatment works, water supply treatment plant, or air pollution control facility) and recyclable
materials, from commercial property throughout the unincorporated area of the county and
from residential property located outside of the urban unincorporated area.
(c) Service agreements may require payment of a franchise fee as set by the board to
compensate the county for the cost of administration, supervision and inspection rendered for
the effective performance of regulated contractors and shall include such other terms and
provisions as the board may deem necessary or advisable.

Sec. 1-9-92. Designation of exclusive service areas.
Prior to entering into any service agreement providing for exclusive service to residential
property, the board shall adopt a resolution designating one (1) or more service areas in which
such exclusive service shall be provided. Service areas may be expanded or contracted by

resolution of the boaxd to include additional property located in the unincorporated area of the
county or to include property located within any municipality with the consent of the
governing body of such municipality.

Sec. 1-9-93. Indemnification.
The county shall not be liable or responsible for any accident or damage that may occur in
conjunction with the collection of solid waste or recyclable materials by any regulated
contractor, as a condition to the authority to provide collection, shall be deemed to have agreed
to indemnify and hold harmless the county from any and all liability, loss, cost, damage or
egpense which may accrue to the county by reason of the neglect, default or misconduct of the
regulated contractor.

Sec. 1-9-94. Revocation of certain per3nits.
The board shall revoke a~~ermit to operate garbage collection services issued pursuant to
Article III of Chapte~ 1-9 of the St. Lucie County Code of Ordinances ugon violation vf the
provisions of this ordinance. The board shall follow the ~rocedures for revocation of the perinit
provided in section 1-9-24 of Chapter 1-9 of the St. Lucie Code of Ordinances.

AR,TICLE IV. LOCAL OPTION MOTOR FUEL TAX*
Sec. 1-19.3-41. Levy of local option motor fuel tax.
(a) Pursuant to section 336.025, Florida Statutes (1985) as amended by Senate Bill 313
passed by the 1986 Florida Legislature, a six cent ($0.06) local option motor fuel tax is imposed
upon every gallon of motor fuel and special fuel sold in St. Lucie County and taxed under the
provisions of Chapter 206, Florida Statutes.
(b) Pursuant to section 336.025(1)(b), Florida Statutes, an additional five cent ($0.05) local
option motor fuel tax is imposed upon every gallon of motor fuel sold in St. Lucie County and
t~ed under the provisions of Part 1 of Chapter 206, Florida Statutes. The revenues received
from the additional five cent ($0.05) local option motor fuel tax may only be utilized for
transportation expenditures needed to meet the requirements of the capital improvements
element of an adopted comprehensive plan. For purposes of this paragraph, expenditures for
the construction of new roads, alternative methods of transportation, or the reconstruction or
resurfacing of existing paved roads shall be deemed to increase capacity and such projects
shall be included in the capital improvements element of the adopted comprehensive plan.
Expenditures for purposes of this paragraph shall not include routine maintenance of roads.

Sec. 1-19.3-42. Distribution of local option motor fuel tax.
(a) All divisions of tax proceeds shall be determined by the county on or before July 1 of each
year during the duration of the tax as set out in section 1-19.3-43 beginning July 1, 1986. The
annual redetermination by the county of the division of the tax proceeds shall be based on
transportation expenditures of the county and all eligible municipalities based on the
transportation expenditures of each for the five (5) fiscal years preceding the year in which the
annual redetermination is made, as a proportion of the total of such expenditures for the
county and all municipalities within the county. The county shall notify the department of
revenue of the results of the county's redetermination of the tax proceeds by July 1 of the year
the redetermination is made. The annual redetermination shall be effective beginning
September 1 of the year the redetermination is made. Any dispute as to the determination by
the county of the distribution of the t~ proceeds shall be in accordance with section
336.025(5)(b), Florida Statutes (1985).

Sec. 1-19.3-43. Duration of tax.
The four cent ($.04) local option gas tax originally imposed by this article shall be effective
from September 1, 1985 through August 31, 1987, both dates inclusive. The six cent ($0.06)
local option gas tax imposed by this article shall be effective from September 1, 1987 through

Sec. 1-20-1. Speed limits.
(a) The speed limits on all state secondary roads in the county set by the state department
of transportation prior to October l, 1971, are hereby established as the maximum speed limits
for such roads.
(b) Such roads, if not already posted, shall be posted with clearly legible signs so placed and
so painted as to be plainly visible and legible in daytime or in darkness when illuminated by
headlights.
(c) The board of county commissioners is authorized to adopt speed limits by resolution
after undertaking an investigation to determine that such regulation is reasonable and for the
benefit of the public health, safety, or general welfare of the citizens of the county.
(d) All previous speed limit resolutions adopted by the board of county commissioners are
hereby approved and incorporated as adopted.

Sec. 1-20.2. Hunting from county roads restricted.
It shall be unlawful during the period of thirty (30) minutes after sunset to thirty (30)
minutes before sunrise for any person on or from any public highway, street or road or on or
from the right-of-way thereof in the unincorporated area of the county to take or attempt to
take any animal, fowl or reptile by the use of any firearm, bow and arrow, net, rope, dog or trap
and shall include the shining of a spotlight or flashlight greater than three (3) cell for the
