Sec. 1-6.5-182. Initial board of supervisors.
The following five (5) persons are designated as the initial members of the Board of

Steven A. Neiberg, W. Peter Varty, Wayne Shaffer and David Gunn.

Sec. 1-6.5-183. Powers.
The Sunnyland Farms Community Development District shall have all those general
powers granted pursuant to F.S. § 190.011, and those special powers granted pursuant to F.S.
Supp. No. 77 296.19
§ 1-6.5-183 ST. LUCIE COiTNTY CODE
§ 190.012(1) and (3). Consent is hereby given to the district to exercise those powers relating
to recreation and security contained in F.S. § 190.012(2)(a) and (d), subject to the following
limitations:
(1) The Sunnyland Farms Community Development District shall not provide water or
wastewater service to the lands located within or outside the boundaries of the district.
(2) The Sunnyland Farms Community Development District shall not be authorized to
construct fire stations or provide for fire trucks or other vehicles and equipment
related thereto.
(3) The Sunnyland Farms Community Development District shall not be authorized to
provide mosquito control services within or without the boundaries of the district.
(4) The Sunnyland Farms Community Development District shall not be authorized to
provide solid waste collection or disposal services within or without the boundaries of
the district without the consent of the county.

Sec. 1-6.5-184. Special conditions.
(a) The Sunnyland Farms Community Development District will use its best efforts to
develop in an integrated fashion the traffic circulation, water, and sewer facilities on the
district property as one functional interrelated community.
(b) The Sunnyland Farms Community Development District shall take no action which is
inconsistent with the comprehensive plan, ordinances or regulations of St. Lucie County.
(c) No publicly owned property that may be located or acquired within the legal description
of this community development district shall be assessed for, or obligated in any way to pay for
the infrastructure constructed, maintained, or operated by the community development
district described in section 1.6-5.151 above.
(d) The Sunnyland Farms Community Development District shall take affirmative steps to
provide for the full disclosure of information relating to the public financing and maintenance
of improvements to real property undertaken by the district. Such information shall be made
available to all e~usting residents, and to all prospective residents, of the district. The district
shall furnish each developer of a residential development within the district with sufficient
copies of that information to provide each prospective initial purchaser of property in that
development with a copy, and any developer of a residential development within the district,
when required by law to provide a public offering statement, shall include a copy of such
information relating to the public financing and maintenance of improvements in the public
offering statement.
(e) Following the establishment of the Sunnyland Farms Community Development Dis-
trict, as provided for in sections 1-6.5-159 and 1-6.5-160 above, each contract for the initial sale
of a parcel of real property and each contract for the initial sale of a residential unit within the

Sec. 1-13.8-1. Purpose.
(1) Excessive, unnecessary or unusually loud noise is a detriment to the public health,
comfort, convenience, safety, welfare and prosperity of county residents.
(2) It is in the public interest that the regulations contained in this chapter be adopted as
public policy to promote the public health, comfort, safety, welfare and repose of the county and
its inhabitants.

Sec. 1-13.8-16. Terminology, standards, and definitions.
For the purposes of this chapter, the following definitions shall apply:
A-Weighting is the electronic filtering in sound level meters that models human hearing
frequency sensitivity.
Background sound leuel is the total sound pressure level in the area of interest excluding the
noise source of interest.
Commercial property is any property zoned for commercial purposes that is used priinarily
for the sale of inerchandise or goods, or for the performance of service, or for office or clerical
work.
Construction is any site preparation, assembly, erection, repair, alteration or similar action,
or demolition of buildings or structures.
Decibel (dB) is the unit of ineasurement for sound pressure level at a specified location.
dBA is the A-weighted unit of sound pressure level.
Emergency is any occurrence or set of circumstances involving actual or imminent physical
trauma or property damage that demands immediate action.

Emergency work is any work or action performed for the purpose of preventing or alleviating
the physical trauma or property damage threatened or caused by an emergency or delivering
essential services.
Impulsive sound is a sound having a duration of less than 1 s with an abrupt onset and rapid
decay.
Industrial property is any property that is used primarily for manufacturing or processing.
Legal holiday includes the following: New Years Day, Martin Luther King Jr. Day, Memorial
Day, Independence Day, Labor Day, Veterans Day, Thanksgiving Day, Christmas Eve and
Christmas Day.
Mixed use building is a building in which both residential and commercial uses are
permitted.
Muffler is a sound-dissipative device or system for attenuating the sound of escaping gases
of an internal combustion engine.
Multi-Family dwelling is any building or other shelter that has been divided into separate
units to house more than one family.
Noise is any sound that annoys or disturbs humans or causes or tends to cause an adverse
psychological or physiological effect on humans or that would unreasonably interfere with the
enjoyment of life or property.
Octave band is all of the components in a sound spectrum whose frequencies are separated
by an octave.
Person is any person, person's firm, association, copartnership, joint venture, corporation or
any entity, public or private in nature.
Real property line is the line, including its vertical extension that separates one parcel of
real property from another.
Residential property is any property on which people live and sleep.
Sound level meter (SLM) is an instrument used to measure sound pressure levels
conforming to 1~pe 1 or Type 2 standards as specified in the ANSI Standard 51.4-1983 or the
latest version thereof.
Sound pressure level (SPL) is twenty (20) multiplied by the logarithm, to the base of ten (10),
of the measured sound pressure divided by the sound pressure associated with the threshold
of human hearing, in units of decibels.
Weekday is any day, Monday through Friday, that is not a legal holiday.

Sec. 1-13.8-17. Classification of use districts.

For purposes of defining the "use occupancy," all premises containing habitually occupied
sleeping quarters shall be considered in residential use. All premises containing transient
commercial sleeping quarters shall be considered commercial use. All premises containing
businesses where sales, professional or other commercial use is legally permitted shall be
considered commercial use. All premises where manufacturing is legally permitted shall be
considered industrial use. In cases of multiple use, the more restrictive use category shall
prevail. Hospitals, nursing homes, schools, libraries, churches and all institutional uses shall
be considered residential uses. Any area not otherwise classified shall conform to commercial
standards.

Sec. 1-13.8-18. Sound level limitations.
No person shall cause, suffer, allow, or permit the operation of any sound source i~ such a
manner as to create a sound level that exceeds the sound level limits set forth in Tabie 1 when
measured at the real property line of the nearest receiving property, using the slaw response
setting unless otherwise noted. Such a sound source would constitute a noise disturbance.

(1) If the noise is an impulsive sound, the fast response setting that shall be used and the
daytime (7:00 a.m.-10:00 p.m.) limits of Table 1 shall be increased by ten (10) dBA.
(2) In a multi-family dwelling, it shall be unlawful to create or permit to be created any
noise that exceeds the daytime (7:00 a.m.-10:00 p.m.) limit of fifty (50) dBA and the
nighttime (10:00 p.m.-7:00 a.m.) limit of forty (40) dBA as measured from a neighbor's
dwelling.
(3) In a mixed use building, it shall be unlawful to create or permit to be created any noise
that exceeds the daytime (7:00 a.m.-10:00 p.m.) lixnit of 55 dBA and the nighttime
(10:00 p.m.-7:00 a.m.) limit of forty-five (45) dBA as measured within the residential
use portion of the building.
(4) In addition to the limits of Table 1, for any sound source which impacts residential
property, the maximum allowable sound level limits for the individual octave bands
whose centers are 31.5, 63 and 125 Hertz shall not exceed su~ty-five (65) dB.

Sec. 1-13.8-19. Egemptions.
(1) The following uses and activities shall be exempt from noise level regulations:
(a) Noise of safety signals, warning devices, and emergency pressure relief valves.
(b) Noise resulting from any authorized emergency vehicles, when responding to an
emergency call or acting in time of emergency.
(c) Noise resulting from emergency work as defined in section 1-13.8-16.
(d) Noise resulting from the operation of any type of aircraft, not including scale model
aircraft.
(e) Noise resulting from the operation of any motor vehicle as specified in F.S. Ch. 316 and
Ch. 403.
(fl Noise resulting from the operation of the following facilities existing and in operation
on the effective date of this chapter:
1. Electricity regulating substations.
2. Electric generation plants.
3. Other electric utilities.
4. Gas pressure control stations.
5. Gas production plants.
6. Natural or manufactured gas storage and distribution points.
7. Other gas utilities.
8. Pipeline pressure control stations.
9. Railroad, rapid rail transit, and street railway transportation.
10. Industrial wastewater disposal.
11. Sewage disposal.
12. Sewage pressure control stations.
13. Sewage treatment plants.
14. Sewage sludge drying beds.
15. Water utilities and irrigation.
16. Solid waste disposal.
(g) Noise resulting from agricultural activities in districts zoned AG-1 (Agricultural-1),
AG-2.5 (Agricultural-2.5), AG-5 (Agricultural-5), and AR,-1 (Agricultural, Residen-
tial-1) under Section 3.01.03 of the St. Lucie County Land Development Code.
(h) Noise resulting from the operation of the engine of any boat on the waters of the
unincorporated areas of the county.
(i) Noise resulting from any authorized law enforcement and firefighting training
activities including, but not limited to, sheriff department shooting range activities.

(j) Noise resulting from the activities of any permitted use, conditional use or accessory
use permitted in districts zoned industrial, light under section 3.3.114, St. Lucie
County Zoning Ordinance, industrial, heavy (IH) under section 3.3.115, St. Lucie
County Zoning Ordinance, and industrial, extraction (IX) under section 3.3.116, St.
Lucie County Zoning Ordinance, existing and in operation on the effective date of this
chapter.
(k) Noise resulting from the temporary operation of equipment or activities relating to
normal lawn and/or landscape maintenance of residential or commercial uses, from
sunrise to sunset including, but not limited to, the following activities: lawn mowing,
maintenance of trees, hedges, and gardens; soil cultivation; and pavement sweeping
and cleaning.
(1) Noise resulting from the operation of any mining activities under a permit issued
pursuant to Chapter 1-12.5 of this Code. The hours of operation shall be limited to the
hours set forth in the permit.
(m) Noise resulting from the operation of railways and shipping activities.
(n) Noise resulting from permitted construction activities occurring between 7:00 a.m. and
sundown pursuant to permits issued prior to December 6, 2006 and between 7:00 a.m.
and 6:00 p.m. on weekdays and 8:00 a.m. and 5:00 p.m. on Saturday for permitted
construction activities pursuant to permits issued on or after December 6, 2006. The
exemption shall be effective upon obtaining a building permit and shall pertain to any
construction activity directly related to the construction authorized under the permit.
A special permit issued pursuant to section 1-13.8-20 shall be required for the
generation of noise resulting from construction activities outside the hours set forth
above in this subsection. In the event of an emergency, the building official may issue
a special permit for extended hours pending review of an application for a special
permit pursuant to section 1-13.8-2. For any violation of the terms of the special
permit, the permit holder and the violator shall be jointly and severably liable.
(o) Any other noise resulting from activities of temporary duration permitted by law and
for which a license or permit therefor has been granted by the board of county
commissioners in accordance with section 1-13.8-20.
(p) Any noise resulting from golf course maintenance activities.
(2) Where an industrial or commercial use is established on property not adjacent to a
residential use district and the adjacent property subsequently becomes residential, the noise
resulting from the operation of the pre-existing industrial or commercial use which is projected
into the residential use district, shall be subject to the permissible noise levels for industrial
or commercial use districts, as appropriate.
(3) Where the noise levels for a pre-existing use are more restrictive than those for a
subsequent use established adjacent to the pre-existing use, the noise levels for the pre-
existing use shall apply.

Sec. 1-13.8-20. Application for special permit.
Application for a permit for relief from the noise and vibration levels designated in this
chapter on the basis of undue hardship may be made to the board of county commissioners.
Any permit granted by the board hereunder shall contain all conditions upon which the permit
has been granted and shall specify a reasonable time that the permit shall be effective. The
board may grant the relief as applied for if it finds:
(1) That additional time is necessary for the applicant to alter or modify his activity or
operation to comply with this chapter; or
(2) The activity, operation, or noise or vibration source will be temporary duration and
cannot be done in a manner that would comply with other sections of this chapter.
(3) That no other reasonable alternative is available to the applicant.
The board of county commissioners may prescribe any conditions or requirements it deems
necessary to minimize adverse effects upon the community or the surrounding neighborhood.

Sec. 1-13.8-21. Penalties.
Violation of this chapter is a misdemeanor pursuant to F.S. § 125.67, and is punishable
under said section by imprisonment for up to sixty (60) days, or a fine of up to five hundred
dollars ($500.00) or both such imprisonment and fine. Each instance of a violation of this
chapter shall constitute a separate offense.

Sec. 1-17-1. Erection of signs or structures within right-of-way prohibited; removal.
(a) No person, as defined in Section 1.01(3) Florida Statutes, shall erect any signs or
structures within the right-of-way limits of any public road in the unincorporated areas of the
county except state maintained roads.
(b) The board of county commissioners shall have the authority to direct removal of any
such signs or structures. However, in the event the sign or structure bears thereon the name
of the owner, no such sign or structure shall be removed until the owner thereof, as sl~own
thereon, shall have received thirty (30) days' written notice that unless such sign or structure
is removed within such thirty (30) day period, it will be removed by the county.

ARTICLE II. SPECIAL IMPROVEMENT SERVICE DISTRICT
Sec. 1-17-16. Creation-Authorized.
Special improvement service districts may be created and established in unincorporated
areas of the county under the provisions of this article for the purpose of acquiring, leasing or
installing street lighting equipment and for the payxnent of electrical services and current used
in the operation of the same.

Sec. 1-1?-17. Same-Proceedings.
The proceedings for the creation and establishment of a distnct authorized by this article
shall be as follows:
(a) There shall be filed with the board of county commissioners, hereinafter called the
board, a petition for the creation of such district and for the levy of special assessments
under the provisions of this article to pay the cost of the improvements and special
services to be furnished by such street lighting district. Such petition shall be signed
by the owners of not less than fifteen (15) per cent of the lots within the boundaries of
the proposed district. Opposite each such signature there shall be inserted the post
office address and a brief reference to the real property within the proposed district
which is owned by such signer. For the purposes of such petition, the signature of any
person holding a fee interest in the property shall be sufficient, and either the
signature of the husband or the wife shall be sufficient in cases where the property is
owned by both husband and wife. The rights of mortgagees and lienors shall not be
considered. Such petition shall also set forth:
(1) The proposed boundaries of the district, which shall not include any territory
within the corporate limits of any municipality, and a request that a special street
lighting improvement service district be created and established under the
provisions of this article embracing the territory within such boundaries;
(2) A brief description of any improvements to be acquired, leased or installed and an
estimate of the cost thereof.
(b) Upon receipt of any petition, the board shall refer the same to the county property
appraiser. At the earliest practicable date, the property appraiser shall examine such
petition and indicate thereon any signers who are not owners of real property in the
proposed district and file with the board a report setting forth the total number of lots
within the boundaries of the proposed district and the number thereof whose owners
have signed such petition.
(c) If such reports shall show that the petition has been properly signed, the county
engineer shall make or cause to be made such surveys and investigations as he may
deem necessary and thereupon file with the board his report, accompanied by a map
and other pertinent data, setting forth:
(1) The boundaries of the proposed district as set forth in the petition and his
recommendations as to any territory within such boundaries which should be

excluded from the district because of the disproportionate cost of providing for
such territory the improvements or special services petitioned for or for any other
reason;
(2) The location or locations of any improvements to be acquired, leased or installed;

providing such special services.

Sec. 1-20-1. Speed limits.
(a) The speed limits on all state secondary roads in the county set by the state department
of transportation prior to October 1, 1971, are hereby established as the maximum speed limits
for such roads.
(b) Such roads, if not already posted, shall be posted with clearly legible signs so placed and
so painted as to be plainly visible and legible in daytime or in darkness when illuminated by
headlights.
(c) The board of county commissioners is authorized to adopt speed limits by resolution
after undertaking an investigation to determine that such regulation is reasonable and for the
benefit of the public health, safety, or general welfare of the citizens of the county.
(d) All previous speed limit resolutions adopted by the board of county commissioners are
hereby approved and incorporated as adopted.

Sec. 1-20-2. Hunting from county roads restricted.
It shall be unlawful during the period of thirty (30) minutes after sunset to thirty (30)
minutes before sunrise for any person on or from any public highway, street or road or on or
from the right-of-way thereof in the unincorporated area of the county to take or attempt to
take any animal, fowl or reptile by the use of any firearm, bow and arrow, net, rope, dog or trap

and shall include the shining of a spotlight or flashlight greater than three (3) cell for the
purpose of disclosing the presence of any animal, fowl or reptile, or to facilitate the taking of

in accordance with the state game and fresh water fish commission regulations.

Sec. 1-20-5. Moving violation penalty surcharge.
In addition to any other penalty for violation of the state uniform traffic control law, a
surcharge of twelve dollars and fifty cents ($12.50) shall be assessed for each moving traffic
violation pursuant to Section 316.655(6), Florida Statutes (1992). This surcharge shall be used

(1) Owned or leased by the county or the City of Fort Pierce for the accomplishment of a
governmental purpose such as tree trimming, road repair or construction, water or
sewerage system repair or construction, maintenance of street and traffic lights and/or
similar activities.
(2) Owned or leased by a contractor or subcontractor under agreement with the city or
county to accomplish a county purpose as provided above.
(3) Owned or leased by a recognized public utility operating within the unincorporated
areas of the county or by a contractor or subcontractor under agreement with such
public utility for the accomplishment of some installation maintenance, adjustment
and/or repair to such public utility.

Sec. 1-20-45. Perrnits.
The sheriff of the county or his duly authorized designee may issue, upon proper application
therefor by the owner or his authorized representative to the sheriffs department, a permit
extending the parking time limits set forth in section 1-20-42 of this division up to, but not
exceeding twenty-four (24) hours upon establishing that such permit is requested in good faith
for a reasonable cause shown or demonstrated to the sheriff or his designee and not for the
purpose of avoiding the intent or objectives of this division.
(1) Whenever any motor vehicle without a driver is found parked, stopped or standing in
violation of any restrictions imposed under this division, the law enforcement officer
finding such vehicle shall take its license number, and may take any other information
displayed on the vehicle which may identify its user, and shall conspicuously affix to
such vehicle a notice in writing, on a form provided by the clerk of the county requiring
the driver to pay a civil penalty of thirty-two dollars ($32.00) to such clerk within ten
(10) days or to appear before a hearing officer at the time, date and location specified
on such notice.
(2) If a violator of the restrictions on stopping, standing or parking under this division
does not pay such civil penalty within such ten (10) days or appear before a hearing
officer as provided in such notice, a warrant for his arrest shall be issued.
(3) In any action charging a violation under this division governing the stopping, standing
or parking of a motor vehicle, proof that the particular vehicle described in the
compliant was parked, stopped or standing in violation under this division, together
with proof that the defendant named in the complaint was at the time of such parking,
stopping or standing the registered owner of such vehicle, shall be prima facie evidence
that the registered owner of such vehicle was the person who stopped, stood or parked
such vehicle at the point where, and for the time during which, such violation occurred.

Sec. 1-20-46. Application of superseding county ordinances and state laws.
This division is primarily for the purpose of protecting residential zoning. Therefore, any
ordinances of this county or laws of this state providing for the regulations of motor vehicles

are in addition to this division and wherever any provision of some other ordinance_ or
applicable statute, whether primarily for the regulation of motor vehicles or for the purposes
of zoning, imposes more stringent requirements, regulations, restrictions or limitations than
are imposed or required by the provisions of this division, then more stringent requirements,
regulations restrictions or limitations shall apply.

Sec. 1-20-47. Exemption for recreational vehicles.
The provisions of this division shall not apply to recreational vehicles used exclusively for
recreational purposes.

This division shall not be construed as authorizing trucks to utilize any street or other

ARTICLE IV. OFF-ROAD VEHICLES
Sec. 1-20-62. Operation regulated.
(a) No person shall operate upon the private property of another or upon any public property
which is not held open to the public for any vehicular use and which is not subject to the
provision of the State Uniform Traffic Control Law, a motor vehicle, including a motorcycle,
motor bike, minibikes, dirt bikes, trail bikes, dune buggies, motor scooters, jeeps, or other form
of off-highway motor vehicle.
(b) The provisions of this section shall not prohibit the operation of off-highway motor
vehicles upon the property of another when the motor vehicles are:
(1) Authorized emergency veliicles;
(2) Used for ingress to and egress from, and parking upon, parking lots or structures open
to the public or private parking lots;

(3) Motor vehicles operated upon property used for a motor vehicle riding area which has
received approval from the county and is being operated as a business;
(4) The property of any governmental agency, including any motor vehicle riding facility
operated by the county;
(5) Upon the property of another when the operator has the written consent of the owner
or person in lawful possession of the property;
(6) Used by the owner of the land, the owner's family, employees, agents, or lessees;
(7) Upon private property for ingress and egress only.

Sec. 1-20-63. Prima facie violation.
The operation of any motorcycle, motor bike minibikes, dirt bikes, trail bikes, dune buggies,
motor scooters, jeeps, or other form of off-highway motor vehicle upon any vacant or
unimproved lands within the unincorporated county shall constitute a prima facie violation of
this article, unless operator is able to exhibit signed written permission by the owner of the
land for such use.

Sec. 1-20-64. Liability of parents of children under eighteen.
Each parent or guardian of any child under the age of eighteen (18) years may be charged
under this article with having permitted a violation of this article. Subsequent to receipt of a
written warning from the sheriff, each parent or guardian so warned shall be assumed
knowingly to have permitted any subsequent violation and shall be subject, upon conviction,
to penalties identical to those provided for the violator for having permitted a violation of this
article.

AR,TICLE I. REGUI.ATION OF WATER AND SEWER UTILITIES*
Sec. 1-20.5-1. Standards for fire hydrant installation.
Any person providing water service and installing water mains, lines or connections within
unincorporated St. Lucie County shall comply with the following standards for water mains,
lines or connections installed or replaced after the effective date of this section:
(1) There shall be fire hydrants located and in service within six hundred (600) feet of each
other in all areas zoned for single-family residential usage, multifamily, commercial,
and industrial usage for flows requiring one thousand (1,000) gallons per minute. The
hydrant spacing requirements shall be one thousand (1,000) feet for fire flows
requiring five hundred (500) gallons per minute.
(2) All fire hydrants shall be located within dedicated Qublic or private rights-of-way,
which shall be paved or readily traversable by firefighting equipment, with required
minimum separation distance to be measured by roadway travel thereon.
(3) All water mains intended and providing water for fire protection shall have a diameter
of no less than eight (8) inches, except that lower sizes of not less than six (6) inches
may be allowed by the St. Lucie County Fire District based on needed fire flow as
determined by the fire district.
(4) The minimum size water main(s) and fire flows shall be determined by the fire
marshal and based on the current Insurance Service Office (ISO) requirements.
(5) There shall be no requirements for the establishment of fire hydrants in areas zoned
for agricultural usage.
(6) For the purposes of this section, person means any developer, property owner, private
utility or public, governmentally owned utility providing water service in unincorpo-
rated St. Lucie County.

AR,TICLE II. WATER SHORTAGE PI.AN*
Sec. 1-20.5-35. Intent and purpose.
It is the intent and purpose of this article to protect the water resources of the county from
the harmful effects of overutilization during periods of water shortage and allocate available
water supplies by assisting the South Florida Water Management District in the implemen-
tation of its water shortage plan.

Sec. 1-20.5-36. Definitions.
For the purpose of this article, the following terms, phrases, words and their derivations
shall have the meanings given herein. When not inconsistent with the context, words used in
the present tense include the future, words in the plural include the singular and words in the
singular include the plural. The word "shall" is always mandatory and not merely directory.
District is the South Florida Water Management District.
Person is any person, firm, partnership, association, corporation, company or organization
of any kind.
Water resource means any and all water on or beneath the surface of the ground, including
natural or artificial water courses, lakes, ponds or diffused surface water, and water
percolating, standing or flowing beneath the surface of the ground.
Water shortage condition is when sufficient water is not available to meet present or
anticipated needs of persons using the water resource, or when conditions are such as to
require a temporary reduction in total water usage within a particular area to protect the
water resource from serious harm. A water shortage usually occurs due to drought.
Water shortage emergency means that situation when the powers which can be exercised
under part II of Chapter 40E-21, Florida Administrative Code, are not sufficient to protect the
public health, safety, or welfare, or the health of animals, fish or aquatic life, or a public water
supply, or commercial, industrial, agricultural, recreational or other reasonable uses.

Sec. 1-20.5-37. Application of article provisions.
The provisions of this article shall apply to all persons using the water resource within the
geographical areas subject to the "water shortage" or "water shortage emergency," as

determined by the district, whether from public or privately owned water utility systems,
private wells, or private connections with surface water bodies. This article shall not apply to
persons using treated effluent or saltwater.

Sec. 1-20.5-38. Amendments to water shortage plan.
Chapter 40E-21, Florida Administrative Code, as the same may be amended from time to
time, is incorporated herein by reference as a part of the Code of Ordinances of the county

Sec. 1-20.5-39. Declaration of water shortage; water shortage emergency.
The declaration of a water shortage or water shortage emergency within all or any part of
the county by the governing board or the executive director of the district shall invoke the
provisions of this article. Upon such declaration, all water use restrictions or other measures
adopted by the district applicable to the county, or any portion thereof shall be subject to
enforcement action pursuant to this article. Any violation of the provisions of Chapter 40E-21,
Florida Administrative Code, or any order issued pursuant thereto, shall be a violation of this
article.

Sec. 1-20.5-40. Enforcement.
Every police officer, sheriff, or fire marshal having jurisdiction in the area governed by this
article shall, in connection with all other duties imposed by law, diligently enforce the
provisions of this article. In addition, the county administrator may also delegate enforcement
responsibility for this article to agencies and departments of county government, or cities in
the service areas governed by this article, in accordance with state and local law.

Sec. 1-20.5-41. Penalties.
Violation of any provision of this article shall be subject to the following penalties:
(1) First violation: ~venty-five dollars ($25.00).
(2) Second and subsequent violation: Fine not to exceed five hundred dollars ($500.00)
and/or imprisonment in the county jail not to exceed sixty (60) days.
Each day in violation of this article shall constitute a separate offense. In the initial stages
of a water shortage or water shortage emergency, law enforcement officials may provide
violators with no more than one (1) written warning. The county, in addition to the criminal
sanctions contained herein, may take any other appropriate legal action, including, but not
limited to, emergency injunctive action, to enforce the provisions of this article.

No water service shall be furnished to any person by a public or private utility unless such
person agrees to accept all the provisions of this article. The acceptance of water service shall

AR,TICLE III. FLUORIDATION OF WATER SYSTEMS*
Sec. 1-20.5-50. Definitions.
As used in this article, the following terms shall have the indicated meanings:
Person. Any individual, corporation, governmental agency, business, trust, estate, partner-
ship, association, or any other legal entity.
Water system. A system for the provision to the public of piped water for human
consumption, whether privately or publicly owned.

Sec. 1-20.5-51. Fluoridation requirements.
By October 1, 1990, any person having jurisdiction over a water system with a design
capacity of one million (1,000,000) gallons or more within the boundaries of the county which
does not have a natural fluoride level of eight-tenths (0.8) milligrams per liter shall apply
fluorides to the system in compliance with the requirements of the department of environ-
mental regulation contained in sections 17-555.325, 17-555.520, 17-550.310, and 17-550.320,
Florida Administrative Code, or as those sections may hereinafter be amended.

Sec. 1-20.5-55. Industrial wastewater.
The district will accept only domestic wastewater in its sewer system. No industrial_
wastewater or the like, including septage, shall be discharged into the district's sewer system
unless proper pretreatment facilities are provided on customer's premises by customer,
properly operated and approved in writing by the district and all applicable regulatory
agencies.

Sec. 1-20.5.56. Grease traps, oil separators.
All commercial food preparation facilities and all other facilities generating wastewater
with high grease and/or oil concentrations must have a grease trap to intercept these wastes
prior to discharge into the district's sanitary sewer system. Location and type of grease trap
used must be approved, in writing, by the district and all applicable regulatory agencies.
Grease traps must be properly maintained by customer or owner. Design and maintenance of
grease traps shall be in accordance with county rules, regulations and codes, and shall conform
to the specifications and requirements of the district. If grease and/or oil in excess of allowable
amounts, in accordance with the district's and regulatory agency requirements, is discharged,
the district shall inform operator and/or owner of premises to properly repair and maintain or
replace, if necessary, the grease traps. Failure to cease discharging wastewater with high
grease and/or oil concentrations shall be cause for discontinuance of water and sewer service.

Sec. 1-20.5-57. Hazardous wastes.
No hazardous wastes of any kind shall be discharged into the district's sewer system under
any circumstances without prior written authorization from the district. Failure to comply
with this rule shall be cause for discontinuance of water and sewer service and violator(s) will
be subject to criminal prosecution.

Sec. 1-20.5-58. All water through meter.
That portion of the customer's installation for water service shall be so arranged that all
water service shall pass through the meter. No temporary pipes, nipples, or spacers are
permitted and under no circumstances are connections allowed which may permit water to
bypass the meter or metering equipment.

AR,TICLE V. ST. LUCIE COUNTY WATER AND SEWER DISTRICT
Sec. 1-20.5-76. Creation; purpose; boundaries.
Pursuant to F.S. Ch. 153, Pt. II, and F.S. § 189.4041, the board of county commissioners
determines it to be necessary in the public interest to create and there is hereby created a
dependent special district to be known as the "St. Lucie County Water and Sewer District"
("District"). The boundaries of the district shall be the contiguous unincorporated area of St.
Lucie County, as identified on Exhibit "A" to the District Charter as adopted below. The
purpose of the special district is to consolidate certain existing County utility facilities into a
single operating entity, and to acquire, own, operate, lease and maintain water and sewer
systems in the unincorporated area of St. Lucie County, Florida. The board of county
commissioners hereby declares that a dependent special district is the best means of
establishing these public purposes and for acquiring, leasing, operating and managing assets
of water and sewer systems within the district.

Sec. 1-20.5-77. Adoption of special district charter.
The board of county commissioners hereby adopts the charter attached as Exhibit "A" to
Ordinance No. 04-023 (the "district charter") to implement the provisions of this article and
