Sec. 1-4-16. Definitions.
As used in this article, the following terms shall have the indicated meaning.
Animal. Any live, vertebrate creature, domestic or wild; but if the context requires, may
refer to only a dog, cat, bird or livestock.
Animal control officer. Any person employed or appointed by the board of county commis-
sioners who is authorized to investigate, on public or private property, civil infractions relating
to animal control, animal cruelty, licensure of animals, or seizure and impoundment of animals
and to issue citations as provided in this act. An animal control officer is not authorized to
make arrests or to bear arms. However, such of~icer may carry a device to chemically subdue
and tranquilize an animal, provided that such officer has successfully completed a minimum
of sixteen (16) hours of training in marksmanship, equipment handling, safety and animal
care, and can demonstrate proficiency in chemical immobilization of animals in accordance
with guidelines prescribed in the Chemical Immobilization Operational Guide of the American
Humane Association.
Bird. Any animal of the aves species, regardless of sex.
Breeder. Any person who owns, keeps, harbors, maintains, or has custody of any dog or cat
which produce a total of two (2) or more litters during a twelve-month period.
Cat. Any animal of the feline species, regardless of sex.

§ 1-4-16 ST. LUCIE COUNTY CODE
Citation. A written notice issued to a person by an officer who has probable cause to believe
that the person has committed an act in violation of this article.
The citation shall contain:
(1) The date and time of issuance.
(2) 1'he name and address of the person.
(3) The date and time the civil infraction was committed.
(4) The facts constituting probable cause.
(5) The ordinance section violated.
(6) The name and authority of the of~'icer.
(7) The procedure for the person to follow in order to pay the civil penalty, to contest the
citation, or to appear in court as required pursuant to section 1-4-26.
(8) The applicable civil penalty if the person elects to contest the citation.
(9) The applicable civil penalty if the person elects not to contest the citation.
(10) A conspicuous statement that if the person fails to pay the civil penalty within the time
allowed, or fails to appear in court to contest the citation, then he shall be deemed to
have waived his right to contest the citation and that, in such case, he may be held in
contempt of court and/or judgment may be entered against the person for an amount
up to the maximum civil penalty.
(11) A conspicuous statement that if the person is required to appear in court as mandated
by section 1-4-26, he does not have the option of paying the fine in lieu of appearing in
court.
Control. Possession, ownership, care, and custody of animals.
Controlled burial. Burying at least two (2) feet below the surface of the ground and one
hundred (100) feet from any water well.
Cruelty. Any act of neglect, torture, or torment that causes the unjustifiable pain or
suffering of an animal.
Dog. Any animal of the canine species, regardless of sex.
Domestic animal. Any equine or bovine animal, goat, sheep, swine, dog, cat, poultry, or other
domesticated beast or bird.
Leash or lead. A cord, rope, chain, or similar device which holds an anunal under restraint
and is not more than six (6) feet in length.
Livestock. Horses, mules, cattle, sheep, goats, swine, and other grazing animals.
Officer. Any law enforcement officer defined in F.S. § 943.10, or any animal control officer.
Owner. Any person, firm, partnership, corporation, organization, two (2) or more persons
having a joint or coxnmon interest, or any other association, owning, keeping, possessing,

harboring or having control or custody of one (1) or more animals including any custodian or
other person in charge of an animal or if the owner is under the age of eighteen (18), that
person's parent or guardian. An animal shall be deemed to be harbored if it is fed or sheltered
for five (5) consecutive days or more.
Public nuisance.
(1) Any animal which:
a. Attacks passersby or passing vehicles without provocation;
b. Attacks any other animal;
c. Is repeatedly at large and not under restraint;
d. Damages private or public property;
e. Repetitively barks, whines, howls, chirps, caws, or whistles for a period of five (5)
minutes or more so as to disturb adjacent residents, except the following:
1. Animals located on property zoned AG-1, AG-2.5, AG-5, AR-1 with agricul-
tural classification pursuant to F.S. § 193.461, or PUD where livestock is
permitted,
2. Animals located on property on which livestock is permitted as a noncon-
forming use, or
3. Birds and livestock located on property zoned AR-1.
f. Causes an annoyance in the neighborhood by acts such as overturning garbage
cans, defecating, digging holes on other than its owner's property, or such other
acts as are generally regarded to create an annoyance.
(2) Any activity, such as, but not limited to, the feeding of wild animals or fowl which:
a. Causes the fouling of the air by odor and thereby creates unreasonable annoyance
or discomfort to those in close proximity to the premises where the animals or
fowl congregate; or
b. Causes a sanitary nuisance as defined in F.S. § 386.01.
(3) Nothing in this section shall be interpreted to contravene the provisions of the "Florida
Right to Farm Act", F.S. § 823.14.
Under restrdint. Any animal secured by a leash or lead.
V'acious animal. Any fierce or dangerous animal that constitutes a physical threat to human
beings or other animals; or any animal for which the animal control officer has documentation
to establish that the animal has bitten any person or other animal on two (2) separate
occasions without provocation within a period of one (1) year.

Sec. 1-4-17. Public nuisance prohibited.
It shall be unlawful for any owner to permit his or her animal to become a public nuisance
or for any individual to create a public nuisance as defined herein.

Sec. 1-4-18. Animals in estrus.
Any dog or cat in estrus must be humanely confined in a building or secure enclosure in such
a manner that such dog or cat cannot come into contact with another animal except for planned
breeding.

Sec. 1-4-19. Vicious animals.
It shall be unlawful for any owner to keep any vicious animal within the county unless it is
confined within a secure building or secure enclosure or unless it is securely muzzled and
under restraint.

Sec. 1-4-20. Dangerous dogs.
(a) Adoption of Sections 767.10 through 767.14, Florida Statutes, (1993 and 1994). Sections
767.10, Florida Statutes, through and including Section 767.14, Florida Statutes (1993), and
all subsequent amendments regulating dangerous dogs, as defined in Section 767.11(1),
Florida Statutes, are adopted by reference and incorporated herein and shall apply to the
unincorporated areas of the county.
(b) Fee. The annual fee for issuance of dangerous dog certificates of registration shall be
established by resolution of the board of county commissioners.
(c) Classification.
(1) The public safety manager shall investigate reported incidents involving any dog that
may be dangerous, as defined in F.S. § 767.11(1), and shall, if possible, interview the
owner and require a sworn ~davit from any person, including any animal control
officer or enforcement officer, desiring to have a dog classified as dangerous. Any dog
that is the subject of a dangerous dog investigation, that is not impounded by the
county, shall be humanely and safely confined by the owner in a securely fenced or
enclosed area pending the outcome of the investigation and resolution of any hearings
related to the dangerous dog classification. The address of where the animal resides
shall be provided to the public safety manager. No dog that is the subject of a
dangerous dog investigation may be relocated or ownership transferred pending the
outcome of an investigation or any hearings related to the determination of a
dangerous dog classification. In the event that a dog is to be destroyed, the dog shall
not be relocated or ownership transferred.

(2) When any violation of this article results in the destruction or loss of personal
property;
(3) When an owner or person is cited with a second or subsequent violation of any part of
section 1-4-23, except for subsections (f) and (h);
(4) When a person is cited with a third or subsequent violation of any part of this article.
(g) If any person fails to pay the civil penalty, fails to appear in court to contest the citation,
or fails to appear in court as required herein, the court may issue an order to show cause. The
order shall require such persons to appear before the court to explain why action on the
citation has not been taken. If any person who is issued such order fails to appear in response
to the court's directive, that person may be held in contempt of court.

Sec. 1-4-27. ~aining requirements for animal control officers.
(a) Animal control officers who were not authorized prior to January 1, 1990, by St. Lucie
County to issue citations must successfully complete a forty-hour minimum standards training
course. Such course shall include, but is not limited to, training for: Animal cruelty
investigations, search and seizure, animal handling, courtroom demeanor, and civil citations.
The course curriculum must be approved by the Florida Animal Control Association. An animal
control officer who successfully completes such course shall be issued a certificate indicating
that he has received a passing grade. Pursuant to F.S. § 82827, a surcharge of two dollars
($2.00) upon each civil penalty imposed for violation of this article shall be collected and the
proceeds from such surcharge shall be used to pay the costs of the forty-hour minimum
standards training course for animal control officers.
(b) In order to maintain valid certification, every two (2) years each certified county animal
control officer shall complete four (4) hours of postcertification continuing education training.
Such training may include, but is not limited to, training for: Animal cruelty investigations,
search and seizure, animal handling, courtroom demeanor, and civil citations.

Sec. 1-4-28. 15raveling animal shows-Permit required.
(a) The owner or operator of any traveling animal show desiring to operate in the
unincorporated area of St. Lucie County, Florida shall make written application for permit on
forms provided by the animal control division no later than si~y (60) days prior to the first
performance of any spectacle, display, act or event within the county. Such application shall
include but not be limited to the name of the owner of the traveling animal exhibition, all
proposed locations within the county for the traveling animal show, the date the animal show
is to arrive within the county, the date of departure and all dates on which it is perform at any
location within the county. The applicant shall further provide proof of the following:
1. Current liability insurance with coverage of one hundred thousand dollars ($100,000.00)
per person, three hundred thousand dollars ($300,000.00) per occurrence, with a
maximum deductible of ten thousand dollars ($10,000.00).

2. All applicable state inspection certificates including a current USDA permit.
3. A veterinarian on duty if the show involves wildlife or captive wild animals.
4. A permit fee of fifty dollars ($50.00) shall be paid at the time the application for permit
was made.
(b) The term "traveling animal show" shall be defined as follows: Any spectacle, display, act
or event, including circuses and carnivals, where animals are maintained, whether or not the
animals actually perform, whose owners or operators do not have their principal place of
business in the county and which is required to obtain an occupational license pursuant to
chapter 1-12 of the St. Lucie County Code and Compiled Laws.

AR,TICLE III. REGISTR.ATION
Sec. 1-4-29. Registration required; effect on dogs or cats in egistence on the effec-
tive date of the article.
Except as otherwise provided herein, it shall be unlawful for any person to own, keep,
harbor, maintain, or have custody of any dog or cat four (4) months or older, unless such dog
or cat has been currently registered in accordance with the provisions of this article. Any dog
or cat four (4) months or older on the effective date of the ordinance from which this article
derives and which has a current valid rabies vaccination as of the effective date shall be
registered in accordance with the provisions of this article.

Sec. 1-4-30. Issuance of animal registration/identification tags.
(a) All owners or custodians of dogs and cats in the unincorporated areas of St. Lucie
County shall obtain a St. Lucie County registration/identification tag for each dog and cat by
the age of four (4) months that they own, keep, harbor, maintain, or have in custody as follows:
(1) Within thirty (30) days of acquiring the dog or cat; or
(2) Within thirty (30) days after the owner or custodian takes residence in the unincor-
porated areas of St. Lucie County, whichever occurs later.
(b) Except as provided herein, registration/identification tags should be securely fastened
about the animal's neck by a collar or other device so as to be clearly visible at all times. Dogs
and cats not so registered/identified may be considered stray and in violation of section 1-4-22
and may be impounded as therein provided. A vaccination certificate and if applicable, a
sterilization certificate, issued by a veterinarian must accompany all applications for a St.
Lucie County registration/identification tag.
(c) The registration/identification tag shall be valid for one (1) year from the date of
issuance or date of the rabies vaccination, whichever is earlier for unsterilized animals and for
the lifespan of sterilized animals.

(d) Animal owners or custodians shall purchase a registration/identification tag directly
from (1) any participatingveterinarians' office displaying the St. Lucie CountyAnimal Control
Division Seal, and (2) the Humane Society of St. Lucie County, Inc., 100 Savannah Road, Fort
Pierce, Florida 34982. Such request shall include proof of current vaccination affidavit as set
forth above in subsection 1-4-30(b) and a sterilization certificate duplicate copy, if applicable.
Participating veterinarians shall provide the Humane Society of St. Lucie County, Inc., with a
list of all licenses issued which shall maintain a database of such information. The fees for
registrationlidentification tags shall be established by resolution of the board. The county shall
pay participating veterinarians and the Humane Society of St. Lucie County, Inc., respectively,
the sums to be determined by resolution of the board for each registration/identification tag
sold.
(e) No registration/identification tag shall be transferable from one animal to another nor
from one owner to another. Upon transfer of a previously registered animal to a new owner or
custodian, the owner or custodian shall have a period of thirty (30) days within which to
comply with the requirements of this article.
(f) Net proceeds accruing to the county from the sale of cat or dog registration/identification
tags shall be turned over to the clerk of the circuit court to be placed in a fund designated as
the "Animal Registration Fund." The proceeds shall be used for spay/neuter programs in St.
Lucie County operated by the St. Lucie County Humane Society.
(g) The registration provisions of this article shall not apply to:
(1) Any owner or custodian who is a nonresident or temporary resident, as defined herein,
provided that the owner's animal has been vaccinated for rabies, which vaccination
remains valid under the laws of St. Lucie County for the duration of the anticipated
stay within the unincorporated areas of the county. A"temporary resident" as used
herein shall be defined to mean a person who intends to reside in the unincorporated
areas of the county for a total period of less than six (6) months during any
twelve-month period. All other requirements including but not limited to restraint
obligations shall apply;
(2) The ownership, care, custody or maintenance, in the ordinary course of business, of
any animal by a research or veterinary medical facility, government operated or
authorized animal shelter, humane society facility, boarding facility, or commercial pet
shop, provided that said shelter, facility, or shop is operating in accordance with all
applicable occupational licensing and zoning ordinances;
(3) Dogs and cats kept on property zoned AG-1, AG-2.5, AG-5, or PUD where livestock is
permitted; or,
(4) Service and/or therapy dogs and cats, including but not limited to guide dogs for
persons with visual impairment.

§ 1-4-31 ST. LUCIE COUNTY CODE
Sec. 1-4-31. Breeder registration required.
It shall be unlawful for any person to operate as a cat or dog breeder unless such person has
been currently registered as a breeder in accordance with the provisions of this article. Any
breeder shall be registered in accordance with the provisions of this article.

Sec. 1-4-32. Issuance of breeder registration certificate.
(a) All breeders of cats and/or dogs in the unincorporated areas of St. Lucie County shall
obtain an annual St. Lucie County breeder registration certificate on or before October 1 of
each year.
(b) The breeder registration number shall be included in all advertisements for sale of any
animals offered for sale or breeding by the breeder.
(c) Breeders shall obtain a registration certificate directly from (1) any participating
veterinarians' office displaying the St. Lucie County Animal Control Division Seal, and (2) the
Humane Society of St. Lucie County, Inc., 100 Savannah Road, Fort Pierce, Florida 34982.
Such request shall include proof of current vaccination affidavit as set forth above in
subsection 1-4-30(b) and a sterilization certificate duplicate copy, if applicable. Participating
veterinarians shall provide the Humane Society of St. Lucie County, Inc., with a list of a11
licenses issued which shall maintain a database of such information. The fees for breeder
registration shall be established by resolution of the board. The county shall pay participating
veterinarians and the Huxnane Society of St. Lucie County, Inc., respectively, the sums to be
determined by resolution of the board for each registration certificate issued.
(d) The breeder registration certificate shall be non-transferable.
(e) Net proceeds accruing to the county from the sale of breeder registration certificates
shall be turned over to the clerk of the circuit court to be placed in a fund designate as the
"Animal Registration Fund." The proceeds shall be used for spay/neuter programs in St. Lucie
County operated by the St. Lucie County Humane Society.

Sec. 1-4-33. Enforcement and penalties.
This article shall be enforced in accordance with the enforcement and penalty provisions set
forth in section 1-4-26.

Sec. 1-6.5-81. Boundaries.

Sec. 1-6.5-83. Special conditions.
The following special conditions shall apply to the creation, operation, and existence of
Tradition Community Development District No. 1:
(1) The powers and responsibilities of the ~adition Community Development District No.
1 shall be lixnited to the following:
To finance, fund, plan, establish, acquire, construct or reconstruct, enlarge or extend,
equip, operate, and maintain systems, facilities, and basic infrastructures for the
following:
a. Water management and control for the lands within the district and to connect
some or any of such facilities with roads and bridges;
b. Water supply, sewer, and wastewater management, reclamation, and reuse or
any combination thereof, and to construct and operate connecting intercepting or
outlet sewers and sewer mains and pipes and water mains, conduits, or pipelines
in, along, and under any street, alley, highway, or other public place or ways, and
to dispose of any ef~luent, residue, or other byproducts of such system or sewer
system;
c. Bridges or culverts that may be needed across any drain, ditch, canal, floodway,
holding basin, excavation, public highway, tract, grade, fill, or cut and roadways
over levees and embankments, and to construct any and all of such works and
improvements across, through, or over any public right-of-way, highway, grade,
fill, or cut;
d. 1. District roads equal to or exceeding the specifications of the county in which
such district roads are located, and street lights;
2. Buses, trolleys, transit shelters, ridesharing facilities and services, parking
improvements, and related signage;
e. Investigation and remediation costs associated with the cleanup of actual or
perceived environmental contamination within the district under the supervision
or direction of a competent governmental authority unless the covered costs
benefit any person who is a landowner within the district and who caused or
contributed to the contamination;
f. Conservation areas, mitigation areas, and wildlife habitat, including the main-
tenance of any plant or animal species, and any related interest in real or
personal property;
g. Parks and facilities for indoor and outdoor recreational, cultural and educational
uses;
h. Fire prevention and control, including water mains and plugs, (but excluding fire
stations, fire trucks and other vehicles and equipment);

i. School buildings and related structures, which may be leased, sold or donated to
the school district, for use in the educational system, when authorized by the
district school board; and,
j. Security, including, but not limited to, guardhouses, fences and gates, electronic
intrusion detection systems, and patrol cars, when authorized by proper govern-
mental agencies; except that the district may not exercise any police power, but
may contract with the appropriate local general purpose government agencies for
an increased level of such services within the district boundaries.
The commission further consents to provide the district of the right and power of
eminent domain, pursuant to Chapter 73, Florida Statutes and Chapter 74, Florida
Statutes, over any property outside the boundaries of the district and within the
unincorporated areas of the county (except municipal, county, state and federal
property) for the uses and purposes of the district relating solely to water, sewer,
district roads, and water management, specifically including, without limitation, the
power of eminent domain for the taking of easements for the drainage of the land of one
person over and through the land of another; provided, however, that the district shall
exercise the eminent domain power only if for uses and purposes contemplated by,
consistent with or in furtherance of the requirements of approved development
permits or development orders relating to the real property within the district.
The foregoing powers shall be in addition, and supplemental, to the powers which the
district is entitled to exercise pursuant to Chapter 190, Florida Statutes.
(2) The district will use its best efforts to develop in an integrated fashion the traffic
circulation, water, and sewer facilities on the district property as one (1) functional
interrelated community.
(3) The district shall take no action which is inconsistent with the comprehensive plan,
ordinances or regulations of St. Lucie County.
(4) No publicly owned property that may be located or acquired within the legal
description of this Community Development District shall be assessed for, or obligated
in any way to pay for the infrastructure constructed, maintained, or operated by the
Community Development [District] described in section 1.6-5.81 above.

AR.TICLE I. IN GENERAI.*
Sec. 1-7-1. Additional costs for law enforcement training.
Every court in the county created by Article V of the State Constitution shall assess four
dollars and fifty cents ($4.50) pursuant to F.S. §§ 318.18(11)(c) and 938.15, to the three dollars
($3.00) assessed by F.S. § 938.01(1), as a court cost against every person convicted for violation
of a state penal or criminal statute or convicted for violation of a municipal or county ordinance
or non-criminal infraction. However, no such assessment shall be made against any person
convicted for violation of any state statute, municipal ordinance, or county ordinance relating
to the parking of vehicles. All such costs collected by the aforesaid courts shall be deposited in
a special grant fund of the county to be used for law enforcement training expenditures by said
county.

Sec. 1-7-2. Assessment of additional court costs.
(a) The court shall assess court costs of sixty-five dollars ($65.00) per case, in addition to
any other authorized cost or fine, on every person who pleads guilty or nolo contendre to, or is
found guilty of, or adjudicated delinquent for, any felony, misdemeanor, delinquent act, or
criminal traffic offense under state law.
(b) The clerk of the circuit and county court ("clerk") shall collect the sixty-five dollar
($65.00) court costs assessed by the court and deposit those funds in a separate, designated
account established by the clerk. The clerk shall release funds to the board upon request.

Sec. 1-7-3. Allocation of additional court costs.
The additional court costs imposed pursuant to section 1-7-2 of this Code shall be used only
in St. Lucie County, to be allocated as follows:
(1) ~venty-five (25) per cent of the axnount collected shall be allocated to fund innovations
to supplement state funding for the elements of the state courts system identified in
F.S. § 29.004, and county funding for local requirements under F.S. § 29.008(2)(a)2.

(2) 1t~venty-five (25) per cent of the amount collected shall be allocated to assist counties
in providing legal aid programs required under F.S. § 29.008(3)(a).
(3) 1t~venty-five (25) per cent of the amount collected shall be allocated to fund personnel
and legal materials for the public as part of a law library.
(4) Zt~venty-five (25) per cent of the amount collected shall be used as determined by the
board to support juvenile assessment centers, and other juvenile alternative programs.

Sec. 1-7-4. Quarterly reports required; priority; indigency.
The board shall report the amount of funds collected pursuant to this section and itemized
list of expenditures for all authorized programs and activities. The report, in a format
developed by the Supreme Court, shall be submitted to the Governor, the Chief Financial
Officer, the President of the Senate, and the Speaker of the House of Representatives on a
quarterly basis beginning with the quarter ending September 30, 2004. Quarterly reports shall
be subxnitted no later than thirty (30) days after the end of the quarter. Any unspent funds at
the close of the county fiscal year allocated under subparagraphs (2), (3), and (4) of section
1-7-3, shall be transferred for use pursuant to subparagraph (1) of section 1-7-3.
The disbursement of costs collected under this section shall be subordinate in priority order
of disbursement to all other state-imposed costs, restitution or other compensation to victims,
and child support payments.
If a person is determined to be indigent, the clerk shall defer payment of this cost.

Sec. 1-7-5. Disposition of law library funds.
All additional costs collected for the law library shall be set aside by the clerk to be used
exclusively for the establishment and maintenance of the county law library. At the end of each
month, such clerk will turn over such funds so collected to the board of trustees of the county
law library as provided in Chapter 57-1790, Laws of Florida as amended by Chapter 71-895,
Laws of Florida.

Sec. 1-7-6. Disposition of legal aid fund.
All additional costs collected for the pro bono legal aid program shall be set aside by the
clerk in a separate account to be used egclusively to fund the pro bono legal aid program under
the supervision of the St. Lucie County Bar Association for the Nineteenth Judicial Circuit or
its designee.

Sec. 1-7-7. Civil traffic infraction fund.
Effective November 1, 1999, there is created a separate fund titled "civil traffic infraction
fund". All monies deposited in the fund by the clerk pursuant to administrative order shall be
used to pay expenses of the civil traffic hearing officer program as approved by the chief judge
of the Nineteenth Judicial Circuit pursuant to the budget for the program established by the
board of county commissioners.

Sec. 1-7-8. Imposition of surcharge for state court facilities.
Pursuant to F.S. § 318.18(13), a court shall charge a surcharge of fifteen dollars ($15.00) for
any non-criminal traffic infraction in St. Lucie County pursuant to F.S. Ch. 318, or for criminal
violations in St. Lucie County listed in F.S. § 318.17, to assist in the cost of providing and
maintaining state court facilities in St. Lucie County. When assessed, the funds will be paid to
the clerk. The clerk will forward to the board on a monthly basis, those costs collected pursuant
to F.S. § 318.18(13), for deposit of said funds into a special and separate account titled "Court
Facilities Fund" as established in section 1-7-9 of the Code.

Sec. 1-7-9. Disposition of state court facilities funds from the surcharge; accounting
by clerk of the court.
Court Facilities Fund - Surcharge: Seventy-five (75) per cent of all moneys collected from the
surcharge imposed by section 1-7-8 shall be set aside by the clerk in a special and separate
account titled "Court Facilities Fund" to be used exclusively for the construction, operation and
maintenance of state court facilities as determined by the board. Twenty-five (25) per cent of
the moneys collected from the surcharge shall be set aside by the clerk in a special and
separate account titled "Law Library Fund" to be used to support the Rupert J. Smith Law
Library.
The clerk in his capacity as accountant to the board shall provide to the board an annual
financial report on the "Court Facilities Fund" outlining the amount of court costs collected,
expenditures and earnings from the investment of said funds.

Sec. 1-7-10. Assessment of court costs to be used for the operation and administra-
tion of teen court programs.
(a) The court (both county and circuit) shall assess court costs of three dollars ($3.00) per
case, in addition to any other authorized cost or fine, against every person who pleads guilty
or nolo contendere to, or is convicted of, regardless of adjudication, or adjudicated delinquent
for a violation of criminal law, a delinquent act, or a municipal or county ordinance, or who
pays a fine or civil penalty for any violation of F.S. ch. 316. Any person whose adjudication is
withheld under F.S. § 318.14(9) or (10) shall also be assessed such cost. The assessment for
court costs shall be assessed in addition to any fine or civil penalty or other court cost and may

not be deducted from the proceeds of that portion of any fine or civil penalty that is received
by a municipality in the county or by the county in accordance with F.S. §§ 316.660 and 31821.
The assessment shall be specifically added to any civil penalty paid for a violation of F.S. ch.
316 regardless of whether the penalty is paid by mail, paid in person without request for a
hearing, or paid after hearing and determination by the court. However, the assessment may
not be made against a person for a violation of any state law or municipal or county ordinance
relating to the parking of vehicles, with the exception of the violation of the handicapped
parking laws.
(b) The clerk of the court shall collect the assessments for court costs collected pursuant to
this section and shall remit the assessments to the teen court monthly, less five (5) per cent,
which is to be retained as fee income of the of~`ice of the clerk of the circuit court. The teen court
must account for all funds received under this section in a written report to the board by
August 1 of each year.

This article is enacted pursuant to the authority vested in the board of county commission-
ers by virtue of F.S. Ch. 125, and F.S. §§ 893.13 and 893.165.

Sec. 1-7-21. Definitions.
For the purpose of this article, the following terms have only those meanings ascribed to

Board of county commissioners shall mean the board of county commissioners of St. Lucie
County, Florida.
Chief judge shall mean the chief judge of Florida's Nineteenth Judicial District.
Clerk shall mean the clerk of the circuit court and county court of Florida's Nineteenth
Judicial District and accountant to the board of county commissioners.
County shall mean the incorporated and unincorporated areas of St. Lucie County, Florida.

Defenddnt shall mean a person charged with a criminal action pursuant to Chapter 839,
Florida Statutes.

Sec. 1-7-22. Creation of fund and accounting.
(a) Pursuant to Section 893.13, Florida Statutes, the court may assess any defendant, on or
after February 1, 1989, who is found guilty of, or pleads nolo contendere to, a violation of any
provision of Chapter 893, Florida Statutes, or which involves a criminal violation of Section
316.193, Section 856.011, Section 856.015, or Chapter 562, Chapter 567, or Chapter 568,
Florida Statutes, in addition to any fine and other penalty imposed by law for any criminal
offense under this chapter or for any criminal violation of Section 316.193, Section 856.011,
Section 856.015, or Chapter 562, Chapter 567, or Chapter 568, Florida Statutes, an amount up
to the amount of the fine authorized for the violation. Such additional assessment shall be used
for alcohol and other drug abuse programs as provided by general law and this article.
Pursuant to Section 893.13, Florida Statutes, the court is authorized to order a defendant to
pay such assessment if it finds that the defendant has the ability to pay the fine and the
additional assessment, and the defendant will not be prevented from being rehabilitated or
from making restitution.
(b) Once assessed, the clerk will keep a record of assessments and those assessments shall
be collected by the clerk. The clerk shall forward all monies collected to the board of county
commissioners for deposit into a special and separate account titled "alcohol and other drug
abuse trust fund." Once each month, the board of county commissioners shall require a full
report from the clerk as to the amount of assessments imposed by its courts, the amount of
funds collected and deposited into the alcohol and other drug abuse trust fund, and amount of
expenditures from the alcohol and other drug abuse trust fund.

Sec. 1-7-23. Expenditures.
Monies deposited into the alcohol and other drug abuse trust fund shall be used to
financially assist alcohol and other drug abuse treatment and education programs. In order to
receive assistance grants from the alcohol and other drug abuse trust fund, county alcohol and
other drug abuse treatment or education programs shall be selected as program recipients on
the basis of selection procedures which shall be developed by the county administrator. Such
procedures shall include as a basis for selection the success of the program. Final approval
shall be made by the board of county commissioners upon recommendation by the county
administrator, and selections shall be made annually.

expenditures from the Driver Education Safety ~4~ust Fund.

Sec. 1-12-16. Definitions.
For purposes of this article, the following terms shall have the meanings indicated:
(1) Business, profession and occupation do not include the customary religious, charitable
or educational activities of nonprofit religious, nonprofit charitable and nonprofit
educational institutions in this state; which institutions are more particularly defined
and limited in this section as follows:
a. Charitable institutions shall mean only nonprofit corporations operating physical
facilities in the state at which are provided charitable services, a reasonable
percentage of which shall be without cost to those unable to pay.
b. Educational institutions shall mean state tax-supported or parochial, church and
nonprofit private schools, colleges or universities conducting regular classes and
courses of study required for accreditation by or membership in the Southern
Associations of Colleges and Secondary Schools, Department of Education or the
Florida Council of Independent Schools. Nonprofit libraries, art galleries and
museums open to the public are defined as educational institutions and eligible
for exemption.
c. Religious institutions shall mean churches and ecclesiastical or denoxninational
organizations, or established physical places for worship in this state at which
nonprofit religious services and activities are regularly conducted and carried on,
and shall also mean church cemeteries.
(2) Business toae means the fees charged and the method by which the county grants
the privilege of engaging in or managing any business, profession, or occupation

within the unincorporated areas of the county. It does not mean any fees or
license paid to any board, commission, or officer for permits, registration,
examination, or inspection. Unless otherwise provided by law, these are deemed
to be regulatory and in addition to, but not in lieu of, the local business tax
imposed under this article.
(3) Business tax receipt means the document that is issued by the tax collector which
bears the words "Local Business Tax Receipt" and evidences that the person in
whose name the document is issued has complied with the provisions of this
article relating to the business tax.
(4) Classification means the method by which a business or group of businesses is
identified by size or type, or both.
(5) Person means any individual, person, firm, partnership, corporation, association,
executor, administrator, trustee, joint adventure, estates, trusts, business trusts,
syndicates, fiduciaries, and all other business groups or combinations.
(6) Taxpayer means any person liable for taxes imposed under the provisions of this
article, any agent required to file and pay any taxes imposed, hereunder, and the
heirs, successors, assignees and transferees of any such person or agent.
(7) Economic development means processes or activities designed to promote, create
and/or maintain long-term economic stability, and to provide quality employment
opportunities for the residents of St. Lucie County.

Sec. 1-12-17. Payment of tax prerequisite to engaging in business, etc.; exception as
to vehicles used in licensed business.
No person shall engage in or manage any business, profession or occupation, in the county
for which a business tax is required by this article or other law of the state, unless a county
business tax receipt shall have been procured from the tax collector for the county. Such receipt
shall be issued to each person upon receipt of the amount provided in this chapter or as may
be otherwise provided by law. Furthermore, fees or licenses paid to any board, commission or
officer for permits, registration, examination or inspection, shall be deemed to be regulatory
and in addition to and not in lieu of any business tax license required by this article or other
law unless otherwise expressly provided by law.

Sec. 1-12-18. Date due of business tag; delinquency.
(a) All business taxes collected by the county tax collector beginning August 1 of each year,
are due and payable on September 30 of each year and shall expire on September 30 of the
succeeding year. In the event that September 30 falls on a Saturday, Sunday or holiday, the tax
shall be due and payable on or before the first working day following September 30.

(b) Those business t~es not paid by October 1 shall be considered delinquent and subject
to a delinquency penalty of ten (10) per cent for the month of October, plus an additional five
(5) per cent penalty for each month of delinquency thereafter until paid; provided that the total
delinquency penalty shall not exceed twenty-five (25) per cent of the business tax for the
delinquent establishment. In addition to the penalty, the tax collector shall be entitled to a
collection cost fee, based on original tax plus penalty, which shall be collected from delinquent
taxpayers at the same time of the payment of business tax and penalty:

Any person who engages in or manages any business, occupation, or profession without first
paying the business tax, if required, is subject to a penalty of twenty-five (25) per cent of the
t~ due, in addition to any other penalty provided by law or ordinance.
However, any person who engages in any business, occupation, or profession who has not
paid the required business tax within one hundred fifty (150) days of the initial tax due notice
shall automatically be liable for a penalty of two hundred fifty dollars ($250.00), and will be
subject to a civil action, including court costs, reasonable attorneys' fees, and additional
administrative costs incurred as a result of collection efforts.
(c) It shall be the duty of every person taking over or purchasing an existing business,
which is required to pay a business tax under this chapter, to notify the tax collector of the
county within thirty (30) days.

Sec. 1-12-19. Application for business tax receipt.
(a) No business tax receipt shall be issued except upon written application of the person
applying for the same. The t~ collector, before issuing a business tax receipt based wholly or
in part upon capacity, number of persons employed, or any other contingency, shall require the
person applying for such business tax receipt to file a statement giving full and complete
information relative to the capacity, number of persons employed, or other contingency, as the
case may be. The applications and statements required by this section shall be retained as a
part of the records of the tax collector's office.
(b) Any person who, in applying to the tax collector for a business tax receipt based upon
capacity, number of persons employed, or any other contingency, shall make a false statement
of capacity, number of persons employed, or other contingency, shall be deemed guilty of a
misdemeanor of the second degree, punishable as provided in F.S. § 775.082 or § 775.083.

Sec. 1-12-20. Issuance of business tag receipt; display.
The tax collector shall issue a business tax receipt to the person paying the amount therefor.
The tax collector shall make a duplicate of each business tax receipt issued. The person
obtaining the business tax receipt shall keep the same displayed conspicuously at the place of
business and in such a manner as to be open to the view of the public and subject to the
inspection of all duly authorized officers of the county.

Sec. 1-12-21. 1~ansfers of business tax receipts.
All business tax receipts may be transferred to a new owner with the approval of the tax
collector and upon presentation of a new application and a transfer fee of up to ten (10) per cent
of the annual business tax, but not less than three dollars ($3.00) nor more than twenty-five
dollars ($25.00) provided there is a bona fide sale of the business. The new owner must present
such evidence and the original business tax receipt for the transfer. Further, upon written
request and presentation of such business tax receipt, the business tax receipt may be
transferred from one location to another location with the county with the approval of the tax
collector and a transfer fee of up to ten (10) per cent of the annual business tax, but not less
than three dollars ($3.00) nor more than twenty-five dollars ($25.00). Such transferred
business tax receipt shall be of the same force and effect and for the same period as the original
business tax receipt.

Sec. 1-12-22. Disposition of taxes collected.
(a) The county shall retain all business tax revenues collected from business, professionals,
or occupations whose places of business are located within the unincorporated areas of the
county. Any business tax revenues collected by the county from businesses, professions, or
occupations whose places of business are located within a municipality, exclusive of the costs
of collection, shall be apportioned between the unincorporated area of the county and the
incorporated municipalities located therein by a ratio derived by dividing their respective
populations by the population of the county. As used in this section, the term "population"
means the latest official state estimate of population certified under F.S. § 186.901.
(b) The revenues so apportioned shall be sent to the governing authority of each munici-
pality according to its ratio and to the governing authority of the county according to the ratio
of the unincorporated area within fifteen (15) days following the month of receipt.
(c) The Clerk of the Circuit Court of St. Lucie County, acting as clerk and auditor to the
board is hereby authorized and directed to establish in the accounts of the board of county
commissioners a St. Lucie County Economic Development ~ust Fund. Seventy (70) per cent
of St. Lucie County's share of the proceeds of the business tax shall be placed in the St. Lucie
County Economic Development Trust Fund.

The board shall distribute such proceeds of the business tax that are placed in the St. Lucie
County Economic Development Trust Fund, plus accrued interest, to implement a compre-

Sec. 1-12-24. Lottery and gambling not authorized.
No provision of this chapter shall be construed to authorize gambling or the operation of a

Sec. 1-12-25. Ezemptions.
Exemptions shall be allowed as provided in F.S. Ch. 205, as it may be amended by the
Florida Legislature.

Sec. 1-12-26. Same-Farm, grove, horticultural, floricultural, tropical piscicultural
and tropical ~sh farm products.
(a) All farm, grove, horticultural, floricultural, tropical piscicultural and tropical fish farm
products and products manufactured therefrom, except intoxicating liquors, wine or beer, shall
be exempt from business t~, when the same is being offered for sale or sold by the farmer or
grower producing such products. The management of wholesale farmers' produce markets
shall have the right to pay a business tax of twenty-seven dollars and fifty-five cents ($27.55)
that will entitle its stall tenants to deal in agricultural and horticultural products without
obtaining individual business tax receipts, but individual receipts shall be required of such
tenants unless such receipt is obtained for the market.
(b) Every person, other than nonprofit cooperative associations, engaged in the business of
packing, processing or canning agricultural products not grown by him, shall for each place of
business pay a business tax of nine dollars and five cents ($9.05), plus one dollar and
ninety-five cents ($1.95) for each five (5) persons employed thereat; provided such licenses
shall not exceed twenty-seven dollars and fifty-five cents ($27.55).

Sec. 1-12-27. Advertising space renters.
Every person renting for profit advertising space in or on any boat, car, bus, truck or other
vehicle shall pay a license tax of one dollar and ninety-five cents ($1.95) for each such boat, car,
bus, truck or other vehicle operated by him.

Sec. 1-12-28. Amusement devices.
(a) Every person who operates for a profit any game, amusement or recreational device,
contrivance, or facility not otherwise licensed by some other law of the state shall pay a
business tax of nine dollars and five cents ($9.05) on each such gaxne, amusement or
recreational device, contrivance or facility.
(b) Any person who operates any of the above devices for profit under the sponsorship of a
merchant, hopping center or merchant's association, charitable, religious or educational
institution shall be subject to the business tax under this section. This business tax receipt
shall be good for one location only; however, the person may return to the same location during
the same tax year without obtaining an additional business tax receipt other than for any
additional devices.

Sec. 1-12-29. Hotels, apartment hotels, motels, etc.
(a) Every person engaged in the business of renting accommodations, except nontransiently
rented apartment houses shall pay for each place of business an amount of seventy-eight cents
($.78) for each room. However, no such establishment shall pay less than nine dollars and five
cents ($9.05) for such business tax receipt. The room count to be used in this section shall be
the same as used by the division of hotels and restaurants of the department of business
regulation.
(b) No business tax receipt shall be issued to any business coming under the provisions of
this section until a license has been procured for such business from the division of hotels and
restaurants of the department of business regulation.

Sec. 1-12-30. Cafes, restaurants and other eating establishments.
(a) Every person engaged in the business of operating a restaurant, cafe, snack bar, take
out service, dining room, drive-in eating establishment or other public eating place, whether
operated in conjunction with some other line of business or not, except dining rooms in licensed
public lodging establishments shall pay a business tax based on the number of people for whom
he has seats or accomxnodations for the service or consumption of food at any one tixne, in
accordance with the following schedule:
(1) Zero to thirty (30) seats, twenty dollars and sixty cents ($20.60).
(2) Over thirty-one (31) seats, twenty-seven dollars and fifty-five cents ($27.55).
(b) The seating capacity and classifications used by the division of hotels and restaurants
of the department of business regulation shall be used in this section.

Sec. 1-12-31. Contracting.
(a) Each person who contracts or subcontracts to construct, alter, repair, dismantle or
demolish buildings, roads, bridges, viaducts, sewers, water and gas mains or engages in the
business of construction, alteration, repairing, dismantling or demolition of buildings, roads,
bridges, viaducts, sewers, water and gas mains must obtain a license as a contractor. The
business tax shall be determined by the maximum number of persons actually employed or to
be employed during the t~ year in the county in which the work is performed and shall be at
the following rate:
(1) From one to ten (10), twelve dollars and thirty-five cents ($12.35).
(2) For eleven (11) to twenty (20), twenty-four dollars and seventy-five cents ($24.75).
(3) Over twenty-one (21), twenty-seven dollars and fifty-five cents ($27.55).
(b) In determining the number of persons employed, all principals shall be deemed
employees and be included in the calculation.

Sec. 1-12-32. Insurance adjusters.
All persons acting as insurance adjusters shall pay a business tax of nine dollars and five
cents ($9.05). The provisions of this section shall not apply to insurance agents.

Sec. 1-12-33. Manufacturing, processing, quarrying and mining.
(a) Every person engaged in the business of manufacturing, processing, quarrying or
mining must obtain a business tax receipt under this section. The amount of the business tax
shall be determined by the maximum number of persons actually employed, or to be employed,
during the tax year in the county in which the work is performed and shall be at the following
rates:
(1) One to ten (10) employees, twenty dollars and sixty cents ($20.60).
(2) Over eleven (11) employees, twenty-seven dollars and fifty-five cents ($27.55).
(b) No business tax receipt shall be required under this section where the manufacturing,
processing, quarrying or mining is incidental to and part of some other business classification
for which a business t~ receipt is required by this chapter and is carried on at the place of
business taxed under such classification.

Sec. 1-12-34. Pawnbrokers.
(a) Pawnbrokers shall keep a complete and true record of all transactions, showing from
who each article of their stock was purchased or pledged, the date of the transaction and the
date and to whom each article was sold, which record shall at all times be subject to the
inspection of all police or peace officers.
(b) Any person violating the provisions of this section shall be guilty of a misdemeanor.

Sec. 1-12-35. Pawnbrokers; reports to sheriff; penalty.
Every person engaged in the business of pawnbrokers, licensed under section 1-12-34 of this
article, shall make monthly reports to the St. Lucie County Sheriff of the information required
to be maintained by such pawnbrokers under the provisions of such section, and any person
failing to make such report shall be subject to the penalty provided in such section. Forms for
the preparation of the reports required herein shall be prescribed and furnished by the St.
Lucie County Sheriff.

Sec. 1-12-36. General business.
There is hereby created a new general business classification. Except as provided herein,
every person engaged in a business in St. Lucie County shall pay a license tax of twenty-seven
dollars and fifty-five cents ($27.55). Provided, however, that a business employing five (5) or
less employees shall pay a tax of fifteen dollars and ninety cents ($15.90). This will include
every person engaged in the practice of any profession who offers his service either directly or
indirectly to the public for a consideration whether or not such endeavor is required by law.
Every person engaged in a profession, business or occupation regulated by law where licensing
and qualification standards are required shall display and exhibit to the tax collector the
business tax receipt for the current year prior to the t~ collector issuing business tax receipt
pursuant to this chapter. A business tax receipt shall not be required where a person, although
licensed by law under a regulatory statute, is prohibited from engaging in a profession,
business or occupation unless under the direct supervision of another person, individual or
corporation. Every individual or group of individuals who operates a branch office, or any
professional corporation which operates an office in which a profession is practiced, shall
obtain a business tax receipt for each of~'ice in which the profession is practiced.

Sec. 1-12-37. Retail store license.
(a) For the privilege of conducting, engaging in and carrying on the business of a retailer as
defined in this section, there is hereby levied and assessed upon every person or association of
persons as herein defined, for each store located and operated within this state by such person
or association of persons, an annual business tax in the sum of twenty-seven and fifty-five
cents ($27.55).

(b) The following words, terms and phrases when used in this section have the meaning
ascribed to them, except where the context clearly indicates a different meaning:
Retailer includes every person engaged in the business of making sales at retail. Such term
shall not include bulk plants or filling stations engaging principally in the sale of gasoline and
other petroleum products; ice plants or ice dealers engaging principally in the sale of ice;
bakeries and other manufacturing or processing plants selling on the products manufactured
or processed therein; or restaurants, cafes, cafeterias, hotels and liquor stores; provided,
however, that where food or intoxicating liquors are sold in connection with a principal
business, but only incidental thereto, such principal business shall not be exempt from the
license tax imposed therein; provided, further, that, incidental sales not otherwise excepted in
this subsection made by a licensed wholesaler to consumers at wholesale prices, shall not be
construed to be retail sales unless such sales exceed five (5) per cent of such wholesaler's total
sale.
Retail sale or sale ¢t retail means any sale to a consumer or to any person for any purpose
other than for resale in the form of tangible personal property; provided, that, no sale shall be
construed to be a retail sale where goods, wares and merchandise are sold in wholesale
quantities at wholesale prices by licensed wholesale dealers under standing orders or through
outside salesmen as distinguished from sales of small packages at retail prices or is sold in
wholesale quantities and at wholesale prices or is sold in wholesale quantities and at
wholesale prices to any governmental institution, subdivision or agency.

Sec. 1-12-38. Trading, etc., in tangible personal property.
(a) Every person engaged in the business of trading, bartering, serving, or selling tangible
personal property, as owner, agent, broker or otherwise, shall pay a business tax of twenty
dollars and sixty cents ($20.60) which shall entitle him to maintain one (1) place of business,
stationary or movable, and shall pay sixteen dollars and fifty cents ($16.50) for each additional
place of business; provided that the business tax for each bulk plant or depot of wholesale
dealers in petroleum products shall be twenty-seven dollars and fifty-five cents ($27.55).
Vehicles used by any person for the sale and delivery of tangible personal property at wholesale
from his established place of business on which a business tax is paid shall not be construed
to be separate places of business, and no business tax may be levied on such vehicles or the
operators thereof as salesmen or otherwise.
(b) No business tax receipt shall be required under this section where the trading, buying,
bartering, serving or selling of tangible personal property is a necessary incident of some other
business classification for which a business tax receipt is required by this article and is carried
on at the place of business taxed under such other classification, nor shall this section apply
to any person engaged in the sale of motor vehicles or principally in the sale at retail of
gasoline and other petroleum products.

Sec. 1-12-39. Vending machines.
(a) As used in this section, the following words shall have the meanings set forth in this
subsection (a)
Laundry equipment means any equipment necessary for the operation of a coin-operated
laundry, including, washers, dryers, pressing or ironing machines and soap, bleach and
laundry bag dispensing machines.
Merchandise vending machines means any machine, contrivance or device which is set in
motion or made or perxnitted to function by the insertion of a coin, slug, token or paper
currency and dispenses merchandise without the necessity of replenishing the device between
each operation.
Merchandise uending machine operator means any person who operates for a profit
thirty-five (35) or more merchandise vending machines.
Seraice vending machine means any machine, contrivance or device which is set in motion
or made or permitted to function by the insertion of a coin, slug, token or paper currency and
which dispenses some service or amusement.
Seruice uending machine operator means any person who operates, for a profit, thirty-five
(35) or more service vending machines.
(1) Merchandise vending machines, nine dollars and five cents ($9.05) for each machine;
provided that when any merchandise vending machine is located in and operated only
in a place of business for which a license has been duly issued for trading, buying,
bartering, sexving or selling tangible personal property under this article or other laws
of this state, the business tax thereon shall be three dollars and thirty cents ($3.30) for
each machine.
(2) Merchandise vending machines operators, twenty-seven dollars and fifty-five cents
($27.55) for the privilege of engaging in such business and shall further pay an annual
license tax of seventy-eight cents ($.78) for each machine.
(3) Service vending machines, nine dollars and sixty cents ($9.60) for each machine.
(4) Service vending machine operators, twenty-seven dollars and fifty-five cents ($27.55)
for the privilege of engaging in such business, and shall further pay an annual license
tax of one dollar and ninety cents ($1.90) for each machine.
(5) Laundry equipment, seventy-eight cents ($.78) for each piece of equipment.
(6) Coin-operated radio, television and similar devices installed in businesses providing
housing accommodations for the traveling public, fourteen dollars and thirty cents
($14.30) for coin-operated radios, television sets, vibrating mattresses or similar
devices installed in guestrooms in hotels, tourist homes, tourist courts, rooming houses
and other businesses providing housing accommodations for the traveling public, and
further pay an annual license tax of thirty-two cents ($.32) for each machine.
(7) Penny vending machines, seventy-eight cents ($.78) for each machine.

(b) The following vending machines and lockers are exempt from the tax provided by this
section:
(1) All vending machines which dispense only United States postage stamps, unadulter-
ated Florida produced citrus juices or newspapers are hereby exempt from the
payment of any excise or license tax levied by the state or any county, municipality or
other taxing districts thereof.
(2) Penny operated vending machines located in licensed places of business and dispens-
ing only nuts, citrus juices and other food products.
(3) Coin-operated parcel checking lockers and toilet locks used in railroad, bus, airport
stations, or depots, and in hotels, boarding houses, restaurants and rest rooms for the
convenience of the public.

Sec. 1-12-41. Traveling junk dealers.
Each person who travels from place to place purchasing junk shall pay a license tax of
twenty dollars and sixty cents ($20.60) and shall, before leaving any municipality, submit to
the appropriate law enforcement agency a list of the junk he has purchased, together with the
names and permanent addresses of the persons from whom purchased.

ARTICLE III. PAR.I-M[JTUEL WAGERING FACILITIES
Sec. 1-12-61. Permit and license required.
Pari-mutuel wagering facilities in St. Lucie County holding valid permits and licenses
issued by the Division of Pari-mutuel Watering pursuant to F.S. Ch. 550 are hereby
authorized, pursuant to F.S. § 849.086, to conduct cardroom activities. Such cardroom
activities are to be conducted in accordance with F.S. § 849.086 and the rules promulgated
