As used in this article, the following terms shall be defined as follows: Board shall mean the Board of County Commissioners of St. Lucie County, Florida. County shall mean St. Lucie County, Florida, a political subdivision of the State of Florida. Facilities shall mean those public facilities or publicly operated facilities determined by the board to be critical to security or public safety. FBI shall mean the Federal Bureau of Investigation. FDLE shall mean the Florida Department of Law Enforcement. Private contractor shall mean any private contractor, employee of a private contractor, vendor, repair person, or delivery person. (Ord. No. 03-07, Pt. A, 1-7-2003) Sec. 1-2-67. Criminal history record check for certain employees and appointees. (a) In accordance with Section 125.5801, Florida Statutes, the county shall require employment screening as provided in this article for any position of county employment or appointment which the board finds is critical to security or public safety. The board shall adopt a resolution, which may be amended from time to time, setting forth a list of such positions. (b) Each person applying for, or continuing employxnent, in any such position shall be fingerprinted. The fingerprints shall be submitted to the FDLE for a state criminal history record check and the to the FBI for a national criminal history record check. (c) The county shall use the inforxnation obtained from the criminal history record checks conducted pursuant to this article to determine an applicant's eligibility for employment or appointment and to determine an employee's eligibility for continued employxnent. Except as otherwise provided herein, the county administrator, or his designee, shall be responsible for this determination. The county attorney shall be responsible for a making a recommendation to the board with regard to criminal history record checks obtained for applicants for the position of county administrator or an existing county administrator's continued employxnent. (Ord. No. 03-07, Pt. A, 1-7-2003) Supp. No. so 70.1 § 1-2-68 ST. LUCIE COUNTY CODE Sec. 1-2-68. Criminal history record check for certain private contractors. (a) In accordance with Section 125.5801, Florida Statues, the county shall require screen- ing as provided in this article for any private contractor who has access to any public facility or publicly operated facility which the board finds is critical to security or public safety. Definitions. Grdffiti: Any unauthorized inscription, word, figure, painting, or other defacement, that is written, marked, etched, sprayed, drawn, painted, or engraved on or otherwise affixed to any surface of any public or private property by any graffiti implement. Graf/"iti implement: An aerosol paint container, broad-tipped marker, gum label, paint stick or graffiti stick, etching equipment, brush or any other device capable of scarring or leaving a visible mark on any natural or manmade surface. (Ord. No. 07-057, Pt. A, 11-20-2007) Sec. 1-2-?0. Prohibited acts. It shall be unlawful for any person to apply graffiti to any natural or man-made surface on any property within the unincorporated county. (Ord. No. 07-057, Pt. A, 11-20-2007) Sec. 1-2-?l. Penalties. Any person violating section 1-2-70 shall be guilty of a second degree misdemeanor, in addition to any penalties that may be imposed by the state. In the case of a minor, the parents or legal guardian shall be jointly and severally liable with the minor for payment of all fines. Failure of the parents or legal guardian to make payment will result in the filing of a lien on the parents' or legal guardians' property that includes the fine and administrative costs. (Ord. No. 07-057, Pt. A, 11-20-2007) Supp. No. 80 7~.2 ADMINISTR,ATION § 1-2-73 Sec. 1-2-72. Accessibility to gr~ti implements. (a) It shall be unlawful for any person, other than a parent or legal guardian, to sell, exchange, give, loan or otherwise furnish, or cause or permit to be exchanged, given, loaned, or otherwise furnished, any aerosol paint container, broad-tipped marker, or paint stick to any person under the age of eighteen (18) years without the written consent of the parents or guardian of the person. (b) Every person who owns, conducts, operates, or manages a retail commercial establish- ment selling aerosol paint containers, paint sticks, or broad-tipped markers shall store the containers, sticks or markers in an area continuously observable, through direct visual observation or surveillance equipment, by employees of the retail establishment during the regular course of business. (c) In the event that a commercial retail establishment is unable to store the aerosol paint containers, paint sticks, or broad-tipped markers in an area as provided above, the establish- ments shall store the containers, sticks, and markers in an area not accessible to the public in the regular course of business without employee assistance. (d) Every person who operates a retail commercial establishment selling graffiti imple- ments shall also: (1) Place a sign in clear public view at or near the display of such products stating: "Graffiti is against the law. Any person who defaces real or personal property is guilty of a crime punishable by imprisonment of up to five years and/or a fine of up to $5,000.00." (2) Place a sign in the direct view of persons responsible for accepting customer payment for graffiti implements stating: "Selling spray paint, paint sticks, or broad-tipped markers to persons less than 18 years of age is against the law and punishable by a fine of $100.00." (e) Any person found in violation of section 1-2-72 shall be fined one hundred dollars ($100.00) for each offense. (Ord. No. 07-057, Pt. A, 11-20-2007) Sec. 1-2-73. Reward for information. The county may offer a reward in an amount to be established by resolution of the board for information leading to the identification and apprehension of any person who willfully damages or destroys any public or private property by the use of graffiti. In the event of damage to public property, the offender or the parents or legal guardian of any unemancipated minor must reimburse the county for any reward paid. In the event of multiple contributors of information, the reward amount shall be divided by the county in the manner it shall deem appropriate. Supp. No. 80 70.3 § 1-2-73 ST. LUCIE COUNTY CODE Claims for reward under this section shall be filed with the county in the manner specified by the board. No claim for reward shall be allowed unless the county investigates and verifies the accuracy of the claim and determines that the requirements of this section have been satisfied. (Ord. No. 07-057, Pt. A, 11-20-2007) Sec. 1-2-74. Public nuisance. The existence of graffiti on public or private property in violation of this article is expressly declared to be a public nuisance. (Ord. No. 07-057, Pt. A, 11-20-2007) Sec. 1-2-75. Responsibility of property owner; notice of defacement. Prior to taking any code enforcement board action, the county shall work with the property owner to achieve voluntary graffiti removal, including using any funds which may be available in the Anti-Graf~ti 14~ust Fund. (1) It shall be the responsibility and duty of any person who is the owner of, or who has primary responsibility for, control, repair, or maintenance of property within the county to at all times keep the property free of graffiti. (2) It shall be the responsibility and duty of any person who is the owner of, or who has primary responsibility for, control, repair, or maintenance of property within the county to abate the nuisance by removal of any gr~ti from such property within ten (10) days after service of notice of defacement. (3) When a code enforcement officer of the county finds graffiti on public or private property in violation of the provisions of this article the code enforcement officer shall cause a notice to be placed upon the property. Such notice shall be sufficient to withstand normal exposure to the elements for a period of ten (10) days. (4) The notice of the e~ustence of graffiti shall contain the following information: a. The name of the property owner or person in primary control of the property. b. The street address and description of the property sufficient for identification of the property. c. A statement that the property is a nuisance, with a concise description of the conditions leading to the finding. d. A statement that the graffiti must be removed within ten (10) days after receipt of the notice and that, if the gr~ti is not abated within this time, the county will declare the property to be a public nuisance subject to abatement by the county, and that the owner will be liable for the costs of the abatement. e. The date of the placement of the notice. f. The signature, title, address, and telephone number of the code enforcement officer giving the notice. Supp. No. 80 70.4 ADMINISTRATION § 1-2-77 (5) If graf~iti appears on private property, the code enforcement officer shall also mail a copy of the notice to the owner of the private property upon which the graffiti appears as shown by the current ad valorem taY records of the county property appraiser. 1'he notice shall also advise the persons to whom the notices are applicable that they have seven (7) days from the date of the mailing of the notice to file a written petition to the code enforcement division for a hearing before the code enforcement board to contest the notice that graffiti exists on the property or, if eligible, to file an application with the code enforcement division for assistance with removal of the graffiti. The hearing before the code enforcement board shall be held at the next regularly scheduled hearing date following receipt of the request by the code enforcement division. (Ord. No. 07-057, Pt. A, 11-20-2007) Sec. 1-2-76. Right of entry on private property. If the code enforcement officer has reason to believe that the nuisance presents a serious threat to public health, safety or welfare, as described in subsection 1-2-22(c) of this Code, and the property owner or such other responsible person fails to remove the offending graffiti within the time specified in the notice, or if the county has requested consent to remove the graffiti and the property owner or such other responsible person has refused consent for entry on terms acceptable to the county and consistent with the terms of this article, the code enforcement division shall notify the board of county commissioners, which may direct that all reasonable measures be taken to remove the nuisance, including entry onto private property. (Ord. No. 07-057, Pt. A, 11-20-2007) Sec. 1-2-77. Removal. (a) If the graffiti is not removed, the property owner shall be liable to the county for all costs incurred by the county in removing the nuisance, including supplies and labor. If an owner or interested person has not requested a hearing before the code enforcement board or has not applied for any available county assistance, as provided in section 1-2-72, within seven (7) days from the date of the notice, the county shall have the right to remove the graffiti at the expense of the owner. (b) If, at the end of ten (10) days after the date of the notice, the owner or any person interested in the property described in such notice has not removed the graf~`iti, the code enforcement officer may cause the graffiti to be removed. The work to remove or conceal the graffiti may be performed only on the areas covered or affected by the graffiti. Any paint or coverage material used need not match the color or texture of the unaffected areas of the property. The county will not be required to remove the graffiti to the satisfaction of the property owner. The services entailed in carrying out the removal of graffiti under this article may be performed by the county or be performed by an independent contractor obtained pursuant to the county's normal practices. (c) If the county has removed the gr~ti and payment is not received from the property owner within thirty (30) days thereafter, the county may place a lien against the property on which the graffiti was located, if applicable, or upon any real or personal property owned by the Supp. No. 80 70.~ § 1-2-77 ST. LUCIE COUNTY CODE violator, for the cost of the work, including inspection and administration costs, plus interest at the ma~mum rate allowable by law, reasonable attorney fees and the costs of collecting such sums without further hearing. (Ord. No. 07-057, Pt. A, 11-20-2007) Sec. 1-2-78. Anti-Graffiti Trust Fund. The board hereby creates the Anti-Graf~`iti ~ust Fund. Penalties assessed against violators of this article, along with monetary donations received from persons wishing to contribute to the fund, shall be placed into the Anti-Graffiti Trust Fund. Such fund shall be used for the payxnent of costs of graffiti removal, the payxnent of rewards for information leading to the conviction of a violation of this article, the costs of administering this article, and such other public purposes as may be approved by the board. (Ord. No. 07-057, Pt. A, 11-20-2007) Supp. No. 80 7~.6 LICENSES, PERMITS, REGULATIONS § 1-12-33 Sec. 1-12-31. Contracting. (a) Each person who contracts or subcontracts to construct, alter, repair, dismantle or demolish buildings, roads, bridges, viaducts, sewers, water and gas mains or engages in the business of construction, alteration, repairing, dismantling or demolition of buildings, roads, bridges, viaducts, sewers, water and gas mains must obtain a license as a contractor. The business tax shall be determined by the maximum number of persons actually employed or to be employed during the tax year in the county in which the work is performed and shall be at the following rate: (1) From one to ten (10), twelve dollars and thirty-five cents ($12.35). (2) For eleven (11) to twenty (20), twenty-four dollars and seventy-five cents ($24.75). (3) Over twenty-one (21), twenty-seven dollars and fifty-five cents ($27.55). (b) In deterxnining the number of persons employed, all principals shall be deemed employees and be included in the calculation. (Ord. No. 00-06, Pt. A, 9-19-2000; Ord. No. 05-014, Pt. A, 8-2-2005; Ord. No. 07-016, Pt. A, 9-4-2007) Sec. 1-12-32. Insurance adjusters. All persons acting as insurance adjusters shall pay a business tax of nine dollars and five cents ($9.05). The provisions of this section shall not apply to insurance agents. (Ord. No. 00-06, Pt. A, 9-19-2000; Ord. No. 05-014, Pt. A, 8-2-2005; Ord. No. 07-016, Pt. A, 9-4-2007) Sec. 1-12-33. Manufacturing, processing, quarrying and mining. (a) Every person engaged in the business of manufacturing, processing, quarrying or mining must obtain a business t~ receipt under this section. The amount of the business tax shall be determined by the maximum number of persons actually employed, or to be employed, during the t~ year in the county in which the work is performed and shall be at the following rates: (1) One to ten (10) employees, twenty dollars and sixty cents ($20.60). (2) Over eleven (11) employees, twenty-seven dollars and fifty-five cents ($27.55). (b) No business tax receipt shall be required under this section where the manufacturing, processing, quarrying or mining is incidental to and part of some other business classification for which a business tax receipt is required by this chapter and is carried on at the place of business taxed under such classification. (Ord. No. 00-06, Pt. A, 9-19-2000; Ord. No. 05-014, Pt. A, 8-2-2005; Ord. No. 07-016, Pt. A, 9-4-2007) Supp. No. 80 623 § 1-12-34 ST. LUCIE COUNTY CODE Sec. 1-12-34. Pawnbrokers. (a) Pawnbrokers shall keep a complete and true record of all transactions, showing from who each article of their stock was purchased or pledged, the date of the transaction and the date and to whom each article was sold, which record shall at all tixnes be subject to the inspection of all police or peace officers. (b) Any person violating the provisions of this section shall be guilty of a misdemeanor. (Ord. No. 00-06, Pt. A, 9-19-2000) Sec. 1-12-35. Pawnbrokers; reports to sheriff; penalty. Every person engaged in the business of pawnbrokers, licensed under section 1-12-34 of this article, shall make monthly reports to the St. Lucie County Sheriff of the information required to be maintained by such pawnbrokers under the provisions of such section, and any person failing to make such report shall be subject to the penalty provided in such section. Forms for the preparation of the reports required herein shall be prescribed and furnished by the St. Lucie County Sheriff. (Ord. No. 00-06, Pt. A, 9-19-2000) Sec. 1-12-36. General business. There is hereby created a new general business classification. Except as provided herein, every person engaged in a business in St. Lucie County shall pay a license tax of twenty-seven dollars and fifty-five cents ($27.55). Provided, however, that a business employing five (5) or fewer employees shall pay a tax of fifteen dollars and ten cents ($15.10). This will include every person engaged in the practice of any profession who offers his service either directly or indirectly to the public for a consideration whether or not such endeavor is required by law. Every person engaged in a profession, business or occupation regulated by law where licensing and qualification standards are required shall display and exhibit to the tax collector the business tax receipt for the current yeax prior to the tax collector issuing business tax receipt pursuant to this chapter. A business tax receipt shall not be required where a person, although licensed by law under a regulatory statute, is prohibited from engaging in a profession, business or occupation unless under the direct supervision of another person, individual or corporation. Every individual or group of individuals who operates a branch office, or any professional corporation which operates an office in which a profession is practiced, shall obtain a business tax receipt for each office in which the profession is practiced. (a) For the privilege of conducting, engaging in and carrying on the business of a retailer as defined in this section, there is hereby levied and assessed upon every person or association of persons as herein defined, for each store located and operated within this state by such person or association of persons, an annual business t~ in the sum of twenty-seven and fifty-five cents ($27.55). Supp. No. 80 624 TRAFFIC § 1-20-16 Road extending from North St. Lucie River Water Control District Canal No. 49 on the south to the northern terminus (North St. Lucie River Water Control District Canal No. 48) is restricted to the hours between sunrise and sunset on weekdays. (Ord. No. 84-07, Pt. A, 5-15-84) Sec. 1-20-5. Moving violation penalty surcharge. In addition to any other penalty for violation of the state uniform traffic control law, a surcharge of twelve dollars and fifty cents ($12.50) shall be assessed for each moving traffic violation pursuant to Section 316.655(6), Florida Statutes (1992). This surcharge shall be used to fund St. Lucie County's participation in an intergovernmental radio communication program as approved by the Division of Communications of the Florida Department of General Services. (Ord. No. 92-26, Pt. A, 11-24-92) Sec. 1-20-6. Turning movements. (a) Vehicle, for the purpose of this section, is defined as set forth in F.S § 316.003(75), as amended. (b) The Board of County Commissioners of St. Lucie County, Florida, is authorized to regulate or prohibit the turning of vehicles or specified types of vehicles at a previously advertised public hearing by resolution after determining that such regulation is reasonable and for the benefit of the public health, safety, or general welfare of the citizens of St. Lucie County. (c) All previous resolutions regulating vehicle turning movements adopted by the Board of County Commissioners of St. Lucie County, Florida, are hereby approved and incorporated as adopted. (Ord. Parking for longer than twenty-four hours restricted; removal of vehicles. (a) No person, as defined in F.S. § 1.01, shall park, leave or place any motor vehicle on the right-of-way of any public road in the unincorporated areas of the county for a period of more than twenty-four (24) hours unless: (1) It is in operating condition; and (2) It bears current license plates. LUCIE COUNTY CODE (b) Any motor vehicle not meeting the conditions of subparagraphs (a)(1) and (2) of this section and that is discarded, left or abandoned on any public road right-of-way in the unincorporated area of the county may be removed or caused to be removed by the sheriffs department of the county af'ter posting a notice on such vehicle advising that if such vehicle is not removed by the owner within forty-eight (48) hours, it will be removed or caused to be removed by the sheriffs department; provided, however, that, this paragraph shall in no way limit the sheriff or any other law enforcement agency's authority to remove vehicles from the paved or main traveled part of any highway under the provisions of F.S. § 316.194 (Ord. No. 78-6, § 1, 6-6-78; Ord. No. 98-25, Pt. A, 12-15-98; Ord. No. 07-012, Pt. A, 11-6-2007) Sec. 1-20-16.1. Authority; intent to supplement. This section is enacted pursuant to the authority granted in F.S. Ch. 125 and F.S. § 715.07 is intended to supplement the provisions of F.S. § 715.07, relating to towing of vehicles illegally parked on private property. (Ord. No. 07-012, Pt. A, 11-6-2007) Sec. 1-20-16.2. Definitions. For purposes of this article, the following definitions shall apply: Non-Consentual towing shall mean the recovery, towing, removal and storage of a vehicle or vessel without authorization of the vehicle/vessel owner or authorized driver and shall include both "Police Directed Tows" and "~espass Towing/Private Property Impounds" as defined herein. Relay towing shall mean the prohibited practice in which the towing wrecker operator removes a vehicle and takes it to an alternate location other than the storage lot in order to simultaneously remove multiple vehicles in a reduced amount of time, then later transporting all vehicles to the storage facility. Roam towing shall mean towing of vehicles as defined in trespass towing where the towing establishment has entered into a contract with a private property owner to roam their property during designated hours to remove illegally parked vehicles. Trespass towing shall mean towing or removal of a vehicle that is illegally parked on private real property, at the property owner's direction, without the consent of the vehicle's owner or operator, as such is authorized by F.S. § 715.07. (Ord. No. 07-012, Pt. A, 11-6-2007) Sec. 1-20-16.3. Fees. In addition to the other requirements of this article, no tow truck company shall, for compensation, recover, tow, or remove a vehicle/vessel or provide storage in connection therewith without the prior express instruction of the vehicle/vessel owner or authorized driver, except in accordance with the following: (1) Nonconsentual tow. (2) Private property impound. Tow truck companies may for compensation recover, tow or remove a vehicle/vessel based upon a private property impound without the prior express instruction of the vehicle/vessel owner or authorized driver, upon the prior express instruction of a real property owner or his authorized agent on whose property the vehiclebessel is disabled, abandoned or parked without authorization or whose vehicle/vessel owner or authorized agent is unwilling or unable to remove the vehiclebessel, provided that the requirements of this article are satisfied. The tow truck company recovering, towing or removing a vehicle/vessel shall, within thirty (30) minutes of completion of such towing or removal, notify the appropriate law enforce- ment agency in which jurisdiction the vehicle/vessel was parked of the nature of the service rendered, the name and address of the storage facility where the vehicle/vessel will be stored, the time the vehicle was secured to the towing vehicle, and the make, Supp. No. 80 lO7O.1 § 1-20-16.3 ST. LUCIE COUNTY CODE model, color and vehicle/vessel license plate number (if any). The tow truck company shall obtain the name of the person at the law enforcement agency to whom such information was reported and note that name on the trip record. a. Except as otherwise provided in this article, every prior express instruction made in writing or in person shall indicate the date and time of the instruction and shall be signed by real property owner/duly authorized agent in the presence of the tow truck company providing the service. The real property owner/the duly authorized agent shall also print his/her full name. b. Signing in the presence of the tow truck company/driver shall not be required for a prior express instruction made by the real property owner or authorized agent forwarded by facsimile transmission. All other requirements of this article shall apply and the real property owner or duly authorized agent shall provide in the facsimile instruction the specific location (i.e., address, parking space, etc.), color of the vehicle, make and/or model of the vehicle (if visible) and either the license tag number or the vehicle identification number (if available) prior to the vehicle/vessel being towed. Such facsimile instruction shall include the real property owner's or authorized agent's signature and printed or typed full name and title, as well as an electronic confirmation or electronic stamp of the date and time the instruction was sent to the tow truck company. The tow truck company shall maintain copies of facsimile instructions. c. If specifically approved in the contract for service, signing in the presence of the tow truck company/driver shall not be required when a vehicle/vessel is parked and blocking public egress/ingress to the business/residential area. In such cases the tow truck company is required to photograph the car and its location prior to removal and said photograph shall conclusively show that the vehicle is clearly in violation this subsection. The photograph must include a date and time stamp. d. No tow truck company/driver shall pay or rebate money, or solicit or offer the rebate of money, or other valuable consideration in order to obtain the privilege of rendering towing services. e. Except as otherwise provided in this article, no such prior express instruction shall be considered to have been given: By the mere posting of signage as required by chapter 175 of this article; 2. By virtue of the terms of any contract or agreement between a tow truck company and a real property owner; 3. When the prior express instruction occurs in advance of the actual unau- thorized parking of the vehicle/vessel; or 4. Where the prior egpress instruction is general in nature and unrelated to specific, individual and identifiable vehicles/vessels which are already parked without authorization. Supp. No. 80 1070.2 TRAFFIC § 1-20-16.3 f. Each tow truck company shall enter into a written contract with every owner of private property that authorizes the tow truck company to tow vehicles/vessels from its property. This written contract shall include the beginning date of said contract, the names and titles of all persons (i.e., owner, property manager, condominium president, etc.) who have the authority to appoint persons (i.e., security guard, night watchman, on-site manager, etc.) who can authorize prior express instruction to the tow truck company to remove, recover or tow any vehicle/vessel from its property. The written contract shall also include the name and current telephone number of the tow truck company performing the towing service. Any addendum to the contract shall include additional names and titles as necessary. The tow truck company must keep on file each contract and addendum (if applicable) with the property owner. Such contract shall be maintained for at least twelve (12) months after termination. The county and law enforcement officers may inspect and request a copy of any and all such contracts from the tow truck company during normal business hours. The tow truck company may not withhold production of the contract upon demand by the division or law enforcement. Failure to enter into or keep on file a contract with the property owner shall be a violation of this article. All contracts which were entered into prior to the effective date of this article, shall accomplish the requirements of this subsection by entering into an adden- dum to the current contract within one (1) year following the enactment of this article. g. No vehicle towed as the result of trespass towing shall be towed to and/or stored at a location more than fifteen-mile radius from the point of initiation of such trespass tow. No person who provides services (trespass, non-consent towing) pursuant to this section shall recover, tow, or remove a vehicle from this county to another county (or vice versus) for the purposes of trespass towing and impounding. h. Real property owners or authorized representatives shall not request the recovery, tow, or the removal of vehicles/vessels that are reasonably identi- fiable from markings or equipment as law enforcement, fire fighting, rescue squad, ambulance, or other emergency vehicles/vessels which are marked as such or to property owned by any governmental entity. i. Any person who improperly causes a vehicle/vessel to be recovered, towed, removed or stored shall be liable to the vehicle owner or authorized representative for the costs of the services provided, any damages resulting from the recovery, towing, removal or storage and attorney's fees and court costs. j. The maximum fee which may be charged on trespass towing of the vehicle/vessel as follows: Supp. No. 80 1070.3 § 1-20-16.3 ST. Persons who provide services pursuant to this section shall transport the vehicle directly to the storage site owned or leased by the towing service and the vehicle shall not be kept in any temporary holding area, unless the towing service is directed to do so by a law enforcement officer authorizing the tow. (Ord. No. 07-012, Pt. A, 11-6-2007) Sec. 1-20-16.4. Review and automatic adjustment of fees (a) The wrecker service fees shall be adjusted by the county administrator in April of each calendar year. Unless otherwise directed by the county commission, any adjustments to the wrecker service fees, made pursuant to this section, shall be efFective the first Monday in October of each calendar year. All adjustments to the wrecker service fees shall be based on the methodology described in paragraph (b) of this section. (b) The base for computing any adjustment is the January Consumer Price Index - All Urban Consumers for the United States, published each year by the United States Depart- ment of Labor, Bureau of Labor Statistics. For the purpose of this section the initial index to be referenced is January 2008. The wrecker service fees shall be adjusted by the percentage change in the index. (c) If the index is changed so that the base year is different, the index shall be converted in accordance with the conversion factor published by the United States Department of Labor, Bureau of Labor Statistics. If the index is discontinued or revised, such other government index or computation with which it is replaced shall be used in order to obtain substantially the same result as would be obtained if the index had not been discontinued or revised. (a) The term "parking" as used herein means the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaging in loading or unloading merchandise or passengers as may be permitted by law. (b) The parking of motor vehicles, except in cases of emergency, is hereby prohibited on the right-of-way of the following roads or streets, or indicated portions thereof, at all times unless otherwise indicated: Angle Road, (both sides) from its intersection of Orange Avenue north to its intersection with Avenue B. REGULATION OF WATER AND SEWER UTILITIES* Sec. 1-20.5-1. Standards for fire hydrant installation. Any person providing water service and installing water mains, lines or connections within unincorporated St. Lucie County shall comply with the following standards for water mains, lines or connections installed or replaced after the effective date of this section: (1) There shall be fire hydrants located and in service within six hundred (600) feet of each other in all areas zoned for single-family residential usage, multifamily, commercial, and industrial usage for flows requiring one thousand (1,000) gallons per minute. The hydrant spacing requirements shall be one thousand (1,000) feet for fire flows requiring five hundred (500) gallons per minute. (2) All fire hydrants shall be located within dedicated public or private rights-of-way, which shall be paved or readily traversable by firefighting equipment, with required minimum separation distance to be measured by roadway travel thereon. (3) All water mains intended and providing water for fire protection shall have a diameter of no less than eight (8) inches, except that lower sizes of not less than six (6) inches may be allowed by the St. Lucie County Fire District based on needed fire flow as determined by the fire district. (4) The minimum size water main(s) and fire flows shall be determined by the fire marshal and based on the current Insurance Service Office (ISO) requirements. (5) There shall be no requirements for the establishment of fire hydrants in areas zoned for agricultural usage. (6) For the purposes of this section, person means any developer, property owner, private utility or public, governmentally owned utility providing water service in unincorpo- rated St. Lucie County. Supp. No. 80 1095 § 1-20.5-35 ST. LUCIE COUNTY CODE ARTICLE II. WATER SHORTAGE PLAN* Sec. 1-20.5-35. Intent and purpose. It is the intent and purpose of this article to protect the water resources of the county from the harmful effects of overutilization of groundwater during periods of water shortage and allocated available water supplies by creating its own water shortage plan and by assisting the South Florida Water Management District in the implementation of its water shortage plan. (Ord. No. 07-054, Pt. A, 12-11-2007) Sec. 1-20.5-36. Definitions. For the purposes of this article, the following terms, phrases, words and their derivations shall have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural include the singular and words in the singular include the plural. The word "shall" is always mandatory and not merely discretion- ary. District is the South Florida Water Management District. Person is any person, firm, partnership, association, corporation, company or organization of any kind. Water resource means any and all water on or beneath the surface of the ground, including natural or artificial water courses, lakes, ponds or diffused surface water, and water percolating, standing or flowing beneath the surface of the ground. Water shortage condition is when sufficient water is not available to meet present or anticipated needs of persons using the water resource, or when conditions are such as to require a temporary reduction in total water usage within a particular area to protect water resource from serious harm. A water shortage usually occurs due to drought. Water shortage emergency means that situation when the powers which can be exercised under part II of Chapter 40E-21, Florida Administrative Code, are not sufficient to protect the public health, safety, or welfare, or the health of animals, fish or aquatic life, or a public water supply, or commercial, industrial, agricultural, recreational or other reasonable uses. Supp. No. 80 1096 WATER AND SEWER § 1-20.5-40 Sec. 1-20.5-37. Application of article provisions. The provisions of this article shall apply to all persons using the water resource within the geographical areas subject to the "water shortage" or "water shortage emergency," as determined by the district or the county, whether from public or privately owned water utility systems, private wells, or private connections with surface water bodies. This article shall not apply to persons using treated effluent or saltwater. (Ord. No. 07-054, Pt. A, 12-11-2007) Sec. 1-20.5-38. Amendments to water shortage plan. Chapter 40E-21, Florida Administrative Code, as the same may be amended from time to time is incorporated herein by reference as a part of the Code of Ordinances of the county. (Ord. No. 07-054, Pt. A, 12-11-2007) Sec. 1-20.5-39. Irrigation hours. (a) Unless otherwise mandated by the county or the district during a water shortage or water shortage emergency, lawn and ornamental irrigation shall be limited to the hours between 4:00 p.m. to 10:00 a.m. (b) There shall be exemptions from the irrigation time restrictions for the following circumstances: (1) Irrigating with a microirrigation system. (2) Reclaimed water end users. (3) Preparing for irrigation of new landscape. (4) Watering in of chemicals, including insecticides, pesticides, fertilizers, fungicides, and herbicides when required by label, recommended by the manufacturer, or implement- ing best management practices. (5) Maintenance and repair of irrigation systems. (6) Irrigating with low volume hand watering including watering by one (1) hose attended by one (1) person fitted with a self-canceling or automatic shut off nozzle or both. (7) Irrigating with seventy-five (75) per cent or more water recovered or derived from an aquifer storage and recovery system. (Ord. No. 07-054, Pt. A, 12-11-2007) Sec. 1-20.5-40. Rain sensor device. Any person who purchases and installs an automatic lawn sprinkler system shall install, operate, and maintain a rain sensor device or automatic switch which will override the irrigation cycle of the sprinkler system when adequate rainfall has occurred, as set forth in F.S. § 373.62. (Ord. No. 07-054, Pt. A, 12-11-2007) Supp. No. 80 1097 § 1-20.5-41 ST. LUCIE COUNTY CODE Sec. 1-20.5-41. Declaration of water shortage; water shortage emergency. Upon a finding that such condition exists, as defined in section 1-20.5-36, the board of county commissioners shall declare a water shortage or water shortage emergency within all or any part of the county. A declaration of a water shortage or water shortage emergency by the county shall invoke the provisions of this article. Upon such declaration, all water use restrictions or other measures adopted by the board, or any portion thereof shall be subject to enforcement action pursuant to this article. If a water shortage or water shortage emergency has not already been declared by the board of county commissioners, the declaration of a water shortage or water shortage emergency within all or any part of the county by the governing board or the executive director of the district shall invoke the provisions of this article. Upon such declaration, all water use restrictions or other measures adopted by the district applicable to the county, or any portion thereof shall be subject to enforcement action pursuant to this article. Any conflict between any water use restrictions or other measures adopted by the board of county commissioners and any adopted by the district shall be resolved in favor of the district. Any violation of the provisions of Chapter 40E-21, Florida Administrative Code, or any order issued thereto, shall be a violation of this article. (Ord. No. 07-054, Pt. A, 12-11-2007) Sec. 1-20.5-42. Enforcement. Every police officer, sheriff, or fire marshal having jurisdiction in the area governed by this article shall, in connection with all other duties imposed by law, diligently enforce the provisions of this article. In addition, the county administrator may also delegate enforcement responsibility for this article to agencies and departments of county government, or cities in the service areas governed by this article, in accordance with state and local law. (Ord. No. 07-054, Pt. A, 12-11-2007) Sec. 1-20.5-43. Penalties. Violation of any provision of this article shall be subject to the following penalties: (1) First violation: ~venty-five dollars ($25.00). (2) Second and subsequent violation: Fine not to exceed five hundred dollars ($500.00) Each day in violation of any section of this article, except section 1-20.5-40, shall constitute a separate offense. Each month in violation of section 1-20.5-40 shall constitute a separate offense. In the initial stages of a water shortage or water shortage emergency, law enforcement officials may provide violators with no more than one (1) written warning. The county, in addition to the criminal sanctions contained herein, may take any other appropriate legal action, including, but not limited to, emergency injunctive action, to enforce the provisions of this article. (Ord. No. 07-054, Pt. A, 12-11-2007) Supp. No. 80 1098 WATER AND SEWER § 1-20.5-52 Sec. 1-20.5-44. Water users to accept provisions of article. No water service shall be furnished to any person by a public or private utility unless such person agrees to accept all the provisions of this article. The acceptance of water service shall be in itself the acceptance of the provisions thereof. (Ord. No. 07-054, Pt. A, 12-11-2007) Secs. 1-20.5-45-1-20.5-49. Reserved. AR,TICLE III. FLUORIDATION OF WATER SYSTEMS* Sec. 1-20.5-50. Definitions. As used in this article, the following terms shall have the indicated meanings: Person. Any individual, corporation, governmental agency, business, trust, estate, partner- ship, association, or any other legal entity. Water system. A system for the provision to the public of piped water for human consumption, whether privately or publicly owned. (Ord. No. 89-39, Pt. A, 9-12-89) Sec. 1-20.5-51. Fluoridation requirements. By October 1, 1990, any person having jurisdiction over a water system with a design capacity of one million (1,000,000) gallons or more within the boundaries of the county which does not have a natural fluoride level of eight-tenths (0.8) milligrams per liter shall apply fluorides to the system in compliance with the requirements of the department of environ- mental regulation contained in sections 17-555.325, 17-555.520, 17-550.310, and 17-550.320, Florida Administrative Code, or as those sections may hereinafter be amended. (Ord. No. 89-39, Pt. A, 9-12-89) AR,TICLE IV. LTIVIFORM WATER AND SEWER SERVICE POLICY Sec. 1-20.5-52. Definition. For the purpose of this article, district is the St. Lucie County Water and Sewer District No. 1. (Ord. No. 90-45, Pt. A, 10-9-90) *Editor's note-Part A of Ord. No. 89-29, adopted Sept. 12, 1989, added Art. II, §§ 1-20.5-30 and 1-20.5-31. Inasmuch as there already e~usted an Art. II, the editor has redesignated the new provisions as Art. III, §§ 1-20.5-50 and 1-20.5-51. Supp. No. 80 1099 § 1-20.5-53 ST. LUCIE COLTNTY CODE Sec. 1-20.5-53. Unauthorized connections-Sewer. Connections to the district's sewer system for any purpose whatsoever are to be made only by employees of the district or under direct supervision of the district's authorized employee. Unauthorized connections render the service subject to immediate discontinuance without notice and sewer service will not be restored until such unauthorized connections have been removed and unless settlement is made in full and for all penalties, damages and sewer service established by the district to have been used by reason of such unauthorized connection. (Ord. No. 90-45, Pt. A, 10-9-90) Sec. 1-20.5-54. Same-Water. Connections to the district's water system for any purpose whatsoever are to be made only by employees of the district or under direct supervision of the district's authorized employee. Unauthorized connections render the service subject to immediate discontinuance without notice and water service will not be restored until such unauthorized connections have been removed and unless settlement is made in full and for all penalties, damages and water service established by the district to have been used by reason of such unauthorized connection. (Ord. No. 90-45, Pt. A, 10-9-90) Sec. 1-20.5-55. Industrial wastewater. The district will accept only domestic wastewater in its sewer system. No industrial wastewater or the like, including septage, shall be discharged into the district's sewer system unless proper pretreatment facilities are provided on customer's premises by customer, properly operated and approved in writing by the district and all applicable regulatory agencies. (Ord. No. 90-45, Pt. A, 10-9-90) Sec. 1-20.5.56. Grease traps, oil separators. All commercial food preparation facilities and all other facilities generating wastewater with high grease and/or oil concentrations must have a grease trap to intercept these wastes prior to discharge into the district's sanitary sewer system. Location and type of grease trap used must be approved, in writing, by the district and all applicable regulatory agencies. Grease traps must be properly maintained by customer or owner. Design and maintenance of grease traps shall be in accordance with county rules, regulations and codes, and shall conform to the specifications and requirements of the district. If grease and/or oil in excess of allowable amounts, in accordance with the district's and regulatory agency requirements, is discharged, the district shall inform operator and/or owner of premises to properly repair and maintain or replace, if necessary, the grease traps. No hazardous wastes of any kind shall be discharged into the district's sewer system under any circumstances without prior written authorization from the district. II, and F.S. § 189.4041, the board of county commissioners determines it to be necessary in the public interest to create and there is hereby created a dependent special district to be known as the "St. Lucie County Water and Sewer District" ("District"). The boundaries of the district shall be the contiguous unincorporated area of St. Lucie County, as identified on E~ibit "A" to the District Charter as adopted below. The purpose of the special district is to consolidate certain existing County utility facilities into a single operating entity, and to acquire, own, operate, lease and maintain water and sewer systems in the unincorporated area of St. Lucie County, Florida. The board of county commissioners hereby declares that a dependent special district is the best means of establishing these public purposes and for acquiring, leasing, operating and managing assets of water and sewer systems within the district.
