borne by the animal's owner. Evidence of current vaccination against rabies shall be retained
by the owner of said dog or cat and made available, upon request, to any officer or health
department investigator. For vaccinations administered prior to January 1, 1995, evidence of
vaccination shall consist of a standard certificate, NASPHV Form Number 50, issued by the
licensed veterinarian administering the vaccine or an affidavit from the licensed veterinarian
administering the vaccine stating that the vaccination was properly administered. Any
certificate must contain the date of vaccination and sufficient information for the identification
of the dog or cat. For vaccinations administered on or after January 1, 1995, evidence of
vaccination shall consist of a completed State of Florida Department of Agriculture and
Consumer Services standard vaccination certificate. A certificate shall not be valid for more
than one (1) animal unless clearly indicated.
(b) A dog or cat shall not be required to be vaccinated against rabies if a licensed
veterinarian has examined the animal and has certified in writing that at such time
vaccination would endanger the animal's health because of its age, infirmity, disability, illness,
or other medical considerations. Such exempt animal shall be vaccinated against rabies as
soon as its health permits.
(c) Upon vaccination against rabies, the licensed veterinarian shall provide the animal's
owner and the public safety manager with a rabies vaccination certificate which shall contain,
but not be limited to, the following information:
(1} A serialized certificate.
(2) The name, address, and phone number of the owner.
(3) The date of vaccination.
(4) The expiration date of the vaccination.
(5) The species, age, sex, color, breed, weight, and name of the animal vaccinated.
(6) The rabies vaccine manufacturer.
(7) The vaccine lot number.
(8) The type and brand of vaccine used.
(9) The route of administration of the vaccine.
(10) The signature of the licensed veterinarian.
(d) A valid rabies tag issued by the licensed veterinarian administering the vaccination
must be worn at all times by the dog or cat for which the tag was issued except when the dog
or cat is being shown in competition, is actively engaged in the sport of hunting, is in the
confines of the owner's property, or is government-owned dog used for law enforcement
purposes.
(e} Violation of this section shall be a civil infraction, punishable as provided in Section
828.27(2), Florida Statutes.

Sec. 1-4-25. Sterilization of animals adopted from county-funded adoption agencies
required.
Provision shall be made for the sterilization of cats and dogs released for adoption from the
humane society or other duly authorized body, assigned as an adoption agency and funded by
the county, by either (a) providing sterilization by a licensed veterinarian before the humane
society or adoption agency relinquishes custody of the animal, or (b) entering into a written
agreement with the adopter guaranteeing that sterilization will be performed within thirty
(30) days or prior to sexual maturity. The adoption agency shall require a sufficient deposit
from the adopter, which deposit shall be refundable upon presentation to the adoption agency
of written evidence by the veterinarian performing the sterilization that the animal has been
sterilized. The deposit or donation may be based upon recommended guidelines established by
the Florida Federation of Humane Societies.

Sec. 1-4-26. Enforcement and penalties; mandatory court appearances.
(a) Any officer who has probable cause to believe that a person has committed an act in
violation of this article shall issue a citation to that person. The determination that violation
has occurred may be the result of the officer's own investigation or as the result of complaint
by an aggrieved person.
(b) Any person who willfully refuses to sign and accept a citation issued by an officer is
declared to be guilty of a criminal offense and misdemeanor within the meaning of Section
775.08, Florida Statutes, and punishable as provided by law.
(c} It shall be a violation of this article for any person to knowingly hinder, resist, or oppose
any officer or employee of the animal control division in the performance of their duties under
this article or to knowingly interfere with any animal trap set by such officers or employees or
to molest or release any animal caught therein.
(d) The commission of a charged infraction at a hearing authorized pursuant to this chapter
must be proven by a preponderance of the evidence. Any violation of this article constitutes a
civil infraction and may be punishable by a civil penalty not to exceed five hundred dollars
($500.00), or as otherwise provided in this article. Penalties for violation of specific sections of
this article shall be established by resolution of the board of county commissioners. If the
person who has committed the violation does not contest the citation, a civil penalty of less
than the maximum allowed will be assessed. In accordance with F.S. § 828.27(4)(b), the
amount of any civil penalty assessed pursuant to this article shall be increased by five dollars
($5.00) for the purpose of funding the cost of training county animal control officers. Any
citation may be contested in county court pursuant to Chapter 86-437, Laws of Florida.
(e) Each day or fraction thereof during which a violation of this article continues shall be
considered as a separate offense.

(f) It shall be mandatory for an owner of an animal to appear in court under the following
circumstances:
(1) When any violation of this article results in the unprovoked biting, attacking, or
wounding of a domestic animal;
(2) When any violation of this article results in the destruction or loss of personal
property;
(3) When an owner or person is cited with a second or subsequent violation of any part of
section 1-4-23, except for subsections (f) and (h);
(4) When a person is cited with a third or subsequent violation of any part of this article.
(g) If any person fails to pay the civil penalty, fails to appear in court to contest the citation,
or fails to appear in court as required herein, the court may issue an order to show cause. The
order shall require such persons to appear before the court to explain why action on the
citation has not been taken. If any person who is issued such order fails to appear in response
to the court's directive, that person may be held in contempt of court.

Sec. 1-4-27. Training requirements for animal control officers.
(a) Animal control officers who were not authorized prior to January 1, 1990, by St. Lucie
County to issue citations must successfully complete aforty-hour minimum standards training
course. Such course shall include, but is not limited to, training for: Animal cruelty
investigations, search and seizure, animal handling, courtroom demeanor, and civil citations.
The course curriculum must be approved by the Florida Animal Control Association. An animal
control officer who successfully. completes such course shall be issued a certificate indicating
that he has received a passing grade. Pursuant to F.S. § 828.27, a surcharge of two dollars
($2.00) upon each civil penalty imposed for violation of this article shall be collected and the
proceeds from such surcharge shall be used to pay the costs of the forty-hour minimum
standards training course for animal control officers.
(b} In order to maintain valid certification, every two (2) years each certified county animal
control officer shall complete four (4) hours of postcertification continuing education training.
Such training may include, but is not limited to, training for: Animal cruelty investigations,
search and seizure, animal handling, courtroom demeanor, and civil citations.

Sec. 1-4-28. Traveling animal shows-Permit required.
(a) The owner or operator of any traveling animal show desiring to operate in the
unincorporated area of St. Lucie County, Florida shall make written application for permit on
forms provided by the animal control division no later than sixty (60) days prior to the first
performance of any spectacle, display, act or event within the county. Such application shall
include but not be limited to the name of the owner of the traveling animal exhibition, all

proposed locations within the county for the traveling animal show, the date the animal show
is to arrive within the county, the date of departure and all dates on which it is perform at any
location within the county. The applicant shall further provide proof of the following:
1. Current liability insurance with coverage of one hundred thousand dollars ($100,000.00)
per person, three hundred thousand dollars ($300,000.00) per occurrence, with a
maximum deductible of ten thousand dollars ($10,000.00).
2. All applicable state inspection certificates including a current USDA permit.
3. A veterinarian on duty if the show involves wildlife or captive wild animals.
4. A permit fee of fifty dollars ($50.00) shall be paid at the time the application for permit
was made.
(b) The term "traveling animal show" shall be defined as follows: Any spectacle, display, act
or event, including circuses and carnivals, where animals are maintained, whether or not the
animals actually perform, whose owners or operators do not have their principal place of
business in the county and which is required to obtain an occupational license pursuant to
chapter 1-12 of the St. Lucie County Code and Compiled Laws.

ARTICLE III. REGISTRATION
Sec. 1-4-29. Registration required; effect on dogs or cats in existence on the effec-
tive date of the article.
Except as otherwise provided herein, it shall be unlawful for any person to own, keep,
harbor, maintain, or have custody of any dog or cat four (4) months or older, unless such dog
or cat has been currently registered in accordance with the provisions of this article. Any dog
or cat four (4) months or older on the effective date of the ordinance from which this article
derives and which has a current valid rabies vaccination as of the effective date shall be
registered in accordance with the provisions of this article.

Sec. 1-4-30. Issuance of animal registration identification tags.
(a) All owners or custodians of dogs and cats in the unincorporated areas of St. Lucie
County shall obtain a St. Lucie County registration/identification tag for each dog and cat by
the age of four (4) months that they own, keep, harbor, maintain, or have in custody as follows:
(1} Within thirty (30) days of acquiring the dog or cat; or
(2) Within thirty (30) days after the owner or custodian takes residence in the unincor-
porated areas of St. Lucie County, whichever occurs later.
(b) Except as provided herein, registration/identification tags should be securely fastened
about the animal's neck by a collar or other device so as to be clearly visible at all times. Dogs
and cats not so registered/identified maybe considered stray and in violation of section 1-4-22

and may be impounded as therein provided. A vaccination certificate and if applicable, a
sterilization certificate, issued by a veterinarian must accompany all applications for a St.
Lucie County registration identification tag.
(c) The registration identification tag shall be valid for one (1) year from the date of
issuance or date of the rabies vaccination, whichever is earlier for unsterilized animals and for
the lifespan of sterilized animals.

Florida Statutes.

Sec. 1-7-22. Creation of fund and accounting.
(a) Pursuant to Section 893.13, Florida Statutes, the court may assess any defendant, on or
after February 1, 1989, who is found guilty of, or pleads nolo contendere to, a violation of any
provision of Chapter 893, Florida Statutes, or which involves a criminal violation of Section
316.193, Section 856.011, Section 856.015, or Chapter 562, Chapter 567, or Chapter 568,
Florida Statutes, in addition to any fine and other penalty imposed by law for any criminal
offense under this chapter or for any criminal violation of Section 316.193, Section 856.011,
Section 856.015, or Chapter 562, Chapter 567, or Chapter 568, Florida Statutes, an amount up
to the amount of the fine authorized for the violation. Such additional assessment shall be used
for alcohol and other drug abuse programs as provided by general law and this article.
Pursuant to Section 893.13, Florida Statutes, the court is authorized to order a defendant to
pay such assessment if it finds that the defendant has the ability to pay the fine and the
additional assessment, and the defendant will not be prevented from being rehabilitated or
from making restitution.
(b) Pursuant to F.S. § 938.13, the clerk shall collect fifteen dollars ($15.00) from any
defendant found guilty of any misdemeanor under the laws of this state in which there is the
unlawful use of drugs or alcohol.
(c) Once assessed, the clerk will keep a record of assessments and those assessments shall
be collected by the clerk. The clerk shall forward all monies collected to the board of county
commissioners for deposit into a special and separate account titled alcohol and other drug
abuse trust fund except the clerk shall retain one dollar ($1.00) of each fifteen dollars ($15.00)
collected pursuant to F.S. § 938.13, as a service charge. Once each month, the board of county
commissioners shall require a full report from the clerk as to the amount of assessments
imposed by its courts, the amount of funds collected and deposited into the alcohol and other
drug abuse trust fund, and amount of expenditures from the alcohol and other drug abuse
trust fund.

Sec. 1-7-23. Expenditures.

other drug abuse treatment or education programs shall be selected as program recipients on
the basis of selection procedures which shall be developed by the county administrator. Such
procedures shall include as a basis for selection the success of the program. Final approval
shall be made by the board of county commissioners upon recommendation by the county
administrator, and selections shall be made annually.

ARTICLE III. DRIVER EDUCATION SAFETY TRUST FUND
Sec. 1-7-30. Authority for enactment of article.
This article is enacted pursuant to the authority vested in the board of county commission-
ers by virtue of the "Dori Slosberg Driver Education Safety Act".

Sec. 1-7-31. Definitions.
For the purpose of this article, the following terms have only those meanings ascribed to
them:
Board of county commissioners shall mean the board of county commissioners of St. Lucie
County, Florida.
Clerk shall mean the clerk of the circuit court and county court of St. Lucie County and
accountant to the board of county commissioners.
County shall mean the incorporated and unincorporated areas of St. Lucie County, Florida.

Sec. 1-7-32. Creation of fund and accounting.
(a) Pursuant to the Dori Slosberg Driver Education Safety Act, the clerk shall collect five

Sec. 1-15-25. Beaches.
(a) No dog or other animal will be permitted on the beach areas regulated by this article
except as set out below:
(1) Authorized law enforcement dogs being used for emergency purposes and patrol.
(2} Horses engaged in horseback riding activities if authorized by permit from the Director
of Recreation and Parks of St. Lucie County and subject to section 1-7.6-55(2) setting
forth further restrictions during turtle nesting season (May 1-October 31).
(3) A maximum of three (3) dogs per person maybe permitted on Walton Rocks Beach and
Wild Cat Cove, including designated parking areas, subject to the following:
a. Any person having a dog on Walton Rocks Beach or Wild Cat Cove must keep the
dog under control. If the dog annoys or bothers other people, dogs or animals, the
dog must be fastened to a suitable leash of dependable strength not to exceed
eight (8) feet in length and leash must be held or controlled.
b. Any person having a dog on Walton Rocks Beach or Wild Cat Cove must carry
with and on such person, suitable materials and utensils with which to remove
any fecal matter deposited by such dog and must remove any fecal matter
immediately upon its deposit by the dog under the person's supervision and
control and either take home or dispose of in the proper receptacles provided by
the county.
c. Each such dog must have affixed to its collar a current rabies inoculation tag
evidencing the dog has been properly inoculated against rabies in accordance
with the provisions of F.S. § 828.40.

Sec. 1-15-26. Group functions.
No group shall hold a function or event on an area regulated by this article unless
authorized by permit from the Director of Parks and Recreation of St. Lucie County pursuant
to applicable regulations.

Sec. 1-15-27. Permits.
(a) All requests for permits required under this article shall be made in writing upon an
application form to be furnished by the Director of Parks and Recreation of St. Lucie County,
which shall require the following:
(1) The name and address of the applicant proposing or sponsoring the activity involved;
(2) The purposes of activities to be engaged in by the participant;
(3) The date and hours for which the permit is desired;

(4) The specific areas for which the permit is requested;
(5) The estimated number of persons who will attend or participate in the activity
involved;
(6) A statement of any special circumstances which are material to the permit required;
(7) Utilities needed for the event; and,
(8) The person who will be responsible for cleaning the area of any trash or debris, and
who will be responsible should any damage occur to the facilities.
(b) If the areas regulated by this article will be available for use on the date and time
requested and is not subject to a prior reservation, the Director of Parks and Recreation of St.
Lucie County may issue a permit if he finds the area use applied for to be in accordance with
the purpose for which such area is designated or intended, and further, that the proposed
activity will not unreasonably interfere with or detract from the general public enjoyment of
the remaining areas regulated by this article, or interfere with or endanger public health,
welfare, or safety, or entail unusual, extraordinary, or burdensome expense for supervision,
maintenance, cleanup, or police protection by the City of Fort Pierce or the St. Lucie County
Sheriffs Department.
(c) Within ten (10) days after receipt of an application for permit, the Director of Parks and
Recreation of St. Lucie County shall either approve or deny the application and advise the
applicant accordingly, either in person or by mail. If an application is denied, the Director of
Parks and Recreation of St. Lucie County at the time of notification shall apprise the applicant
in writing of the reasons for such refusal. Any person aggrieved by a denial shall have the right
of appeal to the board of county commissioners, which shall consider the application under the
standards set forth above and, without undue delay, sustain, overrule, or modify the decision
of the Director of Parks and Recreation of St. Lucie County.
(d) Permits shall be issued subject to applicable regulations, and to such special regulations
and instructions as may be prescribed by the Director of Parks and Recreation of St. Lucie
County. The Director of Parks and Recreation of St. Lucie County, or any officer of the Fort
Pierce Police Department or the St. Lucie County Sheriffs Department, shall have the
authority to revoke a permit upon finding violation of any provision of this article, any
applicable regulation, or any condition of the permit.
