R.egulation of Open Containers, 1-3-5-1-3-9 Art. III. Specified Sexual Activities in Commercial Establishments, 1-3-10-1- 3-17 AR,TICLE I. IN GENERAL Sec. 1-3-1. Hours of sale regulated. No alcoholic beverages may be sold, consumed or served or permitted to be served or consumed, in any place in the unincorporated areas of the county holding a license under the Florida Division of Beverages of the Department of Business Regulations except for licensees operating bottle clubs as defined in section 561.01(15), Florida Statutes (1990 Supplement), in existence on January 1, 1991, during the following hours: (1) Between the hours of 2:00 a.m. and 7:00 a.m. each day. Any bottle club exempted from the provisions of this section shall be treated as a nonconforming use that is subject to the provisions of section 10.00.02 of the St. Lucie County Land Development Code. The exemption of this section shall only apply to the specific licensee operating the bottle club on or before January 1, 1991. (Ord. No. 77-4, § 3, 2-22-77; Ord. No. 89-78, Pt. A, 12-19-89; Ord. No. 90-36, adopted July 26, 1990, effective Aug. l, 1990, which ordinance enacted the land development code. The repealed provisions pertained to distance restrictions for persons selling or transferring alcoholic beverages and derived from Ord. No. 86-17, Pt. A, adopted Aug. 5, 1986; Ord. No. 87-5, Pt. A, adopted June 16, 1987; and Ord. No. 89-02, Pt. A, adopted April 25, 1989. The county's land development code is published separately and is on file and available for inspection in the offices of the county. ARTICLE II. REGULATION OF OPEN CONTAINERS Sec. 1-3-5. Definitions. The following terms and phrases shall have the meanings set forth below, unless the context clearly indicates otherwise: Alcoholic beverage. Any beverage containing more than one (1) per cent of alcohol by weight, as determined in accordance with Section 561A1(4)(b), Florida Statutes. *Cross reference-Ordinance provisions relating to licenses, permits and miscellaneous business regulations, Ch. 1-12. Supp. No. 89 107 § 1-3-5 ST. LUCIE COUNTY CODE Container. Any can, cup, bottle, glass or other receptacle containing any alcoholic beverage. Motor vehicle. Any vehicle which is not powered by muscular power but power upon which or by which any person or property may be transported on a street or highway. Person. Any natural person, corporation, partnership, association or entity. (Ord. No. 87-31, Pt. A, 3-31-87) Sec. 1-3-6. Possession of container or consumption of alcoholic beverage prohibited in or on motor vehicle. It shall be unlawful for any person to possess any container of alcoholic beverage, except an original container with the seal unbroken, or to consume any alcoholic beverage, in or on a motor vehicle being operated on a street or highway open for vehicular travel in unincorpo- rated St. Lucie County. (Ord. No. 87-31, Pt. A, 3-31-87) Sec. 1-3-7. Inapplicability. This article shall not apply to: (1) Any person engaged in picking up empty beverage containers for the purpose of collecting the deposit or value of the bottle or can itself, nor to any person taking part in a litter control campaign. (2) The possession of any open container by any licensed distributor or licensed vendor of alcoholic beverages provided that such alcoholic beverage is being transported solely for commercial purposes. (3) The transportation of any open container of alcoholic beverage in or on any motor vehicle provided that such container is in a compartment of the vehicle not readily accessible to the driver or passengers, such as a locked (not merely latched) glove compartment, trunk or other nonpassenger or nondriver area of the motor vehicle. (4) The transportation of any open container or consumption of alcoholic beverage in or on any motor vehicle duly licensed and operated for hire to transport passengers, such as charter buses, regularly scheduled buses, ta~ucabs, and the separate passenger compartments of limousines; provided the operator thereof is not in immediate possession of, or engaged in the consumption of, any alcoholic beverage or open container of alcoholic beverage. The operator must have in his possession evidence of employment by a bona fide chauffeur service, limousine service, taxicab company or bus company. (Ord. No. 87-31, Pt. A, 3-31-87) Supp. No. 89 108 TRAFFIC § 1-20-16 Road extending from North St. Lucie River Water Control District Canal No. 49 on the south to the northern terminus (North St. Lucie River Water Control District Canal No. 48) is restricted to the hours between sunrise and sunset on weekdays. (Ord. No. 84-07, Pt. A, 5-15-84) Sec. 1-20-5. Moving violation penalty surcharge. In addition to any other penalty for violation of the state uniform traffic control law, a surcharge of twelve dollars and fifty cents ($12.50) shall be assessed for each moving traffic violation pursuant to Section 316.655(6), Florida Statutes (1992). This surcharge shall be used to fund St. Lucie County's participation in an intergovernmental radio communication program as approved by the Division of Communications of the Florida Department of General Services. (Ord. No. 92-26, Pt. A, 11-24-92) Sec. 1-20-6. 'I~xrning movements. (a) Vehicle, for the purpose of this section, is defined as set forth in F.S § 316.003(75), as amended. (b) The Board of County Commissioners of St. Lucie County, Florida, is authorized to regulate or prohibit the turning of vehicles or specified types of vehicles at a previously advertised public hearing by resolution after determining that such regulation is reasonable and for the benefit of the public health, safety, or general welfare of the citizens of St. Lucie County. (c) All previous resolutions regulating vehicle turning movements adopted by the Board of County Commissioners of St. Lucie County, Florida, are hereby approved and incorporated as adopted. (Ord. No. 03-16, Pt. A, 5-6-2003) Sec. 1-20-7. One-way roads. The following roads or portions thereof are designated as one-way roads for traffic moving in one (1) direction: (1) Rosarita Avenue between 25th Street and North 17th Street (eastbound only). (Ord. No. 09-030, Pt. A, 12-15-2009) Secs. 1-20-8-1-20-15. Reserved. ARTICLE II. STOPPING, STANDING AND PAR,KING DIVISION l. GENERALLY Sec. 1-20-16. Removal of vehicles. (a) Any motor vehicle that is discarded, left or abandoned on any public road right-of-way under the jurisdiction of the county in the unincorporated area of the county may be removed or caused to be removed by the county sheriffs o~ce after posting a notice on such vehicle Supp. No. 89 1068.1 § 1-20-16 ST. LUCIE COUNTY CODE advising that if such vehicle is not removed by the owner within forty-eight (48) hours, it will be removed or caused to be removed by the sheriffs office; provided, however, that, this paragraph shall in no way limit the sheriff or any other law enforcement agency's authority to remove vehicles from the paved or main traveled part of any highway under the provisions of F.S. § 316.194. (b) A law enforcement officer, or code enforcement officer, may issue a citation and cause to be immediately removed at the owner's expense, any motor vehicle found in violation of F.S. § 316.1951 (parking for certain purposes prohibited) except as provided in F.S. § 316.1951 as may be amended. The owner shall be assessed a penalty as provided in F.S. § 318.18(21) as may be amended by the government agency or authority that orders removal of the motor vehicle. A motor vehicle removed under this section shall not be released from an impound or towing and storage facility before a release form prescribed by the department of highway, safety and motor vehicles has been completed verifying that the fine has been paid to the government agency or authority that ordered immediate removal of the motor vehicle. However, the owner may pay towing and storage charges to the towing and storage facility pursuant to F.S. § 713.78 before payment of the fine or before the release form has been completed. (Ord. This section is enacted pursuant to the authority granted in F.S. Ch. 125 and F.S. § 715.07 is intended to supplement the provisions of F.S. § 715.07, relating to towing of vehicles illegally parked on private property. (Ord. No. 07-012, Pt. A, 11-6-2007) Sec. 1-20-162. Definitions. For purposes of this article, the following definitions shall apply: Non-Consentu¢l towing shall mean the recovery, towing, removal and storage of a vehicle or vessel without authorization of the vehicle/vessel owner or authorized driver and shall include both "Police Directed Tows" and "Trespass Towing/Private Property Impounds" as defined herein. Relay towing shall mean the prohibited practice in which the towing wrecker operator removes a vehicie and takes it to an alternate location other than the storage lot in order to simultaneously remove multiple vehicles in a reduced amount of time, then later transporting all vehicles to the storage facility. Roam towing shall mean towing of vehicles as defined in trespass towing where the towing establishment has entered into a contract with a private property owner to roam their property during designated hours to remove illegally parked vehicles. Supp. No. 89 1068.2 TR.AFFIC § 1-20-16.3 Trespass towing shall mean towing or removal of a vehicle that is illegally parked on private real property, at the property owner's direction, without the consent of the vehicle's owner or operator, as such is authorized by F.S. § 715.07. (Ord. No. 07-012, Pt. A, 11-6-2007) Sec. 1-20-16.3. Fees. In addition to the other requirements of this article, no tow truck company shall, for compensation, recover, tow, or remove a vehicle/vessel or provide storage in connection therewith without the prior express instruction of the vehicle/vessel owner or authorized driver, except in accordance with the following: (1) Nonconsentual tow. Tow truck companies may, for compensation, recover, tow or remove a vehicle/vessel based upon a police directed tow without the prior express instruction of the vehicleWessel owner or authorized driver upon the prior express Supp. No. 89 1069 TRAFFIC § 1-20-16.3 f. Each tow truck company shall enter into a written contract with every owner of private property that authorizes the tow truck company to tow vehicles/vessels from its property. This written eontract shall include the beginning date of said contract, the names and titles of all persons (i.e., owner, property manager, condominium president, etc.) who have the authority to appoint persons (i.e., security guard, night watchman, on-site manager, etc.) who can authorize prior express instruction to the tow truck company to remove, recover or tow any vehiclelvessel from its property. The written contract shall also include the name and current telephone number of the tow truck company performing the towing service. Any addendum to the contract shall include additional names and titles as necessary. The tow truck company must keep on file each contract and addendum (if applicable) with the property owner. Such contract shall be maintained for at least twelve (12) months after termination. The county and law enforcement officers may inspect and request a copy of any and all such contracts from the tow truck company during normal business hours. The tow truck company may not withhold production of the contract upon demand by the division or law enforcement. Failure to enter into or keep on file a contract with the property owner shall be a violation of this article. All contracts which were entered into prior to the effective date of this article, shall accomplish the requirements of this subsection by entering into an adden- dum to the current contract within one (1) year following the enactment of this article. g. No vehicle towed as the result of trespass towing shall be towed to and/or stored at a location more than fifteen-mile radius from the point of initiation of such trespass tow. No person who provides services (trespass, non-consent towing) pursuant to this section shall recover, tow, or remove a vehicle from this county to another county (or vice versus) for the purposes of trespass towing and impounding. h. Real property owners or authorized representatives shall not request the recovery, tow, or the removal of vehicles/vessels that are reasonably identi- fiable from markings or equipment as law enforcement, fire fighting, rescue squad, ambulance, or other emergency vehicles/vessels which are marked as such or to property owned by any governmental entity. i. Any person who improperly causes a vehicle/vessel to be recovered, towed, removed or stored shall be liable to the vehicle owner or authorized representative for the costs of the services provided, any damages resulting from the recovery, towing, removal or storage and attorney's fees and court costs. j. Persons who provide services pursuant to this section shall transport the vehicle directly to the storage site owned or leased by the towing service and the vehicle shall not be kept in any temporary holding area, unless the towing service is directed to do so by a law enforcement officer authorizing the tow. (Ord. No. 07-012, Pt. A, 11-6-2007; Ord. No. 11-004, Pt. A, 2-1-2011) Sec. 1-20-16.4. R,eview and automatic adjustment of fees. (a) The wrecker service fees shall be adjusted by the county administrator in April of each calendar year. Unless otherwise directed by the county commission, any adjustments to the wrecker service fees, made pursuant to this section, shall be effective the first Monday in October of each calendar year. All adjustments to the wrecker service fees shall be based on the methodology described in paragraph (b) of this section. (b) The base for computing any adjustment is the January Consumer Price Index - All Urban Consumers for the United States, published each year by the United States Depart- ment of Labor, Bureau of Labor Statistics. For the purpose of this section the initial index to be referenced is January 2008. The wrecker service fees shall be adjusted by the percentage change in the index. (c) If the index is changed so that the base year is different, the index shall be converted in accordance with the conversion factor published by the United States Department of Labor, Bureau of Labor Statistics. If the index is discontinued or revised, such other government index or computation with which it is replaced shall be used in order to obtain substantially the same result as would be obtained if the index had not been discontinued or revised. (a) The term "parking" as used herein means the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaging in loading or unloading merchandise or passengers as may be permitted by law.
