I. Art in Public Places, §§ 1-4.5-1-1-4.5-5 ARTICLE I. ART IN PUBLIC PLACES Sec. 1-4.5-1. Definitions. For the purpose of this article, the following words or terms are defined as follows: Artwork means works in a variety of media produced by professional visual. artists. Works may be permanent. temporary or functional. Board means the Board of County Commissioners for St. Lucie County, Florida. Capital prgject means any county capital improvement project costing more than fifty thousand dollars (~50,OOO.OOj anal paid for wholly or in part by funds appropriated by St. Lucie County to construct or renovate an}> park, above grade utility, and to construct or renovate any building, except a county detention facility or any capital improvement project at the St. Lucie County International Airport. C,ount~~ means St. Lucie County, Florida. For the purposes of this article, the St. Lucie County Erosion District and the St. Lucie County Mosquito Control District are specifically excluded from the definition of "County". Council means the St. Lucie Cultural Affairs Council. Eligible construction costs means the total project appropriation of county funds for an eligible project, including engineering and design, but not including demolition costs, equip- ment costs except for the cost of custom designed equipment or equipment that creates a new use for a building or facility, real property acquisition costs, impact fees, enterprise funds, funds contributed by the St. Lucie County Erosion District and/or the St. Lucie County Mosquito Control District, and soil remediation costs. Equipment costs means, for the purposes of the public artldesign and transportation enhancement project calculation, those costs for the acquisition of mechanical equipment of standard manufacture. 1~7aster plan means a manual of criteria for the selection of sites and artwork and transportation enhancement projects for public capital and transportation facilities to be developed by the council u>ith public input and approved by the board prior to its implemen- tation. This manual shall also provide for a comprehensive program for art in public places which shall include the display of loaned art in appropriate public buildings. `Editor's note-Ord. No. 99-07, Pt. A, adopted July 6, 1999, added new provisions to the. Code as Ch. 1-5. As other provisions existed within the Code as Ch. 1-5, the provisions of Ord. No. 99-0 i have been included herein as Ch. 1-4.5 at the discretion of the editor. Supp. No. 97 169 1-4.5-1 ST. LUCIE COUNTY CODE Renovation means a capital project or transportation capital project which is a major redesign of a facility or system or a portion of a facility or system which is included in the county's capital program budget and which requires a building permit from the appropriate governmental jurisdiction. Renovation shall also include a capital project or transportation capital project which is an expansion or upgrading the capacity of the facility or system, enlarging the facility, or creating new use for the facility. It shall not include repairs, maintenance, installation of mechanical equipment, or modifications required solely for ADA compliance. Transportation capital project means any county capital transportation improvement project costing more than fifty thousand dollars ($50,000.00) and paid. for wholly or in part by funds appropriated by St. Lucie County to construct or renovate any highway or arterial, bridge or causeway, sidewalk, or bikeway; or any road beautification project, except any capital transportation improvement project at the St. Lucie County International Airport. Transportation enhancement project means one (1} or more of the following projects, prioritized in the following order: (1) Visual enhancement of facilities far pedestrians and bicycles. (2) Scenic or historic highway programs, including the provision of tourist and welcome center facilities. (3) Landscaping and other scenic beautification projects. (4) Historic preservation. (5) Rehabilitation and operation of historic transportation buildings, structures, or facilities, including historic railroad facilities. B) Preservation of abandoned railway corridors, including the conversion and use thereof for pedestrian or bicycle trails. Tizcst fund means the art in public places trust fund created pursuant to this article and shall include all gifts and donations deposited in the trust fund. (Ord. No. 99-07, Pt. A, 7-6-99; Ord. No. 00-30, Pt. A, 8-15-2000; Ord. No. 02-24, Pt. A, 9-17-2002; Ord. No. 08-001, Pt. A, 1-23-2008} Sec. 1-4.5-2. Art in public places program. (a} Appropriations for county capital projects shall include an amount equal to two (2) per cent of the total eligible construction costs to be used for artist design services and for the selection, acquisition and display of artworks for related education programs, for the maintenance of county artworks, and for the administration of the master plan. Funds appropriated pursuant to this section shall not exceed one hundred thousand dollars ($100,000.00) per project. Funds appropriated for one (1J capital project, but not deemed necessary or appropriate by the council in whole or in part for that project, may be expended on other public art projects approved under the annual master plan, subject to any bond Supp. No. 91 110 ART § 1-4.5-2 restrictions and legal or grant restrictions. Bond funds shall be appropriated and accounted for in the bond capital project. accounts. All county agencies may opt. to participate in the art in public places program far any improvement project not otherwise subject to this article. (b) Appropriations for transportation capital projects shall include an amount equal to one (1) per cent of the total eligible construction costs to be used for site specific transportation enhancement projects, including artist design services for such projects, for the maintenance of such projects, and. for th.e administration of the master plan relating to such projects. Fw~ds appropriated pursuant to this section shall not exceed one hundred thousand dollars {$100,000.00) per project. Bond fiords shall be appropriated and accounted for in the bond capital project accounts. (c) The first priority for use of funds generated by a capital project shall be that capital project site. The monies appropriated under this article may be used for artist design services, for the development of design concepts and models, and for the selection, acquisition, purchase, commissioning, placement, installation, exhibition and/or display of artworks. Artworks and transportation enhancement projects shall be selected in accordance with the master plan and may be temporary or permanent, may be integral to the architecture or may be incorporated into the project. Integration of the artists' design concepts into the project architecture and/or design should be ensured, insofar as is feasible, by the concurrent selection of the artist(s) with the architect, engineer, or project designer. (d7 In the case of a project which. invohtes the use of grant or county bond proceeds issued after the effective date of this article, amounts for artist design services and artworks described in this chapter shall. be used for projects and capital purposes consistent with. state and federal laws, the resolutions and/or ordinances approved by the board and the terms of the grant. agreement. te) With the exception of transportation capital projects or as otherwise restricted by the board, any applicable bond resolution or ordinance, local, state or federal law, or the conditions of a granting authority, monies generated under this article may be pooled and expended for any public art and design project in the county, subject to the approved master plan. Pooled funds may be used as seed money for artists' fees to initiate partnerships with private and other public entities to provide public art and aesthetic enhancements in St. Lucie County, pursuant to a written agreement. (fl To the extent allowed by grant guidelines and by law, all county agencies shall, from the effective date of this article, include in all applications for finding to outside granting organizations or governmental agencies, an amount equal to two {2) per cent. of eligible construction costs far a capital project, not to exceed one hundred thousand dollars ($100,000.00), or an amount equal to one (1) per cent of eligible construction costs for a transportation capital project, not to exceed one hundred thousand dollars ($100,000.00), for artist design services and artworks or transportation enhancement projects, as specified herein. Supp. No. 91 170.1 ~~' 1-4.5-2 ST. LUCIE COUNTY CODE (g) The minimum amount to be appropriated for artist design services, artworks, and transportation enhancement projects shall be the total eligible construction costs multiplied. by 0.02 or 0.01, as appropriate. This calculation shall be made by the county agency prior to the time of the appropriation for the county's capital program. An amount equal to fifteen (15} per cent of the eligible allocation of the construction project t~~hich is 0.003 of the total eligible construction costs for a capital project and 0.0015 of the total eligible construction costs for a transportation capital project) may be used for project support and. community participation activities. For public-owned property this may include staffing, artist selection-related costs (excluding travel of the selection committee), consultants, design/proposaUmoquette costs, identifying plaques, project documentation, publicity, community education activities and other purposes as may be deemed appropriate for the administration of the program. An amount equal to fifteen (15) per cent of the eligible public art. allocation of the construction project for a capital project (which is 0.003 of the total eligible construction costs] shall be set aside in a separate account within the trust fund for curatorial services, insurance coverage, and the preservation and. maintenance of county artworks. An amount equal to fifteen (15) per cent of the eligible public art allocation of the construction project for a transportation capital project (v~~hich is 0.0015 of the total eligible construction costs) shall be set aside in a separate account. within the trust fund for curatorial services, insurance coverage, and. the preservation and maintenance of the specific transportation enhancement project. The council shall recommend that any artwork or transportation enhancement project. needing extraordinary operational or maintenance costs be reviewed by the appropriate county agency director prior to recommendation to the board. The council shall also be responsible for conducting an annual maintenance survey of artworks and transportation enhancement projects. This survey shall include a condition report on each work, prioritized recommendations for the restoration or repair and maintenance, and estimated costs. Such. repair and maintenance shall comply with any contractual obligations which may have been entered into by the county in the acquisition of the artworks. Expenditures of monies in the artwork and transportation enhancement projects maintenance and project support accounts shall be annually recommended by the council and included in the proposed annual budget submitted to the board. Funds in the maintenance and conservation account not expended by the end of the close of any fiscal year shall be carried forward. The council shall also, review and update as necessary the insurance requirements for artworks at ].east every five (5} years. (h) The art in public places program is suspended for twenty-four (24) months. This term may be reduced upon direction of the board of county commissioners. The Arts and Cultural Alliance of St. Lucie, Inc. shall make recommendations to the board of county commissioners for changes to the program before its reinstatement in twenty-four (24} months. The art in public places advisory committee shall sunset until such time as the board of county commissioners determines it appropriate to appoint a committee. (Ord. No. 99-07, Pt. A, 7-6-99; Ord. No. 00-30, Pt. B, 8-15-2000; Ord. No. 11-016, Pt. A, 5-3-11) Sec. 1-4.5-3. Art in public places trust fund. (a) Created. There is hereby created "art in public places trust fund" consisting of all funds appropriated and deposited to the trust fund in connection with the construction or renovation of a facility or system pursuant to sections 1-4.5-2(al and 1-4.5-2(b}. The trust fund is also Supp. No. 97. 170.2 ART § 1-4.5-3 authorized to accept gifts, grants and donations made to St. Lucie County for works of art. All appropriations, gifts, grants and awards of monies hereunder shall be deposited in an interest-bearing account entitled the "St. Lucie County Art in Public Places Trust Fund Account", which shall be a separate account established and maintained apart from the general revenue funds and accounts of St. Lucie County. All interest in said account shall accrue to the use and benefit of the trust fund. account. (b) Term of existence. The St. Lucie County Art in Public Places Trust Fund Account shall be self-perpetuating from. year to year unless specifically terminated. by the board.. (c) Trust assets. All appropriations, gifts, grants and awards of money or property received hereunder from either public or private donors shall be placed in trust for and inure to the use and benefit of St. Lucie County for public art and design purposes; and said property and fiords shall be expended, utilized and disbursed pursuant to the provisions of this section. (d) Appropria.ti.ons and dona~ti,ons. (1) Eligible monies appropriated pursuant to this article shall be transferred to the trust fund. This transfer shall take place within thirty (30) days of the approval. by the board of the construction contract for an eligible project. (21 Funds deposited or credited to the St. Lucie County Art in Public Places Trust Fund Account, except funds for maintenance and conservation of county artFVOrks and transportation enhancement projects, not expended or obligated by the close of any fiscal year shall be carried over automatically for a period of three (3) years beyond the close of the county construction project, or upon recommendation of the council, carried over for an additional two (2) years. Any funds carried over for three (3) years, or upon request five (5) ,years, and still unexpended at the expiration of such period, shall be transferred to the general fund for general art purposes or transportation enhance- ment. projects, as appropriate, only; provided that funds derived from other restricted sources shall revert to the funds from which originally appropriated at the expiration of said. three- or five-year period, or if' project is canceled, as applicable. (3) Any gifts, grants and awards received subject to a condition shall be expended strictly in accordance with such. condition. (ei During the term of the suspension implemented in section 1-4.5-3(h), any fiords in the art. in public places trust fund which are not already encumbered by contract shall be distributed as follows: (1) Fifteen thousand dollars ($15,000.00 ~ shall be set aside for maintenance of the existing art pieces. (2> Any funds placed into the art in public places trust fund during fiscal year 2010-2011 shall be returned to the county department from. where the funds originated. Supp. No. 91 170.3 § 1-4.5-3 ST. LUCIE COUNTY CODE (3) The county will enter into a contract with the arts and cultural alliance of St. Lucie, Inc. for seventy-four thousand dollars (574,000.00) for other activities which would have been permitted under the art in public places ordinance. Funds for this contract will be paid for by the AIPP funds that were contributed from the parks MSTU. (4} Forty-six thousand seven hundred and twenty-nine dollars ($46,729.00) shall be returned to the Airport, County Capital and. Transportation. Trust accounts. (5} Three hundred and forty-two thousand five hundred and thirty-seven dollars ($342,537.00} shall be distributed by grant agreement to the Arts and Cultural Alliance of St. Lucie County, Inc. for implementation of the goals of the strategic plan as presented to the BOCC on March 22, 2011, including hiring an executive director. (Ord. No. 99-07, Pt. A, 7-6-99; Ord. No. 00-30, Pt. C, 8-15-2000; Ord. No. 11-016, Pt. A, 5-3-11) Sec. 1-4.5-4. Ownership and maintenance of artworks. Unless otherwise provided, ownership of all works of art acquired by the county under this article shall be vested in the county, including copyrights, patents and other reproduction rights. The board shall be responsible for managing the reproduction rights of each acquisition with advice from the council. Custody, supei-~~ision, maintenance and preservation of the works of art shall be the responsibility of the county, and shall be carried out by qualified art professionals with appropriate collaboration with the council. (Ord. No. 99-07, Pt. A, 7-6-99) Sec. 1-4.5-5. Compliance with state and federal laws. Nothing in this article shall be deemed or construed to require the county to appropriate or expend funds if (a) the appropriation or expenditure of such funds for the purposes herein described would. not be permitted under any state or federal law, rule or regulation, or (b) the compliance with this article would in any way affect the treatment of interest on any bonds or other indebtedness or the county for federal income tax purposes, or (c) the compliance with this article would in any way prevent or inhibit the county's compliance with state or federal laws, rules or regulations relating to debt obligations of the county. (Ord. No. 99-07, Pt. A, 7 -6-99) Sapp. No. 91 170.4 LICENSES, PERMITS, REGULATIONS ~ 1-12-33 Sec. 1-12-31. Contracting. (a) Each person who contracts or subcontracts to construct, alter, repair, dismantle or demolish buildings, roads, bridges, viaducts, sewers, water and gas mains or engages in the business of construction, alteration, repairing, dismantling or demolition of buildings, roads, bridges, viaducts, sewers, water and gas mains must obtain a license as a contractor. The business tax shall be determined by the maximum number of persons actually employed or to be employed during the tax year in the county in which. the work is performed and shall be at the following rate: (1) From one to ten X10), twelve dollars and thirty-f`ive cents t~12.35}. ~2i For eleven (11) to twenty (20), twenty-four dollars and seventy-five cents ($24.75). t3) Over twenty-one (21), twenty-seven dollars and fifty-five cents 027.55). (b) In determining the number of persons employed, all principals shall be deemed employees and be included in the calculation. (Ord. No. 00-06, Pt. A, 9-19-2000; Ord. No. 05-014, Pt. A, 8-2-2005; Ord. No. 07-016, Pt. A, 9-4-2007) Sec. 1-12-32. Insurance adjusters. All persons acting as insurance adjusters shall pay a business tax of nine dollars and five cents 09.05). Manufacturing, processing, quarrying and mining. (ai Every person engaged in the business of manufacturing, processing, quarrying or mining must obtain a business tax receipt under this section. The amount of the business tax shall be determined by the maximum number of persons actually employed, or to be employed, during the tax year in the county in which the work is performed and shall be at the following rates: (1) One to ten (10) employees, twenty dollars and sixty cents ($20.60). (2) Over eleven (11) employees. twenty-seven dollars and fifty-five cents 027.55). (b) No business tax receipt shall be required under this section where the manufacturing, processing, quarrying or mining is incidental to and part of some other business classification for which. a business tax receipt is required by this chapter and is carried on at the place of business taxed under such classification. General business. There is hereby created a new general business classification. Except as provided herein, every person engaged in a business in. St. Lucie County shall pay a license tax of twenty-seven dollars and fifty-five cents ($27.55). Provided, however, that a business employing five (5) or fewer employees shall pay a tax of fifteen dollars and ten cents ($15.10). This gill include every person engaged in the practice of any profession who offers his service either directly or indirectly to the public for a consideration whether or not such endeavor is required by law. Every person engaged in a profession, business or occupation regulated by law where licensing and qualification standards are required shall display and exhibit to the tax collector the business tax receipt for the current year prior to the tax collector issuing business tax receipt pursuant to this chapter. A business tax receipt shall not be required where a person, although licensed by law under a regulatory statute, is prohibited from engaging in a profession, business or occupation unless under the direct supervision of another person, individual. or corporation. Every individual or group of individuals who operates a branch office, or any professional corporation which operates an office in which a profession is practiced, shall obtain a business tax receipt for each office in which the profession is practiced. (a) For the privilege of conducting, engaging in and carrying on the business of a retailer as defined in this section, there is hereby levied and assessed upon every person or association of persons as herein defined, for each store located and operated within this state by such person or association of persons, an annual business tax in the sum of twenty-seven and fifty-five cents ($27.55). Sapp. No. 97 624 PARKS AND RECREATION ~ 1-15-21 that. park personnel may be empowered to make such removals and scientists and students of botany may be given specimen collecting permits by the Director of Parks and Recreation of St. Lucie County. (c) No person shall dig, move, or remove from any area regulated by this article, any clay, beach sand, soil, rocks, stones, down timber or other woods or materials; or make any excavations by hand, tool, equipment, blasting or other means or agency, or shall construct or erect any building, structure, tent, or shelter, or shall erect or use any electronic sound amplifying device, or shall run or string any public utilities into, across, or over any area regulated by this article, unless authorized by permit or easement. (d) No person shall engage in golfing activities in an area regulated by this article except in an area that has been designated and marked for said operation. (Ord. No. 82-10, Pt. A, 11-9-8; Ord. No. 04-018, fi Pt. A, 4-6-042) Sec. 1-15-19. Overnight camping. (a) Overnight camping shall be prohibited in the areas regulated by this article unless specifically authorized by permit from the Director of Parks and Recreation of St. Lucie County. (b) Bringing into a regulated area and using for overnight occupancy any house trailer, camp trailer, camp wagon, or any form of moveable structure, or special vehicle, is prohibited, except where specifically allowed by permit. (Ord. No. 82-10, Pt. A, 11-9-82; Ord. No. 04-018, ~ Yt. A, 4-6-04) Sec. 1-15-20. Firearms. (a) No person shall carry, use, or possess, bows and arrows or any other form of weapon which is potentially hostile to wildlife or dangerous to human safety on or in the areas regulated by this article, except as authorized by state law or when such items are used in a program sponsored, provided, or authorized by a unit. of St. Lucie County government. Without limitation, a person may carry a concealed weapon or firearm to the extent permitted by section 790.06. Florida Statutes. lb) No person shall harm or cause harm in any way to wildlife, inclusive of all species of mammal, bird, reptile, or amphibian, or harm their nest or burrow on or in the areas regulated by this article, except that park/preserve personnel. may be empo~rered to make such removals and scientists and students of wildlife biology may be given specimen collecting permits by the county administrator. (a) No person shall build, light, or cause to be lighted, any fire upon the ground or beach in any area except as specifically designed and in an approved grill, stove; fireplace, or other suitable container, nor shall any person starting a fire leave the area without extinguishing the fire. Supp. No. 97. 791 § 1-15-21 ST. LUCIE COUNTY CODE (b) No person shall use a grill or other device in such a manner as to burn, char, mar or blemish any bench, table or any other object of property. (Ord. No. 82-10, Pt. A, 11-9-82) Sec. 1-15-22. Operation and parking of motor vehicles. (a) No person shall drive, operate, park, stop, occupy, ride upon, be a passenger in, or alight from, on, or into any motor vehicle in or upon any area regulated by this article, except upon the streets or highways publicly maintained for purposes of vehicular travel, or roads, pathways, and parking areas specifically designated for that purpose. (b) No motor vehicle will be permitted on the beach areas regulated by this article except authorized beach patrol vehicles, city, county, state, or federal vehicles, and ambulances and wreckers on emergency calls. (c) No person shall park a motor vehicle in other than an established or designated parking area and such use shall be in accordance with the posted directions there displayed and with the instructions of any attendant who may be present. (d) No person shall stop or park a motor vehicle in any area regulated by this article beyond the hours of operation and use established above without the prior express permission of the Fort Pierce Police Department or the St. Lucie County Sheriffs Department. Motor vehicles parked in violation. of this article shall be subject to removal by the Fort Pierce Police Department or the St. Lucie County Sheriffs Department and may be impounded until such time as redeemed at the owner's expense. Appeals. ta) Any decision made by the county administrator in the course of administering the provisions of this chapter may be appealed to the board of county commissioners by filing a petition of appeal within thirty (30) calendar days of the date of the rendition of the decision. (b) The board of county commissioners shall. review the petition. at a public meeting within thirty (30) calendar days from the date of appeal of said decision. The petitioner shall be provided reasonable notice of the time, date, and place of the public meeting by certified mail, return receipt requested, and invited to attend. Testimony at the public meeting shall be limited. to ten (IO) minutes per side, unless an extension of time is granted by the board.. The board's decision shall be final for the purpose of administrative appeals. The board of county commissioners shall revoke the decision of the county administrator ~mh~ if there is competent, substantial. evidence in the record that the decision fails to comply with this article. (Ord. No. 95-023. Pt. A, 9-19-95) Sec. 1-15-47. Review and automatic adjustment of fees. (a) Th.e parks impact fee shall be adjusted by the. county administrator in April of each calendar year. Unless otherwise directed by the county commission, any adjustments to the parks impact fee, made pursuant to this section, shall be effective the first Monday in October of each calendar year. All adjustments to the parks impact fee shall be based on the methodology described in subsection ib? of this section. (bi The base for computing any adjustment is the January Consumer Price Index-A11 Urban Consumers for the United States, published by the United States Department of Labor, Bureau of Labor Statistics. For the purpose of this section the initial index to be referenced is January 1996. The parks impact fee shall be adjusted by the percentage change in the index. Supp. No. 9l $09 § 1-15-47 ST. LUCIE COUNTY CODE (c) If the index is changed so that the base year is different, the index shall be converted in accordance with the conversion factor published by the United States Department of Labor, Bureau of Labor Statistics. A, 9-19-95) Supp. No. 91 [The next page is 827] 810 Chapter 1-15.5 PAWNBROKERS AND SECONDHAND DEALERS Sec. 1-15.5-1. Title. This chapter shall be known as the Pawnbroker and Secondhand Dealer Ordinance of St. Lucie County, Florida. (Ord. No. 11-010, Pt. B, 6-7-11) Sec. 1-15.5-2. Definitions. The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Consignment shop means a shop engaging in the business of accepting for sale, on consignment, secondhand goods which, having once been used or transferred from the manufacturer to the dealer, are then received into the possession of a third party. Pawn means either of the following transactions: (ll Buy-sell. agreement means an agreement. whereby a purchaser agrees to hold property for a specified period of time to allow the seller the exclusive right to repurchase the property. Abut'-sell agreement is not a loan of money. (2) Loan of money means a written or oral bailment of personal property as security for an engagement or debt, redeemable on certain terms and with the implied power of sale on default. Pawn. means any advancement of funds an the securit;y of pledged goods on condition that the pledged goods are left in the possession of the pawnbroker for the duration of the pawn and may be redeemed by the pledgor on the terms and conditions contained in this section. Pawnbroker means any person duly licensed under Chapter 539, Florida Statutes, who is regularly engaged in the business of making pawns who makes a public display containing the term. "pawn." "pawnbroker," or "pawnshop" or any derivative thereof; or who publicly displays a sign or symbol historically identified with pawns, but does not include a financial institution as defined in section 655.005, Florida Statutes, or any person who regularly loans money or any other thing of value on stocks, bonds, or other securities. A pawnbroker may also engage in the business of purchasing goods which includes consignment and trade. Pledge means pawn or buy-sell agreement. Precious rnetals means any item containing any gold, silver, or platinum or any combination thereof excluding the following: (1) Any chemical or any automotive, photographic, electrical, medical, or dental materials or electronic parts. ! 2 i Any coin with an intrinsic value less than its numismatic value. Supp. No. 9l. 827 1-15.5-2 ST. LUCIE COUNTY CODE (3) Any gold bullion coin. (4) Any gold, silver, or platinum bullion that has been assayed and that is properly marked as to its weight and fineness. (5) Any coin which is mounted in a jewelry setting. Precious metals dealer means a secondhand dealer who normally or regularly engages in the business of buying used precious metals for resale. The term does not include those persons involved in the bulk sale of precious metals from one (1) secondhand or precious metals dealer to another. Secondhand dealer means any person who is not a secondary metals recycler and who is engaged in the business of purchasing, consigning, or trading secondhand goods. However, secondhand dealers are not limited to dealing only in items defined as secondhand goods in this section. Except as provided in subsection 1-15.5-3(a)(1), the term "secondhand dealer" means jewelers, precious metals dealers, garage sale operators, secondhand stores, and consignment shops. Secondhand goods means personal property previously owned or used, which is not regulated metals property regulated under section 538.18, Florida Statutes, et seq., and which is purchased, consigned, or traded as used property. Such secondhand goods do not include office furniture, pianos, books, clothing, organs, coins, motor vehicles, costume jewelry, and secondhand sports equipment that is not. permanently labeled with a serial number. For purposes of this paragraph, "secondhand sports equipment" does not include golf clubs. Secondhand store means the place or premises at which a secondhand dealer is registered to conduct business as a secondhand dealer or conducts business. Title loan. means a loan of money secured by bailment of a certificate of title to a motor vehicle. A title loan is not a pawn if the secondhand dealer does not maintain physical possession of the vehicle throughout the term of the transaction. Transaction means any title loan, purchase, or consignment of secondhand goods by a secondhand dealer. (Ord. No. 11-010, Pt. B, 6-7-11 Sec. 1-15.5-3. Exemptions. (a) This chapter does not apply to the following: (1) Any secondhand goods transaction involving an organization or entity registered with the state as a nonprofit, religious, or charitable organization or any school-sponsored association or organization other than a secondary metals recycler subject to section 538.18. Florida Statutes. (2) A law enforcement officer acting in an official capacity. (3) A trustee in bankruptcy, executor, administrator, or receiver who has presented proof of such status to the secondhand dealer. Supp. No. 91 828 PAWNBROKERS AND SECONDHAND DEALERS § 1-15.5-3 t41 Any public official acting under judicial process or authority who has presented proof of such status to the secondhand dealer. t 5) A sale on the execution or by virtue of any process issued by a court, if proof thereof has been presented to the secondhand dealer. (6) Any garage sale operator who holds no more than two (2) garage sales of up to three (3) days each at any site during one (1~ calendar year. (7) An_y person at antique, coin; or collectible shows or sales. t8) Any person who sells household personal property as an agent for the property owner or the owner's representative pursuant to a written agreement at that person's residence. (91 The purchase, consignment, or pawn of secondhand goods from. one t1} secondhand dealer to another secondhand dealer when the selling secondhand dealer has complied with the requirements of this chapter. (10) Any person accepting a secondhand good as a trade-in for a similar item of greater value. (ll) Any person purchasing, consigning, or trading secondhand goods at a flea market regardless of whether at a temporary or permanent business location at the flea market, unless said vendor conducts business transactions otherwise governed by the State of Florida. tl2) Any auction business as defined in section 468.382(1), Florida Statutes. (13) Any business that is registered with the state department of revenue for sales tax purposes as an antique dealer pursuant to Chapter 212, Florida Statutes, and that purchases secondhand goods from the property ov~~ner or such owner's representative at the property owner's residence pursuant to a written agreement that states the name, address, and telephone number of the property owner and the type of property purchased. (14) Any person purchasing, consigning, or pawning secondhand goods ordered by mail; computer-assisted shopping; media-assisted, media-facilitated, ormedia-solicited shop- ping; or shopping by other means of media communication, including but not limited to direct mail advertising; unsolicited distribution of catalogs; television, radio, or other electronic media; telephone, magazine, or newspaper advertising, so long as such. person is in this state at the time of the order. tl5) A motor vehicle dealer as defined in section 320.27, Florida Statutes. (b) This chapter does not apply to secondary metals recyclers regulated under section 538.18. Florida Statutes. (Ord. No. i1-010, Pt. B, 6-7-11) suPp. N~. sl 829 1-15.5-4 ST. LUCIE COUNTY CODE Sec. 1-15.5-4. Business tax receipt. Secondhand dealers, precious metals dealers, pawnbrokers, and junk dealers shall obtain a county business tax receipt from the St. Lucie County Tax Collector as required under Chapter 1-12, St. Lucie County Code of Ordinances and Compiled Laws. (Ord. No. 11-010, Pt. B, 6-t-11) Sec. 1-15.5-5. Recordkeeping requirements. (a) The St. Lucie County Sheriff shall designate an electronic reporting system for all. pawn and secondhand dealer transactions. The St. Lucie County Sheriff shall provide copies of the electronic reporting system software to all pawnbrokers and secondhand dealers. (b) A pawnbroker shall comply with the recordkeeping requirements set forth in section 539.001(9), Florida Statutes, including but not limited to electronic transfer to the St. Lucie County Sheriff of all pawn transactions using the electronic reporting system designated by the sheriff. (c) In addition to the recordkeeping requirements set forth in section 538.04, Florida Statutes, secondhand dealers shall also comply with the recordkeeping requirements set forth in this section. (d) A secondhand dealer as defined in this chapter shall provide an electronic transaction of all articles of any kind purchased or received using the electronic reporting system designated by the St. Lucie County Sheriff pursuant to section 539.001(9)(b), Florida Statutes. The electronic transaction record shall at all times during business hours be open to the inspection of the St. Lucie County Sheriff 's Office. The report shall be a full, true, and complete report of all goods, wares, merchandise, or things received on deposit or purchased the previous day. The report shall contain the following: (1) The time, date, and place of the transaction. (2) A complete and accurate description of the goods acquired, including digital images, any serial numbers, manufacturer's numbers, or other identifying marks or charac- teristics. (3) A description of the person from whom the goods were acquired, including: a. Full name, address, place of employment, and home telephone number. b. Height, weight, date of birth, race, gender, hair color, eye color, and any other identifying marks. c. The right thumbprint, free of smudges and smears, of the person from. whom the goods were acquired (4) If any article has engraved thereon a number, word, or initial, or contains settings of any kind, the description of the article in the report shall contain the number, word, or initial and shall show the kind of settings and the number of each kind. Supp. No. 9l. 830 PAWNBROKERS AND SECONDHAND DEALERS § 1-15.5-7 (5) In the case of a purchase, the amount of money paid for the goods or the monetary value assigned to the goods in connection with the transaction. The amount of money paid for the goods or the monetary value assigned to the goods in connection with the transaction. (6) Any other information required by the Florida Department of Law Enforcement. (e) A secondhand dealer shall require verification of the identification of the seller by the exhibition of agovernment-issued photographic identification card such as a driver's license or military identification card. The record shall contain. the type of identification. exhibited, the issuing agency, and the number thereon. (f) A secondhand dealer shall. require a seller to sign a statement verifying that the seller is the rightful owner of the goods or is entitled to sell the goods. (g) Each receipt issued by a secondhand dealer shall be numbered consecutively, and if stubs are used in connection with the record of the transaction retained by the secondhand dealer, each stub shall be numbered consecutively to conform to the receipt. (h? The electronic reporting system will provide for an upload of a complete electronic report as described in this section. Each secondhand dealer and pawnbroker shall, at the end of each business day, provide an electronic upload to the electronic reporting system of all transactions that occurred during the previous business day. (i7 Secondhand dealers are exempt from this section for all transactions invoh~ing second- hand sports equipment, except secondhand sports equipment that is permanently labeled with a serial number. (Ord. No. I1-010, Pt. B, 6-7-11) Sec. 1-15.5-6. Inspection of records and premises. (al The premises and required records of each secondhand dealer and pawnbroker are subject to inspection during regular business hours by the St. Lucie County Sheriff s Office and by any state lativ enforcement officer who has jurisdiction over the dealer. (b) The inspection authorized by subsection (a) of this section shall. consist of an examina- tion on the premises of the inventory and required records to determine whether the records and inventory are being maintained on the premises as required by section 1-15.5-5 and whether the secondhand dealer or pawnbroker has complied with the holding period require- ments of section 1-15.5-%. (Ord. No. 11-010, Pt. B, 6-r-11} Sec. 1-15.5-7. Holding period. (a) A pawnbroker shall comply with the holding requirements set. forth in section 539.001(9). Florida Statutes. Supp. No. 97 831 1-15.5-7 ST. LUCIE COUNTY CODE (b) A secondhand dealer shall comply with the following holding requirements: (1) A secondhand dealer shall not sell, barter, exchange, alter, adulterate, or in any ~>ay dispose of any secondhand goods within thirty (30} calendar days of the date of acquisition of the goods. Such holding period is not. applicable when the person known by the secondhand dealer to be the person from whom the goods were acquired desires to redeem, repurchase, or recover the goods, provided the dealer can. produce the record of the original transaction with verification that the customer is the person from whom the goods were originally acquired. (2) A secondhand dealer shall maintain actual physical possession of all secondhand goods throughout a transaction. It is unlawful for a secondhand dealer to accept title or any other form of security in secondhand goods in lieu of actual physical possession. (3) Upon probable cause that goods held by a secondhand dealer are stolen, a law enforcement ofI`icer with jurisdiction may extend the holding period to a maximum of ninety (90} days. The law enforcement officer must make the hold order, and the secondhand dealer must act, in compliance with the provisions of section 538.06(3) Florida Statutes. However, the holding period may be extended beyond ninety (90} calendar days by a court of competent jurisdiction upon a finding of probable cause that the property is stolen and further holding is necessary for the purposes of trial or to safeguard such property. The dealer shall assume all responsibility, civil or criminal, relative to the property or evidence in question, including responsibility for the actions of any employee with. respect thereto. (4} All dealers in secondhand property regulated by this chapter shall maintain transac- tion records for five (5) years. (c) Subject. to the requirements of Chapter 537, Florida Statutes, and the restrictions in section 538.15, Florida Statutes, a secondhand dealer may engage in a title loan transaction, and the physical possession requirements of subsection 1-15.5-7(b)(2) of this section shall not. apply if the following conditions are met: (1) The secondhand dealer maintains physical possession of the motor vehicle title. (2} The owner maintains possession of or control over the motor vehicle throughout the transaction. (3) The owner is not required to pay rent or any other charge for the use of the motor vehicle. (4) A secondhand dealer who engages in a motor vehicle title loan transaction has the right to repossess the motor vehicle upon failure of the owner to redeem the title. The secondhand dealer shall only repossess a motor vehicle through an agent who is licensed by the state to repossess motor vehicles. The secondhand dealer may dispose of the motor vehicle as provided in section 538.16, Florida Statutes. Any sale or disposal. of the motor vehicle shall be made through a motor vehicle dealer licensed under section 320.27. Florida Statutes. Supp. No. 9l. 832 PA~~'NBROKERS AND SECONDHAND DEALERS § 1-15.5-9 (5) No charges other than those charges permitted in Section 537.011, Florida Statutes, shall be allowed, and such charges shall be fully disclosed, conspicuously in writing, and initialed by the motor vehicle owner at the initiation of the transaction. It is unlawful for a secondhand dealer or any employee of a secondhand dealer to do or allow any of the following acts: (1) Knowingly make a transaction with any person: a. Who is under the influence of drugs or alcohol when such condition is visible or apparent; b. Under the age of eighteen years; or c. Using a name other than such person's own name or the registered name of such person's business. (2} Have a secondhand store open or engage in or conduct business as a secondhand dealer between the hours of 10:00 p.m. and 7:00 a.m. A secondhand dealer shall not conduct any transaction. at adrive-through window or similar device. t31 Fail to pay any sales tax owed to the Florida Department of Revenue or fail to have a sales tax registration number. (4) Engage in both pawn transactions and title loan transactions from at, within or adjoining a licensed pawn shop or secondhand dealer location. (5) Use the word "pawn" or "pawnbroker" in any transaction, documentation, advertising or promotional materials, signs, displays, banners, or other materials of any nature relating to the secondhand dealer's business. Any person willfully violating the provisions of this chapter, other than clerical or recordkeeping errors, shall. be guilty of a .misdemeanor punishable by a fine not to exceed five hundred dollars ($500.00) or by imprisonment in the county jail not to exceed sixty (60) days, or bath such fine and imprisonment. Neighborhood Stabilization Program Sales Standards and Procedures, ~~'§ 1-16.2-13-1-16.2-19 ARTICLE I. DISPOSITION OF SURPLUS REAL PROPERTY Sec. 1-16.2-1. Purpose. This article is created for the purpose of establishing a method of disposition of surplus County real property in accordance with section 125.35(3), Florida Statutes. (Ord. No. 02-18, Pt. B, 6-18-02; Ord. No. 11-014, Pt. A, 5-3-11) Sec. 1-16.2-2. Declaration of surplus property. (a) When. the board of county commissioners finds that any real. property owned by the county is unusable or not needed for county purposes, the board may declare the real property to be surplus property. Once the property is declared surplus, the property may be sold, dedicated, donated or otherwise conveyed. to interested parties pursuant to the terms of this article. The declaration of surplus property shall be recorded in the minutes of the board. {b) Once the real property is declared surplus by the board of county commissioners, the county administrator or designee shall have the authority to sell the property to the highest and best bidder. A deed transferring the property to the highest and best bidder shall be presented to the chairman of the board of county commissioners for signature without any further approval of the board being required. The county administrator or designee shall have the authority to reject all bids if the bids are determined to be too low or not in the best interest of the county. In the event the county administrator or designee desires to transfer the property to a person other than the highest and best bidder, the matter shall be presented to the board for approval. tOrd. Process by which interested persons may acquire surplus property. t a) Any person, corporation, governmental body; or other legal entity may request to acquire surplus real property by submitting a letter of interest to the county administrator or designee. The letter shall include the following information: i 1) I~Tame of the person or legal. entity interested. in the property; (2) The reason for acquiring the property, i.e., personal, charitable, governmental, etc.; (3 i The proposed purchase price; supp. N~. s7 855 § 1-16.2-3 ST. LUCIE COUNTY CODE (4) The legal description, the alternate key number and, if available, the street address of the property; and (5) Any other information the person. deems relevant. (b7 Upon receipt of the letter of interest, the county administrator or designee shall verify whether the property has in fact been declared surplus. If the property has not been declared surplus, the county administrator or designee shall make a determination as to whether the property is needed for county purposes. If the property is no longer needed, then the county administrator or designee shall request the board of county commissioners to declare the property surplus. Once the property is declared surplus, then the county administrator or designee shall seek to dispose of the property in accordance with the standards of competition set forth in this article. (cl The county may, on its own initiative, dispose of surplus property by following the standards of competition. (Ord. No. 02-18, Pt. B, 6-18-02; Ord. No. 11-014, Pt. A, 5-3-11) Sec. 1-16.2-4. Standards of competition and notice of disposal. {a) For real property valued more than $25,000.00, as appraised by the property appraiser's office, the county may sell the property to the highest and best bidder. Notice calling for bids shall be published in a newspaper of genera] circulation. once each week for two (2) consecutive weeks. The county shall have the option to convey the property to the highest bidder or reject all bids. This procedure applies regardless of whether the surplus property is being disposed of on the county's own initiative or upon receiving a letter of interest. {b) For real property valued at $50,000.00 or more, as appraised by the property appraiser, the county shall have the property re-appraised by a fee appraiser designated by a fee appraiser designated by the county. The county may then dispose of the property through the procedure outlined in Section 1-16.2-4 (a). (c) Alternatively, for real property appraised under $25,000.00 by the property appraiser's office, the county may negotiate the private sale of the property to an interested person. The county shall send notice to all adjacent property owners by certified mail indicating the county's desire to dispose of the real property. The county may then effect a sale and conveyance of the parcel. at private sale to an adjacent property owner without receiving bids or publishing notice. If, within ten (10) business days after receiving such notice, two or more adjacent property owners indicate their desire to purchase the property, the county shall accept sealed bids for the property from the interested parties. The county may then convey the property to the highest bidder or reject all bids. This procedure applies regardless of whether the surplus property is being disposed of on the county's own. initiative or upon receiving a letter of interest. If no adjacent. property owners express interest in purchasing the property, the county may dispose of the property through the procedure outlined in Section 1-16.2-4 (a). Supp. No. 91 856 PUBLIC PROPERTY S 1-16.2-6 (d) Alternatively, when a parcel of real property is of insufficient size and shape or is otherwise unable to be issued a building permit for any type of development to be constructed on the property, the county may negotiate the private sale of the property to an adjacent. property owner. Such parcels may only be sold or conveyed to adjacent property owners. The county shall send notice to all adjacent property owners by° certified mail indicating the county's desire to dispose of the real property and requesting interested adjacent property owners to submit to the County a letter of interest. The county may then effect a sale and conveyance of the parcel at private sale to an adjacent property owner v~~ithout receiving bids or publishing notice. If two or more adjacent property owners express interest. in acquiring the property, the County shall evaluate the letters of interest and may convey the property to the adjacent property owner the County deems most appropriate considering the unique location of the surplus property. This procedure applies regardless of whether the surplus property is being disposed of on the countds own initiative or upon receiving a letter of interest. (e) The county, regardless of the appraised value of the property, may convey such property to another governmental entity or charitable institution at a private sale for such price as the board of county commissioners may fix. Negotiation procedures. ta) In negotiating the terms anal conditions of the disposal of surplus property, the county administrator or designee shall take into consideration the following factors: (1) The appraised value of the real property; (2) The condition of the real property, and the extent to which the party seeking to acquire the property will have to expend funds to make the property useable, or, to bring the property into compliance with the St. Lucie County Code of Ordinances; and (3? The proposed use of the party seeking to acquire the property. (b In no event shall the disposition of surplus property violate the St. Lucie County Comprehensive Plan. or the zoning regulations of St. Lucie County, Florida. (Ord. No. 02-18, Pt. B, 6-18-02; Ord. No. ll-014, Pt. A, 5-3-11) Sec. 1-16.2-6. Notification of disposition. to interested parties. The county administrator or designee shall publish a notice in a newspaper of general circulation once at least twenty t20J days prior to the board of county commissioners' hearing in which the real property is to be declared surplus. The notice shall contain a description of the surplus property sought to be disposed of, the name of the county administrator or designee to which objections shall be addressed, and the date of the regular meeting of the board in which proposed final action is to be taken. The purpose of developing the Airport West Commerce Park is to generate revenue for the St. Lucie County International Airport in accordance with Federal Aviation Administration and Florida Department of Transportation grant assurances by providing economic develop- ment opportunities for companies interested in locating in St. Lucie County. (Ord. No. 09-028, Pt. A, 10-6-2009) Sec. 1-16.2-8. Competition and qualification standards. In order to expand economic development at the Airport West Commerce Park, the board of county commissioners may either (1) bid and award leases on a competitive sealed bid or proposal basis; or, f2) determine to waive the process of obtaining competitive sealed bids or proposals and award a lease to a company that is a targeted industry meeting the criteria set forth in subsection 1-7.55-1(d)(1) or subsection 1-7.55-1(d)(2) of this Code that will, in the opinion of the board, significantly enhance economic activity in St. Lucie County. (Ord. No. 09-025, Pt. A, 10-6-2009) Sec. 1-16.2-9. Bid proposal waiver procedure. In the event the board determines to consider waiving the competitive bid or proposal process, the board shall: (17 Publish a notice in a newspaper of general circulation in St. Lucie County at least ten (10) days before the board's regular meeting at which the bid or proposal waiver will be considered. The notice shall identify the nature of the proposed bid or proposal waiver; and, shall identify the county office where copies of the draft resolution providing for the bid or proposal waiver may be reviewed or obtained.. The notice shall also provide the time and manner for persons making objections in writing or otherwise. (2) Consider the proposed waiver as a regular (non-consentl agenda item at a regularly scheduled board meeting. Although the item is not a public hearing, interested members of the public may comment on the item during general public comment or at the time the item is presented. The lease of property in the Airport West Commerce Park must. be consistent with the county's comprehensive plan and land development regulations. (Ord. No. 09-028, Pt. A, 10-6-2009) ARTICLE III. NEIGHBORHOOD STABILIZATION PROGRAM SALES STANDARDS AND PROCEDURES Sec. 1-16.2-13. Purpose. The purpose of developing the Neighborhood Stabilization Program ((NSP(.) is to ac0uire foreclosed and abandoned residential properties tivithin the unincorporated areas of the county, rehabilitate them if necessary, incorporating green components where practical, and convey them to homebuyers meeting law and moderate income eligibility requirements. (Ord. No. 10-013, Pt. A, 3-23-2010) Sec. 1-16.2-14. Acquisition procedures. i a) This board hereby authorizes the county administrator, or designee, to execute purchase contracts in accordance with established purchase procedures and all documentation neces- sary to complete purchase of NSP residential properties within St. Lucie County. LUCIE COUNTY CODE (b) The purchase price of foreclosed properties under the NSP shall generally be less than current appraised market value. The county shall adhere to the NSP requirements of minimum discounts for single property purchases and for bulk purchases. The community services director, or designee, is hereby authorized to acquire NSP properties on behalf of the county subject to the following conditions: (1) The community se~-~~ices director or designee, shall utilize a form of agreement acceptable to the county attorney for each property acquired. (2) The community services director will coordinate all. aspects of the acquisition process, including conducting due diligence on each property, negotiation of the ultimate acquisition price, and closing of the real estate transaction. (3) The community services director, or designee, shall evaluate each property acquired and determine the scope of repairs for each home and coordinate the bidding process and contract award for renovation work on each unit requiring repairs. (4) Properties shall be acquired in the name of St. Lucie County, a political subdivision of the State of Florida, unless a different o~rnership is specifically authorized by the board of county commissioners. (Ord. No. 10-013, Pt. A, 3-23-2010) Sec. 1-16.2-15. Sale of properties. The board authorizes the county administrator, or designee, to execute sales contracts in accordance with established purchasing procedures and all documentation, with. the exception of county deeds, necessary to complete the sale of NSP properties. The board authorizes the Chairman to execute county deeds for the sale of NSP properties. The NSP provides for the eligibility and qualification standards addressing the disposition of acquired properties. In conveying NSP properties to consumers, the federal regulations provide eligibility criteria dictated that the properties acquired by the county pursuant to the NSP may only be sold to individuals that qualify under the following standards: (1) All properties made available under the NSP shall only be conveyed to individuals or families whose income does not exceed one hundred twenty (120) percent of the area median income established for St. Lucie County by the United States Department of Housing and Urban Development (HUD). (2) To the extent practicable, residential properties sold by the county under the NSP shall be financed through conventional or other private-sector mortgage financing. To that end, residential properties acquired by the county under the NSP shall only be sold to individuals meeting the income and qualification criteria required by the NSP and preference shall be given to purchasers who also meet credit criteria of private lenders providing home mortgages to NSP home purchasers. Nothing in this Ordinance, however, is intended to preclude the granting of down-payment assistance, principal buy down assistance, or other assistance available through the county or any other public agency for an eligible buyer under any other assistance program. Supp. No. 91 856.4 PUBLIC PROPERTY ~ 1-16.2-16 (31 Notice of the availability for sale of 1VSP properties shall be through the community services department and may include the use of private-sector realtors and such. realty-based ser~~ices as the multiple listing service. In addition, the community services director, or designee, shall make information on the NSP known to the citizens of St. Lucie County through educational outreach programs established by the community services department, county lands or not. for profit organizations. Inter- ested applicants wil] be encouraged. to contact a housing facilitation agency, the community services department or other source deemed appropriate by the community services director, or designee, which has access to the list of homes for sale and home loan eligibility criteria so that prospective home purchasers can. qualify based on NSP income criteria and credit worthiness far private mortgage financing. (4) Criteria applicable to the selection of a person to whom county properties shall be conveyed shall be as set forth herein utilizing the income requirements set forth in the NSP private lender financing program requirements and eligibility and qualifications of persons for other public sector financial assistance. (5) Qualifying purchasers will be notified by community services director, or designee. Potential purchasers would be (assignedt to a particular property on a first come, first considered basis. Upon submittal or reasonable qualification paperwork, said property shall be identified and removed from (available( list which will be retained by the community services department. Other persons expressing interest in a particular property will be advised by the community services department of other properties available and will be informed of the application and qualification process(es). (Ord. No. 10-013, Pt. A. 3-23-2010) Sec. 1-16.2-16. Minimum criteria for conveyance. To meet the policy- and time frame obligations of the NSP and the NSP Grant Agreement, the following procedures will be followed. with regard to the disposition and conveyance of the NSP residential properties. The steps to be followed shall be: (1) The community ser~~ices department may market homes to potential home buyers through a variety of public and private resources, including the local Multiple Listing Service (MLS), the St. Lucie County website and other public and private community facilities frequented by the public. The county shall work with not for profit organi- zations and private realtors to make program guidelines, eligibility considerations, target areas, and buyer qualification criteria. made known to public and private organizations who may present buyers of particular properties to th.e County. (2) The sale price of all NSP properties shall be at or below an amount equal to the cost to acquire the residential property plus the cost to rehabilitate that particular home or the current appraised value, whichever is less. as required by NSP rules or regulations or the hTSP grant agreement. (31 All NSP residential properties sold shall be sold to individuals or families whose income does not exceed one hundred twenty (120) percent of the area median income. LUCIE COUNTY CODE (4) The board reserves the right under this article to convey properties to qualified non-profit organizations for reduced or no monetary consideration if the board declares said non-profit organization can serve the rental. or home ownership needs of persons qualified under the income or other standards of the NSP.
