Secondary Metals Recyclers, fi§ 1-18-31-1-18-36 ARTICLE I. IN GENERAL Sec. 1-18-1. Required to maintain motor vehicle liability insurance. The sheriff' of the county shall. maintain insurance against legal liability for the death, injury, or disability of any person arising from or in connection with the operation of any motor vehicle owned, leased or operated by the sheriff of said. county, or any of his employees, to the extent of not less than one hundred thousand dollars ($100,000.00) bodily injury liability per person; three hundred thousand dollars 0300,000.00) bodily injury liability per occurrence and fifty thousand dollars ($50,000.00,1 property damage liability per accident. (Ord. No. 77-2, § 3, 2-8-771 State law reference-Sheriff' authorized to secure liability insurance for claims growing out of performance of duties of the sheriff or his deputies, F.S. § 30.55. Sec. 1-18-2. Combat Auto Theft Program. (a) Pursuant to section 316.008(6), Florida Statutes, there is hereby established a "Combat Automobile Theft" program in the county, which shall. be known as "Combat Auto Theft." Such a program shall include: (1) A consent form to be signed. by the motor vehicle owners who wish to enroll their vehicles; and (2) Bright yello«~ decals indicating a vehicle's enrollment in. Combat Auto Theft. (b) The consent form shall: (11 Explain the general operation of the program; (2) Provide authorization for a law enforcement officer to stop the vehicle when it is being driven between. the hours of 1:00 a.m. and 5:00 a.m., provided that a decal is conspicuously affixed to the bottom left corner of the back window of the vehicle to provide notice of its enrollment in Combat Auto Theft; (3i Explain the procedures which will be followed by a law enforcement officer making a stop pursuant to the program and advise the motor vehicle owner of the proper means by which the driver of the vehicle should cooperate with the lam- enforcement officer in such instance; supP. LUCIE COUNTY CODE (4 i Provide that the owner of the motor vehicle is responsible for remoaing the decal. when terminating participation in the program, or when selling or otherwise transferring ownership of the program anal for notifying the county sheriffs department in writing of` such termination; (5l Clearly provide that participation in Combat Auto Theft is strictly voluntary and may be terminated at. any time; and (6) Include a separate statement. to be signed by the owner of the motor vehicle which indicates that the consent form has been read and. understood in its entirety including the procedures to be followed in a stop. (c) Combat Auto Theft may be implemented upon approval of program materials and procedures, including guidelines and procedures for making a stop of a vehicle bearing a decal, by the sheriff and county attorney. Such program materials and procedures may be subject to periodic review and approval by the sheriff and. county attorney. (Ord. No. 90-46, Pt. A, 11-20-90; Ord. No. 97-28, Pt. A, 9-2-9 i ) Sec. 1-18-3. Designation of chief correctional officer. (a) The St. Lucie County Sheriff is designated as the Chief Correctional Officer of the St. Lucie County Correctional System. (bl If designated, the sheriff or his designee shall enforce all existing state. law and administrative rules of the department concerning the operation and maintenance of county jails. (c) The salaries for county correctional officials shall be paid from the general revenue fund of the county and shall be included by the sheriff in his proposed budget of expenditures for the maintenance and operation. of the county correctional. system. (Ord. No. 03-30, § Pt. A, 7-22-03) ARTICLE II. LAW ENFORCEMENT IMPACT FEE Sec. 1-18-03. Short title, authority, and applicability. (a) This article shall be known and may be cited as the "Law Enforcement Impact Fee Ordinance". (b) The Board of County Commissioners of St. Lucie County has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and to Chapter 125 and Sections 163.3201 and 163.3202(3) Florida Statutes. (c) The St. Lucie County Sheriffs Department provides countywide laRr enforcement, court security and correctional security throughout. St. Lucie County pursuant to the authority granted and required under Article VIII(1)fd) of the Florida Constitution and Chapter 30, Florida Statutes. Supp. No. 93 958 SHERIFF' ti 1-18-21 (d) The board of county commissioners shall review the law enforcement impact fee at least once every five (5) years from the effective date of this article tJuly 1, 2004), (Ord. No. 04-005. § Pt. A, 4-6-041 ARTICLE III. RESTRICTIONS ON RESIDENCE FOR SEXUAL OFFENDERS AND SEXUAL PREDATORS Sec. 1-18-20. Definitions. Cont~ictian means a determination of guilt which is the result of a trial or the entry of a plea of b silty or nolo contendere, regardless of whether adjudication is withheld. Licensed childcare facilit~~ means any child care facility licensed by the state pursuant to F.S. Ch. 402. Park means a publicly-owned or operated area used or available for the public`s use as a recreational facility including, by way of example and not limitation, ball fields, outdoor play equipment, pools, linear parks. nature preserves and beaches. Perrn.anent residence .means a place where a person abides, lodges, or resides for five (5) or more consecutive days, and which includes, motor vehicles, trailers, mobile homes, manufac- tured homes, vessels, live-aboard vessels and houseboats. Sexual offender shall have the meaning ascribed to such term in F.S. § 943.0435. Se:eual predator shall. have the meaning ascribed. to such. term in F.S. ~ 775.21. Tem.pora,r~~ residence means a place where a person abides, lodges, or resides for a period of five (5) days or more in the aggregate, during any calendar year, and which is not the person's permanent residence, or place where a person. routinely abides, lodges or resides for a period of five (51 or more consecutive or non-consecutive days in any month which is not the person's permanent residence, and which includes, motor vehicles, trailers, mobile homes, manufac- tured homes, vessels, live- aboard vessels, and houseboats. (1) A sexual offender or sexual predator shall not establish a permanent residence or temporary residence within two thousand five hundred (2,500} feet of any public or private elementary, ~m~iddle, or secondary school, park or licensed child care facilit.v. (2) For purposes of determining the minimum distance separation, the distance shall be measured by following a straight line from the outer property line of the permanent residence or temporary residence to the nearest outer property line of the public or private elementary. middle, or secondary school, park. or licensed child care facility. A sexual offender or sexual predator residing within. two thousand. five hundred (2,500) feet of any public or private elementary. middle, or secondary school, park or licensed child care facility does not, commit a violation of this section if any of the following applti-: (a) The sexual offender or sexual predator established the permanent residence prior to the effective date of this article [October 1, 2008]. (b) The sexual. offender or sexual. predator was a minor or youthful offender pursuant to F.S. Ch. 958 when he or she committed the offense and was not convicted as an adult. (c) The sexual offender or sexual predator is a minor. (d) The public or private elementary, middle, or secondary school, park or licensed child care facility within two thousand. fve hundred (2,500) feet of the sexual offender's or sexual predator's permanent or temporary residence was opened and/or established after the person established the permanent or temporary residence. A person who violates this section shall be guilty of asecond-degree misdemeanor and shall be punished. by a fine not to exceed five hundred dollars ($500.00) or by imprisonment for a term not to exceed sixty (60) days, or by both fine and imprisonment. Ferrous metals means any metals containing significant quantities of iron or steel. Fia-ed location means any site occupied by a secondary metals recycler as owner of the site or as lessee of the site under a lease or other rental agreement pro~~iding for occupation of the site by the secondan~ metals recycler for a total duration or not less than three hundred sixty-four (364) days. Monc~1~ means a medium of exchange authorized or adopted by a domestic or foreign government as part of its currency. Nonferrous metals means metals not containing significant quantities of iron or steel, including, without limitation, copper, brass, aluminum, bronze, lead, zinc. nickel, and alloys thereof, excluding precious metals sul?ject to regulation under F.S. Ch. 538, Pt. L Purchase trarzsactzon means a transaction in which a secondary metals recycler gives consideration for regulated metals property. Supp. Nu. 93 974 SHERIFF ~ 1-18-33 Regulated metals property means any item. composed primarily of any nonferrous metals, but shall not include aluminum beverage containers, used beverage containers; or similar beverage containers. For purposes of enforcement under this article, the term shall also include stainless steel beer kegs. Restricted regulated metal propcrt~~ means the specific regulated metal items that are listed in section. 1-18-33 of this Code. Seeonda.~~ metals reeycler shall have the meaning ascribed in subsection F.S. § 538.18(8}, as may be amended from time to time. Seller means the person from whom the regulated metal property is acquired. Utilit~~ means any person, firm, corporation, association, or political subdivision, whether private, municipal, county, or cooperative, which is engaged in the sale, generation, provision, or delivery of gas, electricity, heat, water, oil, sewer service, telephone service, telegraph service, radio service, or telecommunication service. (a) A secondary metals reeycler shall not enter into any cash transaction for purchase of any restricted regulated. metals property listed in section 1-18-33 of this Code. (b) Payment by a secondary metals reeycler for the purchase of restricted regulated metal property shall be made by check issued to the seller and payable to the seller or by electronic payment to the seller's bank account or to the seller's employer's bank account. (c} Each check for payment shall be mailed by the secondary metals reeycler directly to the current street address of the seller which is on file with the secondary metals reeycler unless otherwise provided in this article. Payment shall not be mailed to a post. office boa. Electronic payments shall be sent to a bank account for which the seller is listed as an account holder or an employee or agent thereof. (dl Each check or electronic payment shall be mailed or electronically transferred by the secondary metals reeycler to the seller within three (3) business days of the purchase transaction unless otherwise provided in this article. Ca) A secondary metals reeycler shall not purchase any of the following items of restricted regulated metal. property without obtaining reasonable proof that. the seller owns the property tsuch as a receipt or bill of sale) or reasonable proof that the seller is an employee, agent, or contractor of a governmental entity, utility company, cemetery, railroad, manufacturer, or other entity, owning the property to secondary metals reeycler may retain on file an official 8vpp. Nu. 93 975 1-1$-33 ST. (21 An electric light pole or other utility structure and its fixtures, wires, and hardware which are readily identifiable as coming from the utility structure. (3) A guard rail. (4) A street sign, traffic sign, or traffic signal and its fixtures and hardware. (5) Communication, transmission, distribution, and sen~ice wire, from a utility including copper or aluminum bus bars, connectors, and grounding plates or grounding v~rire. (6) A funeraUgrave marker or funeral vase. t 7) A historical marker. ($) Railroad equipment, including, but not limited to a tire plate, signal house, control box, switch plate, E clip, or rail tie junction. t9) Any metal. item. that is observably marked upon. reasonable inspection. with any form of the name, initials, or logo of a governmental entity, utility company, cemetery, or railroad. (10) A copper, aluminum, or aluminum-copper condensing or evaporator coil, including its tubing or rods, from a heating or air conditioning unit (exclu.ding coils from window air conditioning units and automobiles ). (11) An aluminum or stainless steel container or bottle designed to hold propane for fueling forklifts. {12) Stainless steel beer kegs. (13) A catalytic converter or any nonferrous part of a catalytic converter unless purchased as part of a vehicle. (l~) Metallic wire that was burned in whole or in part to remove insulation. (17) Brass or bronze commercial valves or fittings, referred to as "FDC valves," that are commonly used on structures for access to water for the purpose of extinguishing fires. (16) Brass or bronze commercial potable water backflow preventer valves that are valves commonly used to prevent backflow of potable water into municipal. domestic water service svstems from commercial structures. {17) A shopping cart. Supp. No. 9 976 SHERIFF ~ 1-18-34 (b) Exemptions. The secondary metals recycler may provide a check at the time of the purchase transaction, rather than mailing said check as required in subsection 1-18-32 of this article, if the seller is in one of the foll.otving exempt categories: (1) Organizations, corporations, or associations registered with the state as charitable, philanthropic, religious, fraternal, civic, patriotic, social, or school-sponsored organi- zations or associations, or from any nonprofit corporation or association; (2) A law enforcement officer acting in an official capacity; (3) A trustee in bankruptcy, executor, administrator, or receiver who has presented proof of such status to the secondary metals recycler; (4} Any public official acting under judicial process or authority v~>ho has presented proof of such status to the secondary metals recycler; or (5) A sale on the execution, or by virtue of any process issued by a court, if proof thereof has been presented to the secondary metals recycler; or (6} A manufacturing, industrial, or other commercial vendor that generates regulated materials in the ordinary course of business. (a) All secondary metals recyclers shall maintain a legible electronic record, in the English language, of all. purchase transactions involving regulated metal property and restricted regulated metal property to which. such secondary metals recycler is a party. Such electronic format «>ill be the Leads Online software or such software as is otherwise designated in writing by- the St. Lucie County Sheriffs Office. It shall be the responsibility of the individual. secondary metal. recycler, or any employee thereof, to obtain the most current data specifica- tions of the designated electronic format. (b) The following information shall be maintained and transmitted to the St. Lucie County Sheriffs Office in the specified electronic data format described in subsection(a}, above: (1) The name and address of the secondary metals recycler; {`L) The name, initials, or other identification of the individual entering the information regarding the transaction; (3) The date and time of the transaction; (4) The weight, quantity, or volume and a description of" the type of regulated metals property purchased in a purchase transaction; (5) Photo of items; (6) The distinctive number from the personal identification card of the seller; Supp. No. 93 977 § 1-18-34 ST. LUCIE COUI~T~ CODE (7) A description of the seller including: a. Full name, current residential. address, workplace, and borne and work phone numbers; b. Height, weight, date of birth, bender, hair color, eye color, and any other identifying marks; c. A vehicle description to include the make, model, and tag number of the vehicle anal trailer of the seller of the regulated. metals property; and d. Any other information required by the form approved by the Florida Department of Law Enforcement and as specified in F.S. ~ 538.19, except the amount of consideration given in the purchase transaction. (c) Such information shall be electronically transmitted for the previous day's business to the St. Lucie County Sheriffs Office by 10:00 a.m. on each day the secondary metals recycles is open for business. (d) A secondary metals recycles shall maintain or cause to be maintained the information required by this section for not Less than five f 5 i years from the date of purchase transaction. le) If the purchase transaction involves the transfer of regulated metals property from a) a secondary metals recycles registered with the state or b) an exempt seller under section I-18-3(b) of this Code to a secondary metals recycles registered with the state, the secondary metals recycles receiving the regulated. metals property shall record the seller's business name and address and the name of the seller's business representatiae or seller's point of contact. in lieu of thE: requirements listed. in paragraph (61 above. A secondary metals recycles shall maintain at its place of business, or otherwise have immediate access to, a facsimile, telecopier, or other equipment of similar function on which notifications of stolen property or other notifications relating to regulated metal property may be expeditiously received from the St. Lucie County Sheriffs Office. The equipment shall be operable at all times during the usual and customary business hours of the secondary metals recycles. The secondary metals recycles shall maintain the facsimile number or other access nwnber of the equipment on file with the sheriff and. shall. notify the sheriff within twenty-four (24) hours of any change in the number.
