ARTICLE I. IN GENERAL
Sec. 1-2-1. Authority to offer rewards for arrest and conviction of persons violating
Laws or ordinances.
The board of county commissioners is authorized to offer and pay rewards for the arrest and.
conviction of persons violating any state law or county ordinance, or regulation.

Sec. 1-2-2. County seal.
(a) Adoption of seal. The seal described and depicted in subsection (b~ herein below is
hereby adopted as the official seal of St. Lucie County, a political subdivision of the State of
Florida.
(bl Description of seal. The seal of St. Lucie County consists of a circle, inside of which is a
second. smaller circle, inside of which is a third smaller circle. Inside the first circle are the
words "COUNTY COMMISSIONERS," then a star, then the words "ST. LUCIE COUNTY,
FLORIDA," then a star. Inside the second circle are figures depicting, starting at the top and

a sailfish. Inside the third circle is a figure depicting the shape of St. Lucie County. A
reproduction of the seal is set forth below.
(c) Approved use; unlawful practices; penalties. The county's seal shall be manufactured,
used, displayed, or otherwise employed only for official St. Lucie County govermnent business.
Use of the seal for general public and media applications may be authorized upon the written
approval of the county administrator or designee. In no case, however, shall the seal be used
for any commercial activity or for any other activity resulting in personal monetary gain.
Unauthorized use of the county's seal in any manner or format, including black and white or
other color scheme, shall be a violation of this section and punishable as provided by lave=.

Sec. 1-2-3. County logo.
(a? Adoption of logo. The logo described and depicted in subsection (b) herein below is
hereby adopted as the official logo of St. Lucie County, a political subdivision of the State of
Florida.
(b) Description of logo. The logo of St. Lucie County consists of a rectangle within which is
depicted a sailfish emerging from blue ocean below a light blue sky, next to the words "ST.
LUCIE COUNTY FLORIDA," above and below this is a thin stripe of yellow and then a thick
stripe of green. A reproduction of the logo is set forth below.

Sec. 1-2-26. Duration of lien.
No lien provided by this article shall continue for a period longer than twenty (20) years
after the certified copy of an order imposing a fine has been recorded, unless within that time
an action is commenced pursuant. to section 1-2-25 in a court of competent jurisdiction. In an
action to foreclose on a lien or for a money judgment, the prevailing party is entitled to recover
all costs, including a reasonable attorney's fee that it incurs in the action. The board of county
commissioners shall be entitled to collect all. costs incurred in recording anal satisfying a valid.
lien. The continuation of the lien effected by the cominenceinent of the action shall not. be good
against creditors or subsequent purchasers for valuable consideration without notice, unless a
notice of lis pendens is recorded.

Sec. 1-2-27. Reserved.
Editor's note-Former § 1-2-27, "Appeals; notice; provisions of article supplemental," was
deleted by Ord. No. 87-71, adopted Oct. 13, 1987. New provisions pertaining to this subject
matter were enacted by the same ordinance and. designated as §S 1-2-27.1-1-2-27.3.
Sec. 1-2-27.1. Appeals.
An aggrieved party, including the board of county commissioners, may appeal a final.
administrative order of'the enforcement board to the circuit. court. Such appeal shall not be a
hearing de novo, but shall be limited to appellate review of the record created before the
enforcement board. An appeal shall. be filed. within thirty (301 days of the execution of the order
to be appealed.

Sec. 1-2-27.2. Notice.
(ai All notices required by this part must be provided to the alleged violator by:
(11 Certified mail to the address listed. in the tax collector's office for tax notices, or to any
other address provided by the property owner in writing to the local government for
the purpose of receiving notices. For property owned by a corporation, notices may be
provided by certified mail to the registered agent of the corporation.. If any notice sent
by certified mail is not signed as received within thirty (30) days after the date of
mailing, notice may be provided by posting as described in subparagraphs (2)(b)1 and
2;
(2) Hand delivery by the sheriff or other law enforcement officer, code inspeetar, or other
person designated by the local governing body; or
(3) Leaving the notice at the violator's usual place of residence with any person residing
therein who is above fifteen (151 years of age and informing such person of the contents
of the notice; or

(4) In the case of commercial premises, leaving the notice with the manager or other
person. in charge.
(b) In addition to providing notice as set forth in subsection (1?, at the option of the code
enforcement board, notice may also be served by publication or posting, as follow>s:
(1) a. Such notice shall be published once during each week for four (4) consecutive
weeks (four (4) publications being sufficient) in a newspaper of general circulation
in the county. The newspaper shall meet such requirements as are prescribed
under F.S. ch. 50 for legal and official advertisements.
b. Proof of publication shall be made as provided in F.S. §§ 50.041 and. 50.051.
(2) a. In lieu of publication as described. in subparagraph 1-2-27.2(2)(a)1, such notice
may be posted at least ten (10) days prior to the hearing, or prior to the expiration
of any deadline contained in the notice, in at least two locations, one (1 j of which
shall be the property upon which the violation is alleged to exist and the other of
which shall be, at the front door of the St. Lucie county Courthouse or the St.
Lucie County Administrative Center.
b. Proof of posting shall be by affidavit of the person posting the notice, which
affidavit shall include a copy of the notice posted and the date and places of its
posting.
(3) a. Notice by publication or posting may run concurrently with, or may follow, an
attempt or attempts to provide notice by hand. delivery or by mail as required
under subsection 1.2-27.2(1).
Evidence that an attempt has been made to hand deliver or mail notice as provided in
subsection 1.-2-27.2(1), together with proof of publication or posting as provided in subsection
1-2-27.2(2), shall be sufficient to show- that the notice requirements of this part have been met,
without regard to whether or not the alleged violator actually received such notice.

Sec. 1-2-27.3. Action for money judgments under this chapter; limitation.
Actions for money judgments under this chapter may only be pursued on fines levied after
October 1, 2000.

ARTICLE IX. REFUELING ASSISTANCE FOR PERSONS WITH DISABILITIES
Sec. 1-2-103. Definitions.
For the purposes of this article, the following shall apply:
Complainant shall mean any individual. who witnesses or who is subjected to conduct which
violates this article and who files a written complaint with the division stating the information
required by this article.
Director shall mean the planning and development services director, or the director's
designee.
Division shall mean. the St. Lucie County Code Division.
Gasoline dispensing area shall mean the area where the pumps used. to dispense flammable
and combustible liquids used. as motor fuels are located.
Gasoline station retailer shall mean:
(1) Any full-service gasoline station located in unincorporated St. Lucie County; or
(2) Any self-service gasoline station. located in unincorporated St. Lucie County that has
two (2) or more attendants on duty at any given time during the hours the station is
open for business to the public.
Person.(s,1 with. disability(ies) shall mean any natural person who:
(1} Has been issued and is operating any motor vehicle properly displaying an exemption
parking permit as provided in F.S. § 316.1958, or F.S. § 320.0848, or a license plate
issued pursuant to F.S. §~ 320.084, 320.0842, 320.0843, or 320.0845; or
(21 Is operating any motor vehicle with specialized equipment, such as ramps, lifts, or foot
or hand controls, for use by a person. who has a disability or whose vehicle is displaying
the Florida Toll Exemption permit.
Self-service gasoline station shall mean that portion of property where flammable and
combustible liquids used. as motor fuels are stored. anal subsequently dispensed from fixed,
approved dispensing equipment into the fuel tanks of motor vehicles by persons other than the
service station attendant.

Sec. 1-2-104. Accessibility requirements.
(a) Attendants at all gasoline station retailers shall at all times be able to communicate
with persons in the gasoline dispensing area via telephone, as well as any additional means of
electronic communication with. the attendant such as, but not limited to, an intercom.
(b) Gasoline station retailers shall require an attendant to provide refueling assistance to
persons with disabilities as defined in this article when such service is requested.

(cj Gasoline station retailers shall prominently display a sign, decal, or sticker, no smaller
than fifteen (15) square inches, on the front of all gasoline pumps clearly stating the telephone
number of that gasoline station retailer, as well as the existence of any additional means of
electronic communication with the attendant such as, but not limited to, an intercom, the
international symbol of accessibility ("ISA"), and wording such as "Call for Assistance" or
"Assistance Available upon Request." The sign, decal, or sticker must. also be on a blue
background. The telephone number and all other means of electronic communication indicated.
on the sign, decal, or sticker shall be operational and answered directly by an attendant on
duty during the hours the gasoline station retailer is open for business to the public.
(d1 In the event that assistance is requested during times when. a second attendant is not
present at aself-service gasoline station, the gasoline station retailer is not required to provide
the requested assistance. In such instances, the attendant on duty shall inform the person who
requested assistance that the attendant is not able to provide such assistance because there is
only one (1) attendant on duty.

Sec. 1-2-105. Prohibited conduct.
It shall be a violation of this article far a gasoline station retailer to:
(l j Fail or refuse to prominently display a sign, decal, or sticker, on the front of all gasoline
pumps, which meets the requirements of this article; or
(2) Fail to ensure that the telephone number, intercom, or other means of electronic
communication with. the attendant indicated. on the sign, decal, or sticker is opera-
tional and answered by an attendant on duty during the hours the gasoline station
retailer is open for business to the public; or
(3j Fail. to provide refueling assistance to a person with disabilities when such assistance
is requested and when more than one (lj attendant is on duty.

Sec. 1-2-106. Filing of complaints.
(a) Any person vvho witnesses, or who is subjected to, conduct that violates this article may
file a written complaint. with the division.
(bl The complaint must. be in writing and shall contain the following information:
(1) Name and address of the gasoline station retailer alleged to have committed the
violation; and
(2j Date of alleged violation; and
(3} General statement of the facts of the alleged violation; and
(4) Such other information required by the division.

Trespass toioing shall mean towing or removal of a vehicle that is illegally parked on private
real property, at the property owner's direction, without the consent of the vehicle's owner or
operator; as such is authorized by F.S. § 725.07.

Sec. 1-20-16.3. Fees.
In addition to the other requirements of this article, no tow truck company shall, for
compensation, recover, tow, or remove avehicle/vessel or provide storage in connection
therewith without the prior express instruction of the vehicle/vessel owner or authorized
driver, except in accordance with the following:
(1) Nonconsentual tow. Tow truck companies may, for compensation, recover, tow or
remove avehicle/vessel. based upon a police directed tow without the prior express
instruction of the vehiclelvessel owner or authorized driver upon the prior express
instruction of a law enforcement agency and in accordance with the terms of any
contracts or agreements between the tow truck company and a governmental entity
and/or law enforcement agency.
The maximum fee is established which may be charged on the removal and storage of
wrecked or disabled vehicles from an accident scene or for the removal and storage of
vehicles, in the event the owner or operator is incapacitated, unavailable, leaves the
procurement. of wrecker service to the law enforcement officer at the scene, or
otherwise does not consent to the removal of the vehicle as follows:

(2) Private property impound. Tow truck companies may for compensation recover, tow or
remove avehicle/vessel based upon a private property impound without the prior
express instruction of the vehicle/vessel owner or authorized driver, upon the prior

express instruction of a real property owner or his authorized agent on whose property
the vehicle/vessel is disabled, abandoned or parked without authorization or whose
vehicle/vessel owner or authorized agent is unwilling or unable to remove the
vehicle/vessel, provided that the requirements of this article are satisfied. The tow
truck company recovering, towing or removing a vehicle/vessel shall, within thirty (30}
minutes of completion of such. towing or removal, notify the appropriate law enforce-
ment agency in which jurisdiction the vehicle/vessel. was parked of the nature of the
service rendered, the name and address of the storage facility where the vehicle/vessel
will be stored, the time the vehicle was secured to the towing vehicle, and the make,
model, color and vehicle/vessel license plate number (if any). The tov~r truck company
shall obtain the name of the person at the law enforcement agency to whom such
inforniation was reported and note that name on the trip record.
a. Except as otherwise provided in this article; every prior express instruction made
in writing or in person shall indicate the date and time of the instruction and
shall be signed by real property owner/duly authorized agent in the presence of
the tow truck company providing the service. The real property owner/the duly
authorized agent shall also print his/her full name.
b. Signing in the presence of the tow truck company/driver shall not be required for
a prior express instruction. made by the real. property owner or authorized agent
forwarded by facsimile transmission. All other requirements of this article shall
apply and the real property owner or duly authorized agent shall provide in the
facsimile instruction the specific location (i.e., address, parking space, etc.), color
of the vehicle; make and/or model of'the vehicle (if visible) and either the license
tag number or the vehicle identification number (if available) prior to the
vehicle/vessel being towed. Such facsimile instruction shall include the real
property owner's or authorized agent's signature and printed or typed full name
and title, as well as an electronic confirmation or electronic stamp of the date and
time the instruction was sent to the tow truck company. The tow truck company
shall maintain copies of facsimile instructions.
c. If specifically approved in the contract for service, signing in the presence of'the
tow truck company/driver shall not be required when avehicle/vessel is parked
and blocking public egress/ingress to the businesstresidential area. In such. cases
the tow truck company is required to photograph the car and its location prior to
removal and said photograph shall conclusively show that the vehicle is clearly in
violation. this subsection. The photograph must include a date and. time stamp.
d. No tow truck company/driver shall pay or rebate money, or solicit or offer the
rebate of money, or other valuable consideration in order to obtain the privilege
of rendering towing services.
e. Except as otherwise provided in this article, no such prior express instruction
shall. be considered to have been given:
1. By the mere posting of signage as required b_y F.S. Ch. 715;

2. By virtue of the terms of any contract or agreement between a toc~~ truck
company and a real property owner;
3. When the prior express instruction occurs in advance of the actual. unau-
thorized parking of the vehicle/vessel; or
4. Where the prior express instruction is general in nature and unrelated to
specific, individual. and identifiable vehicles/vessels which are already
parked without authorization.
f. Each tow truck company shall enter into a written contract with every owner of
private property that authorizes the tow truck company to tow vehicles/vessels
from its property. This written contract shall include the beginning date of said
contract, the names and titles of all persons (i.e., owner, property manager,
condominium president, etc.) vvho have the authority to appoint persons (i.e.,
security guard, night. watchman, on-site manager, etc.} who can authorize prior
express instruction to the tow truck company to remove, recover or tow any
vehicle/vessel from its property. The written contract shall also include the name
and current telephone number of the tow truck company performing the towing
sen~ice. Anv addendum to the contract shall include additional names and titles
as necessary. The tow truck company must keep on file each contract anal
addendum (if applicable} with the property owner. Such contract. shall be
maintained for at least twelve (12} months after termination. The county and law
enforcement officers may inspect and request a copy of any and all such contracts
from the tow truck company during normal business hours. The tow truck
company may not withhold production of the contract upon demand by the
division or law enforcement. Failure to enter into or keep on file a contract with
the property owner shall be a violation of this article. All contracts which. were
entered into prior to the effective date of this article, shall accomplish the
requirements of this subsection by entering into an addendum to the current
contract within. one (1) year following the enactment of this article.
g. No vehicle towed as the result of trespass towing shall be towed to and/or stored
at a location more than fifteen-mile radius from the point of initiation of such
trespass tow. No person who provides services (trespass, non-consent towing}
pursuant to this section shall recover, tow, or remove a vehicle from this county
to another county (or vice versus) for the purposes of trespass towing and
impounding.
h. Real. property owners or authorized representatives shall not request the recov-
ery, tow, or the removal of vehicles/vessels that. are reasonably identifiable from
markings or equipment as law enforcement, fire fighting, rescue squad, ambu-
lance, or other emergency vehicleslvessels which are marked as such or to
property owned by any governmental entity.
i. Any person who improperly causes a vehiclelvessel to be recovered, towed,
removed or stored shall be liable to the vehicle owner or authorized. representa-
tive for the costs of the services provided, any damages resulting from the
recovery, towing, removal or storage and. attorney's fees and court costs.

k. Persons who provide services pursuant to this section shall transport the vehicle
directly to the storage site owned or leased by the towing service and the vehicle
shall not be kept in any temporary holding area, unless the towing service is
directed to do so by a law enforcement officer authorizing the tow.

Sec. 1-20-16.4. Review and automatic adjustment of fees.
(a} The wrecker service fees shall be adjusted by the county administrator in April of each
calendar year. Unless otherwise directed. by the county commission, any adjustments to the
wrecker service fees, made pursuant to this section, shall be effective the first Monday in
October of each calendar year. All adjustments to the wrecker service fees shall be based on the
methodology described in paragraph (b) of this section.
{b) The base for computing any adjustment is the January Consumer Price Index - AlI
Urban Consumers for the United States, published each year by the United States Depart-
ment of Labor, Bureau of Labor Statistics. For the purpose of this section the initial index to
be referenced is January 2008. The wrecker service fees shall be adjusted by the percentage
change in the index.
{c) If the index is changed so that the base ,year is different, the index shall be converted in
accordance with the conversion factor published by the United States Department of Labor,
Bureau of Labor Statistics. If the index. is discontinued. or revised, such other government
index or computation with uThich it is replaced shall be used in order to obtain substantially
the same result as would be obtained if the index had not been. discontinued or revised.

ta) The term "parking" as used herein means the standing of a vehicle, whether occupied or
not, otherwise than temporarily for the purpose of and while actually engaging in loading or
