ARTICLE I. IN GENERAL
Sec. 1-14.5-1. Allowance to board members for travel in St. Lucie County.
Each member of the board of county commissioners shall be allowed monthly reimburse-
ment for the use of his or her personal automobile in the performance of official duties within
St. Lucie County. Such reimbursement shall be based upon the prior submission of a typical
month's mileage report as required herein. Annually on October 1, each board member shall
submit a signed statement of a typical month's mileage report to the finance department
showing the destinations and miles traveled on official business and the amount that would
have been allowed under an approved rate per mile for the travel shown on the statement if
payment were made at a fixed rate of twenty cents ($0.20) per mile. This provision shall not
preclude payment of a mileage allowance at a fixed rate of twenty cents ($0.20) per mile upon
monthly submission of a log of actual miles traveled in each calendar month in lieu of the above
travel allowance.

ARTICLE II. DEFERRED COMPENSATION PROGRAM
Sec. 1-14.5-21. Adoption.
Pursuant to Section 112.215, Florida Statutes, a deferred compensation program is adopted
and established as the St. Lucie County, Florida, Deferred Compensation Program for the
voluntary participation of all eligible county officials and employees. A copy of program
documents will be made available for public inspection at the office of the clerk to the board.
Other than the incidental expenses of collecting and disbursing of the employees' deferrals and
other minor administrative matters, the county shall incur no cost of and make no contribution
to the program.

Sec. 1-14.5-22. Administration.
TIAA CREF shall administer the deferred compensation program on behalf of St. Lucie
County. The deferred compensation committee shall review the program periodically. Changes
to the program administrator maybe made by resolution of the board of county commissioners.

Sec. 1-14.5-23. Execution of participation agreements.
The St. Lucie County Administrator or his designate is authorized to execute, on behalf of
St. Lucie County, individual participation agreements with each official or employee request-
ing to participate in the program.

Sec. 1-14.5-24. Program committee.
(a) The deferred compensation program committee shall be composed of the following
persons or designates of those persons:
(1) County administrator;
(2) County attorney;
(3) Sheriff;
(4) Tax collector;
(5) Property appraiser;
(6) Supervisor of elections; and
(7) Clerk of the circuit court.
The county administrator, or designate, shall serve as chairman of the committee.
(b) The committee shall have the power and responsibility for:
(1) Reviewing the performance of the NACo Deferred Compensation Program and the
administrative performance of PEBSCO, and making appropriate recommendations to
the board of county commissioners;
(2) Reviewing petitions by employees for advance distribution of deferred compensation in
cases of unforeseen emergencies, and making recommendations to PEBSCO and
NACo; and
(3) Making recommendations to the board of county commissioners on other matters
related to deferred compensation.
(c) The committee shall meet at such time and place as determined by the committee
chairman, except that a meeting shall be held to consider a petition for hardship distribution
within thirty (30) days of such petition being filed.

ARTICLE N LOCAL OPTION MOTOR FUEL TAX*
Sec. 1-19.3-41. Levy of local option motor fuel tax.
(a) Pursuant to section 336.025, Florida Statutes (1985) as amended by Senate Bill 313
passed by the 1986 Florida Legislature, a six cent ($0.06) local option motor fuel taxis imposed
upon every gallon of motor fuel and special fuel sold in St. Lucie County and taxed under the
provisions of Chapter 206, Florida Statutes.
(b) Pursuant to section 336.025(1)(b), Florida Statutes, an additional five cent ($0.05) local
option motor fuel tax is imposed upon every gallon of motor fuel sold in St. Lucie County and
taxed under the provisions of Part 1 of Chapter 206, Florida Statutes. The revenues received
from the additional five cent ($0.05) local option motor fuel tax may only be utilized for
transportation expenditures needed to meet the requirements of the capital improvements
element of an adopted comprehensive plan. For purposes of this paragraph, expenditures for
the construction of new roads, alternative methods of transportation, or the reconstruction or
resurfacing of existing paved roads shall be deemed to increase capacity and such projects
shall be included in the capital improvements element of the adopted comprehensive plan.
Expenditures for purposes of this paragraph shall not include routine maintenance of roads.

Sec. 1-19.3-42. Distribution of local option motor fuel tax.
(a) All divisions of tax proceeds shall be determined by the county on or before July 1 of each
year during the duration of the tax as set out in section 1-19.3-43 beginning July 1, 1986. The
annual redetermination by the county of the division of the tax proceeds shall be based on
transportation expenditures of the county and all eligible municipalities based on the
transportation expenditures of each for the five (5) fiscal years preceding the year in which the
annual redetermination is made, as a proportion of the total of such expenditures for the
county and all municipalities within the county. The county shall notify the department of
revenue of the results of the county's redetermination of the tax proceeds by July 1 of the year
the redetermination is made. The annual redetermination shall be effective beginning
September 1 of the year the redetermination is made. Any dispute as to the determination by
the county of the distribution of the tax proceeds shall be in accordance with section
336.025(5)(b), Florida Statutes (1985).

Sec. 1-19.3-43. Duration of tax.
The four cent ($.04) local option gas tax originally imposed by this article shall be effective
from September 1, 1985 through August 31, 1987, both dates inclusive. The six cent ($0.06)
local option gas tax imposed by this article shall be effective from September 1, 1987 through

August 31, 2015, both dates inclusive. The first additional two cent ($0.02) local option motor
fuel tax imposed by this article shall be effective from January 1, 1998 through August 31,
2015, both dates inclusive. The remaining additional three cent ($0.03) local option motor fuel
tax imposed by this article shall be effective from January 1, 2000 through August 31, 2015,
both dates inclusive.

ARTICLE V. ECONOMIC DEVELOPMENT AD VALOREM TAX EXEMPTIONS*
Sec. 1-19.3-51. Short title.
This article shall be known as county Ordinance No. 92-24, "Economic Development Ad
Valorem Tax Exemption Regulations of St. Lucie Co., Florida."

Sec. 1-19.3-52. Enactment and authority.
Pursuant to section 3, Article VII of the State Constitution and in accordance with Chapters
125, 163, 192, 196 and 214, Florida Statutes and Florida Department of Revenue Rules,

TAXATION § 1-19.3-52
Chapter 12D-7, Florida Administrative Code, incorporated municipalities and counties indi-
vidually or in combination are authorized and empowered to adopt, amend or revise and
enforce an ordinance relating to economic development ad valorem tax exemptions, after the
electors of such municipality or county, voting on the question in a referendum, authorize the
adoption of such ordinance.
