Authority and purpose. § 22-95 Pursuant to F.S. § 420.9072, state statutes and F.A.C. ch. 67-37.005, to be eligible to receive its share of the local housing distribution, the county is adopting this article to create an affordable housing assistance trust fund, establish a local housing assistance program, designate responsibility for the implementation and administration of the local housing assistance program and create an affordable housing advisory committee. As the county is contributing its fiscal year 1992-1993 SHIP fund allotment to the city, this article is being enacted for the sole purpose of administrative compliance with F.S. § 420.9072. (Code 1982, § 1-10.5-37; Ord. No. 93-17, pt. A, 6-15-1993) Sec. 22-92. Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Local housing assistance plan means a concise description of the local housing assistance strategies and local housing incentive strategies adopted by local government resolution with an explanation of the way in which the program meets the requirements of F.S. §§ 420.907 through 420.9079 and Florida Housing Finance Corporation Rule. Local housing partnership means the implementation of the local housing assistance program in a manner that involves, but is not limited to, the county/city, community-based organizations, for-profit housing developers, lending institutions, providers of professional services relating to affordable housing and service organizations working on behalf of persons with special housing needs. The term "local housing partnership" includes initiatives to provide support services for housing program beneficiaries such as training to prepare persons for the responsibility of homeownership, counseling of tenants and the establishment of support services such as day care, health care and transportation. The local housing assistance trust fund is hereby created and established as required pursuant to F.S. § 420.9072. (Code 1982, § 1-10.5-39; Ord. No. 93-17, pt. A, 6-15-1993) Sec. 22-94. Establishment of a local housing assistance program and partnership. The local housing assistance program and partnership is hereby created and established as required pursuant to F.S. § 420.9072. LUCIE COUNTY CODE (b) The affordable housing advisory committee shall submit its initial report to the board of county commissioners on or before December 1, 2008, and thereafter as directed by the board of county commissioners in accordance with F.S. § 420.9076. The report shall include recommendations on and evaluate the implementation of affordable housing in the following specific areas: (1) The processing of approvals of development orders or permits, as defined in F.S. § 163.3164(7) and (8), for affordable housing projects is expedited to a greater degree than other projects. (2) The modification of impact fee requirements, including reduction or waiver of fees and alternative methods of fee payment for affordable housing. (3) The allowance of flexibility in densities for affordable housing. (4) The reservation of infrastructure capacity for housing for very -low income persons, low-income persons, and moderate -income persons. (5) The allowance of affordable accessory residential units in residential zoning districts. (6) The reduction of parking and setback requirements for affordable housing. (7) The allowance of flexible lot configurations, including zero -lot -line configurations for affordable housing. (8) The modification of street requirements for affordable housing. (9) The establishment of a process by which the county considers, before adoption, policies, procedures, ordinances, regulations, or plan provisions that increase the cost of housing. (10) The preparation of a printed inventory of locally owned public lands suitable for affordable housing. (11) The support of development near transportation hubs and major employment centers and mixed-use developments. (c) The action, decisions and recommendations of the committee shall not be final or binding on the board of county commissioners, but shall be advisory only. (d) The affordable housing advisory committee shall consist of 11 members as follows: (1) A citizen who is actively engaged in the banking or mortgage industry in connection with affordable housing; (2) One citizen who is actively engaged in the residential home building industry in connection with. affordable housing; (3) One citizen who is a representative of those areas of labor actively engaged in home building in connection with affordable housing; (4) One citizen who is actively engaged as a for-profit provider of affordable housing; Supp. No. 1 CD22:12 HOUSING § 22-95 (5) One citizen who is actively engaged as a real estate professional in connection with affordable housing; (6) One citizen who is actively engaged as a not-for-profit provider of affordable housing; (7) One citizen who serves on the local planning agency pursuant to F.S. § 163.3174; (8) One citizen who resides within the jurisdiction of the local governing body making the appointments; (9) One citizen who represents employers within the jurisdiction; (10) One citizen who represents essential services personnel, as defined in the local housing assistance plan; and (11) One citizen who is actively engaged as an advocate for low-income persons in connection with affordable housing. (e) Each commissioner shall appoint two members to the committee. The committee members' terms shall run concurrent with the term of the appointing commissioner. A commissioner may remove his appointee from the committee at any time with or without cause. (f) The board of county commissioners shall appoint one at large member to the committee. The at large member shall not serve more than two consecutive full four-year terms. The board may remove the at large member with or without cause at any time upon the affirmative vote of a majority of the board. (g) During the first meeting of each calendar year, the members shall select a chairperson and a vice -chairperson from among the membership to serve one-year terms. (h) All members shall serve without compensation. (i) Vacancies for all appointments shall be filled upon: (1) Death of a member. (2) Resignation. (3) Removal. (4) Three absences in a six-month period. (j) Vacancies shall be filled by the commissioner who appointed the former member to the vacant seat. (k) The committee chairperson shall establish a time and place for holding meetings as shall be necessary, and the committee shall adopt such rules of organization and procedure as may be required. One-half of the committee membership plus one shall constitute a quorum for the transaction of official business during committee meetings. The purpose of developing the neighborhood stabilization program (NSP) is to acquire foreclosed and abandoned residential properties within the unincorporated areas of the county, rehabilitate them if necessary, incorporating green components where practical, and convey them to homebuyers meeting low and moderate income eligibility requirements. (Code 1982, § 1-16.2-13; Ord. No. 10-013, pt. A, 3-23-20101) Sec. 22-122. Acquisition procedures. (a) This board hereby authorizes the county administrator, or designee, to execute purchase contracts in accordance with established purchase procedures and all documentation neces- sary to complete purchase of NSP residential properties within the county. The community services director, or his designee, shall be responsible for administration of the NSP on behalf of the county. (b) The purchase price of foreclosed properties under the NSP shall generally be less than current appraised market value. The county shall adhere to the NSP requirements of minimum discounts for single property purchases and for bulk purchases. The community services director, or his designee, is hereby authorized to acquire NSP properties on behalf of the county subject to the following conditions: (1) The community services director, or his designee, shall utilize a form of agreement acceptable to the county attorney for each property acquired. (2) The community services director will coordinate all aspects of the acquisition process, including conducting due diligence on each property, negotiation of the ultimate acquisition price, and closing of the real estate transaction.
