(2)Thepublicsafetydirectorshallclassifyanydogasadangerousdogintheeventhe determinesthatthedog: a.Hasaggressivelybitten,attacked,orendangeredorhasin¯ictedsevereinjuryon humanbeingonpublicorprivateproperty; b.Hasmorethanonceseverelyinjuredorkilledadomesticanimalwhileoffthe owner©sproperty;or c.Has,whenunprovoked,chasedorapproachedapersonuponthestreets, sidewalks,oranypublicgroundsinamenacingfashionorapparentattitudeof attack,providedsuchactionsareattestedtoinaswornstatementbyoneormore personsandinvestigatedbythepublicsafetydirector. (3)Adogshallnotbedeclareddangerousifeitherofthefollowinghasoccurred: a.Thethreat,injury,ordamagewassustainedbyapersonwho,atthetime,was unlawfullyonthepropertyor,whilelawfullyontheproperty,wastormenting, abusing,orassaultingthedogoritsownerorafamilymember;or b.Thedogwasprotectingordefendingapersonwithintheimmediatevicinityofthe dogfromanunjusti®edattackorassault. (4)Thefollowingproceduresshallbefollowedintheinvestigationofadangerousdog complaint: a.Ifpossible,theowneroftheanimalbeinginvestigatedshallbeinterviewed.Any personand/orwitnessdesiringtohaveadogclassi®edasdangerousshallsubmit anaffidavittothedivision. b.Adogthatisthesubjectofadangerousdoginvestigationthatisnotimpounded bythedivisionshallbehumanelyandsafelycon®nedbytheownerinasecured CD6:8 Supp.No.3 ANIMALS§6-23 fencedorenclosedareaandshallbesubjecttoanyreasonablerestrictionsplaced thereonbythedivisionpendingtheoutcomeoftheinvestigationandresolution ofanyhearingsrelatedtothedangerousdogdesignation. c.Theaddressofwherethedogresidesshallimmediatelybeprovidedtothe division. d.Nodogthatisthesubjectofadangerousdoginvestigationmayberelocatednor mayownershipbetransferredpendingtheoutcomeofaninvestigationand/or anyhearingsrelatedtothedeterminationofadangerousdogdeclaration. (2)Hasbittenahumanbeingorattackedanotheranimal. (3)Issold,givenaway,ordies. (4)Ismovedtoanotheraddress. Priortoadangerousdogbeingsoldorgivenaway,theownershallprovidethename,address, andtelephonenumberofthenewownertothepublicsafetydirector.Thenewownermust complywithalloftherequirementsofthisordinance. (i)Ifadogthathaspreviouslybeendeclareddangerousattacksorbitesapersonora domesticanimalwithoutprovocation,theownerisguiltyofamisdemeanorofthe®rstdegree, punishableasprovidedinF.S.§775.082or775.083.Inaddition,thecountyshallimmediately con®scatethedangerousdogandplaceitinquarantine,ifnecessary,fortheproperlengthof time,orimpoundandholditfortenbusinessdaysaftertheownerisgivenwrittennoti®cation undersection6-23(d),andthereafterdestroythedoginanexpeditiousandhumanemanner. (m)Ifadogattacksorbitesapersonwhoisengagedinorattemptingtoengageina criminalactivityatthetimeoftheattack,theownerisnotguiltyofanycrimespeci®edunder thissection. (n)Itisunlawfulfortheownerofadangerousdogtopermitthedogtobeoutsideaproper enclosureunlessthedogismuzzledandrestrainedbyasubstantialchainorleashandunder controlofacompetentperson.Themuzzlemustbemadeinamannerthatwillnotcauseinjury tothedogorinterferewithitsvisionorrespirationbutwillpreventitfrombitinganyperson oranimal.Theownermayexercisethedoginasecurelyfencedorenclosedareathatdoesnot haveatop,withoutamuzzleorleash,ifthedogremainswithinhisorhersightandonly membersoftheimmediatehouseholdorperson18yearsofageorolderareallowedinthe enclosurewhenthedogispresent.Whenbeingtransported,suchdogsmustbesafelyand securelyrestrainedwithinavehicle. (o)Huntingdogsareexemptfromtheprovisionofthissectionwhenengagedinanylegal huntortrainingprocedure.Dogsengagedintrainingorexhibitinginlegalsportssuchas obediencetrials,conformationshows,®eldtrials,hunting/retrievingtrialsandherdingtrials areexemptfromtheprovisionsofthissectionwhenengagedinanylegalprocedures.However, suchdogsatallothertimesinallotherrespectsshallbesubjecttothissection.Dogsthathave beenclassi®edasdangerousshallnotbeusedforhuntingpurposes. (p)Thissectiondoesnotapplytodogsusedbylawenforcementofficialsforlawenforcement work. (q)Anypersonwhoviolatesanyprovisionofthissectionisguiltyofanoncriminal infraction,punishablebya®nenotexceeding$500.00. Anydogorcatorlivestockfoundrunningatlargeintheunincorporatedareaofthecounty byanofficerandwhoseownershipcannotbedeterminedbymeansofrabies,license,orother identi®cationtags,shallbeturnedovertothehumanesocietyorothersuitableanimalcare facility.Thedispositionoflivestockimpoundedunderthissectionshallbeconductedpursuant toF.S.ch.588.Ifthedogorcat©sownershipcannotbedetermined,thedogorcatshallbeheld bythefacilityfor®vedays.Thereafter,ownershipofsaidcatordogshallreverttotheowner ofthefacilitytobeplacedforadoptionorhumanelyeuthanized,asdeemednecessary,bythe ownerofthefacilityand/oritsauthorizedhumaneofficer.Intheeventacatordogissickor injuredandifinthejudgmentoftheownerofthefacilityand/oritsauthorizedhumaneofficer suchcatordogissogrievouslysickorinjuredthattoholdsuchcatordogforthe®ve-day periodwouldeitherbeahealthhazardtotheotheranimalsshelteredatthefacilityorwould in¯ictfurtherpainandneedlesssufferingonthecatordog,andifownershipofsuchcatordog cannotbeimmediatelydetermined,thecatordogmaybe,uponsuchjudgment,humanely euthanizedbytheownerofthefacilityand/oritsauthorizedhumaneofficer. (a)Itshallbeaviolationofthisarticleforanypersontoimpoundorcon®neanyanimalin anyplacewithoutsufficientfreshfoodandwateratalltimesdaily,includingweekendsand holidays;tokeepanyanimalinanyenclosurewithoutprovidingsufficientdailyexercise;tofail toprovideshelterfromtheweather,andcleanquartersasfurtherprovidedherein;medical attentionforsickly,diseased,orinjuredanimals;ortofailtoinoculatetheanimalagainst rabiesasrequiredbythisarticle.Howeverthissectionshallnotrequiretheprovisionof shelterfromtheweatherandcleanquartersforlivestockinopenpasture.Dogs,cats,and smalldomesticanimalsshallnotbekeptoutsideincrates,whethermetal,wood,plasticor othermaterials.Dogs,catsandsmalldomesticanimalsmaybekeptoutsideinafenced enclosureiftheenclosurecontainsashelterwhichmeetsthefollowingrequirements: (1)Providesadequateprotectionfromthecoldandheat; (2)Providesprotectionfromthedirecteffectofthesun,windandrain; (3)Providesasolidroofandawindandrainbreak; (4)Containscleananddrybeddingmaterial; (5)Elevatedaminimumofsixinchesfromtheground; (6)Providessufficientspaceforeachanimaltocomfortablystandup,sitdown,liedown andturnaroundintheshelter.Iftheshelterisusedformorethanoneanimalatthe sametime,itmustprovideenoughspaceforeachanimaltocomfortablystandup,sit down,liedown,andturnaroundsimultaneously;and (7)Providesingressandegressfortheanimaltoenterandexittheshelteratalltimes. CD6:13 Supp.No.3 §6-26ST.LUCIECOUNTYCODE (b)Itshallbeunlawfulforanypersontoexposeanyknownpoisonoussubstance,whether mixedwithfoodornot,sothatitmaybeconsumedbyadogorcatorlivestock. (c)Itshallbeunlawfulforanypersoninjuringanydog,cat,orlivestock,byanymeans,to failtonotifytheowneroftheanimal,theanimalcontrolofficer,ortoreporttheincidenttothe county"911"system. (d)Itshallbeunlawfulforanypersontoteaseormolestananimal. (e)Itshallbeunlawfulforanyoperatorofamotorvehicletoallowananimaltorideinany unenclosedsectionofthatvehiclewithoutenclosingtheanimalinacagethatissecuredtothe vehicleorsecuringtheanimalwitharestrainingdevicethatwillnotpermittheanimalto reachtheoutsideperimeterofthevehicle. (f)Theownerofanyanimalshallberesponsiblefortheremovalofanyexcretadepositedby hisanimalonpublicwalks,recreationareas,orthepropertyofothers. (g)AlldomesticanimalsputtodeathshallbedonesopursuanttoF.S.§§828.05,828.055, 828.058,and828.065. (h)Alldeadanimalsshallbedisposedofbymeansofcremation,controlledburial,as de®nedherein,ordisposaltorenderingcompanies.Itshallbeunlawfulforanypersonto disposeofdeadanimalsbyuseofgarbagecollectionand/orsanitaryland®llexcept,upon noti®cationoftheland®llsupervisor,arrangementsmaybemadeforcontrolledburialatthe sanitaryland®ll. Notwithstandingtheforegoing,thecountyadministratorshallhavetheauthoritytogranta variancefromthisprovisiontoanynonpro®torcharitableorganizationthathasnotformally quali®edfornonpro®tstatusunderInternalRevenueCodeSection501(c)or(d),butwhose organizationaldocuments,includingbylaws,exhibitthesameorsimilarattributesofsuch typeoforganizationandoperatesforthepurposesenumeratedabove. (j)Noanimalshallbetetheredunlessallofthefollowingprovisionsaremet: (1)Animalsyoungerthansixmonthsold,olderthansevenyears,orillshallnotbe tethered. CD6:14 Supp.No.3 ANIMALS§6-26 (2)Thelengthandweightofthetethershallbeappropriatefortheanimalbreedandshall beaminimumoftenfeetlongorfourtimesthelengthoftheanimal(measuredfrom tipofnosetobaseoftail),whicheverisgreater. (3)Thetethermusthaveswivelsatbothendsoftherope,chainorsimilarrestraintfor holdingananimalinplace,allowingashortradiusinwhichitcanmoveaboutandnot becometangled. (4)Prong,chokeorchaincollarsareprohibitedintheuseoftetheringanimal. (5)Areawhichtheanimalmayreachwhiletetheredshallbefreeofentanglements. (6)Thelengthandlocationofthetethermustnotallowtheanimaltoreachafenceor neighboringproperty. (7)Collarweightshallbeappropriatefortheanimalasdeterminedbyareasonable person. (8)Theanimalmustbeinviewofthepersonresponsiblefortheanimalatalltimeswhile tethered. (9)Atrolleysystemispermitted. (10)Ananimalmaynotbetetheredinextremeweather,includingbutnotlimitedto hurricanes,tropicalstormsortornados. (11)Theanimalshallhaveaccesstoadryandraisedareaatalltimes. (k)Anydogleftunattendedinanoutdoorenclosureshallbeprovidedaminimumofopen space,excludingtheshelter(s)withintheenclosure,baseduponthedog©ssizeassetforth below: (1)Twentypoundsorless(small):Thirty-twosquarefeet. (2)Twenty-oneto50pounds(medium):Sixtysquarefeet. (3)Over50pounds(large):Eightysquarefeet. (2)Ifaperson©sonlymeanstotransportananimalisinanunenclosedorpartially enclosedvehicle,includingbutnotlimitedtoconvertibles,pick-uptrucks,and¯atbed trucks,thepersonshallcon®netheanimalinacontainer,cage,orwithaharnesswith doubletetheringthatisofproperandadequatesizetopreventtheanimalfromfalling CD6:14.1 Supp.No.3 §6-26ST.LUCIECOUNTYCODE fromorjumpingfromthemotorvehicle.Withtheexceptionoftrailersusedto transporthoovedlivestock,the¯ooringofthevehicleshallbecoveredinatypeof materialthatpreventstheanimal©sfeetfromburning. (3)Ifacontainerorcageisused,itmustbesecurelyfastenedsoastopreventthe containerorcagefrommovinginthemotorvehicle. (4)Theanimalmustbeprovidedfreshwaterandfoodasdeemedappropriatebya responsibleperson. (5)Nopersonshallcarryorcausetobecarriedinoruponanyvehicleorotherwise,any domesticanimalhavingitsfeetorlegstiedtogetherorinanyothercruelorinhumane mannerorwithoutprovidingsuitableandhumanefacilitiesincludingracks,cratesor cagesinwhichsuchanimalmaystanduporliedownduringtransportation. (6)Therabiesvaccinemanufacturer. (7)Thevaccinelotnumber. (8)Thetypeandbrandofvaccineused. (9)Therouteofadministrationofthevaccine. (10)Thesignatureofthelicensedveterinarian. (d)Avalidrabiestagissuedbythelicensedveterinarianadministeringthevaccination mustbewornatalltimesbythedog,catorferretforwhichthetagwasissuedexceptwhen thedog,catorferretisbeingshownincompetition,isactivelyengagedinthesportofhunting, isinthecon®nesoftheowner©sproperty,orisagovernment-owneddogusedforlaw enforcementpurposes. (a)Anyofficerwhohasprobablecausetobelievethatapersonhascommittedanactin violationofthisarticleshallissueacitationtothatperson.Thedeterminationthatviolation hasoccurredmaybetheresultoftheofficer©sowninvestigationorastheresultofcomplaint byanaggrievedperson. (b)Anypersonwhowillfullyrefusestosignandacceptacitationissuedbyanofficeris declaredtobeguiltyofacriminaloffenseandmisdemeanorwithinthemeaningofF.S. §775.08,andpunishableasprovidedbylaw. (c)Itshallbeaviolationofthisarticleforanypersontoknowinglyhinder,resist,oroppose anyofficeroremployeeoftheanimalcontroldivisionintheperformanceoftheirdutiesunder thisarticleortoknowinglyinterferewithanyanimaltrapsetbysuchofficersoremployeesor tomolestorreleaseanyanimalcaughttherein. (d)Thecommissionofachargedinfractionatahearingauthorizedpursuanttothisarticle mustbeprovenbyapreponderanceoftheevidence.Anyviolationofthisarticleconstitutesa civilinfractionandmaybepunishablebyacivilpenaltynottoexceed$500.00,orasotherwise providedinthisarticle.Penaltiesforviolationofspeci®csectionsofthisarticleshallbe establishedbyresolutionoftheboardofcountycommissioners.Ifthepersonwhohas committedtheviolationdoesnotcontestthecitation,acivilpenaltyoflessthanthemaximum allowedwillbeassessed.InaccordancewithF.S.§828.27(4)(b),theamountofanycivilpenalty assessedpursuanttothisarticleshallbeincreasedby$5.00forthepurposeoffundingthecost oftrainingcountyanimalcontrolofficers.Anycitationmaybecontestedincountycourt. (3)Whenanownerorpersoniscitedwithasecondorsubsequentviolationofanypartof section6-26,exceptforsubsections(f)and(h)ofsaidsection. Suchcourseshallinclude,butisnotlimitedto,trainingforanimalcrueltyinvestigations, searchandseizure,animalhandling,courtroomdemeanor,andcivilcitations.Thecourse curriculummustbeapprovedbytheFloridaAnimalControlAssociation.Ananimalcontrol officerwhosuccessfullycompletessuchcourseshallbeissuedacerti®cateindicatingthathe hasreceivedapassinggrade. (b)Inordertomaintainvalidcerti®cation,everytwoyearseachcerti®edcountyanimal controlofficershallcompletefourhoursofpost-certi®cationcontinuingeducationtraining. Suchtrainingmayinclude,butisnotlimitedto,trainingforanimalcrueltyinvestigations, searchandseizure,animalhandling,courtroomdemeanor,andcivilcitations. (a)Theowneroroperatorofanytravelinganimalshowdesiringtooperateinthe unincorporatedareaofthecountyshallmakewrittenapplicationforpermitonformsprovided bytheanimalcontroldivisionnolaterthan60dayspriortothe®rstperformanceofany spectacle,display,actoreventwithinthecounty.Suchapplicationshallinclude,butnotbe limitedto,thenameoftheownerofthetravelinganimalexhibition,allproposedlocations withinthecountyforthetravelinganimalshow,thedatetheanimalshowistoarrivewithin thecounty,thedateofdepartureandalldatesonwhichitisperformatanylocationwithinthe county.Theapplicantshallfurtherprovideproofofthefollowing: (1)Currentliabilityinsurancewithcoverageof$100,000.00perperson,$300,000.00per occurrence,withamaximumdeductibleof$10,000.00. (2)Allapplicablestateinspectioncerti®cates,includingacurrentUSDApermit. (3)Aveterinarianondutyiftheshowinvolveswildlifeorcaptivewildanimals. (4)Apermitfeeof$50.00shallbepaidatthetimetheapplicationforpermitwasmade. (a)Thedivisionshallinvestigatecomplaintsinvolvinganimalsthatmaybeaggressive.The publicsafetydirectorshallhavetheauthoritytodesignateananimalasaggressive: (1)Providedthatsuchactionsareattestedtoinaswornstatementbyoneormorepersons anddutifullyinvestigatedbythedivision,ananimalshallbedesignatedasaggressive ifananimal,whenunprovoked,has: a.Severelyinjuredorkilledadomesticanimalwhileofftheowner©sproperty; b.Beenusedprimarilyorinpartforthepurposeofdog®ghtingorisadogtrained for®ghtingandhasbeendeterminedbyaneutraldogtrainerorveterinary behavioristtobeaggressivetootherdomesticanimalsorpeopleduetoforced ®ghting; c.Beeninvolvedinanattackthatdoesnotresultinsevereinjuryordeathofa person;or d.Intheopinionofananimalcontrolofficerorlawenforcementofficer,theanimal posedathreattothesafetyandwelfareofthecommunity. (b)Ananimalshallnotbedeclaredaggressiveifthethreat,injuryordamagetoaperson oranimalwas: (1)Unlawfullyontheproperty; (2)Tormenting,abusingorassaultingtheanimal,itsowner,afamilymemberorguest;or (3)Theanimalwasprotectingordefendingapersonwithinimmediatevicinityofthe animalfromanunjusti®edattackorassault. (c)Thefollowingproceduresshallbefollowedintheinvestigationofanaggressiveanimal complaint: (1)Ifpossible,theowneroftheanimalbeinginvestigatedshallbeinterviewed.Any personand/orwitnessdesiringtohaveananimalclassi®edaggressiveshallsubmitan affidavittothedivision. (2)Ananimalthatisthesubjectofanaggressiveanimalinvestigationshallbehumanely andsafelycon®nedbytheownerinasecuredfencedorenclosedareaandshallbe CD6:14.6 Supp.No.3 ANIMALS§6-33 subjecttoanyreasonablerestrictionsplacedthereonbythedivisionpendingthe outcomeoftheinvestigationandresolutionofanyhearingsrelatedtotheaggressive animaldesignation. (3)Theaddressofwheretheanimalresidesshallimmediatelybeprovidedtothedivision. (4)Noanimalthatisthesubjectofanaggressiveanimalinvestigationmayberelocated normayownershipbetransferredpendingtheoutcomeofaninvestigationand/orany hearingsrelatedtothedeterminationofanaggressiveanimaldeclaration. (d)Aftertheinvestigation,thepublicsafetydirectorshallmakeaninitialdeterminationas towhetherthereissufficientcausetoclassifytheanimalasaggressiveandshallaffordthe owneranopportunityforahearingpriortomakinga®naldetermination.Thepublicsafety directorshallprovidewrittennoti®cationofthesufficientcause®ndingtotheownerby registeredmail,certi®edhanddelivery,orserviceinconformancewiththeprovisionsofF.S. ch.48,relatingtoserviceofprocess.Theownermay®leawrittenrequestforanadministra- tivehearingbythepublicsafetydirectortoappealtheclassi®cationwithin15calendardays afterreceiptofthesufficientcause®ndings.Thewrittenrequestforahearingshallbemailed totheaddressprovidedbythedivisionintheaggressiveanimalnoti®cationletter. (e)Administrativehearingprocessforaggressiveanimalappeal. (2)Anoticeofhearingshallbesentby®rstclassmailorcerti®edhanddeliverytothe namedappellantathis/herlastknownaddress.Thenoticeofhearingshallincludethe following: a.Place,dateandtimeofhearing; b.Rightoftheownertoberepresentedbyanattorney;and c.Rightoftheownertopresentwitnessesandevidence. (3)Ahearingdateshallnotbepostponedorcontinuedunlessarequestforcontinuance, showinggoodcauseforsuchcontinuance,isreceivedinwritingbythedivisionatleast ®vecalendardayspriortothedatesetforthehearing. (3)Aggressiveanimallicensetagsshallonlybeissuedtocompetentpersonsovertheage of18andwhopresenttothedivisionsufficientevidenceofcompliancewithallofthe following: a.Acurrentcerti®cateofrabiesvaccinationfortheanimal; b.Theanimalshallbesafelyandsecurelycon®nedontheowner©spropertyinan enclosuresuitableforadangerousdog; c.Clearlyvisiblewarningsignsatallentrypointstothepropertywhichinformboth childrenandadultsofthepresenceofanaggressiveanimalontheproperty.Such signagemustbeapprovedbythedivision; d.Permanentidenti®cationoftheanimal,suchasatattooontheinnerthighor electronicimplantation; CD6:14.8 Supp.No.3 ANIMALS§6-33 e.Theanimalhasbeensterilized;and f.Compliancewithadditionalreasonablerestrictionsasdeterminedonacaseby casebasisbythedivision. (7)Ifanaggressiveanimalismovedoutsideofthecountyandislaterrelocatedback withintheunincorporatedareasofthecounty,theownermustnotifythedivisionthat theanimaliswithinthecountywithin48hoursoftheanimalbeingrelocated (8)Itshallbeunlawfulfortheownerofanaggressiveanimaltopermittheanimaltobe outsideaproperenclosureunlesstheanimalismuzzledandrestrainedbyaleashand underthecontrolofacompetentpersonovertheageof18yearsofage.Themuzzle shallbemadeinamannerthatwillnotcauseinjurytotheanimalorinterferewithits visionorrespirationbutwillpreventitfrombitinganypersonoranimal. (9)Whenbeingtransported,anaggressiveanimalshallbesafelyandsecurelyrestrained withinavehicle. (10)Theownerofanaggressiveanimalmayexercisetheanimalinasecurelyfencedor enclosedareawithoutamuzzleorleash,iftheanimalremainsintheowner©ssightand onlymembersoftheowner©simmediatehouseholdorpersons18yearsofageorolder areallowedintheenclosurewhentheanimalispresent. (11)Huntingdogsareexemptfromtheprovisionsofthissectionwhenengagedinanylegal huntortrainingprocedure.Dogsengagedintrainingorexhibitinginsportssuchas obediencetrials,conformationshows,®eldtrials,hunting/retrievingtrialsandherding trialsareexemptfromthissection.Suchdogsshallbesubjecttotheprovisionsofthis sectionatallothertimes. (12)Thissectionshallnotapplytodogsusedbylawenforcementofficialsforlaw enforcementpurposes. (14)Uponcon®scationoftheanimal,thedivisionshallprovidetheownerofrecord,a writtencivilviolationnoticelistingthe®ne,con®scation,quarantine,impoundment andintentofthedivisiontohavetheanimaldeclareddangerouswithinthetime prescribed. (1)Anypersonseekingtooperateaguarddogserviceorwhoownsadogthatsuchperson isseekingtouseforthepurposeofdefending,patrollingorprotectingpropertyorlife atanynonresidentialestablishmentintheunincorporatedareasofthecountyshall obtainaguarddogpermit. (2)Aguarddogpermitshallbevalidforaperiodof12monthsfromthedateofissuance andmustberenewedannually.Renewalapplicationsforpermitsshallbemadeat least30dayspriortothedateofexpiration. (3)Aguarddogpermitisnottransferable,assignableorrefundable. (4)Theboardofcountycommissionersshallestablishthefeescheduleforguarddog permitsbyresolution. (b) Obtainingguarddogpermit. (1)Apersonseekingtoobtainaguarddogpermitshallapplytotheanimalcontrol divisionusingaformapprovedbythedivision. (2)Theguarddogpermitapplicationshallincludebutisnotlimitedtothefollowing information: a.Thename,addressandtelephonenumberoftheapplicantandadescriptionof thelocation(s),includingaddress,atwhichguarddogswillbemaintained. b.Astatementastowhethertheapplicantoranyofficeroremployeeofthe applicanthaseverbeenconvictedofanoffenseinvolvingneglectorcrueltyto animalsorhashada®naljudgmententeredagainstthatpersonunderF.S. §828.063,oranyotherstatuteprohibitinganimalcruelty,neglectormistreat- ment. (4)Permitapplicationsshallbevalidfor30daysinorderforapplicantstomakecorrection tomeetminimumcompliancespeci®cations. (c) Permitdenial,revocation,andsuspension. (1)Bynoticeofadverseaction,thedivisionmaydeny,revokeorsuspendanypermitifit isdeterminedbythedivisionthat: a.Therehasbeenamaterialmisstatementormisrepresentationinthepermit applicationorinanyinformationordocumentsrequiredtobemaintainedbythe applicant/permitholderorprovidedtothedivision. b.Theapplicant/permitholderhasbeencitedforatleasttwoviolationsofthis chapterwithinaone-yearperiod,eachresultingintheimpositionofa®ne. c.Theapplicant/permitholderhasfailedtopaya®neortorequestahearingin countycourttoanswerthechargesofacitationwithin30daysofissuanceofthe citation. d.Ananimalunderthecareandresponsibilityofanapplicant/permitholderhas beenfoundtobeinneedofveterinarycarethat,ifnottreated,wouldresultin suffering,painordeathoftheanimal,andcareisnotprovidedwithina reasonableperiodoftime. (2)Nopermitfeeshallberefundedforapermitthatisrevokedorsuspended.Forapermit thatisdeniedafterreviewandinspection,thepermitfeeshallberefundedasprovided inthefeeresolution. (d) Appealprocess. (1)Anyapplicantorpermitholderwhohasbeendeniedapermitorwhosepermithas beenrevokedorsuspendedmayappealtheadverseactiontoahearingofficerby®ling awrittennoticeofappealwiththedivisionwithintendaysafterissuanceofthenotice ofadverseaction. (1)Guarddogservicesandguarddogownersshallannuallyregistereachguarddog ownedorusedintheunincorporatedareasofthecountywiththedivision.The registrationshallincludethefollowingforeachdog: a.Name,addressandtelephonenumberoftheownerand/ormanageroftheguard dogservice. b.Thebreed,sex,weight,ageandcolor(s)oftheguarddog. c.Acolorphotographoftheguarddog. d.Otherdistinguishingphysicalfeaturesoftheguarddog. e.Certi®cationofrabiesvaccination. f.Theguarddog©sregistrationtagnumber. g.Theguarddog©selectronicanimalidenti®cationdevicenumber(EAISD). h.Proofofownership(i.e.billofsale,receiptornotarizedaffidavit)includingthe nameandaddressofthepersonfromwhomthedogwasobtained. CD6:14.12 Supp.No.3 ANIMALS§6-34 i.Ifthepermitholderisnottheoriginalownerofthedog,anotarizedaffidavit signedbythepreviousowneracknowledgingthatthedogwillbeusedasaguard dog.Thisrequirementmaybewaivedifthedoghasbeenpreviouslyregisteredto theguarddogownerformorethanoneyearinthecounty. j.Acurrentcerti®cationfromaveterinarianwhoislicensedinFloridastatingthat theguarddoghasbeenexaminedandishealthyandphysically®ttoperform serviceasaguarddog.Theownershallobtainthecerti®cationformfromthe divisionandshallprovideittotheexaminingveterinarianforcompletion,and, uponcompletion,shallprovideittothedivision. (2)Aguarddoglicensetagshallbeanannualrequirement.Theguarddoglicensetagis onlyavailablethroughthedivision.Theguarddogshallbewornatalltimesorshall befastenedtoeachguarddog©senclosurewhentheguarddogisinsideit. (3)Nodogshallbeusedaasguarddogunlessanduntilthedoghasbeenregisteredwith thedivision. (4)Nodogshallberegisteredorusedasaguarddogifaveterinariandeemsthatthedog isphysicallyun®ttoperformserviceasaguarddog. (5)Ifanydogisusedasaguarddogpriortobeingregistered,adoubleregistrationfee shallbeimposedtoregistertheguarddog. (1)Itshallbeaconditionoftheissuanceofanyguarddogpermitandguarddog registrationthatofficersofthedivisionshallatanyreasonabletime,unannounced, havetherighttoenterthepremisesandinspect: a.Alldogsandallpremiseswheresuchdogsaretrained,inuse,orkept. b.Allrecordsforeachguarddogincluding,butnotlimitedto,vaccination, veterinaryandmedicaltreatmentrecords. c.Allrecordsconcerningthetraining,sale,oruseofaguarddog. (2)Refusaltoallowinspectionofaguarddog,premises,orrecordsshallbeaviolationof thischapter. (3)Guarddogservicesshallrequireanycustomerthatprocurestheuseofaguarddogto signanagreementauthorizingofficersofthedivisiontoperformunannounced inspectionsofanyguarddogandpremiseswheretheguarddogisbeingusedasa guarddog. CD6:14.13 Supp.No.3 §6-34ST.LUCIECOUNTYCODE (4)Guarddogservicesshallmaintainrecordsidentifyingthename,address,and telephonenumberofeachcustomerprocuringtheuseofaguarddogandthephysical locationofeachguarddog(withregistrationnumber),ifdifferentthanthecustomer©s address. (5)Onamonthlybasis,guarddogservicesshallprovidethedivisionwithcomplete recordsidentifyingthename,address,andtelephonenumberofeverycustomer procuringtheuseofaguarddogandthephysicallocationofeveryguarddog(with guarddoglicensetagnumber). (6)Guarddogservicesandguarddogownersshallimmediatelynotifythedivisionin writingwhenaguarddogistemporarilyorpermanentlyremovedfromservicedueto sickness,injury,amedicalcondition,ordeath. (7)Guarddogservicesandguarddogownersshallmaintainrecordsoftheacquisition, transferofownership,death,ordisappearanceofaguarddog. (8)Therecordsrequiredtobemaintainedhereinshallbemaintainedforaperiodofat leasttwoyearsfromthedateofcreationandshallbeprovidedtothedivisionupon requestunlessotherwiseprovidedherein. (h) Useofguarddogs. (1)Anyentitywhichhiresorusesaguarddogshallprovideadequatefencingorsome othercon®ningstructuretokeeptheguarddogwithintheguardedarea.Thebusiness ownerorpersonresponsibleformanagingeachentitythathiresorusesaguarddog isresponsibleforeachguarddoghiredorused.Theguarddogshallwearacurrent guarddogregistrationtagwithproofofrabiesinoculationavailableforinspectionby thedivisionandshallbeimplantedwithanelectronicanimalidenti®cationdeviceas requiredbythissection. (2)Eachentitywhichhiresorusesaguarddogthatisonthepremisesduringits operatinghoursshallhavethedogcon®nedorrestrainedinsuchamannersoasnot tohaveaccesstothoseareasopentothepublicortootherwiseposeadangertothe public. (3)Theentityownerorpersonresponsibleformanaginganentitywhichhiresorusesa guarddogshallberesponsibleforhavingateachappropriatelocationandentrypoint, andat50-footintervalsalongthefenceperimeter,ifapplicable,asignpostedincluding thewords"guarddog"or"dangerousdog"inblacksix-inchhighlettersonawhite background. (4)Entrypointsshallhaveasignpostedwiththetelephonenumberofthedog©strainer orhandlerandownerincaseofanemergency. (5)Guarddogsshallbegivenahumaneexistence,andshallatalltimesbemaintainedin accordancewiththerequirementsofsection6-26.Anypersonwhousestheserviceof aguarddogshallberesponsibletoassurethattheguarddogisprovidedahumane existenceinaccordancewithsection6-26,andshallimmediatelycontactthedivision CD6:14.14 Supp.No.3 ANIMALS§6-34 toreportanyguarddogthatissick,diseased,lame,orinjured.Guarddogsthatare con®nedinacageshallhaveatleastone-halfhourofexercisewithineacheighthours ofcon®nement.Itshallbeunlawfulforanyperson,owner,ormanagerkeepingaguard dogtofailtoprovideclean,sanitary,safe,andhumaneconditions;sufficientquantities ofwholesomefooddaily;adequatequantitiesofvisible,clean,andfreshwater availableatalltimes;properairventilationandcirculation;iflocatedoutside,full protectionandshelterfromtheelements;andmedicalattentionandnecessary veterinarycarewhenitissick,diseased,orinjured. (6)Nodogwhichhasbeenclassi®edasdangerouspursuanttothischaptershallbeused asaguarddog. (7)Nodogshallbeusedasaguarddogwhileitispregnantorlactating. (8)Thedivisionshallimpoundanyguarddogownedbyapersonthatiscitedandfound tobeinviolationofsection6-26herein.Theguarddogmayberedeemedupon submittalofevidencesatisfactorytothedivisionthatthecauseoftheviolationhas beenremediedandany®neshavebeenpaid.Theguarddogshallonlybereleasedafter asatisfactoryreviewofthelivingconditionsoftheguarddogbyananimalcareofficer. (9)Eachpersonorentitythatrentsorusesaguarddogtopatrolthepremisesafterthat business©soperatinghoursshallprovideadequatefencing,orsomeothercon®ning structure,tokeeptheguarddogwithinthepremises. (10)Anydogregisteredorusedasaguarddogshallreceiveaminimumofonewellness examinationeverysixmonthsconductedbyaveterinarianlicensedtopractice veterinarymedicineintheStateofFlorida.Nodogshallberegisteredorusedasa guarddogifaveterinariandeemsthatthedogisphysicallyun®ttoperformserviceas aguarddog. (11)Newlyacquireddogsshallbeimmediatelyvaccinatedagainstrabies,tagged,and registeredwiththedivisionasaguarddogbeforebeingusedasaguarddog. (1)Thevehicleofeveryguarddogserviceorownertransportinganyguarddogmustbe clearlymarked,showingthatitistransportingaregisteredguarddog.Acompartment separatefromthedriverisrequiredwhichshallbearrangedtoensureadequate ventilationforthedog. (2)Noguarddogshallbetransportedinthetrunkofacarorinanunenclosedportionof avehicle,including,butnotlimitedtoconvertibles,pickuptrucks,open-bedtrucks,or ¯at-bedtrucks.However,aguarddogmaybetransportedinanunenclosedportionof avehicleiftheanimalissecurelycon®nedwithinacage.Thecagemustbesecurely CD6:14.15 Supp.No.3 §6-34ST.LUCIECOUNTYCODE anchoredtothevehicleinordertopreventmovementaboutthevehicle.The¯ooring ofthecageshallbecoveredinatypeofmaterialthatpreventsthedog©sfeetfrom burning. CD6:14.16 Supp.No.3 IMPACTFEES§24-1 ARTICLEI.INGENERAL Sec.24-1.Economicdevelopmentimpactfeemitigationprogram. (a)Forthepurposeofthissection,theterm"quali®edtargetindustrybusiness"shallmean aneworexpandingbusinessinthecountythathasapositiveeconomicand®scalimpacton thecountyandmeetstherequirementsofF.S.§288.106,oritsstatutorysuccessorinfunction, asaquali®edtargetindustrybusiness.Forthepurposeofthissection,theterm"applicant" shallincludeanyperson,company,researchinstituteorbusinessparkdeveloperthatwill housequali®edtargetindustrybusinesses. (b)Forthepurposesofthissection,theterm"locallyownedandoperatedsmallbusiness" shallmeanatargetindustrycontinuallyoperatedinSt.LucieCountyforatleastthreeyears whichisownedandoperatedbyaSt.Lucie,Martin,IndianRiverorOkeechobeeCounty residentwhosehomesteadislocatedinSt.Lucie,Martin,IndianRiver,OkeechobeeCounty, andwhichemploys50orfeweremployees. (c)Becausetheimpositionoftheimpactfeeshereinmayplacethecountyinanon- competitivepositionwithotherlocalgovernmentsthathavechosennottorequiregrowthto payitsfairshareofneededcapitalfacilities,thushinderingeffortsbythecountyandthe communitytoencourageeconomicdevelopmentopportunitieswithinthecountyandtocreate permanentemploymentexpansionopportunitiesforthecounty©scitizens,thereishereby createdaneconomicdevelopmentimpactfeemitigationprogramforcertainquali®edtarget industrybusinessestomitigateanyrealorperceiveddisadvantageoccurringfromthe impositionoftheimpactfees. (d)Thisprogramisnotintendedasanentitlementprogram.Theprogramisintendedto providetheboardofcountycommissionerstheopportunity,initssolediscretion,togrant impactfeemitigationtoquali®edtargetindustrybusinesses. (e)Tobeeligibleforaneconomicdevelopmentimpactfeewaiver,anapplicantmustmeet thefollowingrequirements: (1)Qualifyasaquali®edtargetindustrybusinessandcreateaminimumoftennewjobs oratenpercentincreaseinexistingemployment(whicheverisgreater)withan averageprivatesectorwage(excludingbene®ts)ofatleast107percentofthecounty©s averageprivatesectorwage(excludingthetoptwoexecutivesalaries)andprovidea bene®tpackagethatincludeshealthinsuranceandremaininthecountyfora minimumoftenyears;or (2)Qualifyasaquali®edtargetindustrybusinessandcreateaminimumoftennewjobs oratenpercentincreaseinexistingemployment(whicheverisgreater)withan averageprivatesectorwage(excludingbene®ts)of100percentofthecounty©saverage privatesectorwage(excludingthetoptwoexecutivesalaries)andmakeacapital investmentinthecountyof$10,000,000.00orgreaterinconstruction,renovations, equipmentpurchases,orothermajorcapitalinvestmentitemsandremaininthe countyforaminimumoftenyears;or CD24:5 Supp.No.3 §24-1ST.LUCIECOUNTYCODE (3)Qualifyasalocallyownedandoperatedsmallbusinessandcreateaminimumoften newjobswithanaverageprivatesectorwage(excludingbene®ts)of100percentofthe county©saverageprivatesectorwage(excludingthetoptwoexecutivesalaries)and provideabene®tpackagethatincludeshealthinsuranceandremaininthecountyfor aminimumoftenyears;and (4)Enterintoanagreementwiththecountywhereintheapplicantagreestolocateor expanditsbusinessoperationsto/withinthecountyforaperiodofatleasttenyears. Theagreementwillalsorequiretheapplicanttoprovidethecountywiththe applicant©squarterlyreport(UCT-6)andallotherdocumentationtodemonstratethat thejobcreationandsalarylevelcommitmentswereachieved. (f)Anyapplicantseekinganeconomicdevelopmentimpactfeewaivershall®lean applicationforwaiverwiththecountyadministratorpriortotheissuanceofthebuilding permitforthesubjectcapitalfacilitiesimpactconstruction.Theapplicationshallcontain: (1)Adesignationofthecapitalfacilitiesimpactconstructionforwhichtheapplicationis beingsubmitted,includingacurrentandcompletelegaldescriptionoftheproperty uponwhichthequali®edtargetindustrybusinessisproposedtobelocated; (2)Thenameandaddressoftheownerofthepropertyuponwhichthequali®edtarget industrybusinessisproposedtobelocated; (3)Proofthatthecapitalfacilitiesimpactconstructionwillbeaquali®edtargetindustry business; (4)Anotarizedaffidavitandallnecessarysupportingevidenceaffirmingthatthe applicablerequirementsofsubsection(e)ofthissectionwillbemetwithinoneyearof thedatethecerti®cateofoccupancyisissuedwhichtermmaybeextendedbytheboard ofcountycommissionersupongoodcauseshown;and (5)Othernecessaryinformationasdeterminedbythecountyadministrator. (g)Anyapplicantwhosubmitsanapplicationforeconomicdevelopmentimpactfee mitigationpursuanttothissectionanddesirestheimmediateissuanceofabuildingpermit priortoapprovaloftheapplicationshallpaytheimpactfeesimposedherein.Shouldtheboard ofcountycommissionersapproveandacceptthemitigationapplication,themitigationamount shallberefundedtotheapplicantorowner.
