(c) Securityrequirements. (1)Allownersareresponsibleformaintainingtheirabandonedrealpropertiesina securemannersoasnottobeaccessibletounauthorizedpersons. (2)Asecuremannershallinclude,butnotbelimitedto,theclosureandlockingof windows,doors,gates,fencingandotheropenings.Brokenwindowsshallbesecured byreglazingorreplacingofthewindow. (3)Anyexcavations,swimmingpoolsorotherattractivenuisancesmustbefilledinwith dirtorproperlyclosedinasecuremanner. (4)Iftheowneroftherealpropertyisacompanyand/ormortgagee,therealproperty shallbepostedwiththenameand24-hourcontacttelephonenumberoftheowner©s localagent.Thepostingshallbenolessthan18inchesby24inches,andshallbe clearlyvisiblefromthestreetbutnotreadilyaccessibletovandals.Thepostingshall containthefollowinglanguage: THISPROPERTYISMANAGEDBY: TOREPORTANYPROBLEMSORCONCERNSCALL: (d) Inspections. (c) Declarationanddurationofstateofemergency;activationofdisasterplans. (1)Thecountyadministrator,orhisdesignee,shallhavetheauthoritytodeclareastate oflocalemergency,pursuanttoCountyResolutionNo.00-277. (2)Thedeclarationofthestateofemergencyshallactivatethedisasteremergencyplans applicabletothecountyandshallbetheauthorityforemergencymeasuressuchas evacuationordersanddeclaringofcertainareasasbeingofflimits,aswellas authorizetheuseordistributionofanysupplies,equipment,materialsorfacilities assembledorarrangedtobemadeavailabletosuchplans. (3)Astateoflocalemergencyshallcontinueforsevendays,unlessextendedas necessary,inseven-dayincrements.However,ifthelocalemergencyinvolvesa threattoprivatestructureorpublicinfrastructure,thelocalemergencymayremain ineffectforupto30days. (d)Duringthestateofemergency,theproceduresandformalities Emergencypowers. otherwiserequiredofthecountybylawmaybewaivedbythecountyadministratorandhe mayauthorizeactionspertainingtothefollowingashedeemsnecessary: (1)Performingpublicworkandtakingwhateveractionisnecessarytoensurethe health,safety,andwelfareofthecommunity. CD38:35 Supp.No.4 §38-161ST.LUCIECOUNTYCODE (2)Determiningathreattopublichealthandsafetythatmayresultfromthegeneration ofwidespreaddebristhroughoutthecounty,thatsuchdebrisconstitutesahazardous environmentforallmodesofmovementandtransportationoftheresidentsaswell asemergencyaidandreliefservices,endangermenttoallpropertiesinthecounty,an environmentconducivetobreedingdiseaseandvermin,andgreatlyincreasedriskof fire,andthatitisinthepublicinteresttocollectandremovedisasterdebrisfromall propertywhetherpubliclands,publicorprivateroads,andgatedcommunitiesto eliminateanimmediatethreattolife,publichealthandsafetytoreducethethreat ofadditionaldamagetoimprovedpropertyandtopromoteeconomicrecoveryofthe communityatlarge. (3)Authorizethecountyortheircontractedagentrightofaccesstoprivateroadsor gatedcommunitiesasneededbyemergencyvehicles,suchas,butnotlimitedto, police,fire,medicalcare,debrisremoval,andsanitationtoalleviateimmediate threatstopublichealthandsafety. (4)Authorizetheremovalofdebrisandwreckageresultingfromamajordisasterfrom allpropertywhetherpubliclands,publicorprivateroads,orgatedcommunitiesfor asafeandsanitarylivingorfunctioningcondition. (e) Holdharmless. (1)ThissectionshallprovidetoindemnifyandholdharmlesstheUnitedStates Government,theFederalEmergencyManagementAgency(FEMA),thestate,the countyandtheiragencies,agents,contractors,andsubcontractors,fordamagesof anytypewhatsoever,eithertopropertyortopersonssituatedthereon,byobtaining arightofentrypermitandagreementfromprivateandgatedcommunitiespriorto removingstorm-generateddebrisfromtheproperty. (2)Thecountyshallobtaintheseagreementsandannuallyshalladdnewcommunities. Theagreementswillberetainedbythecountyandshallbereadilyavailableforuse asneeded.
