(a)Everyalarmbusinesssellingorleasingtoanypersonanautomaticdialingdevice whichisinstalledonsuchperson©spremisesinthecountyaftertheeffectivedateofthe ordinancefromwhichthisarticleisderivedshallfurnishthatpersonwithinstructionsthat provideadequateinformationasrequiredbytheNationalFireProtectionAssociation Standardstoenablepersonsusingsuchdevicetooperateitproperlyand,ifthedeviceisto beservicedormaintainedbyanotheralarmbusiness,shallfurnishsuchotheralarm businesswithamanualorotherinformation,includingadiagramofthefinalinstallation necessarytoenableittoserviceorproperlymaintainsuchdevice. (b)Ifthelawenforcementexecutiveorfiremarshalresponsiblefindssuchinstructionsto beincompleteorunclear,orinadequatetoexplainhowthedeviceoperatesandis constructed,hemayrequirethealarmbusinesstorevisetheinstructionsandmailthemout bycertifiedlettertoprovideadequateinformation,andthentodistributetherevised informationtopersonswhohavehadsuchdevicesinstalledaswellastopersons subsequentlyhavingsuchdevicesinstalled. (c)Everyalarmbusinesssellingorleasingtoanypersonanautomaticdialingdevice whichisinstalledonsuchperson©spremisesinthecountyaftertheeffectivedateofthe ordinancefromwhichthisarticleisderivedshallfurnishtothepersonbuyingorleasing suchdevicewritteninformationandtrainingconcerninghowservicemaybeobtainedatany time,includingtelephonenumbertocallforservice. (Code1982,§1-2.5-5;Ord.No.87-44,pt.A,11-17-1987) Sec.18-92.Directconnectionstolawenforcementagenciesand/orfiredepart- ment. Nodirectconnectionsshallbepermittedinthecountyunlessauthorizedbythechief executiveofthelawenforcementagencyorthefiremarshalforthecounty. (a)Eachalarmuser,athisexpense,isrequiredtomaintainallcomponentsofhisalarm systemingoodworkingorderatalltimestoensurethatthesensorymechanismusedin connectionwithsuchdeviceisadjustedtosuppressfalseindicationsofholdupsorintrusions orfireorsmokeconditionssothatthedevicewillnotbeactivatedbyimpulsesduetoshort flashesorlight,wind,noises,vehicularnoiseorotherforcesunrelatedtogenuinealarms. (b)Noalarmsystemdesignedtotransmitemergencymessagesshallbetestedor demonstratedwithoutfirstnotifyingthecentralstation,911centralcommunicationsand thefiredepartment. (c)Firealarmsystemsshallberequiredtohaveamaintenancecontractfortestingand inspectionsinaccordancewiththeNationalFireProtectionAssociation(NFPA)Standards: forexample,smokeand/orheatdetectors,manualpullstationsandwaterflowalarms (sprinklersystems).Copiesofthemaintenancecontractandtestresultsofthefirealarm systemshallbeforwardedtothefiremarshalwithin30daysfromthedateofthetest. CD18:25 Supp.No.5 §18-93ST.LUCIECOUNTYCODE (d)Thealarmusershallmakeeveryreasonableefforttorespondorcausearepresenta- tivetorespondtothealarmsystem©slocationwithin30minuteswhennotifiedbylaw enforcementtodeactivateamalfunctioningalarmsystem,toprovideaccesstothepremises, ortoprovidesecurityforthepremises. (e)Thealarmusershallmaintainthepremisesandthealarmsysteminamannerthat willminimizeoreliminatefalsealarmdispatches. (f)Thealarmusershallnotmanuallyactivateanalarmsystemforanyreasonotherthan anoccurrenceofaneventthatthealarmsystemwasintendedtoreport. (g)Analarmusershalladjustthemechanismorcausethemechanismtobeadjustedso thatanalarmsignalaudibleontheexteriorofanalarmsitewillsoundfornolongerthanten minutesafterbeingactivated,or15minutesforsystemsoperatingunderUnderwriters Laboratories,Inc.Standards365or609. (h)Within15daysafterthesecondfalsealarmdispatchtoanalarmsiteinanyone-year period,thealarmusershallhaveaproperlylicensedalarmbusinessinspecthisalarm system.Afterthethirdfalsealarmdispatchinanyone-yearperiod,thealarmusershall haveaproperlylicensedalarmbusinessmodifythealarmsystemtobemorefalsealarm resistantorprovideadditionalusertraining,asappropriate.Thealarmusershallprovide writtendocumentationtothesherifforfiremarshal,asappropriate,ofsuchinspection, modification,ortrainingwithin30daysofthefalsealarmdispatchwhichnecessitatedsuch service. (a)Itshallbeunlawfulforanypersonorcompanytooperate,monitor,orberesponsible foranalarmsystem,withoutpriorregistrationwiththeentitydesignatedbythecounty. Thisshallapplytobothcommercialandresidentialsystems.Aseparatepermitisrequired foreachalarmsite. (b)Eachpersonorcompanywhichoperates,monitors,orhasresponsibilityforalarm systems,whonotifiesthecountyofanalarmactivation,shallatthetimeofnotification, disclosethename,address,telephonenumber,andpermitnumberofthealarmusertothe county. (a)Anypersondesiringanalarmsystempermitshallfileanapplicationwiththecounty©s thirdpartyalarmadministratoronaformprovidedbytheadministratormanuallyor electronicallywhichincludes,butisnotlimitedto,thefollowinginformation: (1)Thenameandaddressoftheapplicant; CD18:26 Supp.No.5 EMERGENCYMANAGEMENTANDEMERGENCYSERVICES§18-96 (2)Ifdifferentthanabove,theaddressatwhichthealarmsystemistobeinstalledand used; (3)Iftheapplicantisacorporationthenamesandaddressesofitsprincipalofficers; (4)Iftheapplicantisapartnership,association,orotherbusinessentity,thenamesand addressesofthepartnersorpersonscomprisingthesame; (5)Adescriptionofthealarmsystemproposedtobeinstalled,includingthemanufacturer©s nameandmodelnumber,ifany; (6)Forresidentialproperties:Thenames,addressesandtelephonenumbersoftwoor morepersonswhowillbeavailabletosecurethepremisesduringanyhouroftheday ornight.Forcommercialproperties:Thenames,addresses,andtelephonenumbers ofthreeormorepersonswhowillbeavailabletosecurethepremisesduringanyhour ofthedayornight; (7)Classificationofthealarmsiteasbeingequippedornon-equippedforduressalarm. Anysuchadditionalinformationthatthecountymaydeemnecessaryinorderto fullyandproperlyadministerthischapter. (b)Wheneveranychangeoccursrelatingtotheinformationrequiredbythissection,the applicantorpermitteeshallgivewrittennoticethereoftothecountythirdpartyalarm administratorwithintendaysaftersuchchange. (c)Analarmsystempermitmaybedeniediftheapplicationisnotintheproperform, doesnotcontainallinformation,orfeesrequiredbythischapterarenotpaid. (d)Totheextentallowedbylawandintheinterestofpublicsafety,allinformation containedinandgatheredthroughthealarmpermitapplications,recordsrelatingtoalarm dispatchrequests,andapplicationsforappealsshallbeprivilegedinformationheldin confidencebyallemployeesorrepresentativesofthecountyandbyanythird-party administratororemployeesofathird-partyadministratorwithaccesstosuchinformation. (a)Alarmsystempermitsareissuedforaperiodofoneyearandwillexpire365daysafter thedateofissuanceorrenewal,unlessotherwisesuspendedorrevokedatanearliertime. Uponexpirationofanalarmsystempermit,arenewalpermitmustbeobtained. (b)Inthemannerspecifiedbythecountybeforeanalarmsystemmaycontinueinuse. (c)Alarmpermitsmaynotbetransferredtoanotherpersonoralarmsite.Permitsare validonlyforthepermitteeandaddresslistedonthepermit. (d)Analarmusershallinformthecounty©sthirdpartyalarmadministratorofany changethataltersanyinformationlistedonthepermitapplicationwithintenworkingdays. CD18:27 Supp.No.5 §18-96ST.LUCIECOUNTYCODE (e)Itistheresponsibilityofthealarmusertosubmitarenewalapplicationpriortothe permitexpirationdate.Failuretorenewshallbeclassifiedasuseofanon-permittedalarm systemandcitationsandpenaltiesshallbeassessedwithoutwaiver. (f)Withinsixmonthsoftheeffectivedateoftheordinancefromwhichthisarticleis derivedanypersonwhohasapre-existingalarmsystemwhichwasnotinstalledundera permitmayobtainaninstallationpermitforthescheduledfeewithoutapenalty. Analarmpermitshallbemailedtothealarmuserbythecounty©sthirdpartyalarm administratorattheaddressofthealarmusersatedontheapplicationwithintendaysafter receiptofthecompletedapplicationbythecounty©sthirdpartyalarmadministrator.An alarmpermitshallbedeniedif: (1)Therequestedinformationisnotsuppliedontheapplication. (2)Materialinformationontheapplicationisincorrect. (3)Anypersonorentitylistedontheapplicationasresponsiblefortheinstallation, maintenanceand/ormonitoringofthealarmsystemdoesnotpossessanyrequired occupationalorregulatorylicensetoconductsuchactivitiesunlessthepersonor entityisthealarmuser. (4)Allfalsealarmdispatchchargesforexcessivefalsealarmsowedbythealarmuser havenotbeenpaid. (5)Thealarmuserhadanalarmpermitforthealarmsitesuspendedorrevoked,and theviolationcausingthesuspensionorrevocationhasnotbeencorrected. (a)Priortotheactivationorsubstantialmodificationoruseofanalarmsystem,as definedinsection18-89,theowner,manager,orlesseeofthepremisesshallfurnishtothe county©sthirdpartyalarmadministratoronaformprovidedbythecounty©sthirdparty alarmadministratormanuallyorelectronicallywhichincludesinformationdeemedneces- sarytoprovideadequateresponsetothealarm. (b)Owners,managersorlesseesofexistingalarmsystemsasdefinedinsection18-89 shallhave30daysfromtheeffectivedateoftheordinancefromwhichthisarticleisderived tocomplywiththeabovenoticerequirements. CD18:28 Supp.No.5 EMERGENCYMANAGEMENTANDEMERGENCYSERVICES§18-98 (c)Owners,managerorlessees,oragentsofanyalarmsystemshallrespondtothealarm location,whenrequested,inordertoresetordeactivatethealarmsystemwithina reasonabletimeofnotification.Failuretoprovidesuchaccessshallresultinafalsealarm assessmentasprovidedinsection18-100. (d)Priortotheactivationoruseofanytypeofgeneralalarmdevicetheowner,manager orlesseeofthepremisesshallfurnishtothecounty©sthirdpartyalarmadministrator, informationregardingthefullnames,addressesandtelephonenumbersofatleastthree personsforcommercialpropertiesandtwopersonsforresidentialpropertieswhocanbe reachedatalltimesandwhoareauthorizedandhavethecapabilitytoenterthepremises anddeactivatethealarmdevice.Owners,managersorlesseesofthepremiseswithalarm devicesalreadyinstalledshallhave30daysfromtheeffectivedateoftheordinancefrom whichthisarticleisderivedtocomplywiththeabovenoticerequirement.Itshallbethe responsibilityoftheowner,managerorlesseeofthepremisestoprovideanupdatedlist annuallytothecounty©sthirdpartyalarmadministrator.Failuretodosomayresultina falsealarmassessmentsubjecttothesanctionsofsection18-100. (e)Allburglaralarmsystemshavinganaudibleorvisualsignalatthepremisesshallbe equippedsoastoautomaticallyshutofftheaudibleorvisualsignalafter15minutes,except thosesystemsrequiredbylawtohavealongeroperatingperiod,inwhichcasesaidsystem shallbeequippedsoastoautomaticallyshutofftheaudibleorvisualsignalattheconclusion ofthelongerrequiredoperatingtime. (f)Allalarmsystemsshallbeproperlymaintained.Systemmalfunctionduetofaulty maintenanceshallnotbegroundsforanexcusedfalsealarmassessment. (g)Allalarmsystemsshallobtainallnecessarypermitsandinspectionsforthe installationofthesystem. (h)Allalarmcompaniesthatsell,lease,install,operate,monitororhavetheresponsibil- ityforalarmsystems,shallmaintaintheappropriatelicenseasrequiredunderF.S.ch.489, andshallregisterannuallywiththecounty.Afineof$500.00shallbeassessedtoanyalarm monitoringcompanywhofailstoregister.Eachregistrationshallbevalidfor12months. Thealarmmonitoringcompanyshallprovidethefollowinginformation: (1)Name,streetaddressandtelephonenumber.Monitoringcompaniesshallmaintain, foraperiodofatleastoneyear,recordsrelatingtoalarmnotificationandshall providesuchrecordstothecounty©sthirdpartyalarmadministratoruponrequest,or afineof$125.00shallbeassessed. (2)Thenames,streetaddresses,andtelephonenumbersofallcontractedalarm operatorswithintheterritorialjurisdictionofthecounty. (3)Theprocedureusedtoverifythelegitimacyofanalarmpriortonotificationofcounty lawenforcement. (4)Thename,streetaddress,andtelephonenumberofthealarmcompany. CD18:29 Supp.No.5 §18-98ST.LUCIECOUNTYCODE (i)Analarmcompanyperformingmonitoringservicesshall: (1)Attempttoverify,bycallingthealarmsiteand/oralarmuserbytelephone,to determinewhetheranalarmsignalisvalidbeforerequestingdispatch.Telephone verificationshallrequire,asaminimum,thatasecondcallbemadetoadifferent number,ifthefirstattemptfailstoreachanalarmuserwhocanproperlyidentify themselvestoattempttodeterminewhetheranalarmsignalisvalid,exceptinthe caseofapanicorrobbery-in-progressalarm,orincaseswhereacrime-in-progress hasbeenverifiedbyvideoand/oraudiblemeans. (2)Providealarmuserregistrationnumber,whenavailable,tothecommunications centertofacilitatedispatchand/orcancellation. (3)Communicateanyavailableinformationaboutthelocationofthealarmstothe communicationscenter. (4)Communicateacancellationtothecommunicationscenterassoonaspossible followingadeterminationthataresponseisunnecessary. Sec.18-99.Responsetoalarms;determinationofvalidity. (a)Wheneveranalarmisactivatedinthecounty,therebyrequiringanemergency responsetothelocationbylawenforcementand/orthefiredistrict,andthemanagementof thealarmsitedoesnotrespond,apoliceofficerorfirefighteronthesceneoftheactivated alarmsystemshallvisuallyinspecttheareaprotectedbythesystemandshallexercise reasonablejudgmenttodeterminewhethertheemergencyresponsewasinfactrequiredas indicatedbythealarmsystemorwhetherinsomewaythealarmsystemmalfunctionedand therebyactivatedafalsealarm. (b)Ifapoliceofficerorfirefighteratthesceneoftheactivatedalarmsystemdetermines thealarmtobefalse,saidofficershallmakeareportofthefalsealarm,anotificationof whichshallbemailedordeliveredbythethirdpartyalarmadministratortothealarmuser and/orrecordtitleownerattheaddressonfilewithlawenforcement,advisingthealarm userandrecordtitleownerofthefalsealarm. (c)Lawenforcementshallhavetherighttoinspectanyalarmsystemonthepremisesto whicharesponsehasbeenmadeandtheymaycauseaninspectionofsuchsystemtobemade atanyreasonabletimethereaftertodeterminewhetheritisbeingusedinconformitywith thetermsofthischapter.
