LUCIE COUNTY CODE OF ORDINANCES AND COMPILED LAWS BY AMENDING SECTION 1-10.5-45 ("CREATION OF THEAFFORDABLE HOUSING ADVISORY COMMITTEE) TO PROVIDE FOR FINDINGS, MEMBERSHIP, AND DUTIES OF THE AFFORDABLE HOUSING ADVISORY COMMITTEE; PROVIDING FOR SEVERABILITY, EFFECTIVE DATE, FILING WITH DEPARTMENT OF STATE, ADOPTION, AND CODIFICATION WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. The Board recognizes the importance of Affordable Housing Policies and the need to review and update the St. Lucie County Comprehensive Plan and Land Development Code to enable such policies to be fully utilized by developers. 2. On June 15, 1993, this Board adopted Ordinance No. 93-17 which amended Chapter 1-10.5 ("Housing") of the St. Lucie County Code of Ordinances and Compiled Laws to create Article V (" State Housing Initiatives Partnership Program"). 3. Section 1-10.42 provided for the creation of an Affordable Housing Advisory Committee (the "Committee") for the purpose of advising the Board of County Commissioners on matters relating to codes and regulations that currently preclude Affordable Housing Policies. 4. This Board should further define the membership and duties of the Committee. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of St. Lucie County, Florida: Part A. The affordable Housing Advisory Committee is hereby created and established as required pursuant to Section 420.9072, Florida Statutes. (Q) The Affordable Housing Advisory Committee shall submit a report to the Board of County Commissioners every three years on or before December pt beginning December 1. 2008 that includes recommendations on and evaluate the implementation of. affordable housing in the following specific areas: ill The processina of approvals of development orders or permits. as defined in Sections 163.3164(7) and (8). Florida Statutes. for affordable housing pro iects is expedited to a greater degree than other pro iects; m The modification of impact-fee requirements. including reduction or waiver of fees and alternative methods of fee payment for affordable ,housing; ill The allowance of flexibility in densities for affordable housing; ill The reservation of infrastructure capacity for housing for very-low income persons. low income persons. and moderate-income persons; !ID The allowance of affordable accessory residential units in residential zoning districts; (Q) The reduction of parkina and setback requirements for affordable housina; ill The allowance of flexible lot configurations. including zero-lot-line configurations for affordable housing; @ The modification of street requirements for affordable housing; (2) The establishment of a process by which the County considers. before adoption. policies. procedures. ordinances. regulations. or plan provisions that increase the cost of housing; '(!Q) The preparation of a printed inventory of locally owned public lands StF'l:lel, tRF'Sl:lgR passages are deleted. 2 Underlined passages are added. suitable for affordable housing; .li!1 The support of development near transportation hubs and ma ior employment centers and mixed-use developments. if) The action. decisions and recommendations of the committee shall not be final or bindina on the Board of County Commissioners, but shall be advisory only. @ The Affordable Housina Advisory Committee shall consist of eleven (11) members as follows: ill A citizen who is actively engaged in the banking or mortgage industry in connection with affordable housing; ill One citizen who is actively enaaged in the reSidential home building industry in connection with affordable housing; (3) One citizen who is a representative of those areas of labor actively engaged in home buildina in connection with affordable housing; ill One citizen who is actively engaged as. a for-profit provider of affordable housing; @ One citizen who is actively engaged as a real estate professional in connection with affordable housina; fQ) One citizen who is actively enaaged as a not-for-profit provider of affordable housing ill One citizen who serves on the local planning agency pursuant to Section 163.3174. Florida Statutes; lID One citizen who resides within the iurisdiction of the local governing body making the appointments; f2) One citizen who represents employers within theiurisdiction; f!Q} One citizen who represents essential services personnel. as defined in the local housing assistance plan; and. (e) Each commissioner shall appoint two (2) members to the Committee. The Committee members' terms shall run concurrent with the term of the appointing commissioner. A commissioner may remove his appointee from the Committee at any time with or without,cause. ill The Board of County Commissioners shall appoint one at large member to the Committee. The at large member shall not serve more than two consecutive full four (4) year terms. The Board may remove the at large member with or without cause at any time upon the affirmative vote of a ma iority of the Board. (9) During the first meeting of each calendar year, the members shall select a chairman and a vice chairman from among the membership to serve one (1) year terms. (h) All members shall serve without compensation. ill Vacancies for all appointments shall be filled upon: ill Death of a member. ill Resignation. ill Removal. ill Three (3) absences in a six (6) month period. ill Vacancies shall be filled by the commissioner who appointed the former member to the vacant seat. (!s} The Committee chairman shall establish a time and place for holding meetings as shall be necessary, and the Committee shall adopt such rules of oraanization and procedure as may be required. One-'half (B of the Committee membership plus one (1) shall constitute a quorum for the transaction of official business during Committee meetings. ill The Committee may establish sub-committees for specific sub iects or tasks from among its members. (m) The Community Services Department and the Growth Management Department shall provide administrative support and shall maintain the records of the Committee. PART B. SEVERABILITY. Provisions of this Ordinance are severable; and if any section, subsection, sentence or clause or provision is held invalid by any court of competent jurisdiction, the remaining provisions of this ordinance shall not be affected thereby. PART C. EFFECTIVE DATE. This ordinance shall take effect on the date of adoption. PART D. FILING WITH DEPARTMENT OF STATE. The Clerk be and hereby is directed forthwith to send a certified copy of this Ordinance to the Bureau of Laws, Department of State, the Capitol, Tallahassee, Florida 32304. PART E. ADOPTION.
