ORDINANCE NO. 06-019 AN ORDINANCE OF ST. LUCIE COUNTY, FLORIDA, ADOPTING AMENDMENTS TO THE COMPREHENSIVE PLAN RELATING TO TOWNS, VILLAGES AND COUNTRYSIDE (TVC) WHICH SHALL APPLY TO PROPERTY GENERALLY LOCATED WITHIN AREA MORE SPECIFICALLY DEPICTED IN EXHIBIT "A" HERETO, WHICH AMENDMENTS ARE ATTACHED AS EXHIBIT "B" HERETO; ADOPTING COMPREHENSIVE PLAN AMENDMENTS TO THE FUTURE LAND USE MAP FOR THE PRESERVE AND QUAIL MEADOWS, ATTACHED AS EXHIBIT "C" HERETO; ADOPTING COMPREHENSIVE PLAN TEXT AMENDMENTS TO THE FUTURE LAND USE, TRANSPORTATION, RECREATION& OPEN SPACE, INTERGOVERNMENTAL COORDINATION, AND CAPITAL ELEMENTS OF THE COMPREHENSIVE PLAN, ATTACHED AS EXHIBIT "D" HERETO; PROVIDING FOR TRANSMITTAL TO THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS AND OTHER AGENCIES AS REQUIRED BY LAW; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the SI. Lucie County Board of County Commissioners (the "Board") has prepared Comprehensive Plan Amendments to implement the results of the North SI. Lucie County Charette, which are known as the Towns, Villages and Countryside amendments (TVC amendments), to apply to that area depicted on Exhibit A attached hereto; and WHEREAS, the Board has prepared Comprehensive Plan Amendments to implement the results of the North SI. Lucie County Charette, which are known as the Towns, Villages and Countryside amendments (TVC amendments), to apply to that area depicted on ExhibitA attached hereto; and WHEREAS, the Board has reviewed comprehensive plan amendments to the future land use map for projects that are known as the Preserve and Quail Meadows that apply to that area depicted on Exhibit C attached hereto; and WHEREAS, the Board has prepared text amendments to the Future Land Use, Transportation, Recreation & Open Space, Intergovemmental Coordination, and Capital Elements of the Comprehensive Plan as depicted on Exhibit D attached hereto; and WHEREAS, the Board recommended approval for transmittal of the proposed Towns, Villages and Countryside amendments; the Preserve and Quail Meadows amendments; and the text -, amendments to the Florida Department of Community Affairs; and WHEREAS, the Board has transmitted the Comprehensive Plan Amendments for the TVC, the Preserve and Quail Meadows, the text amendments, and the Scenic Highway Text Amendments to the Florida Department of Community Affairs; and WHEREAS, on January 13, 2006, the Florida Department of Community Affairs provided Objections, Recommendations, and Comments regarding the proposed TVC, the Preserve, and Quail Meadows Comprehensive Plan Amendments; and WHEREAS, the Board has responded to Objections, Recommendations, and Comments with certain changes to the proposed TVC, the Preserve, and Quail Meadows amendments that are reflected herein; and WHEREAS, the adoption of the TVC amendments and their implementation by the adoption of land development regulations, and the adoption of the aforesaid Comprehensive Plan Amendments shall serve to further guide land use and development within the County, so that the public health, welfare and safety is protected and the aesthetic, and environmental resources of the County are further enhanced and protected from impairment and suburban sprawl is avoided; and WHEREAS, the TVC amendments and aforesaid Comprehensive Plan Amendments have received public input and participation through public hearings before the Local Planning Agency and the Board in accordance with Section 163.3181, Florida Statutes. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA, AS FOLLOWS: Section 1. confirmed. Section 2. Adoption of Towns. Villaaes and Countryside Comprehensive Plan Amendments. The Board hereby adopts the Towns, Villages and Countryside Comprehensive Plan Amendments, attached as Exhibit B hereto, which amendments shall apply to that property generally located in the Towns, Villages and Countryside comprehensive plan element boundary as Recitals Adopted. Each of the above stated recitals is hereby adopted and , more specifically depicted in Exhibit A hereto. Section 3. Adoption of Comprehensive Plan Amendments to the Future Land Use Map for the Preserve and Quail Meadows PUD Proiects. The Board hereby adopts the Comprehensive Plan Amendments attached as Exhibit C hereto. Section 4. Adoption of Comprehensive Plan Text Amendments to the Future Land Use, Transportation. Recreation & Open Space,lnteraovernmental Coordination, and Capital Elements. The Board hereby adopts the Comprehensive Plan Amendments attached as Exhibit D hereto. Section 5. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 6. Transmittal. The County Growth Management Director is hereby directed to ensure that this Ordinance and all necessary supporting data and analysis and other relevant documents are forwarded to the Florida Department of Community Affairs and other agencies in accordance with Section 163.3184(3), Florida Statutes. Section 7. Effective Date. The effective date of the comprehensive plan amendments shall be the date a final order is issued by the Department of Community Affairs or Administration Commission finding the amendments in compliance in accordance with Section 163.3184(1)(b), Florida Statutes, whichever is applicable. If a final order of noncompliance is issued by the Administration Commission, these amendments may nevertheless be made effective by adoption of a resolution affirming its effective status, a copy of which resolution shall be sent to the Florida Department of Community Affairs, Division of Community Planning, Plan Processing Team. An adopted amendment whose effective date is delayed by law shall be considered part of the adopted plan until determined to be not in compliance by final order of the Administration Commission. r Then, it shall no longer be part of the adopted plan unless the Board adopts a resolution affirming its effectiveness in the manner provided by law.
