An Ordinance defining child, criminal act,
habitual offender, parent and parental neglect;
requiring the notification of the parent of
any child arrested or detained; requiring a
record of such notification to be kept; making
it unlawful to be guilty of parental neglect;
providing a penalty for violation and providing
an effective date.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY:
Section 1. For the purpose of this ordinance certain terms
and words are defined as follows:
(1) CHILD - Any person defined as a child by Section
39.01, Florida Statutes.
(2) CRIMINAL ACT - An act which violates the statutes
of the State of Florida or the ordinances of St. Lucie County.
(3) HABITUAL OFFENDER - One who commits two or more
criminal acts or four or more moving traffic violations with-
in a twelve month period.
(4) PARENT - Mother, father, legal guardian and any
other person having the care or custody of a child or such
other adult with whom a child may be found residing.
(5) PARENTAL NEGLECT - The failure of the parent of any
child to exercise reasonable parental control which results
in the child committing any criminal act or to allow or
encourage any child to commit any criminal act or become
delinquent in accordance with the juvenile laws of the State
of Florida.
Section 2. Whenever a child shall be arrested or detained
for the commission of any criminal act within the unincorporated
area of St. Lucie County, the parent of such child shall be
immediately notified by the St. Lucie County Sheriff's Department
advising the parent of such arrest or detention, the reason
thereof and their responsibility under this ordinance. A record
of such notification shall be kept by the St. Lucie County Sheriff's
Department.
Section 3. It shall be unlawful for the parent of any child
to be guilty of parental neglect and upon conviction thereof the
parent shall be subject to the penalty herein provided.
Section 4. The parent of a habitual offender may be deemed
guilty of parental neglect and shall upon conviction thereof be
subject to the penalty herein provided.
Section 5. Any person violating any provision of this
ordinance shall upon conviction be punished by fine not to exceed.
Five Hundred Dollars ($500.00) or by imprisonment in the County
jail of St. Lucie County not to exceed sixty days (60) or by both
fine and imprisonment.
Section 6. This ordinance shall take effect upon receipt of
official acknowledgement from the Office of the Secretary of
State of Florida that said ordinance has been filed in said Office.

ORDINANCE NO. 71-3
An ordinance creating the St. Lucie County
Historical Commission for said county;
providing who shall be the members of said.
commission; prescribing the powers and duties;
providing who shall be chairman, secretary,
and county historian; providing that the
expenses of such commission shall be paid by
the county commissioners of said county out
of the general fund; providing that the Clerk
of the Circuit Court of said county shall file
and record without charge historical data and
material and authorizing the county commissioners
of said county to provide a suitable place as
a repository for such data and material.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY:
Section 1. There is hereby created in St. Lucie County a
historical commission to be known as the St. Lucie County Historical
Commission. It shall consist of not more than ten (10) members
or fewer than five (5) members, all of whom shall be selected by
the Board of County Commissioners of St. Lucie County. One or
more members of said Board of County Commissioners may be selected
to serve on the Historical Commission.
Section 2. In selecting citizens to serve on said Historical
Commission said Board of County Commissioners shall consider the
interest of such citizens in the history and cultural lore and
development of the county. The chairman of said Historical Commis-
sion shall be named by the Board of County Commissioners. The
Historical Commission shall appoint a secretary who may or may
not be a member of the commission. The members of the Historical
Commission shall receive no compensation, but may be reimbursed
for traveling expenses as provided in Section 112.061, Florida
Statutes.
Section 3. Said commission shall meet at an appropriate
place and shall arrange a time for holding regular meetings and
such other meetings as shall be necessary. It may adopt such
rules of organization and procedure as it may deem necessary and
determine the duties of its members and employees. The commission
may, when necessary, appoint a clerk to be known as "county
historian."
Section 4.
arrange, record and preserve historical material and data, includ-
ing books, pamphlets, maps, charts, manuscripts, family histories,
U. S. Census records, papers and other objects and material
illustrative of and relating to the history of said county and of
Florida; to procure and preserve narratives of the early pioneers,
their exploits, perils, privations and achievements, and to
collect material of every description relative to the history of
its Indian tribes and wars and relative to its soldiers, its
schools and its churches.
Section 5. Such commission may upon its own initiative or
upon petition of historical societies, mark by proper monuments,
tablets or markers, the location of forts, Indian mounds or other
places in said county where historical events have occurred..
Section 6. The Clerk of the Circuit Court of said county
shall file and record, without charge, in a book or books which
shall be furnished such clerk by the Board of County Commissioners
all such historical material and data that said commission may
direct to be filed and recorded.
Section 7. The Board of County Commissioners of said county
shall pay the expenses of such commission out of the general fund
of said county, but such expenses shall not at any time exceed
$1,500.00 per annum.
Section 8. The Board of County Commissioners of said county
It shall be the duty of such commission to collect,
shall provide suitable and adequate space as a repository for
the findings, collections and other material of the Historical
Commission.
Section 9. This ordinance shall take effect upon receipt of
official acknowledgement from the Office of the Secretary of State
that said ordinance has been filed in said office.

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY:
Section 1. Section 1 of Chapter 67-2000,Special Acts of 1967,
is amended to read:
"Section 1. Definitions.
(1) "Board", "board of examiners" or examining board~t
shall mean the appropriate one of the examining boards herein
provided for.
(2) '~Contractor" shall mean any party who is engaged
in the business of building, remodeling, repairing, painting,
wiring, plumbing, razing or moving any building or structure
whether by contract, cost plus, fixed fee, stated sum, per-
centage, or any combination thereof, other than wages, such
as, but not limited to, general contractors, building contractors,
residential building contractors, electrical contractors,
plumbing contractors, mechanical contractors and the following
specialty contractors: air conditioning, aluminum specialty,
carpentry, demolition, dry wall, elevator, fence erection,
heating, masonry, painting, plastering, resilient floors,
roof painting, roofing, septic tanks, sheet metal, structural
steel erection, swimming pools and tile, terrazo and marble.
(3) "General Contractor" shall mean any party whose
services are unlimited, about the type of work which they may
do as set forth in subsection 2 above.
(4) "Building Contractor" shall mean any party whose
services are limited to construction of commercial buildings
and single or multiple dwelling residential buildings, neither
to exceed three (3) stories in height, and accessory use
structures in connection therewith, or those whose services
are limited to remodeling, repair or improvement of any size
building if the services do not affect the structural members
of the building.
(5) "Residential Building Contractor" shall mean any
party whose services are limited to construction, remodeling,
repair or improvement of one, two or three family unit
residential, not to exceed two (2) stories in height and
accessory use structure in connection therewith.
(6) "Party" shall mean any individual, sole proprietor-
ship, partnership, corporation, association or any other type
of business organization.
Section 2. This ordinance shall take effect upon receipt of
official acknowledgement from the Office of the Secretary of State
that said ordinance has been filed in said office.

ORDINANCE NO. 71-5
An ordinance amending Sections 4 and 7 of
Chapter 31235, Laws of Florida, 1955, as
amended by Chapter 59-1805, Laws of Florida,
1959, to provide that the members of the
St. Lucie County Planning and Zoning Commis-
sion and the members of the St. Lucie County
Board of Adjustment shall be appointed for
stated terms rather than at the pleasure of
the Board of County Commissioners; and
providing an effective date.
WHEREAS, Chapter 31235, Laws of Florida, 1955, as amended by
Chapter 59-1805, Laws of Florida, 1959, provides that the members
of the St. Lucie County Planning and Zoning Commission and the
members of the St. Lucie County Board of Adjustment shall serve
at the pleasure of the Board of County Commissioners of St. Lucie
County, and
WHEREAS, said Board. of County Commissioners desires to amend
said special act to provide that the members of the Planning and
Zoning Commission and the members of the Board of Adjustment shall
be appointed, for stated terms rather than at the pleasure of the
Board of County Commissioners, NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY:
Section 1. Section 4 of Chapter 31235, Laws of Florida, 1959,
as amended, is amended to provide that three (3) members of the
Planning and Zoning Commission shall be appointed for a term of
one (1) year, three (3) members shall be appointed for a term of
two (2) years and three (3) members shall be appointed for a term
of three (3) years; thereafter the term of office of each member
shall be for three (3) years.
Section 2. Section 7 of Chapter 31235, Laws of Florida, 1959,
as amended, is amended to provide that each member of the Board
of Adjustment shall be appointed for a term to coincide with
the term of the county commissioner of the district from which
such member is appointed.
Section 3. This ordinance shall take effect on October 1,1971.

ORDINANCE NO. 71-6
An ordinance declaring that an emergency exists
as to speed limits on State secondary roads in
St. Lucie County requiring the immediate enact-
ment of said ordinance; waiving the notice
requirements of Section 125.66 (2), Florida
Statutes, 1971; establishing the speed limits on
all State secondary roads in St. Lucie County;
requiring the posting of such speed limits;
providing a penalty for its violation, and
providing an effective date.
WHEREAS, Section 206.60, Florida Statutes, 1971, provides
that after October 1, 1971 the County shall be fully responsible
for the maintenance of roads in the State Secondary Road System
within the County, and
WHEREAS, the State Department of Transportation has advised
the Board of County Commissioners of St. Lucie County that after
October 1, 1971 all existing speed limits and restrictive type
signs on the secondary roads in St. Lucie County will not have
the effect of law since the Department of Transportation will no
longer have jurisdiction, and
WHEREAS, Section 316.182, Florida Statutes, 1971, provides
that on county maintained roads, the Board of County Commissioners
may set speed zones both as to maximum and minimum speeds after
investigation determines that said speeds are reasonable and in
conformity to criteria promulgated by the Department of Transport-
ation.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS
OF ST. LUCIE COUNTY:
Section 1. That an emergency exists as to speed limits on
the State secondary roads in St. Lucie County and that the immediate
enactment of this ordinance is necessary.
Section 2. That the notice requirements of Section 125.66 (2),
Florida Statute
, be waived.
Section 3. That the speed limits on all State secondary
roads in St. Lucie County set by the State Department of Trans-
portation prior to October 1, 1971, are hereby established as
the maximum speed limits for said roads.
Section 4. That said roads, if not already posted, shall
be posted with clearly legible signs so placed and so painted
as to be plainly visbile and legible in daytime or in darkness
when illuminated by headlights.
Section 5. Any person violating any provision of this
ordinance shall upon conviction be punished by fine not to ex-
ceed $500.00 or be imprisoned in the County jail of St. Lucie
County not to exceed sixty (60) days or by both such fine and
imprisonment.
Section 6. This ordinance shall take effect when a copy
has been accepted by the Postal Authorities of the Government
of the United States for special delivery by registered mail
to the Department of State.

Section 1. Section 12 of Chapter 67-2000, Special Acts of
Florida, 1967, is amended to read:
"Section 12. The board may by reciprocity grant a
certificate of competency to any party who has obtained a
certificate of competency in any other county or city in
the state of Florida, having codes and conducting exam-
inations which are, in the opinion of the board,
substantially equal to those of St. Lucie County, upon
the applicant furnishing proof of the insurance coverage
required hereunder, payment of an application fee the
same as that charged by the other county or city but not
less than $25.00 and furnish to the board in writing all
information as required by Section 6 of this act but with-
out the taking of an examination. Certificates issued
through reciprocity shall be subject to all of the other
provisions of this act."
Section 2. This ordinance shall take effect upon receipt of
official acknowledgment from the Office of the Secretary of State
that said ordinance has been filed in said office.

may be placed in the Indian River in St. Lucie
County to 1200 yards; requiring certain nets
to have lights on them; providing a penalty
for the violation of said ordinance and provi-
ding an effective date.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY:
Section 1. It shall be unlawful for any person, firm or
corporation to place or cause to be placed in the waters of the
Indian River in St. Lucie County any net or combination of nets
tied, joined or connected in any manner which exceed 1200 yards
in length.
Section 2. Any person, firm or corporation that places or
causes to be placed, or has nets placed in the waters of the
Indian River in St. Lucie County between sunset and sunrise shall,
on all nets over 200 yards in length, have and maintain a bright
burning light on each end of each net. On nets having a length
of 200 yards or less, where one end of the net is not more
than 50 yards from land, the offshore end of each net shall be
marked with a bright burning light.
Section 3. Any person violating any provision of this
ordinance shall upon conviction be punished by fine not to exceed
$500.00 or by imprisonment in the County Jail of St. Lucie County
