An ordinance prohibiting the

or appliance in such manner that

providing a penalty for the violation
of said ordinance and providing an

Section 1. It is unlawful for any
person to operate or play or cause or
permit to be operated or played
within those portions of the unincor-
porated areas of St. Lucia County

P.M. and 7:00 A.M. of each day and
on Sunday from 7:00 A.M. to 1 P.M.

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY, FLORIDA:
Section 1. It is unlawful for any person to operate or play or
cause or permit to be operated or played within those portions of the
unincorporated areas of St. Lucie County zoned and designated as
business districts, between the hours of 11:00 P.M. and 7:00 A.M.
of each day and on Sunday from 7:00 A.M. to 1:00 P.M. any radio,
phonograph, piano, music box or ~other machine, instrument or appliance
for making music or noise in such a manner that the music or noise
produced by the same may be heard at a greater distance than 50 feet
therefrom.
Section 2. It is unlawful for any person to operate or play or
cause or permit to be operated or played within those portions of the
unincorporated areas of St. Lucie County zoned and designated as
agricultural or residential districts, between the hours of 10:00 P.M.
and 7:00 A.M. each day any radio, phonograph, piano, music box or
other machine, instrument or appliance for making music or noise in

Section 3. Any person violating any provision of this ordinance
shall upon conviction be punished by a fine not to exceed five hundred
($500.00) dollars or by imprisonment in the County Jail of St. Lucie
County not to exceed sixty (60) days or by both such fine and imprison-
ment.
Section 4. This ordinance shall take effect upon receipt of
official acknowledgment from the Office of the Secretary of State that
said ordinance has been filed in said office.

ORDINANCE NO. 75-2
An ordinance amending Ordinance No. 72-2 of
St. Lucie County by reducing the number of
signatures required on a petition for the
creation of a special improvement district
from "the owners of more than 50% of the
lots" to "the owners of not less than 15%
of the lots" and changing the title of the
Tax Assessor to Property Appraiser and
providing an effective date.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY, FLORIDA:
Section 1. Subsection (1) of Section.2 of Ordinance No. 72-~
is amended by striking the phrase "the owners of more than 50%"
and adding in lieu thereof the phrase "the owners of not less than
15%~'
Section 2. Subsections (2) and (4) of Section 2 of Ordinance
No. 72-2 of St. Lucie County is amended by striking "Tax Assessor"
and adding in lieu thereof "Property Appraiser".
SectiOn 3. This ordinance shall take effect'upon receipt of

parks in St. Lucia County;
providing a penalty for the viola-
tion of said ordinance and
providing an effective date.
WHEREAS, St. Lucia County or
the City of Fort Pierce owns or
leases the following described beach
front parks in St. Lucia County,
Ftorida which are operated by the
Fort Pierce-St. Lucia County
Recreation Department, to-wit:
1. South Jetty Park - A strip of
land at the west end of the south jet-
ty bounded on the north by the
Government easement on the south
side of Ft. Pierce inlet, on the south
by the north line of Block 1 of Ft.
Pierce Beach Subdivision, extended
to ocean, on the west by the east line
of Lot 1, Block 4 of Ft. Pierce Sub-
division extended to the inlet and on
the east by the Atlantic Ocean.
2. South Beach Boardwalk - A
strip of land approximately 1200 feet
long bounded on the north by the

ORDINANCE NO. 75-3
An ordinance establishing rules and
regulations for the operation and use
of certain beach front parks in St. Lucie
County; providing a penalty for the
violation of said ordinance and providing
an effective date.
WHEREAS, St. Lucie County or the City of Fort Pier.ce owns
or leases the following described beach front parks in St. Lucie
County, Florida which are operated by the Fort Pierce-St. Lucie County
Recreation Department, to-wit-
]. South Jetty Park - A strip of land at the west end of

WHEREAS, the Board of County Coummissioners and the City
Commission of the City of Fort Pierce have agreed that it is necessary
to adopt rules and regulations governing the operation and use of said
parks.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA, as follows:
Section 1. The following rules and regula$ions are hereby
adopted for the use and operation of the above described park areas.
1. No overnight parking or camping will be permitted in said areas.
2. No peddlers will be permitted in said areas.
3. No dogs or other animals will be permitted on the beach in
said areas except authorized law enforcement dogs for emergency purposes
and patrol. ~
4. No boats will be permitted within 100 yards of the shore within
said areas except in the inlet.
5. No motor vehicles, including cars, trucks, scooters, motorcyles
or other devices propell.ed by other than muscular power, will be
permitted on the beach in said areas except authorized beach patrol
vehicles, city, county, state or federal vehicles, and ambulances and
wreckers on emergency calls.
6. No picnicking will be permitted on the beach fro~ in said areas.
Areas for picnicking are provided immediately adjacent to said beach
areas and should be used for this purpose leaving the beach area itself
free of bottles, cans, or other refuse.
7. No athletic games will be permitted on the beach in said areas
without the express permission of lifeguard personnel.
8. No contest or competitive events to include the following:
swimming, diving, boating, surfing or surf fishing will be permitted at
said areas .without first scheduling such events with the Recreation
Department making it possible to furnish adequate lifeguard protection
or other necessary services and eliminating the possibility of over-
crowding said areas thereby keeping possible accidents or hazards to
a minimum. Sufficient time or advance notice (minimum of two (2) weeks
is required relative to scheduling of any event.)
9. No surfing, surf fishing or spearfishing will be permitted in
said areas, excep.t as provided in Subsection 8.
10. All signs, containers, lifeguard stands, benches, playground
equipment, picnic shelters or other structures placed in above stated
areas are public property, and shall not be damaged or defaced by anyone.
ll. All skin divers entering and exiting water area within beach
area must check in and out with lifeguard personnel.'
Section 2. Any person violating any provision of this
ordinance shall upon Conviction be punished by a fine not to exceed
five hundred ($500.00) dollars or by imprisonment in the County Jail
of St. Lucie County not to exceed sixty (60) days or by both such
fine and imprisonment.

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST.
LUCIE COUNTY, FLORIDA:
Section 1. That Ordinance No. 75,3 of St. Lucie County
be amended by deleting therefrom Paragraphs No. 4 and No.

ORDINANCE NO. 75-5
An ordinance making it unlawful to throw, discard,
place or deposit or cause to be thrown, discarded,
placed or deposited, litter or junk in the
unincorporated areas of St. Lucie County; defining
the terms "junk", "litter" and "person"; providing
that the existence of evidence of ownership of such
litter shall be prima facie evidence of the intent
to violate and of the violation of said ordinance;
providing a penalty for the violation of said
ordinance; repealing Ordinance No. 74-6 and providing
an effective date.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY, FLORIDA:
Section 1.
Definitions: For the purpose of this ordinance, the following
words shall have the meaning indicated:
(1) "Junk" means pieces, parts or discarded whole units of metal,
rubber, plastic, glass or other objects manufactured from
either organic or inorganic materials including discarded
appliances, furniture, motor vehicles and the parts thereof.
(2) "Litter" means any garbage, rubbish, cans, bottles, containers,
trash, refuse and papers.
(3) "Person" means any individual, firm, corporation or unincorp-
orated association.
Section 2.
Litter or junk in or on roads or public lands: It shall be
unlawful for any person to throw, discard, place or deposit, or cause
to be thrown, discarded, placed or deposited, litter or junk in any
manner or amount whatsoever in or on any public highway, road, street,
alley, thoroughfare or any other public lands in the unincorporated
areas of St. Lucie County, except in containers or areas lawfully
provided therefor.
Section 3.
Prima facie evidence of violation of Section 2: The existence
of any litter or junk, in or on any public highway, road, street,
alley, thoroughfare or any other public lands in the unincorporated
areas of St. Lucie County, containing evidence of ownership of the
litter, shall be prima facie evidence of intent to violate and of
the violation of Section 2 by the person whose name appears within
the litter.
Section 4.
Litter or junk in or on public waters: It shall be unlawful for
any person to throw, discard, place or deposit, or cause to be
thrown, discarded, placed or deposited, any litter or junk in any
manner or amount whatsoever in or on any fresh water lakes, rivers,
streams or tidal or coastal waters in the unincorporated areas of
St. Lucie County.
Section 5.
Prima facie evidence of violation of Section 4: The existence
of any litter or junk, in or on any fresh water lakes, rivers, streams,
or tidal or coastal waters in the unincorporated areas of St. Lucie
County, containing evidence of ownership of the litter, shall be
prima facie evidence of intent to violate and of the violation of
Section 4 by the person whose name appears within the litter.
Section 6.
Litter or junk in or on private property: It shall be unlawful
for any person to throw, discard, place or deposit, or cause to be
thrown, discarded, placed or deposited, litter or junk in any
manner or amount whatsoever on any private property in the unincorp-
orated areas of St. Lucie County, unless the prior written consent
of the owner of said property has been given, and unless said litter
will not cause a public nuisance.
Section 7.
Prima facie evidence of violation of Section 6: The existence of
any litter or junk, in or on any private property in the unincorporated
areas of St. Lucie County, containing evidence of ownership of the
litter, shall be prima facie evidence of intent to violate and of
the violation of Section 6 by the person whose name appears within
the litter.
Section 8.
Penalty: Any person violating any provision of this ordinance
shall, upon conviction be punished by a fine of not more than $500.00
or by imprisonment in the County Jail of St. Lucie County for not
to exceed sixty (60) days or by both such fine and imprisonment.
Section 9.
Repealed: Ordinance No. 74-6 of St. Lucie County is repealed.
Section 10:
Effective Date: This ordinance shall take effect upon receipt
of official acknowledgment from the Office of the Secretary of State
that said ordinance has been filed in said office.
