ORDINANCE NO. 77-1
An ordinance prohibiting trucks having a gross
weight in excess of five (5) tons on Ca.rlton
Road Extension; requiring the posting of a
notice of such prohibition; providing a penalty
for such violation and providing an effective
date.
WHEREAS, Section 316.202, Florida Statutes, provides that
the Board of County Commissioners may prescribe weight limits
lower than the limits prescribed in Chapter 316, Florida Statutes,
whenever in its judgment any road or part thereof shall, by
reason of its design, deterioration or other climatic or natural
causes be liable to be damaged or destroyed by motor vehicles
if the gross weight thereof shall exceed the limits established
by the Board of County Commissioners.
NOW, THEREFORE, BE IT ORDAINED 'BY THE BOARD OF COUNTY
COMMISSIONERS OF ST. LUCIE COUNTY:
Section 1. All trucks having a gross weight in excess of
five (5) tons are prohibited on Carlton Road Extension from the
north line of Section 34, Township 36 South, Range 38 Eas~ south
to its intersection with Glades Cut-Off Road in St. Lucie County.
Section 2. Notice of the establishment of said weight limit
shall be posted at the intersections on said road.
Section 3. Any person violating any provisions of this
ordinance shall, upon conviction be punished by fine not to
exceed $500.00 or be imprisoned in the County jail of St. Lucie
County not to exceed sixty (60) days or by both such fine and
imprisonment.
Section 4. This ordinance shall take effect upon receipt of
official acknowledgment from the Office of the Secretary of State
that said ordinance has been filed in said office.

ORDINANCE NO. 77-2
An emergency ordinance of St. Lucie County,
Florida, requiring the Sheriff of said
county to carry liability insurance on all
motor vehicles owned or leased by the
Sheriff's Department to the extent of not
less than $100,000.00 bodily injury liability
per.person; $300,000.00 for each occurrence;
$50,000.00 property damage liability for
each accident and providing an effective date.
WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, is authorized as a local subdivision of the
State to purchase and carry liability insurance on all motor
vehicles owned or leased by the County or any Department thereof
as provided by Section 455.06, Florida Statutes, and
WHEREAS, the Board of County Commissioners of St. LUcie
County, Florida, feels it advisable and in the best interest of
the people of St. Lucie County to adopt an ordinance providing
for liability insurance on all motor vehicles owned or leased by
the St. Lucie County Sheriff's Department as authorized under
Section 455.06, Florida Statutes.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA:
Section 1. An emergency exists as to the procurement of
liability insurance on all motor vehicles owned, leased or
operated by the Sheriff's Department of St. Lucie County and
the immediate enactment of this ordinance is necessary-
Section 2. The notice requirements of Section 125.66(2),
Florida Statutes, are waived.
Section 3. The Sheriff of St. Lucie County, shall maintain
insurance against legal liability for the death, injury, or
disability of any person arising from or in connection with the
operation of any motor vehicle owned, leased or operated by
the Sheriff of said County, or any of his employees, to the
extent of not less than $100,000.00 bodily injury liability
per person; $300,000.00 bodily injury liability per occurrence
and $50,000.00 property damage liability per accident.
Section 4. This ordinance shall take effect when a copy
has been accepted by the postal authorities of the Government
of the United States for special delivery by registered mail
to the Department of State of Florida.
Passed and duly enacted this 8th day of February, 1977.

ORDINANCE NO. 77-3
An ordinance creating the Sunland Gardens
Street Lighting District in St. Lucie
County; defining the boundaries of said
district; authorizing the levy by the Board
of County Commissioners of said county of
special assessments on all real property in
the district, including homesteads, on an
ad valorem basis of not more than $2.00 per
$1,000 annually on the assessed value of
said property; providing for the adoption of
a budget and the assessment, levy and
collection of such special assessments within
said district and providing an effective date.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY, FLORIDA:
Section 1. There is hereby created the Sunland Gardens
Street Lighting District in St. Lucie County under the authorization
of Section 125.01, Florida Statutes.
Section 2. The boundaries of said street lighting district
are as follows, all of which are in the unincorporated area of
St. Lucie County, Florida:
Beginning at the intersection of the centerlines of.
Avenue T and North 33rd Street, thence southerly along
the centerline of North 33rd Street to its inter-
section with the extension of the centerline of
Block 1 of Sabal Palms Subdivision, Pleat Book 10,
page 16, thence westerly along the centerline of
said Block l, the centerline of Lot 102 of Garden
City Farms, Plat Book 2, page 5, the centerline
of Block A of Sumner Heights, Plat Book 5, page
12 and the centerline of Block 4 of Sunland Gardens
Addition, Plat Book 8, page 49 to the centerline
of North 41st Street, thence northerly along the
centerline of North 41st Street to its intersection
with the centerline of Avenue Q, thence westerly
along the centerline of Avenue Q 175 feet; thence
north parallel with the centerline of 41st Street
to the southerly right of way line of the North
Emergency Relief Canal; thence northeasterly to
the centerline of Avenue T; thence easterly along
the centerline of Avenue T to the Point of
Beginning. ~
Section 3. Said street lighting district is created for the
purpose of providing street ligh~-s within the boundaries of said
district. The Board of County Commissioners shall determine each
year the estimated cost of providing street lights, including
capital and equipment improvements, rentals and acquisition and
operating and maintenance cost and expenses for the insuing county
fiscal year within the boundaries of said district.
Section 4. The improvements and special services to be
provided will be of special benefit to all real property within
the boundaries of said district, The cost of providing such
improvements and services will not be in excess of such special
benefits. The apportionment of such cost by the levy of special
assessments on all real property in the district, including
homesteads, on an ad valorem basis will be in proportion to
such benefits.
Section 5. The Board of County Commissioners of St. Lucie
County hereby authorizes the levy of special assessments on all
real property in said district, including homesteads, on an ad
valorem basis of not more than $2.00 per $1,000 annually on the
assessed value of said property for the purpose of providing
street lights within the boundaries of said district. Said
special assessments shall be levied and a budget prepared and
adopted by said Board at the same time and in the same manner
as said Board prepares and adopts its county annual budget and
levies taxes as provided by law. Said special assessments shall
be assessed, levied, collected, remitted to and accounted for at
the time and in the manner as the assessments, levy, collection,
remittance and accountability of taxes by said Board as provided
by law. Said budget shall contain all of the estimated cost of
providing street lights within said district as said'Board shall
determine to be necessary to provide such services.
Section 6. Those funds obtained from the levy of special
assessments on all the-r~al property, including homesteads, within
the boundaries of said district shall be maintained in a separate
account and used solely for the purpose of providing street
lights within the boundaries of said district.
Section 7' All resolutions or ordinances in conflict herewith
are repealed.
Section 8. This ordinance shall take effect upon receipt of
official acknowledgment from the office of the Secretary of State
that said ordinance has been filed in said office.

ORDINANCE NO. 77-4
An emergency ordinance of St. Lucie County,
Florida prohibiting the sale, consumption
and serving of alcoholic beverages in the
unincorporated areas of St. Lucie County
during certain hours; providing a penalty
and providing an effective date.
WHEREAS, the Board of County Commissioners of St. Lucie
County by Resolution No. 68-42 adopted on April 15, 1968
established the hours of sale of alcoholic beverages in the
uninc6rporated areas of St. Lucie County according to the
provisions of Section 562.14(4), Florida Statutes, 1967, and
WHEREAS, said Section has been amended and now requires that
such regulation of the hours of sale of alcoholic beverages by
the County be by ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA:
Section 1. An emergency exists as to the prohibited hours
of sale of alcoholic beverages in the unincorporated areas of
St. Lucie County and the immediate enactment of this ordinance
is necessary.
Section 2. The notice requirements of Section 125.66(2),
Florida Statutes, are waived.
Section 3. No alcoholic beverages may be sold, consumed,
or served or permitted to.be served or consumed, in any place
in the unincorporated areas of St. Lucie County holding a license
under the Florida Division of Beverage of the Department of
Business Regulations, between the hours ~of 2 o'clock A.M. and
7 o'clock A.M. of same day on week days; between the hours of
2 o'clock A.M. and 1 o'clock P.M. on Sunday and between the hours
of midnight on Sunday and 7 o'clock A.M. on Monday.
Section 4. Any person violating any provisions of this
ordinance shall, upon conviction be punished by fine not to exceed
$500.00 or be imprisoned in the County Jail of St. Lucie County

recreational areas and other publicly owned
property in St. Lucie County; providing for a
waiver of said ordinance under certain
circumstances; providing a penalty for the

Section 1. Overnight parking or camping is prohibited in

An ordinance of St. Lucie County prohibiting
overnight parking or camping in certain parks,
recreational areas and other publicly owned
property in St. Lucie County; providing for a

declaring a thirty (30) day moratorium on the
acceptance of applications for and the issuance of
permits for fortunetellers, clairvoyants, etc. in
said county under the provisions of St. Lucie County
Ordinance No. 72-5 and providing an effective date.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
.COUNTY, FLORIDA:
Section 1. An emergency exists as to the issuance of permits
for fortunetellers, clairvoyants, etc. in St. Lucie County and the
immediate enactment of this ordinance is necessary.
Section 2. The notice requirements of Section 125.66(2),
Florida Statutes, are waived.
Section 3. No application for the issuance of a permit for
fortunetellers, clairvoyants, etc. under the provisions of St~ Lucie
County Ordinance No. 72-5 shall be accepted by the Board of County
Commissioners of said county for a period of thirty (30) days from
the effective date of this ordinance.
Section 4. No permit for fortunetellers, clairvoyants, etc.
under the provisions of St. Lucie County Ordinance No. 72-5 shall be
issued by the Board of County Commissioners of said county for a
period of thirty (30) days from the effective date of this ordinance.
Section 5. This ordinance shall take effect when a copy has
been acCepted by the postal authorities of the Government of the
United States for special delivery by registered mail to the Department
of State of Florida.

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST LUCIE
COUNTY, FLORIDA: '
Section 1. Subsection (1) of Section 26 of St. Lucie County
Ordinance No. 72-5 is amended to read:
"Section 26. Fortunetellers, clairvoyants, etc.; county
permit required; penalty.
(1) No license to engage in the occupation of fortunetelling
or any other pursuit for which a license is required by Section
25 shall be issued to any person unless such person holds a per-
mit therefor given by the Board of County Commissioners. No per-
Is at least 18 years of age.
Has been a resident of and a registered voter in St.
Lucie County for at least one (1) year prior to the
date of application.
(cf Is of good moral character as shown by five (5) letters
of reference from local citizens who have know the
applicant for at least one (1) year.
(df Has not been convicted of a felony or a misdemeanor of
the first degree.
(e) Has his or her fingerprints on file with the Sheriff of
St. Lucie County.
(f) Has furnished letters from the Sheriff's Department of
St. Lucie County and the Police Department of the City
of Fort Pierce stating that the applicant does not have
an arrest record in the City of Fort Pierce or St. Lucie
County."
Section 2. Subsection (2) of Section 26 of St. Lucie County

An ordinance of St. Lucie.County establishing the
St. Lucie County Library as a county department;
providing for the administration, personnel,
finances and maintenance of said Library; creating
the St. Lucie County Library Board and providing
for 'its membership, organization, powers, duties
and responsibilities; providing for a St. Lucie
County Library Director and providing an effective
date.
WHEREAS, in order to provide free library services to the citizens
of St. Lucie County, there shall be a St. Lucie County Library and a
St~ Lucie County Library Board. In administrative and fiscal matters,
the St. Lucie County Library shall be a department of the general
government of St. Lucie County under the supervision of the County
Administrator. In matters related to the provisions of library
services, the St. Lucie County Library shall be under the supervision
of the St. Lucie County Library Board. The St. Lucie County Commis-
sion is recognized as being ultimately responsible for the operation
of the St. Lucie County Library.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS
OF ST. LUCIE COUNTY, FLORIDA:
Section 1. Administrative: The St. Lucie County Library shall
be a department of the general government of St. Lucie County, and
the Library Director shall be a department head. The St. Lucie
County Library shall be subject to the administrative rules and
regulations of the general government of St. Lucie CoUnty.
Section 2. Personnel: The employees of the St. Lucie County
Library shall be employees of St. Lucie County. As such, they shall
be entitled to all the benefits of such employees and shall be subject
to all the r61es and regulations governing such employees.
Section 3. Financial: The financial records of the St. Lucie
County Library shall be the responsibility of the St. Lucie County
Finance Department. These shall include, but are not necessarily
limited to, payroll and other disbursements, and receipt and proper
accounting of funds.
Section 4. Maintenance~ The buildings in the St. Lucie County
Library system shall be budgeted for and maintained by the St. Lucie
County Building Maintenance Department.
Section 5. St. Lucie County Library Board Membership: The St.
Lucie County Library Board shall be Composed of nine citizens, 2/3
appointed by the St. Lucie County Board of County Commissioners and
1/3 appointed b.y the St. Lucie County Library Association or its
successor agency. The terms of office of board members shall be 3
years, except that three members shall initially be appointed for
one-year terms, three members shall be initially appointed for two
year terms and three members shall be initially appointed for three
year terms in order that an orderly sequence of thre~ 3-year terms
expiring every year may be established. No member shall serve more
than two consecutive terms. Vacancies shall be filled by appointment
by the organization originally appointing such member for the
unexpired portion of their term.
Section 6. St. Lucie County Library Board - Organization: The
St. Lucie County Library Board shall meet not less than once each two
calendar months. A majority of the membership shall constitute a
quorum for the purpose of meeting and transacting business. The Board
shall elect a chairman, a vice-chairman, and a secretary annually. The~
minutes of each meeting shall accurately reflect the matters discussed
and actions taken and may be kept by the elected secretary, a clerk
or by mechanical recording. The Board may adopt by-laws and make
rules and regulations not inconsistent with its mission.
Section 7. St. Lucie County Library Board - Duties, Powers and
~.esponsibilities: The St. Lucie County Library Board shall establish
library policy. The Board shall recommend for employment to the
St. Lucie County Commission a Library Director, who shall be educationally
and professionally qualified to occupy the position. The Library
Director shall, with the assistance of the Library Board, submit an
annual budget request for library operating funds to the St. Lucie
County Commission in the manner prescribed by that body, and the
Board shall review the expenditure of budgeted funds to the degree
it finds necessary. The Board shall report to the St. Lucie County
Commission and to the citizens of St. Lucie County not less than
annually upon the status, progress and needs of the St. Lucie County
Library. The Board shall make recommendations to the St. Lucie County
Commission concerning the provision of regional library service and
any inter-local agreements necessary t0 provide such service.
Section 8. St. Lucie County Library Director: The Library
Director shall be the executive officer of the St. Lucie County
Library. The Director shall be charged with planning, organizing,
delegating, and supervising all programs and personnel, with the
further responsibility of presenting a program for the ensuing year.
He shall, subject to the approval of the County Administrator, employ,
promote, demote or dismiss library personnel within the provisions
of the annual budget and the rules and regulations governing employees
of St. Lucie County. He shall purchase all books and other library-
related materials. The Director shall implement library policy as
determined by the Library Board. The Director shall be present at
all Board meetings unless specifically excused, and shall report
to the Board at each meeting any matters which he feels the Board
should consider. He shall be the professional adviser to the Board
in matters relating to the library policies and functions and shall
assist the Board in any manner possible to better the St. Lucie
County Library and its services to the citizens of St ~ucie County.
Section 9. Effective Date: This ordinance shall take effect
on October 1, 1977.
