ORDINANCE NO. 79-2
An ordinance amending St. Lucie County Ordinance
No. 75-1 by deleting certain phrases in Section
2 thereof and providing an effective date.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY, FLORIDA:
Section 1. Section 2 of St. Lucie County Ordinance No.
75-1 is amended to read:
"Section 2. It is unlawful for any person to operate or
play or cause or permit to be operated or played within the
unincorporated areas of St. Lucie County, any radio, phonograph,
piano, music box or other machine, instrument or appliance for
making music in such a manner that the music produced by the same
may be heard at a greater distance than 50 feet from the property
line of the property on which the radio, phonograph, piano,
music box or other machine, instrument or appliance is located."
Section 2. This Ordinance shall take effect upon receipt
of official acknowledgment from the Office of the Secretary of
State that said ordinance has been filed in said office.

ORDINANCE NO. 79-3
An ordinance prohibiting trucks having a
gross weight in excess of eight (8) tons
on Peterson Road Bridge; requiring the
posting of a notice of such prohibition;
providing a penalty for such violation
and providing an effictive date.
WHEREAS, Section 316.555, Florida Statutes, provides that
the Board of County Commissioners may prescribe weight limits
lower than the limits prescribed in Chapter 316, Florida Statutes,
whenever in its judgment any road or part thereof shall, by reason
of its design, deterioration or other climatic or natural causes
be liable to be damaged or destroyed by motor vehicles if the gross
weight thereof shall exceed the limits established by the Board of
County Commissioners.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMIS-
SIONERS OF ST. LUCIE COUNTY:
Section 1. All trucks having a gross weight in excess of eight
(8) tons are prohibited on Peterson Road Bridge located between
Sections 7 and 18, Township 35 South, Range 40 East (over North
St. Lucie River Water Management District Canal 29) in St. Lucie
County.
Section 2. Notice of the establishment of said weight limit
shall be posted at the intersections on said road.
Section 3. Any person violating any provision of this ordinance
shall, upon conviction be punished by fine not to exceed $500.00
or be imprisoned in the County Jail of St. Lucie County not to exceed
sixty (60) days or by both such fine and imprisonment.
Section 4. This ordinance shall take effect upon receipt of
official acknowledgment from the Office of the Secretary of State
that said ordinance has been filed in said office.

ORDINANCE NO. 79-4
An emergency ordinance of St. Lucie County,
Florida adopting the Florida Model Energy
Efficiency Building Code, as amended; providing
an effective date. '
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. L[3CIE
COUNTY, FLORIDA:
Section 1. An emergency exists as to the adoption of an e~rgy
efficiency building code in St. Lucie County as mandated by Chap. ~r
553, Florida Statutes, and the immediate enactment of this ordinance
is necessary.
Section 2. The notice requirements of Section 125.66(2),
Florida Statutes~ are waived.
Section 3. The Florida Model Energy Efficiency Building Code,
as amended, will serve the needs of St. Lucie County and is hereby
adopted as the energy building code standard for energy efficiency
in the thermal design and operation of all buildings for which a
building permit is issued after March 15, 1979, in St. Lucie County,
subject to the exemptions contained in Section 553.902(1),Florida
Statutes.
Section 4. This ordinance shall take effect when a copy has
been accepted by the postal authorities of the Government of the
United States for special delivery by registered mail to the Department
of State of Florida.

ORDINANCE NO. 79-5
An emergency ordinance of the County of
St. Lucie, Florida, providing that, subject
to the monetary limitations set forth in
subsection 5 of Section 768.28, Florida
Statutes, the County shall pay any monetary
judgment which is rendered in a civil action
personally against any officer, employee or'
agent of the County which arises as a result
of an act, event or omission of action within
the scope of his employemnt or function;
providing an effective date.

COUNTY, FLORIDA:

necessity of payment of monetary judgment in civil actions and the
immediate enactment of this ordinance is necessary.

Florida Statutes, are waived.

ORDINANCE NO. 79-7
An ordinance amending St. Lucie County Ordinance
No. 76-5 by establishing late renewal fees for
contractors; providing an effective date;
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY, FLORIDA:
Section 1. Amend Section 8(2) (b) of Ordinance No. 76-5
as follows:
"Section 8(2) (b) A certificate which is inoperative because
of failure to renew shall be restored on payment of the
proper renewal fee as hereafter provided, if the application
for restoration is made within one year of expiration.
Renewal fee:
Within 3 months of expiration' - 25% of renewal fee*
Over 3 months but not more than 6 months - 50% of renewal fee*
Over 6 months but not more than 9 months - 75% of renewal fee*
Over 9 months but..not more than one year ~100% of renewal fee*
*(rounded to the next highest full dollar amount)
If the application for restoration is not made within one
year of expiration, the fee for restoration shall be equal
to the originaI application fe~; and in addition, the board
may require reexamination of the applicant.
Section 2. This ordinance shall take effect upon receipt of
official acknowledgment from the Office of the Secretary of State that
said ordinance has been filed in said office.

ORDINANCE NO. 79-10
An emergency ordinance of the County of St.
Lucie, Florida, a'uthorizing St. Lucie County
to charge and collect a fee from any municipally
operated or franchised garbage or trash collection
service which utilizes the county landfill sir for
disposal purposes; providing a method for
determining the amount and payment of the fee for
such use; providing an effective date.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY, FLORIDA:
Section 1. An emergency exists in the county as to the
payment for use of the county landfill site and the immediate
enactment of this ordinance is necessary.
Section 2. The notice requirements of Section 125.66(2),
Florida Statutes, are waived.
Section 3. St. Lucie County is hereby authorized to charge
and collect a fee from any municipally operated or franchised
garbage or trash collection service.,which utilizes the county land-
fill site for disposal purposes.
Section 4. The disposal fee shall be an amount equal to 'f~ve
(5%) percent of the gross garbage or trash collection charges
received from the customers of such municipally operated or franchised
service and shall be paid to St. Lucie County monthly by the person,
firm or organization that receives the gross collection fees.
Section 5. This ordinance shall take effect when a copy has
been received by the postal authorities of the Government of the
United States for special delivery by registered mail to the Depart-
ment of State.

Dear Devitt:
The Humane Society has always been involved in the investigation of cruelty complaints
in the County. However do to inexperienced personnel the Society was seldom called on
by law enforcement personnel to assist in animal cruelty complaints.
For the past one and one-half years we have had an ex-police , Mike
Price, working at the Shelter as our Shelter Director. Mike aggressively enforces
animal cruelty laws and is knowledgeable about animal cruelty laws, and legal
procedures.
The result of this is that the Socigty is assisting in the investigation of many
animal cruelty complaints now. 80% of these complaints are in the County, particu-
larly the serious ones (such as Shorty Eberhardt), thus this letter to you.
Some of the situations our animal cruelty investigator, Mike Price, finds himself in
are quite dangereous and he has been advised by Judge Tye to obtain a firearm and
appropriate bond. He has done that.
In todays lititious society I wonder what our exposure is to a lawsuit resulting
from the actions of our now more active and armed animal cruelty investigator.
Devitt, if we were unfortunate enough to be involved in a lawsuit as a result of
an animal cruelty investigation in the County would the County's position be that the
Humane Society would be "on its own" to defend the suit?
If so we certainly need to consider what to do to protect ourselves.
Lastly, is there anyway to get our animal investigator appointed to the Sheriff's
Department in some way, allowing us to take advantage of whatever kind of liability
coverage the Sheriff has?
