LUCRE COUNTY, FLORZDA, A5 CH'rEF CORRECTIONAL OFF'rCER OF THE ST. LUCRE COUNTY CORRECTIONAL SYSTEM; PROVZDZNG FOR CONFLTCTZNG PROVZSTONS; SEVERAB'rL3TY AND APPL'rCAB'rLZTY; F1'~ I'NG WZTH THE DEPARTMENT OF STATE; AN EFFEC1-J:VE DATE; ADoP'r~ON; AND CODTFTCAT'ZON WHEREAS, the Board of County Commissioners of St. Lucia County, Florida, has mode the following determinations: 1. Pursuant to Section 951.061, Florida Statutes, as created by Chapter 86-183, Laws of Florida, the Board qas the authority upon adoption of on ordinance by o majority of the County Commission to designate the Sheriff os the Chief Correctional Officer of the County Correctional System. 2. This Board b~lieves that adoption of this ordinance is in the best interest of the health, safety, and welfare of the citizens of St. Lucia County, Florida. NOW, THEREFORE, BE 'rT ORDAZNED BY THE BOARD OF COUNTY COMM'rs$'rONER5 OF S-. LUC]:E COUNTY, FLOI~DA: PART A. ADDITZON OF SECTZON 1-18-3 TO CHAPTER 1-18. Chapter 1-18 of the Code of Ordinances of St. Lucia County, Florida, is hereby amended by adding 5ectio, 1-18-3 to read as follows: Section 1-18-3. Designation of Chief Correctional Officer The St. Lucia County Sheriff is designated as the Chief Correctional Officer of the St. Lucia County Correctional System. If designated, the .,Sheriff or his designee shall enforce oil existing state law and administrative rules of the department concerning the operation and maintenance of county jails. The salaries for couaty correctional officials shall be paid from the general revenue fund of the County and shall be included by the Sheriff in his proposed budget of expenditures for the maintenance and operation of the county correctional system. PART B. CONFI TCT[N6 PROVISIONS. Special acts of the Florida legislature applicable only to unincorporated areas of St. Lucia County, and adopted prior to ~Tanuary 1, lg6c), County ordinance and County resolutions, or parts thereof, in conflic- with this ordinance are hereby superseded by this ordinance to the extent of such conflict. PART C. SEVERABIL3.TY AND AppITCABILiTY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordnance or any provision thereof shall be held to be inapplicable to any person, property, or circumstance, such holding shall not affect its applicability to any other person, property, or circumstance. PART b. EFFECTIVE bATE. This ordinance shal take effect upon receipt of official acknowledgment from the office of the Secretary of 5tote that this ordinance has been filed in that office. PART E. Provisions of this ordinance shall be incorporated in the Code of Ordinances of St. Lucia County, Florida, and the word "ordinance" may be changed to "section", "article", or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, that Parts B through F shall not be codified.
