LU¢IE COUNTY LAND DEVELOPMENT CODE BY AMENDING SECTION 7. lO. 13 SEWAGE AND 5EPTAGE TREATMENT FACILITIES IN AGRICULTURAL ZONING DISTRIC'I'$ TO PROVIDE FOR MUNICIPAL ANNEXATION OF A FACILITY SITE; PROVIDING ¢ONFLIG"I'ING PROVISIONS; PROVIDING FOR 5EVERABILrrY; PROVIDING FOR APPLICABILITY; PROVIDING FOR FILING WITH THE DEPARTMENT OF STATE; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR ADOPTION AND PROVIDING FOR CODIFICATION WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determination: On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted the St. Lucie County Land Development Code. On ,Tonuory 6, 2004, this Board held its first public hearing on the proposed ordinance, after publishing o notice of such hearing in the Port St. Lucia News and the Tribune on December 26, 2003. On ,Tanuory20, 2004, this Board held its second public hearing on the proposed ordinance, after publishing a notice of such hearing in the Port St. Lucia News and the Tribune on ,Tonuory 9, 2004. The proposed amendments to the St. Lucia County Land Development Code are consistent with the general purpose, goals, objectives and standards of the St. Lucia County Comprehensive Plan and are in the best interest of the health safety and public welfare of the citizens of St. Lucia County, Florida. 'THE SPECIFIC AMENDMENT5 TO THE ST. LUCIE COUNTY LAND DEVELOPMENT ,CODE TO READ A5 FOLLOWS, INCLUDE: CHAPTER VIZ 17.00.00 DEVELOPMENT DESIGN STANDARD5 AND IMPROVEMENT 7.10.13 SEWAGE AND 5EPTAGE TREATMENT FACILTT~E5 IN AGRICULTURAL ZONING DISTRICTS Zn the AG-l, AG-2.5 and AG-5 zoning districts, the establishment of a sewage and septage treatment facility may be authorized as a conditional use, subject to the following criteria: minimum of ten (10) acres shall be required for all treatment facility sites. No structure, treatment storage oreo or treatment facility shall be located within fifty (§0) feet of any property line or required bose building line. C'o All areas of development shall be fenced or walled. A minimum twenty (20) foot wide landscape barrier shall be provided around the perimeter of the treatment facility. This buffer shall contain at least one tree for every thirty (30) linear feet around the perimeter. Trees, shrubs and hedges must comply with the requirements of Section 7.09.00. F~ OD 0". "1'! All gates must be constructed with an opaque material. Except for business operation hours, all gates are to be kept closed and locked. E. A site plan of this facility must accompany the application for conditional use. JF_. In the event of municipal annexation of a site pursuant to Chapter 171, Florida Statutes, an application for a facility shall require review and approval by the County until the applicable provisions of the municipal comprehensive plan and land development regulations for the annexed site have been approved by the municipality and determined to be in compliance pursuant to Part II, Chapter 163, Florida Statutes. PART B. CONFLICTING PROVISIONS. Special acts of the Florida legislature applicable only to unincorporated areas of St. Lucia County, County ordinances and County resolutions, or parts thereof, in conflict with this ordinance are hereby superseded by this ordinance to the extent of such conflict. PART C. SEVERABIL~TY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provision thereof shall beheld to be inapplicable to any person, property, or circumstance, such holding shall not affect its applicability to any other person, property, or circumstance. PART b. APPLICABILITY OF ORDINANCE. This ordinance shall be applicable in the unincorporated oreo of St. Lucia County. PART E. FILING WITH THE DEPARTMENT OF STATE.
