A RESOLUTION OF THE ST. LUCIE COUNTY BOARD OF COUNTY
COMMISSIONERS REGARDING THE CONSTRUCTION OF POTABLE
WATER AND FIRE PROTECTION IMPROVEMENTS TO SERVE THE
PROPOSED SABAL CREEK MUNICIPAL SERVICE BENEFIT UNIT AND THE
FUNDING THEREOF THROUGH SPECIAL ASSESSMENTS; DESCRIBING
THE REAL PROPERTY TO BE INCLUDED WITHIN THE SABAL CREEK
MUNICIPAL SERVICE BENFEFIT UNIT; AUTHORIZING AND DIRECTING
COUNTY STAFF TO TAKE SUCH ACTIONS AS MAY BE NECESSARY IN
FURTHERANCE OF SUCH PROJECT AND THE FUNDING THEREOF
THROUGH SPECIAL ASSESSMENTS; APPROVING AND CONFIRMING THE
PETITIONS SUBMITTED BY AFFECTED PROPERTY OWNERS CONCERNING
THE IMPOSITION OF SUCH ASSESSMENTS TO FUND THE PROJECT; AND
PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF ST. LUCIE COUNTY AS
FOLLOWS:
SECTION 1. AUTHORITY. This Resolution of the Board of Commissioners (the
"Board") of St. Lucie County, Florida (the "County") is adopted pursuant to the provisions
of Chapter 40, Article IV of the County Code of Ordinances (the "Assessment Ordinance"),
sections 125.01, 125.66, 197.3632, and 197.3635 of the Florida Statutes, and other applicable
provisions of law (collectively, the "Act").
SECTION 2. DEFINITIONS. Capitalized terms not otherwise defined herein shall
have the meanings set forth in Assessment Ordinance.
SECTION 3. FINDINGS. It is hereby ascertained, determined and declared as
follows:
(A) The County has undertaken preliminary measures related to the provision of
potable water and fire protection improvements to serve the area generally described as
Sabal Creek (the 'Project"), including but not limited to engineering due diligence,
submitting petitions to affected property owners regarding support for the Project, and
developing a plan of finance and a timetable for the Project.
(B) The single family residential properties comprising Sabal Creek currently
receive potable water through onsite wells, and the Sabal Creek subdivision is adjacent to
the Reserve Community Development District, a community development district
organized and existing pursuant to Chapter 190, Florida Statutes (the "CDD")

(C) While the CDD is authorized to provide centralized potable water service to
the real property within and adjacent to the CDD boundaries, including Sabal Creek, the
CDD is not authorized to impose special assessments outside its territorial limits to fund
the construction of capital improvements such as those comprising the Project.
(D) The CDD has requested that the County proceed with constructing the
Project, and to that end the County and CDD have entered into an interlocal agreement
dated September 19, 2017, (the "Interlocal Agreement") describing the cooperative efforts
and respective responsibilities to be undertaken by the parties in providing for the delivery
of potable water infrastructure and service to Sabal Creek.
(E) The Assessment Ordinance established a procedure for the levy and
collection of special assessments (as defined therein, "Assessments") by the County to fund
the delivery of capital improvements such as those comprising the Project. The County is
authorized by the Act to levy and collect Assessments.
(F) The Board now wishes to authorize and direct County staff to take such
actions as may be necessary or desirable in furtherance of the Project, including but not
limited to initiating the process set forth in the Assessment Ordinance for the levy and
collection of Assessments.
SECTION 4. PROPOSED MSBU. The Board hereby proposes establishment of the
"Sabal Creek Municipal Service Benefit Unit" generally consisting of the real property
described in Appendix A attached hereto (the "MSBU'). Subsequent resolutions of the
County may modify and/or confirm the boundaries of the MSBU, and shall confirm
establishment of the MSBU, as required by the Assessment Ordinance.
SECTION 5. PROPERTY OWNER PETITIONS. Property owners within the
proposed MSBU submitted petitions in accordance with the process set forth in Section 40-
99 of the Assessment Ordinance, which petitions indicate that 55% of affected property
owner approved creation of the MSBU and imposition of the Assessments to fund the
Project. The results of the petition process are hereby approved and confirmed. Copies of
the petitions are on file in the St. Lucie County Engineering Division.
SECTION 6. AUTHORITY AND DIRECTION. The County Engineer and other
members of County staff are hereby authorized and directed to take such actions as may be
necessary or desirable in furtherance of the Project, including but not limited to the
following:

(A) Obtain easements or other necessary interests or authorizations for
construction of the Project.
(B) Finalize plans and specifications necessary for construction of the Project.
(C) Prepare such resolutions as may be required under the Assessment
Ordinance in order to impose and collect Assessments to provide for the funding of the
Project.
(D) Finalize an apportionment methodology for allocation of the Assessments
among specially benefited property and develop a preliminary Assessment Roll for
consideration by the Board.
(E) Prepare such agreements by and between the County and the St. Lucie
County Tax Collector and St. Lucie County Property Appraiser as may be required by the
Uniform Assessment Collection Act.
(F) Implement procurement processes pertaining to construction of the Project.
(G) Mail and publish any required notices.
(H) Prepare for Board consideration any amendments to the Interlocal Agreement
which are determined by County staff to be necessary or desirable in furtherance of
constructing and funding the Project.
(I) Take such other actions as may be required by the Assessment Ordinance or
the Act in furtherance of the Project.

SECTION 7. EFFECTIVE DATE. This Resolution shall take effect immediately
upon adoption.
