HomeMy WebLinkAboutPDS-18-019 - Save the ChimpsPDS 18-019 SPMN1220175235 AN ORDER GRANTING APPROVAL FOR A MINOR ADJUSTMENT #3 TO MAJOR SITE PLAN KNOWN AS SAVE THE CHIMPS (FKA CENTER FOR CAPTIVE CHIMPANZEE CARE). WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a site plan adjustment submitted by Lucido and Associates on behalf of Save the Chimps and made the following determinations. Save the Chimps (fka Center for Captive Chimpanzee Care) requested a minor adjustment to a Major Site Plan to allow for the reconfiguration of Pod 13 into two pods (13 and 14), the addition of two chimpanzee housing units, four Primadomes, and a lake expansion. The subject property is zoned AG -5 (Agricultural - 5) and is located at 16891 Carole Noon Lane, Fort Pierce. 2. On December 16, 2003, the Board of County Commissioners through Resolution No. 03- 245 granted a Major Site Plan approval known as Save the Chimps (fka Center for Captive Chimpanzee Care), which is a non-profit organization that rehabilitates and provides safe harbor for adult chimpanzees. 3. On November 12, 2010, through PDS No. 10-016, the Director of the Planning and Development Services Department granted approval for a minor adjustment to Save the Chimps (fka Center for Captive Chimpanzee Care) Major Site Plan. 4. On September 18, 2013, through PDS No. 13.030, the Director of the Planning and Development Services Department granted approval for a second minor adjustment to Save the Chimps (fka Center for Captive Chimpanzee Care) Major Site Plan. 5. The Development Review Committee reviewed this minor adjustment and found it to meet the technical requirements of the St. Luce County Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 6. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 7. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with St. Lucie County Land Development Code requirements. 9. The proposed project is to be served by on-site septic and well, governed by the State of Florida Health Department. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, this third minor adjustment to the Save the Chimps (fka Center for Captive Chimpanzee Care) Major Site Plan is hereby approved as shown on the site plan drawings dated November 28, 2017 for the project prepared by Lucido & Associates and date stamped received by the St. Lucie County Planning and Development Services Department on December 1, 2017, subject to the following conditions of approval. 1) Within 120 days of site plan approval the applicant shall submit a Maintenance and Monitoring Plan addressing the removal of all FLEPPC Category I listed species located within the property boundary shall be removed [LDC 7.09.05]. The plan shall be reviewed and approved by ERD and include a maintenance schedule. 2) Within 180 days of site plan approval all berm landscape requirements shall be in compliance with the previously approved landscape plan [LDC 7.09.04]. 3) The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 4) All other applicable state or federal permits must be obtained before commencement of the development. B. The property on which this third minor adjustment to a Major Site Plan approval is being granted is described as follows: LEGAL DESCRIPTION: The Northwest 1/4 of Section 25, Township 35 South, Range 38 East in St. Lucie County, Florida. Less and except that part thereof owned in fee simple by any party for roads, canals, ditches, drainage and water management purposes. PARCEL I D# 2225-211-0001-000/2 C. The developer is advised as part of this minor adjustment approval for Save the Chimps, including any successors in interest, the developer shall obtain all applicable development File No.: SPMN 1220175235 PDS Order No. 18-019 March 27, 2018 Page 2 permits and construction authorizations from the appropriate state and federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law.
