HomeMy WebLinkAbout18-010 - BOABOARD OF ADJUSTMENT RESOLUTION NO. 18-010 File No.: BA 220185268 A RESOLUTION APPROVING A VARIANCE FOR CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. Petition of Kathryn and Samuel Alioto for a variance from the provisions of Section 7.04.01 (Table 7-10) Lot Size and Dimensional Requirements of the St. Lucie County Land Development Code to allow a proposed screen enclosure to encroach a maximum of 10 feet into the required minimum 15 foot rear yard setback for a property located at 121 Queen Guinevere Court, in the RS -4 (Residential, Single -Family — 4 du/ac) Zoning District. 2. On March 28, 2018, this Board held a public hearing on the petition, after publishing a notice of such hearing, installing a sign on property and notifying by mail all owners of property within 500 feet of the subject property. 3. After consideration of the testimony presented during the public hearing, including staff comments, exhibits, and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determinations: The requested variance meets the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because a. The granting of the requested variance will not increase traffic to the development; b. The variance does not impair or otherwise injure other property values in the area in which the subject property is located; C. There were no objections made from the public in regards to the variance and the variance request received approval from the Queens Cove Home Owners Association. d. The requested variance meets the general spirit and intent of the St. Lucie County Land Development Code and the St. Lucie County Comprehensive Plan. The petition of Kathryn and Samuel Alioto for a variance to reduce the required 15 foot rear yard setback by 10 feet to allow a 5 foot setback for a pool screen enclosure for the property depicted on the attached map as Exhibit "A" and described as follows: Legal: LOT E, BLOCK 2, QUEENS COVE UNIT 1, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 11, PAGE 12, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA Address: 121 Queen Guinevere Court, Fort Pierce, FL 34949 Parcel Identification Number: 1414-701-0016-000-1 B. Based on the evidence presented, this variance is approved. C. This variance shall expire twelve months from the date of adoption unless a building permit is approved or an extension is granted in accordance with Section 10.01.06, of the St. Lucie County Land Development Code. D. This Order shall become effective upon the date indicated below. An appeal from the Board of Adjustment's action may be processed within thirty (30) days in accordance with Section 10.01.07, of the St. Lucie County Land Development Code. E. This Order shall be recorded in the public records of St. Lucie County.
